Filament Mark

The Filament Mark consists of origin-identifying markings along the length of goods that are sold by length units and regularly cut for this purpose.

Filament marks accordingly run regularly parallel to the length of the marked goods and typically consist, for example, of colored stripes, threads, or selvedge areas applied to textiles, ropes, hoses, wires, cables, glass rods, tubes, fabrics, foils, or similar objects.

For example, colored threads are often incorporated into multi-core power cables alongside the individual conductors. This allows an electrician to identify the brand, even if only the end of the cable is visible and not the imprint on the sheathing.

When registering a filament mark, a description of the mark must generally be submitted in addition to the representation of the mark. For filament marks, this description serves to specify the exact nature and position of the filament on the goods, provided this information is not evident from the representation of the mark.

Distinctiveness

As with all types of trademarks, distinctiveness is a prerequisite for the registration of a filament mark. For filament marks, particular attention must be paid to labeling customs and the resulting perception of the relevant trade circles. Thus, it is clear to an electrician that the colored threads in a power cable do not merely serve as decoration.
