In Austrian inheritance law, a small estate refers to an estate whose value is so low that a regular probate procedure does not appear necessary. The legislator has provided a simplified administration procedure for this, which is aimed at efficiency and cost savings.

If the value of an estate is less than €5,000, it is considered a small estate. In this case, the court may waive a formal procedure, in accordance with §153 para 1 AußStrG. The processing is simplified and expedited, either upon application by the heirs or ex officio.
