Fee
Our services in criminal proceedings are always charged according to the lawyer’s tariff. We would be happy to give you an overview of the free initial consultation as part of our expected fee.
IMPORTANT: If there is no legal expenses insurance cover, we invariably charge an advance payment of at least €750.00 (including VAT) in criminal matters to secure our fee.
IMPORTANT: Criminal defense based on procedural assistance or legal aid is not possible in our law firm. Persons without sufficient income must submit an application for legal aid directly to the court and will then be assigned a lawyer.
Reimbursement of defense costs
Fortunately, the law provides for a reimbursement of defense costs in the event of the discontinuance of the investigation proceedings and, staggered according to the competent court, in the event of acquittals in the main proceedings:
- Discontinuance of investigation proceedings: up to €6,000.00
- District Court up to €5,000.00
- Single judge at the Regional Court up to €13,000.00
- Court of Lay Assessors or Jury Court up to €30,000.00
The maximum rates can be exceeded by 50 percent in complex proceedings and by 100 percent in proceedings of extreme scope.

Legal Expenses Insurance
We would be happy to request coverage from your legal expenses insurance for legal representation in Austria. If your legal protection insurance provides coverage, we will bill our fee directly with the insurance company.
Video conference
Our law firm is completely digitalized. In everyday life, we work almost exclusively via video conference.
This means that you can also discuss your criminal case from abroad face-to-face with our Austrian lawyers. You will always receive an appointment at short notice and save yourself a long journey to Austria.
Of course, cooperation via telephone or personal appointments at our law firm locations are also possible as an alternative.

Appearance Representation or Direct Mandate?
You are welcome to engage us directly. However, if you have permanent in-house or corporate counsel, we are also pleased to collaborate with your regular legal representation concerning your criminal case in Austria.
However, for cross-border legal matters, local counsel representation is not the optimal approach. The legal frameworks are too different. Foreign attorneys can therefore contribute little from a legal standpoint. For this reason, we prefer to act as directly mandated correspondent attorneys.
It is therefore advisable that our attorneys receive a direct mandate with the instruction to conduct correspondence with the clients through their in-house or corporate counsel.
In this way, foreign clients have their usual law firm as a proven contact partner. Conversely, foreign law firms can also offer their clients a comprehensive service for Austria.
