Regarding advertising for alcoholic beverages, there are legal restrictions, particularly for TV and radio advertising. In Austria, there is a general advertising ban for spirits. Spirits are beverages with a minimum alcohol content of 15% and are obtained by distilling or mixing with other spirits. According to the ORF and Private Radio Act, advertising for alcoholic beverages that are not considered spirits, such as beer or sparkling wine, must not be specifically aimed at minors. Alcohol must not be portrayed in advertising as if it enhances success. The consumption of alcohol must not be presented as a solution to problems. The Audiovisual Media Services Act and the Private Radio Act also provide for nearly identical advertising restrictions for alcoholic beverages.
