There are a number of professions for which the Austrian legal system provides special advertising restrictions. These primarily affect the so-called liberal professions. The restrictions are primarily intended to prevent inappropriate and blatant advertising.
Advertising is always inappropriate if there is no connection between the offered goods or services and the advertising. Advertising is also inappropriate if it distorts the professional image or awakens incorrect ideas and unfulfillable expectations among market participants.
Advertising is blatant if it is so exaggerated that it is not taken seriously by market participants. The slogan “You get the best ice cream in the Milky Way from us.” is, for example, clearly blatant.
