For the registration of a pattern mark, its two-dimensional representation on paper or in a JPEG file on a data carrier is required.
Distinctiveness
As with all other types of trademarks, distinctiveness is also necessary for the pattern mark.
The distinctiveness of pattern marks is to be assessed with reference to goods. However, a pattern mark that is considered not distinctive for the goods for which it is registered should also be considered not distinctive for services that are closely related to these goods.
Examples of Pattern Marks
Well-known pattern marks often come from the luxury segment of the fashion industry:
- Burberry pattern
- Louis Vuitton pattern
