Acquisition by Foreigners in the Federal State of Vienna
The acquisition of land by foreign persons in Vienna is subject to approval. For this, either an approval according to the Vienna Foreigner Acquisition Act or a negative certificate is required. An approval must be granted if there is an economic or social interest in the creation of the legal transaction.
However, there are also exceptions to the approval requirement:
- The acquisition of ownership by spouses or registered partners, where they act as joint acquirers and one of them holds Austrian citizenship, is not subject to approval.
- In the case of other international treaty obligations (e.g., bilateral agreements) which conflict
