A sound mark, also known as an acoustic mark, consists of sounds or melodies.

Previously, sound marks also had to be graphically representable. This was largely unproblematic for melodies, but not for everyday sounds. This requirement has since been abolished. The graphic representation of a sound mark is done in musical notation or a sonogram. Submission as a digital audio file is also permissible.
Distinctiveness
A sound mark, like any other mark, must also possess inherent distinctiveness. This will not be the case for long, barely memorable melodies. Conversely, sound marks consisting of only a single tone are generally not distinctive. The mere acoustic reproduction of a text through singing is also generally not considered eligible for trademark protection. It is different if the singing is additionally accompanied by a melody – in this case, the sound mark regularly possesses inherent distinctiveness.
Goods and services must also not be described by the sound mark. For example, the mooing of a cow is not distinctive for milk.
Examples
One of the most well-known sound marks is the “Tüdeldüdü” melody of Deutsche Telekom AG. Other registered sound marks include the roar of the MGM lion or the popping of a champagne cork by Henkell & Co. Sektkellerei KG.
