Distinction of Trademark Types

Generally, the relationship between the individual types of trademarks is fluid. For most trademark law issues, it is not the chosen type of trademark that is relevant, but only the manner in which the mark is perceived.

For example, a highly distinctive logo of a chocolate manufacturer, which is accompanied by the word “Schokolade” – a word that is not distinctive in the slightest in this context – is formally a combined mark. Therefore, only the figurative element obtains protection. In this case, it would therefore be more sensible to protect only the logo as a figurative mark.

The registration of a pure color mark is subject to high hurdles. Anyone who sells chocolate in single-colored packaging can only register the color as a trademark if they are as well-known as Milka. Startups therefore have no chance of obtaining a color mark. Colored elements with contours, however, are open to everyone as figurative marks.

Position marks are always also figurative marks (due to their graphic representation). Conversely, a figurative mark can also be a position mark.
