Bu nedenle, t\u00fcm ilgili taraflar\u0131n t\u00fcm talepleri Avusturya hukukuna g\u00f6re de\u011ferlendirilmelidir. Bu durum sadece kazaya neden olan ki\u015fi ve kaza ma\u011fdurunun ayn\u0131 yabanc\u0131 \u00fclkede ikamet etmesi durumunda farkl\u0131l\u0131k g\u00f6sterir.  <\/p>\n\n<p class=\"wp-block-paragraph\">Bir da\u011f bisikleti kazas\u0131nda \u015fu durumlarda <strong>tazminat talepleri<\/strong> s\u00f6z konusu olabilir<\/p>\n\n<ol class=\"wp-block-list\">\n<li>Ac\u0131 ve Ist\u0131rap<\/li>\n\n\n\n<li>Maddi Hasarlar<\/li>\n\n\n\n<li>Kurtarma Masraflar\u0131<\/li>\n\n\n\n<li>Tedavi Masraflar\u0131<\/li>\n\n\n\n<li>Bo\u015fa Giden Harcamalar<\/li>\n\n\n\n<li>Kazan\u00e7 Kayb\u0131<\/li>\n\n\n\n<li>Toplu masraflar<\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\">Bu <strong>taleplerden sorumluluk<\/strong>, kazaya kusurlu ve hukuka ayk\u0131r\u0131 bir \u015fekilde neden olan ki\u015fiye aittir. Bu talepleri bir kaza ma\u011fduru olarak ileri s\u00fcrmek veya bir kaza faili olarak reddetmek isteyen ki\u015fi, <strong>ba\u015ftan itibaren her \u015feyi do\u011fru<\/strong> yapmal\u0131d\u0131r. <\/p>\n\n<p class=\"wp-block-paragraph\">Yaralanmalar\u0131n oldu\u011fu ciddi bir kaza durumunda, polis \u00e7a\u011fr\u0131labilir ve kaza raporunu tutabilir. Di\u011fer trafik kat\u0131l\u0131mc\u0131lar\u0131 (ara\u00e7 s\u00fcr\u00fcc\u00fcleri, bisiklet\u00e7iler, yayalar) kazaya kar\u0131\u015fm\u0131\u015fsa bu otomatik olarak ger\u00e7ekle\u015fir. Bu genellikle kamuya a\u00e7\u0131k cadde ve yollardaki kazalarda da ge\u00e7erlidir. Bu durumda <strong>k\u00fc\u00e7\u00fck hatalar<\/strong> bile ifadede <strong>pahal\u0131 sonu\u00e7lar<\/strong> do\u011furabilir.   <\/p>\n    <div class=\"mr-quote mrbg clearfix\">\n        <a class=\"mr-quote-person\" href=\"\/ueber-uns\/rechtsanwalt-sebastian-riedlmair\/\" title=\"Rechtsanwalt Sebastian Riedlmair\">\n            <img decoding=\"async\" class=\"mr-quote-person-img\" src=\"https:\/\/harlander-partner.eu\/wp-content\/themes\/harlander\/design\/sr100.webp\" width=\"100\"\n                 height=\"100\" loading=\"lazy\" alt=\"Rechtsanwalt Sebastian Riedlmair\">\n            <span class=\"mr-quote-person-text\">\n            Sebastian Riedlmair<br>\n            <span class=\"mr-quote-person-function\">Harlander &amp; Partner Rechtsanw\u00e4lte<\/span>\n        <\/span>\n        <\/a>\n        <span class=\"mr-quote-content\">\u201e\u0130deal olarak, kazada hi\u00e7bir kusurunuz olmasa bile, polis taraf\u0131ndan sorgulanmadan \u00f6nce bizimle ileti\u015fime ge\u00e7in.\u201c<\/span>\n    <\/div>\n<a class=\"mr-cta-link mr-cta-button-cal\" href=\"#h2-booking\" title=\"\u00dccretsiz ilk g\u00f6r\u00fc\u015fme\"><span class=\"mr-cta-link-normal\">\u015eimdi istedi\u011finiz tarihi se\u00e7in:<\/span><span class=\"mr-cta-link-bold\">\u00dccretsiz ilk g\u00f6r\u00fc\u015fme<\/span><\/a>\n\n<h3 class=\"wp-block-heading\" id=\"h-schmerzen\">Ac\u0131 ve Ist\u0131rap<\/h3>\n\n<p class=\"wp-block-paragraph\"><strong>Manevi tazminat<\/strong>, yaralanan ki\u015finin <strong>da\u011f bisikleti kazas\u0131<\/strong> nedeniyle halihaz\u0131rda ya\u015fad\u0131\u011f\u0131 <strong>ac\u0131 ve rahats\u0131zl\u0131klar<\/strong> ile gelecekte ortaya \u00e7\u0131kabilecek t\u00fcm <strong>kal\u0131c\u0131 ve ge\u00e7 d\u00f6nem hasarlar\u0131<\/strong> i\u00e7in \u00f6denir.<\/p>\n\n<p class=\"wp-block-paragraph\">Manevi tazminat\u0131n miktar\u0131, <strong>g\u00fcnl\u00fck \u00fccretler<\/strong> ile hesaplan\u0131r, burada hafif, orta ve \u015fiddetli a\u011fr\u0131lar aras\u0131nda ayr\u0131m yap\u0131l\u0131r. Bunlar, \u00e7e\u015fitli yarg\u0131 b\u00f6lgelerinde k\u0131smen farkl\u0131 miktarlarda h\u00fckmedilir. <\/p>\n\n<p class=\"wp-block-paragraph\"><em>\u00d6rnek olarak, Salzburg Eyalet Mahkemesi, 3 g\u00fcn \u015fiddetli a\u011fr\u0131, 8 g\u00fcn orta a\u011fr\u0131 ve 21 g\u00fcn hafif a\u011fr\u0131 ile birlikte seyreden bir bedensel zararda, muhtemelen yakla\u015f\u0131k 5.520,00 EUR manevi tazminata h\u00fckmedecektir.<\/em><\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-sachschaden\">Maddi Hasarlar<\/h3>\n\n<p class=\"wp-block-paragraph\"><strong>Maddi hasarlar<\/strong>, da\u011f bisikleti kazas\u0131 sonucu <strong>de\u011fi\u015ftirilmesi veya onar\u0131m\u0131<\/strong> i\u00e7in gereken masraflar\u0131 kapsar, <strong>e\u015fyalar\u0131n<\/strong> <strong>tahrip olan veya hasar g\u00f6ren<\/strong>. Da\u011f bisikleti kazas\u0131 sonucu hasar g\u00f6ren bisiklet ekipman\u0131 gibi maddi hasarlar\u0131n da tazmin edilmesi gerekir. <\/p>\n\n<p class=\"wp-block-paragraph\">Tazminat talebinin amac\u0131, ma\u011fdurun u\u011frad\u0131\u011f\u0131 kay\u0131p i\u00e7in bir telafi sa\u011flamakt\u0131r. Kullan\u0131lm\u0131\u015f e\u015fyalar, \u00f6rne\u011fin eski bir bisiklet ekipman\u0131 hasar g\u00f6rd\u00fc\u011f\u00fcnde, &#8220;yeni yerine eski&#8221; problemi ortaya \u00e7\u0131kar. Bu durum, \u00e7ok kullan\u0131lm\u0131\u015f e\u015fyalarda sadece hasarl\u0131 e\u015fyan\u0131n kullan\u0131m de\u011ferinin tazmin edilmesine yol a\u00e7abilir.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-bergungskosten\">Kurtarma Masraflar\u0131<\/h3>\n\n<p class=\"wp-block-paragraph\"><strong>Kurtarma masraflar\u0131<\/strong>, <strong>kaza yerinden kurtarma maliyetlerini<\/strong> kapsar. E\u011fer bir da\u011f bisikleti kazas\u0131 sonucu helikopterle kurtarma gerekiyorsa, yaral\u0131 ki\u015fi bu masraflar\u0131 da kazaya neden olan ki\u015fiden talep edebilir. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>D\u0130KKAT:<\/strong> Kurtarma masraflar\u0131 bir sigorta taraf\u0131ndan kar\u015f\u0131land\u0131ysa, bu konudaki talepler zarar verene kar\u015f\u0131 sigortaya ge\u00e7er.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-heilungskosten\">Tedavi Masraflar\u0131<\/h3>\n\n<p class=\"wp-block-paragraph\"><strong>Tedavi masraflar\u0131<\/strong>, <strong>tedaviler, ila\u00e7lar, t\u0131bbi cihazlar<\/strong> ve <strong>tedavilere gidi\u015f geli\u015fler<\/strong> i\u00e7in yap\u0131lan masraflar\u0131 kapsar.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>D\u0130KKAT:<\/strong> Hizmetler sosyal g\u00fcvenlik kurumu taraf\u0131ndan sa\u011fland\u0131ysa, bu konudaki talepler zarar verene kar\u015f\u0131 sosyal g\u00fcvenlik kurumuna ge\u00e7er.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-frustrierte-aufwendungen\">Bo\u015fa Giden Harcamalar<\/h3>\n\n<p class=\"wp-block-paragraph\"><strong>Bo\u015fa \u00e7\u0131kan masraflar<\/strong>, da\u011f bisikleti kazas\u0131n\u0131n do\u011frudan neden olmad\u0131\u011f\u0131 ancak kaza nedeniyle faydas\u0131z hale gelen t\u00fcm harcamalard\u0131r. Orman sahibi genel kullan\u0131m i\u00e7in izin verirse, bu uygun i\u015faretlerle belirtilir.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-mountainbikefahren-unter-alkoholeinfluss\">Alkol Etkisi Alt\u0131nda Da\u011f Bisikleti Kullan\u0131m\u0131<\/h3>\n\n<p class=\"wp-block-paragraph\">Da\u011f bisikleti kullan\u0131m\u0131 (genel bisiklet kullan\u0131m\u0131 gibi) kandaki alkol i\u00e7in yasal bir \u00fcst s\u0131n\u0131ra (promil s\u0131n\u0131r\u0131) tabidir: 0,8 promil. Bu de\u011ferin a\u015f\u0131lmas\u0131 durumunda bir kaza meydana gelirse yasal sonu\u00e7lar do\u011far. Promil de\u011feri 1,6&#8217;n\u0131n \u00fczerindeyse, ki\u015fi &#8220;s\u00fcr\u00fc\u015f yetersiz&#8221; olarak kabul edilir.   <br\/>Tekrarlanan ihlaller veya \u00f6zellikle ciddi bir kaza durumunda, (motorlu ta\u015f\u0131t) s\u00fcr\u00fcc\u00fc belgesi de geri al\u0131nabilir.<\/p>\n\n<p class=\"wp-block-paragraph\">Ancak yasal olarak hen\u00fcz \u00f6nemli say\u0131lmayan promil de\u011ferlerinde bile, alkol etkisi sorumluluk konular\u0131nda \u00f6nemli olabilir. Kazaya neden olan ki\u015fi alkoll\u00fcyse, bu neredeyse her zaman a\u011f\u0131r ihmal olarak de\u011ferlendirilir. Kazaya neden olan ki\u015fi bu durumda maddi hasarlarda hasarl\u0131 e\u015fyalar\u0131n yeni de\u011ferini ve kaza ma\u011fdurunun kazan\u00e7 kayb\u0131n\u0131 tazmin etmekle y\u00fck\u00fcml\u00fcd\u00fcr.   <br\/>Kaza ma\u011fduru alkoll\u00fcyse, mahkeme genellikle kaza ma\u011fdurunun m\u00fc\u015fterek kusurunu tespit eder. Kaza ma\u011fdurunun tazminat talebi bu durumda y\u00fczdesel olarak azalt\u0131l\u0131r. <\/p>\n\n<p class=\"wp-block-paragraph\">Alkoll\u00fc olma durumu, ileri s\u00fcr\u00fclecek taleplerin kapsam\u0131 ve miktar\u0131 \u00fczerinde do\u011frudan etkiye sahiptir.<\/p>\n\n<p class=\"wp-block-paragraph\">Alkol etkisi alt\u0131nda da\u011f bisikleti kullan\u0131m\u0131 nedeniyle k\u0131s\u0131tl\u0131 olan ki\u015fi, kimse yaralanmam\u0131\u015f olsa bile <strong>su\u00e7<\/strong> olan <strong>bedensel g\u00fcvenli\u011fi tehlikeye atma<\/strong> eylemini ger\u00e7ekle\u015ftirmi\u015f olur. Alkol etkisi nedeniyle ba\u015fkalar\u0131n\u0131 yaralayan ki\u015fi, a\u011f\u0131r ihmal nedeniyle daha a\u011f\u0131r cezaland\u0131r\u0131lan <strong>taksirle yaralama<\/strong> su\u00e7unu i\u015flemi\u015f olur. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-mountainbikefahren-unter-drogeneinfluss\">Uyu\u015fturucu Etkisi Alt\u0131nda Da\u011f Bisikleti Kullan\u0131m\u0131<\/h3>\n\n<p class=\"wp-block-paragraph\">Uyu\u015fturucu etkisi alt\u0131nda da\u011f bisikleti kullan\u0131m\u0131 i\u00e7in alkol etkisi alt\u0131nda da\u011f bisikleti kullan\u0131m\u0131 ile ayn\u0131 kurallar ge\u00e7erlidir. Uyu\u015fturucu etkisi alt\u0131nda da\u011f bisikleti kullan\u0131m\u0131 hem kazaya neden olan ki\u015fi hem de kaza ma\u011fduru i\u00e7in ciddi dezavantajlar do\u011furabilir. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-fehlerhafte-mountainbikeausrustung\">Hatal\u0131 Da\u011f Bisikleti Ekipman\u0131<\/h3>\n\n<p class=\"wp-block-paragraph\">Da\u011f bisikleti ekipman\u0131ndaki bir hata kazalara ve yaralanmalara yol a\u00e7abilir. Bu konuda birka\u00e7 durum d\u00fc\u015f\u00fcn\u00fclebilir: <\/p>\n\n<ol class=\"wp-block-list\">\n<li>Kendi hatalar\u0131<\/li>\n\n\n\n<li>Da\u011f bisikleti sat\u0131c\u0131s\u0131n\u0131n hatas\u0131<\/li>\n\n\n\n<li>Bir uzman at\u00f6lyesinin hatas\u0131<\/li>\n\n\n\n<li>Da\u011f bisikleti kiralama \u015firketinin hatas\u0131<\/li>\n\n\n\n<li>Da\u011f bisikleti \u00fcreticisinin hatas\u0131<\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\"><strong>Kendi hatalar\u0131<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">Da\u011f bisiklet\u00e7iler i\u00e7in kendi g\u00fcvenliklerini nas\u0131l sa\u011flayacaklar\u0131na dair \u00f6zel davran\u0131\u015f y\u00fck\u00fcml\u00fcl\u00fckleri yoktur. \u00d6zellikle yeti\u015fkinler i\u00e7in kask zorunlulu\u011fu veya \u00f6zel koruyucu ekipman kullanma zorunlulu\u011fu yoktur. Ancak 12 ya\u015f\u0131n\u0131 doldurmam\u0131\u015f \u00e7ocuklar i\u00e7in herhangi bir bisiklet kullan\u0131m\u0131nda veya bisiklete binmede kask tak\u0131lmas\u0131 yasal olarak zorunludur. Buna ayk\u0131r\u0131 davran\u0131\u015flar i\u00e7in ceza \u00f6ng\u00f6r\u00fclmemi\u015ftir.    <\/p>\n\n<p class=\"wp-block-paragraph\">Ancak kask veya koruyucu k\u0131yafet olmadan bir kaza meydana geldi\u011finde \u2013 di\u011fer kat\u0131l\u0131mc\u0131lar\u0131n sorumlulu\u011funun derecesinden ba\u011f\u0131ms\u0131z olarak \u2013 m\u00fc\u015fterek kusur de\u011ferlendirmesi yap\u0131labilece\u011fi dikkate al\u0131nmal\u0131d\u0131r. Bu durum tazminat taleplerini azaltabilir. <\/p>\n\n<p class=\"wp-block-paragraph\">Prensip olarak <strong>sportif ama\u00e7l\u0131 bisiklet\u00e7iler<\/strong> ile normal yol bisiklet\u00e7ileri aras\u0131nda ayr\u0131m yap\u0131l\u0131r. Y\u00fcksek Mahkeme (OGH) i\u00e7tihatlar\u0131nda, h\u0131z ve bununla ili\u015fkili kaza risklerini, kask takman\u0131n \u00f6nemine dair &#8220;genel bir bilin\u00e7&#8221; olu\u015fturdu\u011fu gerek\u00e7esiyle dikkate almaktad\u0131r (OGH 2 Ob 8\/20w).  <br\/>Her bir vakada ger\u00e7ekte s\u00fcr\u00fclen h\u0131z ve meydana gelen hasarlar\u0131n \u00f6nlenebilirli\u011fine g\u00f6re de\u011ferlendirme yap\u0131l\u0131r. \u00d6rne\u011fin, d\u00fc\u015f\u00fck h\u0131zla (15-20 km\/s) giden yar\u0131\u015f bisiklet\u00e7ilerinde m\u00fc\u015fterek kusur mahkeme taraf\u0131ndan reddedilmi\u015ftir.  <\/p>\n\n<p class=\"wp-block-paragraph\">Koruyucu k\u0131yafet kullan\u0131m\u0131 konusunda da (spor) \u00e7evresinin genel bilincine bak\u0131lmal\u0131d\u0131r. Y\u00fcksek Mahkeme, y\u00fcksek ki\u015fisel risk durumlar\u0131nda motosiklet k\u0131yafeti kullan\u0131lmamas\u0131 durumunda m\u00fc\u015fterek kusur kabul etmektedir (2 Ob 119\/15m). <\/p>\n\n<p class=\"wp-block-paragraph\">Bisiklet\u00e7iler ayr\u0131ca genel trafik kurallar\u0131na uymak zorundad\u0131r.<br\/><strong>G\u00f6r\u00fc\u015f mesafesi kural\u0131na<\/strong> g\u00f6re, g\u00f6r\u00fclebilir bir yolda bir engel kar\u015f\u0131s\u0131nda zaman\u0131nda durulabilecek h\u0131zda s\u00fcr\u00fc\u015f yap\u0131lmal\u0131d\u0131r. Ola\u011fand\u0131\u015f\u0131 veya zor fark edilebilir bir engelle kar\u015f\u0131la\u015f\u0131lmas\u0131 beklenemiyorsa, g\u00f6r\u00fc\u015f mesafesi kural\u0131 g\u00fcven ilkesiyle s\u0131n\u0131rland\u0131r\u0131l\u0131r. <\/p>\n\n<p class=\"wp-block-paragraph\">Da\u011f bisikleti ekipman\u0131n\u0131n bak\u0131m\u0131n\u0131 kendisi yapan ki\u015fi b\u00fcy\u00fck bir risk alm\u0131\u015f olur. \u00d6rne\u011fin frenler veya direk kendi ayarlanm\u0131\u015fsa ve s\u00fcr\u00fc\u015f s\u0131ras\u0131nda bir ar\u0131za ve d\u00fc\u015fme meydana gelirse, d\u00fc\u015fen ki\u015fi ba\u015fka bir nedeni kan\u0131tlayamad\u0131\u011f\u0131 s\u00fcrece hatal\u0131 ayarlama d\u00fc\u015fme nedeni olarak kabul edilir. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Yabanc\u0131 hatalar\u0131<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">Da\u011f bisikleti sat\u0131c\u0131lar\u0131, da\u011f bisikleti servisleri, da\u011f bisikleti kiralama \u015firketleri, ithalat\u00e7\u0131lar ve da\u011f bisikleti \u00fcreticileri uzman i\u015fletmeler olarak hatal\u0131 ekipman veya hatal\u0131 ayarlamalardan sorumludur.<\/p>\n\n<p class=\"wp-block-paragraph\">Hatal\u0131 da\u011f bisikleti ekipman\u0131n\u0131n kazaya neden oldu\u011funu kan\u0131tlama y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc davac\u0131ya, yani genellikle kaza ma\u011fduruna aittir. Bu durumda &#8220;g\u00f6r\u00fcn\u00fc\u015fte kan\u0131t&#8221; yeterlidir. G\u00f6r\u00fcn\u00fc\u015fte kan\u0131t, deneyim kurallar\u0131na dayanarak kan\u0131tlanm\u0131\u015f olgulardan kan\u0131tlanmas\u0131 gereken olgulara \u00e7\u0131kar\u0131m yap\u0131lmas\u0131na izin verir.   <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-verschulden-bei-organisierten-mountainbikeveranstaltungen\">Organize Da\u011f Bisikleti Etkinliklerinde Kusur<\/h3>\n\n<p class=\"wp-block-paragraph\">\u00d6zel olarak i\u015faretlenmi\u015f ve belirlenmi\u015f da\u011f bisikleti parkurlar\u0131 <strong>organize da\u011f bisikleti yar\u0131\u015flar\u0131<\/strong> i\u00e7in kullan\u0131ld\u0131\u011f\u0131nda, orman sahibinin genel sorumlulu\u011fu kabul edilmez. Bu durumda, organizat\u00f6rler parkurun kat\u0131l\u0131mc\u0131lar i\u00e7in g\u00fcvenli ve korumal\u0131 olmas\u0131n\u0131 sa\u011flamak zorundad\u0131r. \u0130yile\u015ftirmeler ve bariyerler ek g\u00fcvenlik \u00f6nlemleri olarak al\u0131nmal\u0131d\u0131r.   <\/p>\n\n<p class=\"wp-block-paragraph\">Ayr\u0131ca, da\u011f bisikleti yar\u0131\u015f\u0131 organizat\u00f6r\u00fc, tahsis edilen yar\u0131\u015f parkurunun g\u00fcvenli durumda olmas\u0131n\u0131 ve d\u00fczenli bir kurtarma hizmetinin kurulmas\u0131n\u0131 sa\u011flamakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-sicherung-der-waldwege-bei-erlaubnis-zum-befahren\">Orman Yollar\u0131n\u0131n G\u00fcvenli\u011fi (S\u00fcr\u00fc\u015f \u0130zni Oldu\u011funda) <\/h3>\n\n<p class=\"wp-block-paragraph\">Da\u011f bisiklet\u00e7ilerin y\u00fcr\u00fcy\u00fc\u015f yollar\u0131n\u0131 (&#8220;payla\u015f\u0131ml\u0131 parkurlar&#8221;) kullanmas\u0131na izin verilebilir. Bu durumda di\u011fer t\u00fcm yol kullan\u0131c\u0131lar\u0131na (yayalar, da\u011fc\u0131lar, kayak\u00e7\u0131lar) kar\u015f\u0131 kar\u015f\u0131l\u0131kl\u0131 sayg\u0131 g\u00f6sterme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne uyulmal\u0131d\u0131r. Bunun yan\u0131nda \u00f6zel olarak belirlenmi\u015f da\u011f bisikleti parkurlar\u0131 (&#8220;trails&#8221;) olabilir.   <\/p>\n\n<p class=\"wp-block-paragraph\">\u0130zin verilen orman yollar\u0131 veya di\u011fer orman patikalar\u0131 d\u0131\u015f\u0131nda bisiklet veya da\u011f bisikleti kullanan ki\u015fi, zemin ve bitki \u00f6rt\u00fcs\u00fcn\u00fcn durumu a\u00e7\u0131s\u0131ndan prensip olarak <strong>kendi riski<\/strong> ile hareket eder.<\/p>\n\n<p class=\"wp-block-paragraph\">Orman sahibinin tipik (orman) tehlikelerini (d\u00fc\u015fen dallar, zemin d\u00fczensizlikleri vb.) \u00f6nleme konusunda <strong>genel bir y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc yoktur<\/strong>. Bu durum do\u011fal d\u00fc\u015fme, \u00e7arp\u0131\u015fma ve \u00e7\u0131\u011f tehlikeleri i\u00e7in de ge\u00e7erlidir. Burada sadece m\u00fcdahale ilkesi kapsam\u0131nda olu\u015fturulan atipik tehlikelerden sorumluluk s\u00f6z konusudur. Yol sahibi, kaza <strong>izinsiz<\/strong> kullan\u0131lan bir yolda meydana gelirse ve bu durum kullan\u0131c\u0131 taraf\u0131ndan fark edilebilir durumdaysa prensip olarak sorumlu de\u011fildir (4 Ob 200\/12h).   <\/p>\n\n<p class=\"wp-block-paragraph\">Ancak <strong>atipik tehlikeler<\/strong> s\u00f6z konusu oldu\u011funda (\u00f6rn. orman \u00e7al\u0131\u015fmalar\u0131 veya avlanma s\u0131ras\u0131nda gerilen iplerin i\u015faretlenmesi), bu tehlike kayna\u011f\u0131n\u0131n g\u00fcvenli\u011fini sa\u011flamakla y\u00fck\u00fcml\u00fcd\u00fcr.<br\/>Orman sahibi orman ve orman yollar\u0131n\u0131n kullan\u0131m\u0131na izin vermi\u015fse, \u00a7 1319a ABGB uyar\u0131nca sorumludur, bu durumda sorumluluk kast ve a\u011f\u0131r ihmal ile s\u0131n\u0131rl\u0131d\u0131r.<\/p>\n\n<p class=\"wp-block-paragraph\">Orman sahibinin <strong>belirlenmi\u015f da\u011f bisikleti parkurlar\u0131nda<\/strong> daha y\u00fcksek bir \u00f6zen y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc vard\u0131r. Parkur \u00f6zel olarak da\u011f bisiklet\u00e7iler i\u00e7in i\u015faretlenmi\u015fse, parkur bu kapsamda g\u00fcvenli ve iyi g\u00f6r\u00fcn\u00fcr \u015fekilde i\u015faretlenmi\u015f olmal\u0131d\u0131r.<br\/>\u00d6zellikle tehlikeli noktalar gibi tehlike kaynaklar\u0131 (\u00f6rn. u\u00e7urumlar, b\u00fcy\u00fck gev\u015fek ta\u015flar veya engeller) g\u00fcvenlik alt\u0131na al\u0131nmal\u0131 veya kapat\u0131lmal\u0131d\u0131r. Olas\u0131 tehlike kaynaklar\u0131n\u0131 ortadan kald\u0131rmak i\u00e7in d\u00fczenli bak\u0131m da orman sahibinin sorumlulu\u011fundad\u0131r.   <br\/>Da\u011f bisiklet\u00e7iler i\u00e7in, t\u00fcm belirlenmi\u015f da\u011f bisikleti parkurlar\u0131nda Karayollar\u0131 Trafik Kanunu&#8217;nun (StVO) ge\u00e7erli oldu\u011funu unutmamak gerekir (e\u011flence parklar\u0131 hari\u00e7).<\/p>\n\n<p class=\"wp-block-paragraph\">Trafik g\u00fcvenli\u011fi y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn somut kapsam\u0131 her zaman m\u00fcnferit vakan\u0131n ko\u015fullar\u0131na ba\u011fl\u0131d\u0131r. Somut olarak, orman sahibinin bir tehlikeyi \u00f6nlemek i\u00e7in hangi \u00f6nlemleri almas\u0131n\u0131n m\u00fcmk\u00fcn ve makul oldu\u011funa bak\u0131lmal\u0131d\u0131r. <\/p>\n\n<p class=\"wp-block-paragraph\">Ancak orman ve orman yollar\u0131nda tam bir trafik g\u00fcvenli\u011finin sa\u011flanamayaca\u011f\u0131 da dikkate al\u0131nmal\u0131d\u0131r. Bu nedenle, orman sahibinin y\u00fck\u00fcml\u00fcl\u00fckleri konusunda a\u015f\u0131r\u0131 taleplerden ka\u00e7\u0131n\u0131lmal\u0131d\u0131r. <\/p>\n\n<p class=\"wp-block-paragraph\">Bir <strong>turizm birli\u011fi<\/strong> bir yolu genel kullan\u0131ma a\u00e7t\u0131\u011f\u0131nda, Y\u00fcksek Mahkeme (OGH) yak\u0131n zamanda, turizm birli\u011finin s\u00fcr\u00fc\u015f yetkisi olan bisiklet\u00e7ilere kar\u015f\u0131 \u00a71319a ABGB uyar\u0131nca bir (ortak) yol sahibi i\u015flevi g\u00f6rd\u00fc\u011f\u00fcne karar vermi\u015ftir. Bu, bisiklet ama\u00e7l\u0131 kullan\u0131m i\u00e7in bir bak\u0131m ve koruma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn oldu\u011fu anlam\u0131na gelir. Turizm birli\u011fi ve orman\/orman sahibi buna g\u00f6re m\u00fc\u015ftereken sorumludur.   <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-mangelhafte-sonderflachen\">Kusurlu \u00d6zel Alanlar <\/h3>\n\n<p class=\"wp-block-paragraph\">\u00d6zel alanlar aras\u0131nda \u00f6zellikle <strong>e\u011flence\/bisiklet parklar\u0131<\/strong>, i\u015faretli parkurlar ve benzeri tesisler ile <strong>antrenman ve yar\u0131\u015f pistleri<\/strong> yer almaktad\u0131r. Da\u011f bisikleti \u00f6\u011fretmeni ise da\u011f bisikleti okulu sahibinin ifa yard\u0131mc\u0131s\u0131d\u0131r ve konu\u011fa kar\u015f\u0131 yaln\u0131zca haks\u0131z fiilden sorumludur. <\/p>\n\n<p class=\"wp-block-paragraph\">Da\u011f bisikleti okulu taraf\u0131ndan bedensel yaralanma gibi ki\u015fisel zararlar i\u00e7in sorumluluk reddi m\u00fcmk\u00fcn de\u011fildir.
