Belirli bir konuta ba\u011f\u0131ml\u0131 olan e\u015fin, bu konutu <g id=\"gid_2\">kullanmaya devam edebilmesini<\/g> sa\u011flar, yeter ki bu konut onun <g id=\"gid_3\">acil konut ihtiyac\u0131<\/g> i\u00e7in <g id=\"gid_4\">gerekli<\/g> olsun. Bu nedenle, konut \u00fczerinde tasarruf yetkisi olan e\u015f, konutun kaybedilmemesi i\u00e7in t\u00fcm eylemlerden ka\u00e7\u0131nmal\u0131 ve zaman\u0131nda gerekli her \u015feyi yapmal\u0131d\u0131r.<\/a>  <\/p>\n\n<div class=\"wp-block-uagb-container uagb-block-3019fe8e alignfull uagb-is-root-container\">\n<div class=\"wp-block-uagb-container uagb-block-32585033\">\n<p class=\"wp-block-paragraph\">Konut koruma talebi, ortak konuta ba\u011f\u0131ml\u0131 olan e\u015fi korur.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-container uagb-block-45819ab6\"><picture>\n\t\t<source srcset=\"\" >\n\t\t<img decoding=\"async\" class=\"mr-picture-small\" src=\"\" alt=\"\u00a7 97 ABGB uyar\u0131nca konut koruma talebi: Evlilik ve bo\u015fanmada konut hakk\u0131n\u0131z\u0131 nas\u0131l g\u00fcvenceye al\u0131rs\u0131n\u0131z \u2013 basit\u00e7e a\u00e7\u0131klanm\u0131\u015f ve hukuki olarak sa\u011flam bir \u015fekilde.\" >\n\t<\/picture>\n<\/div>\n<\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-wichtige-voraussetzungen-fur-den-anspruch\">Talep \u0130\u00e7in \u00d6nemli Ko\u015fullar<\/h2>\n\n<p class=\"wp-block-paragraph\">\u00a7 97 ABGB uyar\u0131nca talebin ge\u00e7erli olmas\u0131 i\u00e7in belirli ko\u015fullar\u0131n yerine getirilmesi gerekir:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Acil konut ihtiyac\u0131<\/strong>: Sadece ya\u015fam ko\u015fullar\u0131na uygun ve ilgili e\u015fin ger\u00e7ekten ihtiya\u00e7 duydu\u011fu konut korunur.<\/li>\n\n\n\n<li><strong>Tasarruf yetkisi<\/strong>: Talep sadece di\u011fer e\u015fin, \u00f6rne\u011fin m\u00fclkiyet veya kira hakk\u0131 yoluyla konut \u00fczerinde hukuki veya fiili olarak tasarruf edebilmesi durumunda ge\u00e7erlidir.<\/li>\n\n\n\n<li><strong>Makul olmayan y\u00fck olmamas\u0131<\/strong>: Konutun korunmas\u0131 \u00f6nemli nedenlerden dolay\u0131 m\u00fcmk\u00fcn de\u011filse veya makul de\u011filse, talep ortadan kalkar.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-umfang-des-anspruchs\">Talebin Kapsam\u0131<\/h2>\n\n<p class=\"wp-block-paragraph\">Talep bir yandan <strong>zararl\u0131 eylemlerden ka\u00e7\u0131nmay\u0131<\/strong> kapsar. Genellikle maliyetlerin <strong>yar\u0131s\u0131na kadar<\/strong> olan bir kat\u0131l\u0131m s\u00f6z konusudur. <strong>\u00d6zel durumlarda<\/strong><strong>daha y\u00fcksek bir pay<\/strong> da talep edilebilir. Bu her zaman her iki e\u015fin gelir ve malvarl\u0131\u011f\u0131 durumuna ba\u011fl\u0131d\u0131r.   <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verhaltnis-zum-unterhalt\">Nafaka ile \u0130li\u015fkisi<\/h2>\n\n<p class=\"wp-block-paragraph\">Konut koruma talebi, genel para nafakas\u0131ndan <strong>ba\u011f\u0131ms\u0131zd\u0131r<\/strong>. Yani her iki talep de yan yana durur. Ancak <strong>y\u00fczde y\u00f6ntemiyle<\/strong> nafaka \u00f6deniyorsa, bu ek konut masraflar\u0131n\u0131n miktar\u0131n\u0131 <strong>azaltabilir<\/strong>. Bo\u015fanma <strong>kesinle\u015fene<\/strong> kadar <strong>devam eder<\/strong>. Ancak zaman\u0131nda <strong>malvarl\u0131\u011f\u0131n\u0131n payla\u015f\u0131m\u0131 i\u00e7in bir ba\u015fvuru<\/strong> yap\u0131l\u0131rsa, talep devam eder ve payla\u015f\u0131m s\u00fcrecinin sonuna kadar ge\u00e7erlidir.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-wohnungsschutz-unabhangig-von-der-ehewohnung\">Evlilik Konutundan Ba\u011f\u0131ms\u0131z Konut Koruma<\/h2>\n\n<p class=\"wp-block-paragraph\">Konut koruma talebi sadece ortak evlilik konutunu de\u011fil, acil konut ihtiyac\u0131n\u0131 kar\u015f\u0131lamaya yarayan her konutu korur. Konutun daha \u00f6nce birlikte kullan\u0131lm\u0131\u015f olmas\u0131 gerekmez. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-schadenerstaz-bei-eingriffen-durch-dritte\">\u00dc\u00e7\u00fcnc\u00fc \u015eah\u0131slar\u0131n M\u00fcdahalelerinde Tazminat<\/h2>\n\n<p class=\"wp-block-paragraph\">Bir \u00fc\u00e7\u00fcnc\u00fc \u015fah\u0131s, konutu <strong>kasten<\/strong><strong>elden \u00e7\u0131karmaya<\/strong> yard\u0131m ederse, ortaya \u00e7\u0131kan zarardan bu ki\u015fi de sorumlu tutulabilir. S\u0131kl\u0131kla acil bir konut ihtiyac\u0131n\u0131n olup olmad\u0131\u011f\u0131, maliyetlerin kar\u015f\u0131lanabilir olup olmad\u0131\u011f\u0131 ve bir ayr\u0131l\u0131k veya bo\u015fanma s\u0131ras\u0131nda \u00e7at\u0131\u015fmalarla nas\u0131l ba\u015fa \u00e7\u0131k\u0131laca\u011f\u0131 sorular\u0131 g\u00fcndeme gelir. <\/p>\n\n<p class=\"wp-block-paragraph\">Uzmanla\u015fm\u0131\u015f bir hukuk b\u00fcrosu taraf\u0131ndan hukuki destek almak g\u00fcvence sa\u011flar.
