Kadastro dairesinin s\u0131n\u0131r restorasyonu <strong><\/strong> malik taraf\u0131ndan yap\u0131lan ba\u015fvuru \u00fczerine kadastro kay\u0131tlar\u0131 temel al\u0131narak ger\u00e7ekle\u015ftirilir. <\/p>\n\n<p>S\u0131n\u0131rlar\u0131n tan\u0131nmaz hale gelme riski varsa veya s\u0131n\u0131rlar zaten tan\u0131nmaz veya tart\u0131\u015fmal\u0131 hale gelmi\u015fse, s\u0131n\u0131r restorasyonu, sabit bir s\u0131n\u0131r\u0131n yeniden i\u015faretlenmesini i\u00e7erir. Bunun i\u00e7in ilgili m\u00fclk sahipleri resmi i\u015fleme davet edilmelidir. <\/p>\n\n<p>Yeniden belirlenen s\u0131n\u0131r, ba\u015fvuru sahibi taraf\u0131ndan Medeni Kanun&#8217;un (ABGB) 845. maddesinde \u00f6ng\u00f6r\u00fclen \u015fekilde i\u015faretlenmelidir.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-grenzverhandlungen-durch-das-va-mrop-lp-rarad-name\">Kadastro Dairesi taraf\u0131ndan s\u0131n\u0131r g\u00f6r\u00fc\u015fmeleri <\/h3>\n\n<p>S\u0131n\u0131r m\u00fczakeresi, Avusturya Kadastro Kanunu&#8217;nun (VermG) 24. ve 25. maddelerine g\u00f6re arazi s\u0131n\u0131rlar\u0131n\u0131n belirlenmesi i\u00e7in bir prosed\u00fcrd\u00fcr. S\u0131n\u0131r m\u00fczakeresinin amac\u0131, s\u0131n\u0131rlar\u0131 ilgili m\u00fclk sahipleri aras\u0131nda kar\u015f\u0131l\u0131kl\u0131 anla\u015fma ile belirlemek ve sonraki \u00f6l\u00e7\u00fcm i\u00e7in i\u015faretlemektir.<\/p>\n\n<p>Bu s\u00fcre\u00e7te ilgili malikler, Kadastro Dairesi <strong><\/strong> taraf\u0131ndan s\u0131n\u0131rlar\u0131n belirlenmesi ve i\u015faretlenmesi i\u00e7in yerinde toplant\u0131ya davet edilir.<\/p>\n\n<p>S\u0131n\u0131r g\u00f6r\u00fc\u015fmesinde, mevcut belgeler (arazi vergisi kadastrosu ve planlar gibi) g\u00f6sterildikten sonra, haz\u0131r bulunan malikler taraf\u0131ndan s\u0131n\u0131rlar\u0131n gidi\u015fat\u0131 kar\u015f\u0131l\u0131kl\u0131 anla\u015fma ile belirlenir ve Medeni Kanun&#8217;un (ABGB) 845. maddesinde \u00f6ng\u00f6r\u00fclen \u015fekilde i\u015faretlenir.<\/p>\n\n<p>Malikler s\u0131n\u0131r gidi\u015fat\u0131 konusunda anla\u015famazlarsa, mevcut s\u0131n\u0131r gidi\u015fat\u0131n\u0131n do\u011fru olmad\u0131\u011f\u0131n\u0131 iddia eden malik, Kadastro Dairesi <strong><\/strong> taraf\u0131ndan alt\u0131 hafta i\u00e7inde s\u0131n\u0131r anla\u015fmazl\u0131\u011f\u0131n\u0131n \u00e7\u00f6z\u00fcm\u00fc i\u00e7in yasal i\u015flem ba\u015flatmaya davet edilir.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-vermessung-und-eintragung-im-grenzkataster\">\u00d6l\u00e7\u00fcm ve Kadastro Kayd\u0131<\/h3>\n\n<p>S\u0131n\u0131r g\u00f6r\u00fc\u015fmesinin ba\u015far\u0131yla tamamlanmas\u0131ndan sonra, ilgili maliklerin ba\u015fvurusu \u00fczerine Kadastro Dairesi <strong><\/strong> taraf\u0131ndan \u00f6l\u00e7\u00fcm yap\u0131labilir ve araziler kadastro siciline kaydedilebilir.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-gerichtliche-erneuerung-oder-berichtigung-der-grenze\">S\u0131n\u0131r\u0131n Mahkeme Yoluyla Yenilenmesi veya D\u00fczeltilmesi<\/h3>\n\n<p>\u0130ki arazi aras\u0131ndaki s\u0131n\u0131r i\u015faretleri tan\u0131mlanamaz hale geldi\u011finde veya kom\u015fu malikler aras\u0131nda s\u0131n\u0131rlar ihtilafl\u0131 oldu\u011funda, her kom\u015fu ayr\u0131ca Medeni Kanun&#8217;un (ABGB) 850. maddesi uyar\u0131nca s\u0131n\u0131r\u0131n mahkeme yoluyla yenilenmesini veya d\u00fczeltilmesini talep etme hakk\u0131na sahiptir.<\/p>\n\n<p>Bu, \u00f6nceden s\u0131n\u0131r g\u00f6r\u00fc\u015fmesi yap\u0131lmadan da m\u00fcmk\u00fcnd\u00fcr.<\/p>\n\n<p>Mahkeme \u00f6ncelikle son sakin m\u00fclkiyet durumunu belirlemeye \u00e7al\u0131\u015f\u0131r.
