Konut hakk\u0131, bir gayrimenkulde veya ba\u011f\u0131\u015flanan nesnede (ev, daire, &#8230;) ya\u015fama hakk\u0131d\u0131r. Bu hak, son derece ki\u015fisel bir hakt\u0131r ve hi\u00e7 kimseye devredilemez, \u00f6l\u00fcmle birlikte sona erer.   <\/p>\n\n<p>Konut hakk\u0131n\u0131 tapu k\u00fct\u00fc\u011f\u00fcne tescil ettirmek i\u00e7in, bir hak tesisi s\u00f6zle\u015fmesi ve bir tescil beyan\u0131 gereklidir. Konut hakk\u0131 s\u00fcreli veya \u00f6m\u00fcr boyu olabilir. <\/p>\n\n<p>Bir konut hakk\u0131n\u0131n iptali veya silinmesi, hak sahibinin r\u0131zas\u0131 olmadan \u00e7o\u011fu durumda \u00e7ok zordur.<\/p>\n\n<p>Hak sahibinden konut hakk\u0131 ancak &#8220;\u00e7ekilmez hale gelen bir durum&#8221; varsa al\u0131nabilir. Konut hakk\u0131n\u0131 &#8220;\u00f6demek&#8221; de m\u00fcmk\u00fcnd\u00fcr, ancak bunun i\u00e7in hak sahibinin r\u0131zas\u0131 gereklidir. <\/p>\n\n<p>\u00dczerinde konut hakk\u0131 bulunan bir \u015feyin elden \u00e7\u0131kar\u0131lmas\u0131 durumunda, elden \u00e7\u0131kar\u0131lan nesnenin de\u011fer kaybedece\u011fini ve ayr\u0131ca konut hakk\u0131n\u0131n devam edece\u011fini hesaba katmak gerekir, \u00e7\u00fcnk\u00fc bu, nesneye ba\u011fl\u0131 ayni bir hakt\u0131r.<\/p>\n\n<p>Konut kullan\u0131m hakk\u0131, tapu k\u00fct\u00fc\u011f\u00fcne tescil edilmeden yaln\u0131zca malike kar\u015f\u0131 ge\u00e7erlidir, ancak \u00fc\u00e7\u00fcnc\u00fc \u015fah\u0131slara kar\u015f\u0131 koruma sa\u011flamaz. \u00dc\u00e7\u00fcnc\u00fc \u015fah\u0131slara kar\u015f\u0131 da koruma sa\u011flamak i\u00e7in, tapu k\u00fct\u00fc\u011f\u00fcne tescil edilmesi gerekir. <\/p>\n\n<h2 class=\"wp-block-heading\">\u0130ntifa hakk\u0131<\/h2>\n\n<p><em>&#8220;\u0130ntifa, bir ba\u015fkas\u0131n\u0131n mal\u0131n\u0131, \u00f6z\u00fcne zarar vermeden, t\u00fcm k\u0131s\u0131tlamalar olmaks\u0131z\u0131n kullanma hakk\u0131d\u0131r.&#8221;<\/em><\/p>\n\n<p>\u0130ntifa hakk\u0131 sahibi, \u015feyin ekonomik sahibidir ve t\u00fcm &#8220;meyveleri&#8221; alabilir (\u00f6rne\u011fin: bir a\u011fac\u0131n elmalar\u0131, bir ine\u011fin s\u00fct\u00fc, kira,&#8230;)<\/p>\n\n<p>Konut hakk\u0131n\u0131n aksine, bir intifa hakk\u0131 tan\u0131n\u0131rken daha fazla hak tan\u0131n\u0131r. \u0130ntifa hakk\u0131 sahibi, \u015feyi kendisi kullanabilir veya kiralayabilir, ancak y\u00fckleyemez veya elden \u00e7\u0131karamaz. \u0130ntifa hakk\u0131 sahibinin elde etti\u011fi t\u00fcm gelirleri kendisi saklayabilir. Ancak, \u015feyi koruma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc vard\u0131r.   <\/p>\n\n<p>\u0130ntifa hakk\u0131ndan elde edilen gelirlerle, yasa gere\u011fi \u015fey \u00fczerinde iyile\u015ftirmeler, eklemeler ve \u00fcretimler yapmakla y\u00fck\u00fcml\u00fcd\u00fcr. \u015eeyin kendi imkanlar\u0131yla korunmas\u0131, iyile\u015ftirilmesi, tamamlanmas\u0131 ve \u00fcretilmesi yaln\u0131zca a\u00e7\u0131k yaz\u0131l\u0131 bir anla\u015fma ile zorunludur. <\/p>\n\n<p>\u0130ntifa hakk\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc bir ki\u015fiye devri hukuki a\u00e7\u0131dan m\u00fcmk\u00fcnd\u00fcr, ancak &#8220;as\u0131l&#8221; intifa hakk\u0131 sahibinin \u00f6l\u00fcm\u00fcyle sona erer.<\/p>\n\n<p>Konut kullan\u0131m hakk\u0131nda oldu\u011fu gibi, tapu k\u00fct\u00fc\u011f\u00fcne tescil zorunlu de\u011fildir veya bu, tescil edilmeden yaln\u0131zca medeni hukuk sahibi kar\u015f\u0131s\u0131nda ge\u00e7erlidir. Tapu k\u00fct\u00fc\u011f\u00fcne tescil, \u00fc\u00e7\u00fcnc\u00fc \u015fah\u0131slara kar\u015f\u0131 da kapsaml\u0131 koruma sa\u011flar. K\u0131sacas\u0131, gayrimenkul\u00fcn \u00fc\u00e7\u00fcnc\u00fc bir ki\u015fiye sat\u0131lmas\u0131 durumunda da bu ki\u015fiye kar\u015f\u0131 ge\u00e7erli kal\u0131r.  <\/p>\n\n<p>\u0130ntifa hakk\u0131 son derece ki\u015fisel bir hakt\u0131r ve \u00fc\u00e7\u00fcnc\u00fc bir ki\u015fiye devredilmesi durumunda bile &#8220;as\u0131l&#8221; hak sahibinin \u00f6l\u00fcm\u00fcyle her zaman sona erer. \u0130ntifa hakk\u0131 miras yoluyla ge\u00e7mez, ancak hak intifa hakk\u0131 sahibinin miras\u00e7\u0131lar\u0131na geni\u015fletilmi\u015fse miras yoluyla ge\u00e7ebilir. <\/p>\n\n<h2 class=\"wp-block-heading\">Y\u00fckleme ve elden \u00e7\u0131karma yasa\u011f\u0131<\/h2>\n\n<p>Bir gayrimenkul \u00fczerinde bir y\u00fckleme ve elden \u00e7\u0131karma yasa\u011f\u0131 varsa, malik bu gayrimenkul\u00fc hak sahibinin r\u0131zas\u0131 olmadan elden \u00e7\u0131karamaz veya y\u00fckleyemez. Tapu k\u00fct\u00fc\u011f\u00fcne tescil ile \u00fc\u00e7\u00fcnc\u00fc \u015fah\u0131slara kar\u015f\u0131 da mutlak etkisi vard\u0131r. <\/p>\n\n<p>Ancak, tapu k\u00fct\u00fc\u011f\u00fcne tescil yaln\u0131zca yasa\u011f\u0131n e\u015fler, kay\u0131tl\u0131 partnerler, ebeveynler ve \u00e7ocuklar, evlatl\u0131k veya koruyucu \u00e7ocuklar veya bunlar\u0131n e\u015fleri veya kay\u0131tl\u0131 partnerleri aras\u0131nda kurulmas\u0131 durumunda m\u00fcmk\u00fcnd\u00fcr.<\/p>\n\n<p>Y\u00fckleme ve elden \u00e7\u0131karma yasa\u011f\u0131 son derece ki\u015fisel bir hakt\u0131r, devredilemez ve hak sahibinin \u00f6l\u00fcm\u00fcyle sona erer.<\/p>\n\n<p>Herhangi bir akrabal\u0131k ili\u015fkisi yoksa (hayat arkada\u015flar\u0131 taraf\u0131ndan daire sat\u0131n al\u0131nmas\u0131), bir y\u00fckleme ve elden \u00e7\u0131karma yasa\u011f\u0131n\u0131n tapu k\u00fct\u00fc\u011f\u00fcne tescili hukuki a\u00e7\u0131dan m\u00fcmk\u00fcn de\u011fildir. Ancak, bu hedeflenen ama\u00e7larla uyumluysa, alternatif olarak taraflar aras\u0131nda gayrimenkul \u00fczerinde bir \u00f6n al\u0131m hakk\u0131 kurulabilir. Bu sayede s\u00f6zle\u015fme orta\u011f\u0131n\u0131n, sat\u0131n al\u0131nan gayrimenkul pay\u0131n\u0131 gizlice \u00fc\u00e7\u00fcnc\u00fc bir ki\u015fiye satmas\u0131 m\u00fcmk\u00fcn olmaz.  <\/p>\n\n<h2 class=\"wp-block-heading\">\u00d6n al\u0131m haklar\u0131<\/h2>\n\n<p>\u00d6n al\u0131m hakk\u0131, \u00f6n al\u0131m hakk\u0131 sahibini bir \u015feyi \u00fc\u00e7\u00fcnc\u00fc bir ki\u015fiden \u00f6nce sat\u0131n almaya yetkilendirir. Y\u00fcklenmi\u015f gayrimenkul\u00fcn elden \u00e7\u0131kar\u0131lmas\u0131 durumunda, malik \u00f6n al\u0131m hakk\u0131 sahibini bilgilendirmekle veya \u00fc\u00e7\u00fcnc\u00fc \u015fah\u0131slarla yap\u0131lan s\u00f6zle\u015fmeleri yaln\u0131zca ask\u0131ya al\u0131c\u0131 ko\u015fulla yapmakla y\u00fck\u00fcml\u00fcd\u00fcr. <\/p>\n\n<p>\u00d6n al\u0131m hakk\u0131n\u0131n kullan\u0131lmas\u0131n\u0131n \u00f6n ko\u015fulu, malik ile sat\u0131n alma ilgilisi aras\u0131nda ba\u011flay\u0131c\u0131 bir teklif veya s\u00f6zle\u015fme bulunmas\u0131d\u0131r. Teklif usul\u00fcne uygun olmal\u0131, sat\u0131\u015f i\u00e7in gerekli t\u00fcm temel i\u00e7erikleri i\u00e7ermelidir, \u00f6rne\u011fin sat\u0131n alma fiyat\u0131, haklar ve y\u00fck\u00fcml\u00fcl\u00fckler vb. <\/p>\n\n<p>\u00d6n al\u0131m hakk\u0131 sahibi bilgilendirildikten sonra, teklif art\u0131k de\u011fi\u015ftirilemez. \u00d6n al\u0131m hakk\u0131 sahibi, ta\u015f\u0131n\u0131r mallar i\u00e7in 24 saat i\u00e7inde, ta\u015f\u0131nmaz mallar i\u00e7in ise 30 g\u00fcn i\u00e7inde \u00f6n al\u0131m hakk\u0131n\u0131 &#8220;kullanmak&#8221; i\u00e7in s\u00fcreye sahiptir. Ancak, teklif yetersizse (\u00f6rne\u011fin: temel i\u00e7erikler belirtilmemi\u015fse, sat\u0131n alma fiyat\u0131 belirtilmemi\u015fse&#8230;) kullan\u0131m s\u00fcresi ba\u015flamaz.  <\/p>\n\n<p>\u00d6n al\u0131m hakk\u0131, ABGB&#8217;ye g\u00f6re yaln\u0131zca bir \u015fey sat\u0131ld\u0131\u011f\u0131nda kullan\u0131labilir, ba\u011f\u0131\u015flar\u0131, takaslar\u0131 vb. kapsamaz. Ancak, \u015fey ba\u011f\u0131\u015flan\u0131r veya miras yoluyla ge\u00e7erse, \u00f6n al\u0131m hakk\u0131 devam eder.<\/p>\n\n<p>\u00d6n al\u0131m hakk\u0131, miras yoluyla ge\u00e7meyen son derece ki\u015fisel bir hakt\u0131r. \u00d6n al\u0131m hakk\u0131 a\u015fa\u011f\u0131daki nedenlerle sona erebilir: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Hak sahibinin \u00f6l\u00fcm\u00fcyle<\/li>\n\n\n\n<li>Hak sahibinin \u00f6n al\u0131m hakk\u0131ndan feragat etmesiyle<\/li>\n\n\n\n<li>\u00d6n al\u0131m hakk\u0131ndan feragat edilmesi ve bir tazminat \u00f6denmesiyle<\/li>\n\n\n\n<li>\u00d6n al\u0131m hakk\u0131n\u0131n kullan\u0131m s\u00fcresi i\u00e7inde kullan\u0131lmamas\u0131yla<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">Vasiyetname<\/h2>\n\n<h3 class=\"wp-block-heading\">Sakl\u0131 paydan feragat<\/h3>\n\n<p>Miras b\u0131rakan\u0131n \u00f6l\u00fcm\u00fcnden sonra herhangi bir hukuki anla\u015fmazl\u0131k \u00e7\u0131kmayaca\u011f\u0131ndan emin olmak i\u00e7in, sakl\u0131 paydan feragat vard\u0131r. Sakl\u0131 paydan ya\u015fam\u0131 boyunca veya miras i\u015flemleri s\u0131ras\u0131nda feragat edilebilir. Sakl\u0131 paydan feragat bir \u015fekil \u015fart\u0131na, noter senedine tabidir. Sakl\u0131 paydan feragat \u00f6zellikle ya\u015fam\u0131 boyunca yap\u0131lan ba\u011f\u0131\u015flarda tavsiye edilir.
