P\u00ebrve\u00e7 k\u00ebsaj, ajo mund t\u00eb urdh\u00ebroj\u00eb paraburgim deri n\u00eb nj\u00eb koh\u00ebzgjatje totale prej nj\u00eb viti. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-parteien-der-unterlassungsexekution\">Pal\u00ebt n\u00eb ekzekutimin e ndalimit<\/h2>\n\n<p class=\"wp-block-paragraph\">N\u00eb ekzekutimin e ndalimit, p\u00ebrballen <strong>kreditori ekzekutues<\/strong> dhe <strong>debitori i detyruar<\/strong>. Kreditori \u00ebsht\u00eb ajo pal\u00eb q\u00eb posedon nj\u00eb titull ekzekutiv t\u00eb zbatuesh\u00ebm, i cili i ndalon debitorit nj\u00eb sjellje t\u00eb caktuar ose i p\u00ebrshkruan tolerimin e nj\u00eb veprimi. Ai fillon procedur\u00ebn dhe paraqet si k\u00ebrkes\u00ebn p\u00ebr ekzekutim ashtu edhe \u00e7do k\u00ebrkes\u00eb p\u00ebr d\u00ebnim.  <\/p>\n\n<p class=\"wp-block-paragraph\">Debitori, nga ana tjet\u00ebr, \u00ebsht\u00eb personi q\u00eb duhet t\u00eb respektoj\u00eb urdhrin e ndalimit ose tolerimit dhe shkelja e t\u00eb cilit shkakton zbatimin e ekzekutimit. Procedura sh\u00ebrben k\u00ebshtu p\u00ebr mbrojtjen e t\u00eb drejtave t\u00eb kreditorit dhe nj\u00ebkoh\u00ebsisht krijon nj\u00eb korniz\u00eb t\u00eb qart\u00eb ligjore, brenda s\u00eb cil\u00ebs debitori \u00ebsht\u00eb i detyruar t\u00eb respektoj\u00eb detyrimet e caktuara t\u00eb sjelljes. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-exekutionsantrag\">K\u00ebrkesa p\u00ebr ekzekutim<\/h2>\n\n<p class=\"wp-block-paragraph\">Procedura e ekzekutimit t\u00eb ndalimit fillon me k\u00ebrkes\u00ebn p\u00ebr ekzekutim t\u00eb kreditorit ekzekutues. Kjo k\u00ebrkes\u00eb p\u00ebrb\u00ebn baz\u00ebn q\u00eb gjykata t\u00eb mund t\u00eb marr\u00eb masa, n\u00ebse debitori shkel nj\u00eb detyrim ekzistues t\u00eb ndalimit ose tolerimit. <\/p>\n\n<p class=\"wp-block-paragraph\">N\u00eb k\u00ebrkes\u00ebn p\u00ebr ekzekutim, kreditori duhet t\u00eb shpjegoj\u00eb konkretisht n\u00eb \u00e7far\u00eb konsiston shkelja e debitorit. Pretendimet e p\u00ebrgjithshme ose t\u00eb paqarta nuk jan\u00eb t\u00eb mjaftueshme. N\u00eb vend t\u00eb k\u00ebsaj, k\u00ebrkesa duhet t\u00eb p\u00ebrmbaj\u00eb nj\u00eb fakt jet\u00ebsor t\u00eb kuptuesh\u00ebm dhe t\u00eb qart\u00eb, q\u00eb tregon se cili veprim shkeli urdhrin e ndalimit.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-zustandiges-gericht\">Gjykata kompetente<\/h2>\n\n<p class=\"wp-block-paragraph\">P\u00ebr ekzekutimin e ndalimit ekziston nj\u00eb e drejt\u00eb zgjedhjeje lidhur me juridiksionin gjyq\u00ebsor. N\u00eb parim, vendos gjykata e rrethit, n\u00eb zon\u00ebn e s\u00eb cil\u00ebs debitori ka juridiksionin e tij t\u00eb p\u00ebrgjithsh\u00ebm. Por kreditori mund ta paraqes\u00eb k\u00ebrkes\u00ebn edhe n\u00eb at\u00eb gjykat\u00eb, n\u00eb zon\u00ebn e s\u00eb cil\u00ebs \u00ebsht\u00eb kryer veprimi i ndaluar ose ka ndodhur suksesi i tij.   <\/p>\n\n<p class=\"wp-block-paragraph\">Kjo e drejt\u00eb zgjedhjeje i mund\u00ebson kreditorit t\u00eb filloj\u00eb procedur\u00ebn aty ku shkelja ka ndodhur drejtp\u00ebrdrejt ose ku efektet e saj jan\u00eb b\u00ebr\u00eb t\u00eb dukshme, gj\u00eb q\u00eb shpesh \u00e7on n\u00eb nj\u00eb zbatim m\u00eb efikas.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verhangung-von-geldstrafen\">Caktimi i gjobave<\/h2>\n\n<p class=\"wp-block-paragraph\">Sapo gjykata t\u00eb ket\u00eb miratuar ekzekutimin e ndalimit, p\u00ebr \u00e7do shkelje mund t\u00eb caktohet nj\u00eb gjob\u00eb. N\u00eb k\u00ebt\u00eb faz\u00eb, merret parasysh vet\u00ebm nj\u00eb k\u00ebrkes\u00eb p\u00ebr d\u00ebnim. <\/p>\n\n<p class=\"wp-block-paragraph\">P\u00ebr shkak t\u00eb shkeljes s\u00eb p\u00ebrs\u00ebritur, gjykata, me k\u00ebrkes\u00eb t\u00eb kreditorit, mund t\u00eb caktoj\u00eb ose nj\u00eb gjob\u00eb shtes\u00eb ose paraburgim deri n\u00eb nj\u00eb koh\u00ebzgjatje totale prej nj\u00eb viti.
