Krahas themelimit t\u00eb detyruar t\u00eb t\u00eb drejt\u00ebs s\u00eb pengut dhe ankandit t\u00eb detyruar, ai i mund\u00ebson kreditorit ekzekutues t\u00eb shlyej\u00eb k\u00ebrkes\u00ebn e tij jo p\u00ebrmes shitjes s\u00eb pron\u00ebs s\u00eb paluajtshme, por p\u00ebrmes p\u00ebrfitimeve dhe t\u00eb ardhurave t\u00eb saj.  <\/p>\n\n<div class=\"wp-block-uagb-container uagb-block-3019fe8e alignfull uagb-is-root-container\">\n<div class=\"wp-block-uagb-container uagb-block-32585033\">\n<p class=\"wp-block-paragraph\">Sipas <strong><a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10001700&amp;Artikel=&amp;Paragraf=97&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 97 EO<\/a><\/strong>, n\u00eb favor t\u00eb nj\u00eb k\u00ebrkese monetare t\u00eb ekzekutueshme, mund t\u00eb miratohet administrimi i detyruar i nj\u00eb prone, nj\u00eb superedifikati ose nj\u00eb t\u00eb drejte nd\u00ebrtimi. N\u00eb k\u00ebt\u00eb rast, p\u00ebrdoren p\u00ebrfitimet dhe t\u00eb ardhurat e objektit. Nd\u00ebrsa kreditori ekzekutues k\u00ebrkon fillimin dhe zbatimin e administrimit t\u00eb detyruar, debitori i n\u00ebnshtrohet kufizimeve ligjore q\u00eb lidhen me administrimin e urdh\u00ebruar t\u00eb pron\u00ebs s\u00eb tij. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-ablauf-des-zwangsverwaltungsverfahrens\">Zhvillimi i procedur\u00ebs s\u00eb administrimit t\u00eb detyruar<\/h2>\n\n<p class=\"wp-block-paragraph\">N\u00eb thelb, procedura e administrimit t\u00eb detyruar p\u00ebrb\u00ebhet nga tre faza procedurale:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Procedura e inicimit<\/li>\n\n\n\n<li>Procedura e administrimit<\/li>\n\n\n\n<li>Procedura e shp\u00ebrndarjes<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-einleitungsverfahren\">Procedura e inicimit<\/h3>\n\n<p class=\"wp-block-paragraph\">Procedura e administrimit t\u00eb detyruar fillon, si \u00e7do procedur\u00eb ekzekutimi, me nj\u00eb <strong>k\u00ebrkes\u00eb ekzekutimi<\/strong>. Kreditori k\u00ebrkon n\u00eb gjykat\u00eb zbatimin e administrimit t\u00eb detyruar mbi nj\u00eb pron\u00eb t\u00eb caktuar t\u00eb paluajtshme ose nj\u00eb objekt tjet\u00ebr t\u00eb ekzekutuesh\u00ebm. <\/p>\n\n<p class=\"wp-block-paragraph\">N\u00ebse gjykata miraton administrimin e detyruar, kjo <strong>sh\u00ebnohet n\u00eb regjistrat kadastral\u00eb<\/strong>. Ky regjistrim siguron q\u00eb administrimi i detyruar t\u00eb jet\u00eb i vlefsh\u00ebm edhe ndaj bler\u00ebsve t\u00eb m\u00ebvonsh\u00ebm t\u00eb pron\u00ebs s\u00eb paluajtshme. <\/p>\n\n<p class=\"wp-block-paragraph\">Vendimi i miratimit i dor\u00ebzohet si kreditorit, ashtu edhe debitorit. Nga ky moment, veprimet e debitorit mbi pron\u00ebn e paluajtshme, t\u00eb cilat tejkalojn\u00eb nj\u00eb administrim t\u00eb zakonsh\u00ebm, jan\u00eb <strong>t\u00eb pavlefshme<\/strong> ndaj kreditor\u00ebve. <\/p>\n\n<p class=\"wp-block-paragraph\">N\u00eb t\u00eb nj\u00ebjt\u00ebn koh\u00eb, kreditorit ekzekutues i k\u00ebrkohet t\u00eb paguaj\u00eb nj\u00eb <strong>paradepozit\u00eb shpenzimesh<\/strong> brenda nj\u00eb afati prej t\u00eb pakt\u00ebn kat\u00ebr jav\u00ebsh. Kjo sh\u00ebrben p\u00ebr t\u00eb siguruar shp\u00ebrblimin minimal t\u00eb administratorit t\u00eb detyruar q\u00eb do t\u00eb em\u00ebrohet m\u00eb von\u00eb. <\/p>\n\n<p class=\"wp-block-paragraph\">Sapo t\u00eb jet\u00eb paguar paradepozita e shpenzimeve, gjykata em\u00ebron nj\u00eb <strong>administrator<\/strong>. P\u00ebrve\u00e7 k\u00ebsaj, debitori njoftohet se ai vet\u00eb nuk lejohet t\u00eb kryej\u00eb m\u00eb asnj\u00eb veprim administrativ dhe nuk mund t\u00eb nd\u00ebrhyj\u00eb n\u00eb detyrat e administratorit. <\/p>\n\n<p class=\"wp-block-paragraph\">Vendimi i em\u00ebrimit u d\u00ebrgohet disa instancave, duke p\u00ebrfshir\u00eb kreditorin, debitorin, administratorin, si dhe autoritetet p\u00ebrgjegj\u00ebse p\u00ebr taksat dhe detyrimet e pron\u00ebs. Ai merr p\u00ebrsip\u00ebr menaxhimin e vazhduesh\u00ebm, mbledh t\u00eb ardhurat dhe siguron q\u00eb t\u00eb gjitha hapat administrativ\u00eb t\u00eb kryhen n\u00eb p\u00ebrputhje me dispozitat e Ligjit t\u00eb Ekzekutimit. <\/p>\n\n<p class=\"wp-block-paragraph\">Miratimi i administrimit t\u00eb detyruar nuk ndryshon asgj\u00eb n\u00eb <strong>kontratat ekzistuese t\u00eb qiras\u00eb dhe enfiteoz\u00ebs<\/strong> fillimisht. Megjithat\u00eb, administratori ka disa kompetenca: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Ai mund t\u00eb anuloj\u00eb kontratat ekzistuese sipas rregullave t\u00eb p\u00ebrgjithshme ligjore<\/li>\n\n\n\n<li>T\u00eb ngrej\u00eb padi p\u00ebr d\u00ebbim<\/li>\n\n\n\n<li>t\u00eb lidh\u00eb kontrata t\u00eb reja qiraje p\u00ebr koh\u00ebzgjatjen e zakonshme lokale<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">P\u00ebr vendimet q\u00eb <strong>nuk i p\u00ebrkasin administrimit t\u00eb zakonsh\u00ebm<\/strong>, administratori ka nevoj\u00eb p\u00ebr p\u00eblqimin e gjykat\u00ebs s\u00eb ekzekutimit. K\u00ebtu p\u00ebrfshihen ve\u00e7an\u00ebrisht:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Lidhja e kontratave afatgjata t\u00eb qiras\u00eb q\u00eb tejkalojn\u00eb koh\u00ebzgjatjen e parashikuar t\u00eb administrimit t\u00eb detyruar<\/li>\n\n\n\n<li>Dh\u00ebnia me enfiteoz\u00eb e t\u00eb gjith\u00eb pron\u00ebs ose pjes\u00ebve t\u00eb ve\u00e7anta<\/li>\n\n\n\n<li>Dh\u00ebnia me enfiteoz\u00eb e t\u00eb ardhurave t\u00eb pron\u00ebs p\u00ebrmes ankandit publik<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Veprimtaria e administratorit mbik\u00ebqyret nga gjykata e ekzekutimit. Gjykata mund t&#8217;i jap\u00eb udh\u00ebzime, t\u00eb k\u00ebrkoj\u00eb raporte dhe sqarime, t\u00eb shqyrtoj\u00eb dokumente dhe t\u00eb kryej\u00eb vet\u00eb hetimet e nevojshme. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-verteilungsverfahren\">Procedura e shp\u00ebrndarjes<\/h3>\n\n<p class=\"wp-block-paragraph\">N\u00eb procedur\u00ebn e shp\u00ebrndarjes, shp\u00ebrndahen <strong>t\u00eb ardhurat e pron\u00ebs s\u00eb paluajtshme<\/strong> t\u00eb realizuara gjat\u00eb administrimit t\u00eb detyruar. K\u00ebto t\u00eb ardhurat sh\u00ebrbejn\u00eb fillimisht p\u00ebr mbulimin e shpenzimeve administrative dhe m\u00eb pas p\u00ebr shlyerjen e kreditorit ekzekutues, si dhe t\u00eb pal\u00ebve t\u00eb tjera t\u00eb autorizuara. <\/p>\n\n<p class=\"wp-block-paragraph\">Shpenzimet q\u00eb lidhen me administrimin dhe p\u00ebrdorimin e zakonsh\u00ebm ekonomik t\u00eb pron\u00ebs s\u00eb paluajtshme, administratori mund t&#8217;i mbuloj\u00eb direkt nga t\u00eb ardhurat. K\u00ebtu p\u00ebrfshihen, p\u00ebr shembull, shpenzimet operative ose shpenzimet e nevojshme t\u00eb menaxhimit t\u00eb vazhduesh\u00ebm. K\u00ebto shpenzime mbulohen pra <strong>pa procedur\u00eb shtes\u00eb<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">Vet\u00ebm <strong>tepricat e t\u00eb ardhurave<\/strong> q\u00eb mbeten pas zbritjes s\u00eb k\u00ebtyre shpenzimeve administrative shp\u00ebrndahen. Nd\u00ebrprerja mund t\u00eb b\u00ebhet ose <strong>kryesisht nga gjykata<\/strong> ose <strong>me k\u00ebrkes\u00eb<\/strong>. Gjykata nd\u00ebrpret administrimin e detyruar sapo t\u00eb gjitha k\u00ebrkesat, p\u00ebrfshir\u00eb shpenzimet shtes\u00eb, t\u00eb jen\u00eb shlyer. Debitori mund t\u00eb k\u00ebrkoj\u00eb vet\u00eb nd\u00ebrprerjen.   <\/p>\n\n<p class=\"wp-block-paragraph\">Administrimi i detyruar duhet t\u00eb nd\u00ebrpritet gjithashtu n\u00ebse vazhdimi do t\u00eb shkaktonte shpenzime t\u00eb ve\u00e7anta q\u00eb nuk mund t\u00eb mbulohen nga t\u00eb ardhurat, ose n\u00ebse, sipas rrethanave, nuk priten t\u00eb ardhura t\u00eb mjaftueshme.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-ihre-vorteile-mit-anwaltlicher-unterstutzung\">Avantazhet tuaja me mb\u00ebshtetje ligjore<\/h2>\n\n<p class=\"wp-block-paragraph\">Nj\u00eb avokat ju shoq\u00ebron gjat\u00eb gjith\u00eb procedur\u00ebs s\u00eb administrimit t\u00eb detyruar dhe siguron q\u00eb ju t\u00eb p\u00ebrmbushni sakt\u00eb t\u00eb gjitha k\u00ebrkesat formale.
