Gjykata e ekzekutimit kontrollon vet\u00ebm titullin formal, jo sakt\u00ebsin\u00eb e tij aktuale. P\u00ebr k\u00ebt\u00eb arsye, mund t\u00eb ndodh\u00eb q\u00eb kreditori t\u00eb vazhdoj\u00eb ekzekutimin, megjith\u00ebse k\u00ebrkesa n\u00eb fakt nuk ekziston m\u00eb.  <\/p>\n\n<p class=\"wp-block-paragraph\">Padia e kund\u00ebrshtimit korrigjon k\u00ebt\u00eb gjendje. Debitori parashtron n\u00eb m\u00ebnyr\u00eb aktive se k\u00ebrkesa ka ndryshuar, sepse ai tashm\u00eb e ka p\u00ebrmbushur detyrimin ose sepse kreditori ka dh\u00ebn\u00eb nj\u00eb shtyrje pagese. Ai gjithashtu mund t\u00eb parashtroj\u00eb se ka ndodhur nj\u00eb rrethan\u00eb q\u00eb pengon ose eliminon k\u00ebrkes\u00ebn. K\u00ebshtu, padia e kund\u00ebrshtimit drejtohet drejtp\u00ebrdrejt kund\u00ebr vet\u00eb k\u00ebrkes\u00ebs dhe jo kund\u00ebr m\u00ebnyr\u00ebs se si kryhet ekzekutimi.   <\/p>\n\n<p class=\"wp-block-paragraph\">Padia sh\u00ebrben si procedur\u00eb gjyq\u00ebsore shqyrtimi dhe detyron gjykat\u00ebn t\u00eb konstatoj\u00eb n\u00ebse k\u00ebrkesa ekziston ende n\u00eb momentin e ngritjes s\u00eb padis\u00eb. K\u00ebshtu, debitori fiton mund\u00ebsin\u00eb p\u00ebr t\u00eb ndaluar shpejt dhe me siguri ligjore ekzekutimet e paautorizuara. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-parteien-der-oppositionsklage\">Pal\u00ebt e padis\u00eb s\u00eb kund\u00ebrshtimit<\/h2>\n\n<p class=\"wp-block-paragraph\">N\u00eb procedur\u00ebn e ekzekutimit zakonisht shfaqen dy pal\u00eb:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>kreditori ekzekutues<\/strong>, i cili k\u00ebrkon ekzekutimin<\/li>\n\n\n\n<li><strong>debitori<\/strong>, kund\u00ebr t\u00eb cilit kryhet ekzekutimi<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">N\u00eb rastin e padis\u00eb s\u00eb opozit\u00ebs, situata paraqitet si m\u00eb posht\u00eb:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Padit\u00ebs<\/strong> \u00ebsht\u00eb <strong>debitori<\/strong>, sepse ai vepron aktivisht kund\u00ebr k\u00ebrkes\u00ebs ekzistuese.<\/li>\n\n\n\n<li><strong>I paditur<\/strong> \u00ebsht\u00eb <strong>kreditori ekzekutues<\/strong>, k\u00ebrkesa e t\u00eb cilit shqyrtohet.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Prandaj, gjykata nuk shqyrton vet\u00ebm ekzekutimin, por konstaton n\u00ebse k\u00ebrkesa vet\u00eb ekziston ende. Kreditori duhet t\u00eb shpjegoj\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb plot\u00eb pse k\u00ebrkesa vazhdon t\u00eb ekzistoj\u00eb. Debitori duhet gjithashtu t\u00eb parashtroj\u00eb t\u00eb gjitha kund\u00ebrshtimet q\u00eb i njeh. K\u00ebshtu, procedura krijon marr\u00ebdh\u00ebnie t\u00eb qarta dhe p\u00ebrfundimtare midis pal\u00ebve.   <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-zweck-und-wirkung-der-oppositionsklage\">Q\u00ebllimi dhe efekti i padis\u00eb s\u00eb kund\u00ebrshtimit<\/h2>\n\n<p class=\"wp-block-paragraph\">Padia e kund\u00ebrshtimit sqaron n\u00ebse k\u00ebrkesa e p\u00ebrcaktuar n\u00eb titull ekziston ende. Debitori mund t\u00eb parandaloj\u00eb q\u00eb nj\u00eb k\u00ebrkes\u00eb t\u00eb ekzekutohet, megjith\u00ebse ajo \u00ebsht\u00eb paguar tashm\u00eb ose nuk \u00ebsht\u00eb m\u00eb e zbatueshme p\u00ebr shkak t\u00eb ngjarjeve t\u00eb m\u00ebvonshme. Gjykata korrigjon vet\u00eb k\u00ebrkes\u00ebn dhe k\u00ebshtu i heq baz\u00ebn ekzekutimit.  <\/p>\n\n<p class=\"wp-block-paragraph\">N\u00ebse gjykata pranon padin\u00eb, ekzekutimi p\u00ebrfundon menj\u00ebher\u00eb. Vendimi konstaton se k\u00ebrkesa e parashtruar nuk ekziston m\u00eb. K\u00ebshtu, ekzekutimi b\u00ebhet i paligjsh\u00ebm n\u00eb at\u00eb mas\u00eb. Debitori fiton k\u00ebshtu siguri ligjore dhe qart\u00ebsi se cilat k\u00ebrkesa jan\u00eb ende t\u00eb hapura dhe cilat jo.   <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-ablauf-des-verfahrens\">Zhvillimi i procedur\u00ebs<\/h2>\n\n<p class=\"wp-block-paragraph\">Padia e kund\u00ebrshtimit paraqitet n\u00eb gjykat\u00ebn q\u00eb ka miratuar ekzekutimin n\u00eb shkall\u00eb t\u00eb par\u00eb. Megjithat\u00eb, n\u00eb var\u00ebsi t\u00eb llojit t\u00eb titullit ekzekutiv, mund t\u00eb ekzistojn\u00eb kompetenca t\u00eb ndryshme, si p.sh. n\u00eb t\u00eb drejt\u00ebn e pun\u00ebs ose n\u00eb t\u00eb drejt\u00ebn e mb\u00ebshtetjes familjare. Debitori duhet t\u00eb parashtroj\u00eb t\u00eb gjitha kund\u00ebrshtimet nj\u00ebkoh\u00ebsisht. Ky parim, i ashtuquajturi parimi i eventualitetit, siguron q\u00eb gjykata t\u00eb mund t\u00eb shqyrtoj\u00eb t\u00eb gjitha faktet relevante n\u00eb nj\u00eb procedur\u00eb t\u00eb vetme.   <\/p>\n\n<p class=\"wp-block-paragraph\">N\u00eb vet\u00eb procedur\u00ebn, gjykata shqyrton ekskluzivisht ato fakte q\u00eb kan\u00eb ndodhur pas krijimit t\u00eb titullit ose q\u00eb debitori nuk ka mundur t&#8217;i parashtroj\u00eb n\u00eb procedurat e m\u00ebparshme.
