Tipike jan\u00eb situatat kur dikush ndihet i k\u00ebrc\u00ebnuar dhe p\u00ebr k\u00ebt\u00eb arsye nd\u00ebrmerr nj\u00eb veprim mbrojt\u00ebs. N\u00ebse kjo \u00ebsht\u00eb e d\u00ebnueshme, varet nga disa faktor\u00eb:  <\/p>\n\n<ul class=\"wp-block-list\">\n<li>A ishte gabimi i kuptuesh\u00ebm nga k\u00ebndv\u00ebshtrimi i nj\u00eb personi t\u00eb arsyesh\u00ebm?<\/li>\n\n\n\n<li>A mbeti veprimi mbrojt\u00ebs brenda kufijve t\u00eb rrezikut t\u00eb supozuar?<\/li>\n\n\n\n<li>A ishte gabimi i shmangsh\u00ebm, dhe n\u00ebse po: A \u00ebsht\u00eb vepra penale e d\u00ebnueshme edhe n\u00eb rast pakujdesie?<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">Klasifikimi juridik dhe shembuj<\/h2>\n\n<p class=\"wp-block-paragraph\">Gjykatat shqyrtojn\u00eb gjithmon\u00eb n\u00ebse rreziku i supozuar do t\u00eb ishte i dalluesh\u00ebm edhe p\u00ebr nj\u00eb v\u00ebzhgues objektiv.
