Prandaj, \u00ebsht\u00eb pothuajse e pamundur p\u00ebr laik\u00ebt t\u00eb llogarisin paraprakisht se \u00e7far\u00eb honorari parashikon Ligji p\u00ebr Tarifat e Avokat\u00ebve p\u00ebr sh\u00ebrbimet ligjore t\u00eb rregulluara nga Ligji p\u00ebr Tarifat e Avokat\u00ebve. Edhe ne avokat\u00ebt p\u00ebrdorim nj\u00eb softuer t\u00eb ve\u00e7ant\u00eb p\u00ebr faturimin e honorareve.  <\/p>\n\n<p class=\"wp-block-paragraph\">Prandaj, zyra jon\u00eb ofron nj\u00eb konsult\u00eb fillestare ligjore p\u00ebr klient\u00ebt e rinj, e cila sh\u00ebrben ve\u00e7an\u00ebrisht p\u00ebr t\u00eb sqaruar shum\u00ebn e honorarit t\u00eb mundsh\u00ebm.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-rechtsanwaltstarifgesetz\">Ligji p\u00ebr Tarifat e Avokat\u00ebve<\/h2>\n\n<p class=\"wp-block-paragraph\"><strong>Objekti i tarif\u00ebs<br\/>Neni 1<\/strong><br\/>(1) Avokat\u00ebt kan\u00eb t\u00eb drejt\u00eb p\u00ebr shp\u00ebrblim n\u00eb procedur\u00ebn civile dhe n\u00eb procedur\u00ebn e arbitrazhit sipas nenit 577 e tutje t\u00eb Kodit t\u00eb Procedur\u00ebs Civile, si dhe n\u00eb procedurat penale p\u00ebr nj\u00eb akuz\u00eb private dhe p\u00ebr p\u00ebrfaq\u00ebsimin e personave t\u00eb p\u00ebrfshir\u00eb privatisht, n\u00eb p\u00ebrputhje me dispozitat e m\u00ebposhtme dhe tarif\u00ebn e bashkangjitur, e cila p\u00ebrb\u00ebn nj\u00eb pjes\u00eb p\u00ebrb\u00ebr\u00ebse t\u00eb k\u00ebtij ligji federal. Vlerat e tarifave q\u00eb rezultojn\u00eb nga operacionet llogarit\u00ebse t\u00eb urdh\u00ebruara n\u00eb tarif\u00eb duhet t\u00eb rrumbullakohen n\u00eb 10 cent t\u00eb plot\u00eb lart ose posht\u00eb. <br\/>(2) Dispozitat e k\u00ebtij ligji federal zbatohen, p\u00ebrve\u00e7 n\u00ebse parashikohet ndryshe m\u00eb posht\u00eb, si n\u00eb marr\u00ebdh\u00ebniet midis avokatit dhe pal\u00ebs q\u00eb ai p\u00ebrfaq\u00ebson, ashtu edhe n\u00eb p\u00ebrcaktimin e kostove q\u00eb duhet t\u00eb z\u00ebvend\u00ebsoj\u00eb kund\u00ebrshtari, madje edhe n\u00ebse kund\u00ebrshtari duhet t\u00eb z\u00ebvend\u00ebsoj\u00eb kostot e avokatit n\u00eb \u00e7\u00ebshtjen e tij. Ato zbatohen gjithashtu n\u00ebse sh\u00ebrbimet e specifikuara n\u00eb t\u00eb kryhen nga noter\u00ebt, me kusht q\u00eb noteri t\u00eb jet\u00eb i autorizuar p\u00ebr nj\u00eb sh\u00ebrbim t\u00eb till\u00eb dhe shp\u00ebrblimi t\u00eb mos rregullohet n\u00eb tarif\u00ebn noteriale ose n\u00eb tarif\u00ebn p\u00ebr shp\u00ebrblimin e noter\u00ebve si agjent\u00eb t\u00eb gjykat\u00ebs. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Kufizimi i vlefshm\u00ebris\u00eb s\u00eb tarif\u00ebs<br\/>Neni 2<\/strong><br\/>(1) Tarifa nuk prek t\u00eb drejt\u00ebn e marr\u00ebveshjes s\u00eb lir\u00eb.<\/p>\n\n<p class=\"wp-block-paragraph\">(2) Edhe n\u00ebse nuk \u00ebsht\u00eb r\u00ebn\u00eb dakord p\u00ebr nj\u00eb shp\u00ebrblim, avokati mund t\u00eb b\u00ebj\u00eb nj\u00eb k\u00ebrkes\u00eb m\u00eb t\u00eb lart\u00eb se sa parashikohet n\u00eb tarif\u00eb kund\u00ebr k\u00ebsaj pale, e cila justifikohet nga rrethana t\u00eb ve\u00e7anta ose nga nj\u00eb p\u00ebrdorim i ve\u00e7ant\u00eb i shkaktuar nga pala e tij.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Baza e vler\u00ebsimit<br\/>Neni 3<\/strong><br\/>Shuma vendimtare p\u00ebr zbatimin e nj\u00eb shkalle t\u00eb caktuar tarifore (baza e vler\u00ebsimit) duhet t\u00eb llogaritet n\u00eb procedur\u00ebn civile sipas vler\u00ebs s\u00eb objektit t\u00eb mosmarr\u00ebveshjes, n\u00eb procedur\u00ebn e ekzekutimit (sigurimit) sipas vler\u00ebs s\u00eb k\u00ebrkes\u00ebs (\u00a7 13), n\u00eb procedur\u00ebn e falimentimit dhe ristrukturimit p\u00ebr nj\u00eb kreditor sipas shum\u00ebs s\u00eb k\u00ebrkes\u00ebs s\u00eb paraqitur s\u00eb bashku me shpenzimet an\u00ebsore, n\u00eb procedur\u00ebn jokontestuese sipas vler\u00ebs s\u00eb objektit t\u00eb procedur\u00ebs.<br\/>Vini re<br\/>Duhet t\u00eb zbatohet vet\u00ebm n\u00ebse \u00e7\u00ebshtja pas 31 dhjetorit 2004<br\/>\u00ebsht\u00eb b\u00ebr\u00eb e varur. P\u00ebr t\u00eb gjitha procedurat q\u00eb jan\u00eb b\u00ebr\u00eb t\u00eb varura m\u00eb par\u00eb<br\/>k\u00ebto dispozita duhet t\u00eb vazhdojn\u00eb t\u00eb zbatohen n\u00eb versionin e tyre t\u00eb m\u00ebparsh\u00ebm<br\/>version (shih Art. 10 \u00a7 2, BGBl. I Nr. 113\/2003). <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 4<br\/><\/strong>P\u00ebrve\u00e7 n\u00ebse parashikohet ndryshe m\u00eb posht\u00eb, baza e vler\u00ebsimit (\u00a7 3) bazohet n\u00eb dispozitat e \u00a7\u00a7 54 deri n\u00eb 59 t\u00eb Norm\u00ebs s\u00eb Juridiksionit, n\u00eb procedur\u00ebn jokontestuese, n\u00ebse objekti nuk p\u00ebrb\u00ebhet nga nj\u00eb shum\u00eb parash, megjithat\u00eb, sipas vler\u00ebs q\u00eb pala ka specifikuar n\u00eb k\u00ebrkes\u00ebn e saj si vler\u00eb t\u00eb objektit t\u00eb procedur\u00ebs.<br\/>Vini re<br\/>Duhet t\u00eb zbatohet vet\u00ebm n\u00ebse \u00e7\u00ebshtja pas 31 dhjetorit 2004<br\/>\u00ebsht\u00eb b\u00ebr\u00eb e varur. P\u00ebr t\u00eb gjitha procedurat q\u00eb jan\u00eb b\u00ebr\u00eb t\u00eb varura m\u00eb par\u00eb<br\/>k\u00ebto dispozita duhet t\u00eb vazhdojn\u00eb t\u00eb zbatohen n\u00eb versionin e tyre t\u00eb m\u00ebparsh\u00ebm<br\/>version (shih Art. 10 \u00a7 2, BGBl. I Nr. 113\/2003). <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 5<\/strong><br\/>(1) N\u00ebse k\u00ebrkohet vet\u00ebm nj\u00eb pjes\u00eb e nj\u00eb k\u00ebrkese kapitale, at\u00ebher\u00eb vet\u00ebm pjesa e k\u00ebrkuar \u00ebsht\u00eb vendimtare. N\u00ebse k\u00ebrkohet teprica q\u00eb rezulton nga krahasimi i k\u00ebrkesave q\u00eb i takojn\u00eb t\u00eb dyja pal\u00ebve kund\u00ebr nj\u00ebra-tjetr\u00ebs, at\u00ebher\u00eb shuma e tepric\u00ebs s\u00eb k\u00ebrkuar \u00ebsht\u00eb vendimtare. (2) Mosmarr\u00ebveshjet sipas \u00a7 37 t\u00eb Kodit t\u00eb Ekzekutimit duhet t\u00eb vler\u00ebsohen sipas vler\u00ebs s\u00eb k\u00ebrkes\u00ebs (\u00a7 13), p\u00ebr shkak t\u00eb s\u00eb cil\u00ebs kryhet ekzekutimi, por n\u00ebse gj\u00ebrat e sekuestruara n\u00eb ekzekutim kan\u00eb nj\u00eb vler\u00eb m\u00eb t\u00eb ul\u00ebt, sipas k\u00ebsaj. N\u00ebse padia drejtohet kund\u00ebr disa t\u00eb paditurve dhe vendoset p\u00ebr detyrimin p\u00ebr t\u00eb z\u00ebvend\u00ebsuar kostot n\u00eb nj\u00eb vendim, at\u00ebher\u00eb vlera m\u00eb e lart\u00eb e k\u00ebrkesave duhet t\u00eb zbatohet si baz\u00eb vler\u00ebsimi p\u00ebr sh\u00ebrbimet e p\u00ebrbashk\u00ebta, por n\u00ebse vlera e gj\u00ebrave t\u00eb sekuestruara n\u00eb ekzekutim \u00ebsht\u00eb m\u00eb e ul\u00ebt, kjo duhet t\u00eb zbatohet. Kostot duhet t\u00eb ndahen sipas raportit t\u00eb vlerave t\u00eb mosmarr\u00ebveshjeve vendimtare p\u00ebr t\u00eb paditurit individual\u00eb.    <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 6<br\/><\/strong>K\u00ebrkesat n\u00eb valut\u00eb t\u00eb huaj duhet t\u00eb vler\u00ebsohen sipas kursit n\u00eb koh\u00ebn e vendimit ose marr\u00ebveshjes p\u00ebr detyrimin p\u00ebr t\u00eb z\u00ebvend\u00ebsuar kostot.<br\/>Vini re<br\/>Duhet t\u00eb zbatohet vet\u00ebm n\u00ebse \u00e7\u00ebshtja pas 31 dhjetorit 2004<br\/>\u00ebsht\u00eb b\u00ebr\u00eb e varur. P\u00ebr t\u00eb gjitha procedurat q\u00eb jan\u00eb b\u00ebr\u00eb t\u00eb varura m\u00eb par\u00eb<br\/>k\u00ebto dispozita duhet t\u00eb vazhdojn\u00eb t\u00eb zbatohen n\u00eb versionin e tyre t\u00eb m\u00ebparsh\u00ebm<br\/>version (shih Art. 10 \u00a7 2, BGBl. I Nr. 113\/2003). <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>\u00a77<\/strong> (1) N\u00ebse i padituri e gjen vler\u00ebsimin e objektit t\u00eb mosmarr\u00ebveshjes sipas \u00a7\u00a7 56 ose 59 t\u00eb Norm\u00ebs s\u00eb Juridiksionit nga padit\u00ebsi shum\u00eb t\u00eb lart\u00eb ose shum\u00eb t\u00eb ul\u00ebt, ai mund t\u00eb kund\u00ebrshtoj\u00eb vler\u00ebsimin m\u00eb s\u00eb voni n\u00eb seanc\u00ebn e par\u00eb t\u00eb caktuar p\u00ebr negociatat gojore. N\u00ebse vlera e objektit t\u00eb procedur\u00ebs n\u00eb procedur\u00ebn jokontestuese p\u00ebrcaktohet ndryshe nga pal\u00ebt, kjo duhet t\u00eb trajtohet si nj\u00eb kund\u00ebrshtim i vler\u00ebsimit. N\u00ebse i padituri e gjen vler\u00ebsimin e objektit t\u00eb mosmarr\u00ebveshjes sipas Paragrafeve 56, ose 59 t\u00eb Norm\u00ebs s\u00eb Juridiksionit nga padit\u00ebsi shum\u00eb t\u00eb lart\u00eb ose shum\u00eb t\u00eb ul\u00ebt, ai mund t\u00eb kund\u00ebrshtoj\u00eb vler\u00ebsimin m\u00eb s\u00eb voni n\u00eb seanc\u00ebn e par\u00eb t\u00eb caktuar p\u00ebr negociatat gojore. N\u00ebse vlera e objektit t\u00eb procedur\u00ebs n\u00eb procedur\u00ebn jokontestuese p\u00ebrcaktohet ndryshe nga pal\u00ebt, kjo duhet t\u00eb trajtohet si nj\u00eb kund\u00ebrshtim i vler\u00ebsimit. (2) N\u00eb munges\u00eb t\u00eb nj\u00eb marr\u00ebveshjeje midis pal\u00ebve, gjykata duhet t\u00eb vler\u00ebsoj\u00eb objektin e mosmarr\u00ebveshjes p\u00ebr zbatimin e k\u00ebtij ligji federal n\u00eb kuad\u00ebr t\u00eb shumave t\u00eb pretenduara nga pal\u00ebt, sa m\u00eb shpejt t\u00eb jet\u00eb e mundur pa hetime t\u00eb m\u00ebtejshme dhe pa vonuar ndjesh\u00ebm p\u00ebrfundimin ose shkaktuar kosto. E nj\u00ebjta gj\u00eb vlen n\u00eb procedur\u00ebn jokontestuese p\u00ebr vler\u00ebsimin e objektit t\u00eb procedur\u00ebs. Ky vendim nuk mund t\u00eb apelohet me nj\u00eb mjet ligjor. Vini re Duhet t\u00eb zbatohet vet\u00ebm n\u00ebse \u00e7\u00ebshtja pas 31 dhjetorit 2004 \u00ebsht\u00eb b\u00ebr\u00eb e varur. P\u00ebr t\u00eb gjitha procedurat q\u00eb jan\u00eb b\u00ebr\u00eb t\u00eb varura m\u00eb par\u00eb, k\u00ebto dispozita duhet t\u00eb vazhdojn\u00eb t\u00eb zbatohen n\u00eb versionin e tyre t\u00eb m\u00ebparsh\u00ebm (shih Art. 10 \u00a7 2,          <a href=\"https:\/\/www.ris.bka.gv.at\/Dokumente\/BgblPdf\/2003_113_1\/2003_113_1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">BGBl. I Nr. 113\/2003 <\/a>).<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 7a<br\/><\/strong>(1) N\u00eb procedurat e padis\u00eb s\u00eb asociacionit p\u00ebr kompensim sipas \u00a7\u00a7 623 e tutje t\u00eb ZPO, institucioni i kualifikuar duhet t\u00eb vler\u00ebsoj\u00eb tashm\u00eb n\u00eb padi asociacioni p\u00ebr kompensim nj\u00eb k\u00ebrkes\u00eb t\u00eb p\u00ebrkohshme p\u00ebr p\u00ebrcaktim sipas \u00a7 624 Abs. 2 ZPO n\u00eb nj\u00eb shum\u00eb. Institucioni i kualifikuar nuk \u00ebsht\u00eb i lidhur me asnj\u00eb rregull ligjore vler\u00ebsimi n\u00eb k\u00ebt\u00eb vler\u00ebsim. N\u00ebse i padituri nuk kund\u00ebrshton nj\u00eb vler\u00ebsim t\u00eb till\u00eb m\u00eb s\u00eb voni n\u00eb seanc\u00ebn e par\u00eb t\u00eb caktuar p\u00ebr negociatat gojore, gjykata duhet t\u00eb p\u00ebrdor\u00eb k\u00ebt\u00eb shum\u00eb si baz\u00eb vler\u00ebsimi (\u00a7 3) p\u00ebr t\u00eb gjith\u00eb procedur\u00ebn e padis\u00eb s\u00eb asociacionit p\u00ebr kompensim deri n\u00eb vendimin p\u00ebr k\u00ebrkes\u00ebn e p\u00ebrkohshme p\u00ebr p\u00ebrcaktim. N\u00ebse institucioni i kualifikuar nuk kryen nj\u00eb vler\u00ebsim ose n\u00ebse i padituri kund\u00ebrshton vler\u00ebsimin n\u00eb koh\u00eb, at\u00ebher\u00eb duhet t\u00eb veprohet sipas \u00a7\u00a7 4 dhe 12 p\u00ebr t\u00eb p\u00ebrcaktuar baz\u00ebn e vler\u00ebsimit t\u00eb k\u00ebrkes\u00ebs s\u00eb p\u00ebrkohshme p\u00ebr p\u00ebrcaktim n\u00eb procedur\u00ebn e padis\u00eb s\u00eb asociacionit p\u00ebr kompensim; \u00a7 7 Abs. 2 zbatohet.N\u00eb procedurat e padis\u00eb s\u00eb asociacionit p\u00ebr kompensim sipas Paragrafeve 623, e tutje ZPO, institucioni i kualifikuar duhet t\u00eb vler\u00ebsoj\u00eb tashm\u00eb n\u00eb padi asociacioni p\u00ebr kompensim nj\u00eb k\u00ebrkes\u00eb t\u00eb p\u00ebrkohshme p\u00ebr p\u00ebrcaktim sipas Paragrafit 624, Abs. 2, ZPO n\u00eb nj\u00eb shum\u00eb. Institucioni i kualifikuar nuk \u00ebsht\u00eb i lidhur me asnj\u00eb rregull ligjore vler\u00ebsimi n\u00eb k\u00ebt\u00eb vler\u00ebsim. N\u00ebse i padituri nuk kund\u00ebrshton nj\u00eb vler\u00ebsim t\u00eb till\u00eb m\u00eb s\u00eb voni n\u00eb seanc\u00ebn e par\u00eb t\u00eb caktuar p\u00ebr negociatat gojore, gjykata duhet t\u00eb p\u00ebrdor\u00eb k\u00ebt\u00eb shum\u00eb si baz\u00eb vler\u00ebsimi (Paragrafi 3,) p\u00ebr t\u00eb gjith\u00eb procedur\u00ebn e padis\u00eb s\u00eb asociacionit p\u00ebr kompensim deri n\u00eb vendimin p\u00ebr k\u00ebrkes\u00ebn e p\u00ebrkohshme p\u00ebr p\u00ebrcaktim. N\u00ebse institucioni i kualifikuar nuk kryen nj\u00eb vler\u00ebsim ose n\u00ebse i padituri kund\u00ebrshton vler\u00ebsimin n\u00eb koh\u00eb, at\u00ebher\u00eb duhet t\u00eb veprohet sipas Paragrafeve 4 dhe 12 p\u00ebr t\u00eb p\u00ebrcaktuar baz\u00ebn e vler\u00ebsimit t\u00eb k\u00ebrkes\u00ebs s\u00eb p\u00ebrkohshme p\u00ebr p\u00ebrcaktim n\u00eb procedur\u00ebn e padis\u00eb s\u00eb asociacionit p\u00ebr kompensim; Paragrafi 7, Abs. 2, zbatohet. (2) Padia asociacioni p\u00ebr kompensim (\u00a7 624 ZPO) dhe t\u00eb gjitha parashtresat ose seancat q\u00eb i referohen vet\u00ebm ose edhe nj\u00eb k\u00ebrkese t\u00eb p\u00ebrkohshme p\u00ebr p\u00ebrcaktim nga institucioni i kualifikuar sipas \u00a7 624 Abs. 2 ZPO, duhet t\u00eb shp\u00ebrblehen n\u00eb baz\u00eb t\u00eb baz\u00ebs s\u00eb vler\u00ebsimit sipas Abs. 1. Padia asociacioni p\u00ebr kompensim (Paragrafi 624, ZPO) dhe t\u00eb gjitha parashtresat ose seancat q\u00eb i referohen vet\u00ebm ose edhe nj\u00eb k\u00ebrkese t\u00eb p\u00ebrkohshme p\u00ebr p\u00ebrcaktim nga institucioni i kualifikuar sipas Paragrafit 624, Abs. 2, ZPO, duhet t\u00eb shp\u00ebrblehen n\u00eb baz\u00eb t\u00eb baz\u00ebs s\u00eb vler\u00ebsimit sipas Abs. 1. (3) Ndryshe nga Abs. 1 dhe 2, deklaratat e aderimit sipas \u00a7 628 ZPO, si dhe t\u00eb gjitha parashtresat dhe seancat e tjera q\u00eb i referohen vet\u00ebm k\u00ebrkesave individuale, duhet t\u00eb shp\u00ebrblehen sipas baz\u00ebs s\u00eb vler\u00ebsimit q\u00eb rezulton p\u00ebr parashtres\u00ebn p\u00ebrkat\u00ebse ose p\u00ebr seanc\u00ebn p\u00ebrkat\u00ebse.<br\/>Vini re<br\/>Duhet t\u00eb zbatohet vet\u00ebm n\u00ebse \u00e7\u00ebshtja pas 31 dhjetorit 2004<br\/>\u00ebsht\u00eb b\u00ebr\u00eb e varur. P\u00ebr t\u00eb gjitha procedurat q\u00eb jan\u00eb b\u00ebr\u00eb t\u00eb varura m\u00eb par\u00eb<br\/>k\u00ebto dispozita duhet t\u00eb vazhdojn\u00eb t\u00eb zbatohen n\u00eb versionin e tyre t\u00eb m\u00ebparsh\u00ebm<br\/>version (shih Art. 10 \u00a7 2, BGBl. I Nr. 113\/2003).                <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 8<br\/><\/strong>(1) N\u00ebse vlera e nj\u00eb objekti mosmarr\u00ebveshjeje ose objekti procedure q\u00eb nuk ekziston n\u00eb para ndryshon gjat\u00eb rrjedh\u00ebs s\u00eb nj\u00eb procesi ose procedure jokontestuese n\u00eb at\u00eb m\u00ebnyr\u00eb q\u00eb vler\u00ebsimi i kryer duksh\u00ebm nuk korrespondon m\u00eb me kushtet aktuale t\u00eb vler\u00ebs, at\u00ebher\u00eb baza e vler\u00ebsimit duhet t\u00eb rivendoset nga gjykata sipas \u00a7 7 me k\u00ebrkes\u00eb t\u00eb nj\u00eb pale, n\u00eb munges\u00eb t\u00eb nj\u00eb marr\u00ebveshjeje midis pal\u00ebve. N\u00eb procedur\u00ebn para gjykat\u00ebs s\u00eb apelit ose gjykat\u00ebs s\u00eb rekursit t\u00eb apelit, kjo k\u00ebrkes\u00eb mund t\u00eb b\u00ebhet n\u00eb p\u00ebrgjigjen e apelit ose rekursit t\u00eb apelit; n\u00ebse k\u00ebrkesa b\u00ebhet n\u00eb p\u00ebrgjigjen e apelit ose rekursit t\u00eb apelit, gjykata e apelit ose gjykata e rekursit t\u00eb apelit mund t\u00eb k\u00ebrkoj\u00eb nj\u00eb deklarat\u00eb nga apeluesi ose rekursuesi i apelit. <br\/>(2) N\u00ebse baza e vler\u00ebsimit \u00ebsht\u00eb ndryshuar sipas Abs. 1 gjat\u00eb rrjedh\u00ebs s\u00eb nj\u00eb procedure, at\u00ebher\u00eb vlera e mosmarr\u00ebveshjes e vlefshme n\u00eb koh\u00ebn e vendimit ose marr\u00ebveshjes p\u00ebr detyrimin p\u00ebr t\u00eb z\u00ebvend\u00ebsuar kostot \u00ebsht\u00eb vendimtare p\u00ebr p\u00ebrcaktimin e kostove t\u00eb t\u00eb gjith\u00eb procedur\u00ebs q\u00eb i paraprin k\u00ebtij p\u00ebrcaktimi t\u00eb kostove. <br\/>(3) Abs. 2 zbatohet gjithashtu n\u00eb procedur\u00ebn e apelit, por vet\u00ebm p\u00ebr kostot e gjykatave t\u00eb varura n\u00eb instanc\u00eb n\u00ebse k\u00ebto kosto p\u00ebrcaktohen nga gjykata e instanc\u00ebs m\u00eb t\u00eb lart\u00eb. N\u00ebse vendimet e gjykatave t\u00eb varura jan\u00eb anuluar plot\u00ebsisht ose pjes\u00ebrisht n\u00eb instanc\u00eb, at\u00ebher\u00eb vendimi i fundit mbi \u00e7\u00ebshtjen kryesore duhet t\u00eb bazohet gjithashtu n\u00eb vler\u00ebn e mosmarr\u00ebveshjes ose vler\u00ebn e procedur\u00ebs t\u00eb p\u00ebrcaktuar s\u00eb fundmi kur p\u00ebrcaktohen kostot e atyre gjykatave, vendimet e t\u00eb cilave jan\u00eb anuluar.  <br\/>(4) Abs. 3 zbatohet gjithashtu n\u00ebse kursi i konvertimit vendimtar sipas \u00a7 6 p\u00ebr vler\u00ebsimin ka ndryshuar gjat\u00eb rrjedh\u00ebs s\u00eb instanc\u00ebs. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 9<br\/><\/strong>(1) K\u00ebrkesat p\u00ebr pages\u00ebn e shumave t\u00eb mbajtjes ose t\u00eb sigurimit dhe p\u00ebr pages\u00ebn e pensioneve n\u00eb rast t\u00eb d\u00ebmtimeve trupore ose vrasjes s\u00eb nj\u00eb personi duhet t\u00eb vler\u00ebsohen me trefishin e pages\u00ebs vjetore. N\u00ebse k\u00ebrkesa b\u00ebhet p\u00ebr nj\u00eb koh\u00eb m\u00eb t\u00eb shkurt\u00ebr se tre vjet, at\u00ebher\u00eb shuma totale e pagesave t\u00eb k\u00ebrkuara p\u00ebr k\u00ebt\u00eb koh\u00eb sh\u00ebrben si baz\u00eb vler\u00ebsimi. <br\/>(2) N\u00ebse k\u00ebrkohet nj\u00eb rritje ose ulje e shumave t\u00eb p\u00ebrmendura n\u00eb Abs. 1, at\u00ebher\u00eb trefishi i pages\u00ebs vjetore t\u00eb rritjes ose uljes s\u00eb k\u00ebrkuar duhet t\u00eb supozohet si baz\u00eb vler\u00ebsimi. <br\/>(3) K\u00ebrkesat p\u00ebr pages\u00ebn e mbajtjes s\u00eb bashk\u00ebshortit ose mbajtjes s\u00eb f\u00ebmij\u00ebs, p\u00ebrfshir\u00eb k\u00ebrkesat p\u00ebr pages\u00ebn e mbajtjes s\u00eb p\u00ebrkohshme, duhet t\u00eb vler\u00ebsohen me nj\u00eb t\u00eb vetme t\u00eb pages\u00ebs vjetore. Abs. 1 fjalia e fundit dhe Abs. 2 zbatohen n\u00eb m\u00ebnyr\u00eb t\u00eb ngjashme.<br\/>Vini re<br\/>Duhet t\u00eb zbatohet vet\u00ebm n\u00ebse \u00e7\u00ebshtja pas 31 dhjetorit 2004<br\/>\u00ebsht\u00eb b\u00ebr\u00eb e varur. P\u00ebr t\u00eb gjitha procedurat q\u00eb jan\u00eb b\u00ebr\u00eb t\u00eb varura m\u00eb par\u00eb<br\/>k\u00ebto dispozita duhet t\u00eb vazhdojn\u00eb t\u00eb zbatohen n\u00eb versionin e tyre t\u00eb m\u00ebparsh\u00ebm<br\/>version (shih Art. 10 \u00a7 2, BGBl. I Nr. 113\/2003).    <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 10<\/strong><br\/>Objekti duhet t\u00eb vler\u00ebsohet:<br\/>1. n\u00eb mosmarr\u00ebveshjet p\u00ebr padit\u00eb p\u00ebr nd\u00ebrprerje t\u00eb posedimit me 800 Euro;<br\/>2. n\u00eb mosmarr\u00ebveshjet nga kontrata e inventarit dhe n\u00eb mosmarr\u00ebveshjet p\u00ebr padit\u00eb p\u00ebr d\u00ebbim<br\/>a) p\u00ebr ambiente komerciale, p\u00ebr apartamente, sip\u00ebrfaqja e t\u00eb cilave tejkalon 90 m2, dhe p\u00ebr objekte t\u00eb tjera me qiran\u00eb vjetore q\u00eb rezulton nga 12 muajt e fundit para paraqitjes s\u00eb njoftimit t\u00eb p\u00ebrfundimit ose padis\u00eb, por t\u00eb pakt\u00ebn, si dhe n\u00eb rastet kur kjo baz\u00eb vler\u00ebsimi nuk pretendohet n\u00eb m\u00ebnyr\u00eb numerike n\u00eb njoftimin e p\u00ebrfundimit ose padi, me 2 000 Euro,<br\/>b) p\u00ebr apartamente, sip\u00ebrfaqja e t\u00eb cilave tejkalon 60 m2 dhe q\u00eb nuk bien n\u00ebn lit. a, me 1 500 Euro,<br\/>c) p\u00ebr apartamente m\u00eb t\u00eb vogla me 1 000 Euro;<br\/>3. n\u00eb procedurat jasht\u00eb mosmarr\u00ebveshjeve sipas \u00a7 37 Abs. 1 MRG, \u00a7 52 Abs. 1 WEG 2002, \u00a7 22 Abs. 1 WGG, \u00a7 25 HeizKG dhe Ligjit p\u00ebr Kopshtet e Vogla<br\/>a) p\u00ebr k\u00ebrkesat q\u00eb lidhen me objektin<br\/>aa) p\u00ebr ambiente komerciale, p\u00ebr apartamente, sip\u00ebrfaqja e t\u00eb cilave tejkalon 90 m2, dhe p\u00ebr garazhe me m\u00eb shum\u00eb se dy vende parkimi, n\u00ebse objekti nuk p\u00ebrb\u00ebhet nga nj\u00eb shum\u00eb parash, me 2 000 Euro,<br\/>p\u00ebrndryshe maksimumi me &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;. 6 000 Euro,     <br\/>bb) p\u00ebr apartamente me nj\u00eb sip\u00ebrfaqe prej m\u00eb shum\u00eb se 60 m2 dhe deri n\u00eb 90 m2, n\u00ebse objekti nuk p\u00ebrb\u00ebhet nga nj\u00eb shum\u00eb parash, me 1 500 Euro, p\u00ebrndryshe maksimumi me 4 500 Euro,<br\/>cc) p\u00ebr objekte t\u00eb tjera, n\u00ebse objekti nuk p\u00ebrb\u00ebhet nga nj\u00eb shum\u00eb parash, me 1 000 Euro,<br\/>p\u00ebrndryshe maksimumi me &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;.. 3 000 Euro<br\/>b) p\u00ebr k\u00ebrkesat q\u00eb lidhen me pron\u00ebn<br\/>aa) p\u00ebr prona me m\u00eb shum\u00eb se pes\u00ebdhjet\u00eb objekte me qira ose objekte t\u00eb p\u00ebrshtatshme p\u00ebr pron\u00ebsi apartamenti (\u00a7 2 Abs. 2 WEG 2002), n\u00ebse objekti nuk p\u00ebrb\u00ebhet nga nj\u00eb shum\u00eb parash, me 4 000 Euro,<br\/>p\u00ebrndryshe maksimumi me &#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230;&#8230; XVII<br\/>\u00a7 16, BGBl. I Nr. 111\/2007).         <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 11<br\/><\/strong>(1) P\u00ebrve\u00e7 n\u00ebse kostot nuk duhet t\u00eb anulohen kund\u00ebr nj\u00ebra-tjetr\u00ebs, shuma e kostove sh\u00ebrben si baz\u00eb vler\u00ebsimi n\u00eb procedurat p\u00ebr k\u00ebrkesat p\u00ebr p\u00ebrcaktimin e kostove, dh\u00ebnia e s\u00eb cil\u00ebs k\u00ebrkohet. Baza e vler\u00ebsimit n\u00eb procedur\u00ebn e rekursit t\u00eb kostove \u00ebsht\u00eb shuma, dh\u00ebnia ose mohimi i s\u00eb cil\u00ebs k\u00ebrkohet n\u00eb rekursin e kostove. (2) N\u00ebse shuma e k\u00ebrkuar n\u00eb rastet e Abs. 1 nuk tejkalon 100 Euro, at\u00ebher\u00eb ekziston vet\u00ebm nj\u00eb e drejt\u00eb p\u00ebr z\u00ebvend\u00ebsimin e shpenzimeve t\u00eb gatshme n\u00eb raport me suksesin.<br\/>Vini re<br\/>Duhet t\u00eb zbatohet vet\u00ebm n\u00ebse \u00e7\u00ebshtja pas 31 dhjetorit 2004<br\/>\u00ebsht\u00eb b\u00ebr\u00eb e varur. P\u00ebr t\u00eb gjitha procedurat q\u00eb jan\u00eb b\u00ebr\u00eb t\u00eb varura m\u00eb par\u00eb<br\/>k\u00ebto dispozita duhet t\u00eb vazhdojn\u00eb t\u00eb zbatohen n\u00eb versionin e tyre t\u00eb m\u00ebparsh\u00ebm<br\/>version (shih Art. 10 \u00a7 2, BGBl. I Nr. 113\/2003).    <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>\u00a7 12<br\/><\/strong>1) N\u00ebse pretendohen disa k\u00ebrkesa n\u00eb t\u00eb nj\u00ebjt\u00ebn padi, vlerat e objekteve t\u00eb mosmarr\u00ebveshjes duhet t\u00eb mblidhen s\u00eb bashku. E nj\u00ebjta gj\u00eb vlen p\u00ebr koh\u00ebzgjatjen e bashkimit t\u00eb disa mosmarr\u00ebveshjeve dhe p\u00ebr bashkimin e padis\u00eb dhe kund\u00ebrpadis\u00eb p\u00ebr negociata t\u00eb p\u00ebrbashk\u00ebta. (2) N\u00ebse negociohet ve\u00e7mas p\u00ebr disa k\u00ebrkesa t\u00eb ngritura n\u00eb t\u00eb nj\u00ebjt\u00ebn padi, at\u00ebher\u00eb vlera e pjesshme p\u00ebrkat\u00ebse \u00ebsht\u00eb vendimtare p\u00ebr secil\u00ebn nga negociatat e ndara gjat\u00eb koh\u00ebzgjatjes s\u00eb ndarjes. (2a) Abs. 1 dhe 2 zbatohen gjithashtu n\u00eb m\u00ebnyr\u00eb t\u00eb ngjashme p\u00ebr pretendimin e disa k\u00ebrkesave n\u00eb t\u00eb nj\u00ebjt\u00ebn procedur\u00eb jokontestuese dhe p\u00ebr bashkimin e disa procedurave jokontestuese. Abs. 1 dhe 2 zbatohen gjithashtu n\u00eb m\u00ebnyr\u00eb t\u00eb ngjashme p\u00ebr pretendimin e disa k\u00ebrkesave n\u00eb t\u00eb nj\u00ebjt\u00ebn procedur\u00eb jokontestuese dhe p\u00ebr bashkimin e disa procedurave jokontestuese. (3) Nj\u00eb ndryshim n\u00eb vler\u00ebn e objektit t\u00eb mosmarr\u00ebveshjes si pasoj\u00eb e nj\u00eb ndryshimi n\u00eb nj\u00eb padi, si pasoj\u00eb e nj\u00eb kufizimi t\u00eb k\u00ebrkes\u00ebs s\u00eb padis\u00eb ose si pasoj\u00eb e nj\u00eb p\u00ebrfundimi t\u00eb pjessh\u00ebm t\u00eb mosmarr\u00ebveshjes duhet t\u00eb merret parasysh p\u00ebr sh\u00ebrbimet q\u00eb pasojn\u00eb ndryshimin e vler\u00ebs dhe, n\u00ebse ndryshimi shkaktohet nga nj\u00eb deklarat\u00eb e pal\u00ebs, edhe p\u00ebr parashtres\u00ebn p\u00ebrkat\u00ebse. N\u00ebse vlera e mosmarr\u00ebveshjes ndryshohet gjat\u00eb nj\u00eb seance, at\u00ebher\u00eb ndryshimi duhet t\u00eb merret parasysh tashm\u00eb p\u00ebr at\u00eb or\u00eb t\u00eb seanc\u00ebs n\u00eb t\u00eb cil\u00ebn ndodh ndryshimi. E nj\u00ebjta gj\u00eb vlen gjithashtu n\u00eb zbatim t\u00eb ngjash\u00ebm p\u00ebr ndryshimet n\u00eb objektin e procedur\u00ebs n\u00eb procedur\u00ebn jokontestuese. (4) N\u00ebse k\u00ebrkesa kufizohet n\u00eb shpenzime an\u00ebsore, at\u00ebher\u00eb duhet t\u00eb supozohen vlerat e m\u00ebposhtme t\u00eb mosmarr\u00ebveshjes ose vlerat e procedur\u00ebs, por kurr\u00eb m\u00eb shum\u00eb se gjysma e vler\u00ebs fillestare: a) n\u00eb \u00e7\u00ebshtjet ligjore para Gjykat\u00ebs, p\u00ebr t\u00eb cilat duhet t\u00eb vendos\u00eb Senati, 2 000 Euro, b) n\u00eb \u00e7\u00ebshtjet ligjore para Gjykat\u00ebs, p\u00ebr t\u00eb cilat duhet t\u00eb vendos\u00eb gjyqtari i vet\u00ebm, 1 000 Euro, c) n\u00eb \u00e7\u00ebshtjet ligjore para gjykat\u00ebs s\u00eb rrethit, 200 Euro. E nj\u00ebjta gj\u00eb vlen n\u00ebse k\u00ebrkesa a) n\u00eb \u00e7\u00ebshtjet ligjore para Gjykat\u00ebs, p\u00ebr t\u00eb cilat duhet t\u00eb vendos\u00eb Senati, kufizohet n\u00eb m\u00eb pak se 2 000 Euro, b) n\u00eb \u00e7\u00ebshtjet ligjore para Gjykat\u00ebs, p\u00ebr t\u00eb cilat duhet t\u00eb vendos\u00eb gjyqtari i vet\u00ebm, kufizohet n\u00eb m\u00eb pak se 1 000 Euro, c) n\u00eb \u00e7\u00ebshtjet ligjore para gjykat\u00ebs s\u00eb rrethit kufizohet n\u00eb m\u00eb pak se 200 Euro.                 <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Neni 13<br\/><\/strong>(1) N\u00eb procedur\u00ebn e ekzekutimit (sigurimit), baza e vler\u00ebsimit \u00ebsht\u00eb<br\/>a) p\u00ebr kreditorin iniciues ose personin tjet\u00ebr t\u00eb autorizuar, vlera e k\u00ebrkes\u00ebs p\u00ebr kapital; kostot e procesit ose tarifat an\u00ebsore merren parasysh vet\u00ebm n\u00ebse ato p\u00ebrb\u00ebjn\u00eb vet\u00ebm objektin e k\u00ebrkes\u00ebs q\u00eb do t\u00eb zbatohet ose sigurohet; nj\u00eb ndryshim n\u00eb baz\u00ebn e vler\u00ebsimit nuk ndodh gjat\u00eb procedur\u00ebs; b) p\u00ebr debitorin, vlera e k\u00ebrkes\u00ebs s\u00eb prekur nga k\u00ebrkesa e tij; c) p\u00ebr debitorin e tret\u00eb, vlera e k\u00ebrkes\u00ebs s\u00eb sekuestruar, n\u00ebse kjo \u00ebsht\u00eb m\u00eb e ul\u00ebt se k\u00ebrkesa e kreditorit iniciues, p\u00ebrndryshe vlera e specifikuar n\u00eb shkronj\u00ebn a; p\u00ebr debitorin e tret\u00eb, vlera e k\u00ebrkes\u00ebs s\u00eb sekuestruar, n\u00ebse kjo \u00ebsht\u00eb m\u00eb e ul\u00ebt se k\u00ebrkesa e kreditorit iniciues, p\u00ebrndryshe vlera e specifikuar n\u00eb shkronj\u00ebn a; d) p\u00ebr ofertuesin dhe p\u00ebr bler\u00ebsin e par\u00eb, vlera e ofert\u00ebs m\u00eb t\u00eb lart\u00eb t\u00eb arritur.      <em>(Sh\u00ebnim: Paragrafi 2 \u00ebsht\u00eb shfuqizuar nga <a href=\"https:\/\/www.ris.bka.gv.at\/Dokumente\/BgblPdf\/1995_519_0\/1995_519_0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">BGBl. Nr. 519\/1995 <\/a>)<\/em><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Neni 14<br\/><\/strong>N\u00ebse baza e vler\u00ebsimit nuk mund t\u00eb p\u00ebrcaktohet sipas dispozitave t\u00eb m\u00ebparshme, at\u00ebher\u00eb do t\u00eb bazohen vlerat e m\u00ebposhtme:<br\/>a) n\u00eb \u00e7\u00ebshtjet ligjore para Gjykat\u00ebs, p\u00ebr t\u00eb cilat vendos Senati, 24.000 euro,<br\/>b) n\u00eb \u00e7\u00ebshtjet ligjore para Gjykat\u00ebs, p\u00ebr t\u00eb cilat vendos gjyqtari i vet\u00ebm, 10.000 euro,<br\/>c) n\u00eb \u00e7\u00ebshtjet ligjore para Gjykat\u00ebs s\u00eb Rrethit 1.000 euro.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Rritja e shp\u00ebrblimit n\u00eb rast t\u00eb disa personave<br\/>Neni 15<br\/><\/strong>(1) Avokatit i takon nj\u00eb rritje e shp\u00ebrblimit t\u00eb tij, n\u00ebse ai p\u00ebrfaq\u00ebson disa persona n\u00eb nj\u00eb \u00e7\u00ebshtje ligjore (\u00a7 1) ose p\u00ebrballet me disa persona. Rritja \u00ebsht\u00eb: Avokatit i takon nj\u00eb rritje e shp\u00ebrblimit t\u00eb tij, n\u00ebse ai p\u00ebrfaq\u00ebson disa persona n\u00eb nj\u00eb \u00e7\u00ebshtje ligjore (Paragrafi nj\u00eb,) ose p\u00ebrballet me disa persona. Rritja \u00ebsht\u00eb: a) n\u00ebse vet\u00ebm n\u00eb nj\u00ebr\u00ebn an\u00eb ka dy persona t\u00eb p\u00ebrfaq\u00ebsuar nga avokati ose q\u00eb i kund\u00ebrshtohen atij 10%, b) p\u00ebr \u00e7do person tjet\u00ebr t\u00eb p\u00ebrfaq\u00ebsuar prej tij dhe p\u00ebr \u00e7do person tjet\u00ebr q\u00eb i kund\u00ebrshtohet atij nga 5% secili, por kurr\u00eb m\u00eb shum\u00eb se gjithsej 50% t\u00eb shum\u00ebs s\u00eb fitimeve, duke p\u00ebrfshir\u00eb norm\u00ebn uniforme; shpenzimet e udh\u00ebtimit, kompensimi p\u00ebr humbjen e koh\u00ebs dhe shpenzimet e tjera nuk llogariten n\u00eb shum\u00ebn e fitimeve. (2) Paragrafi 1 nuk zbatohet n\u00eb procedurat e padis\u00eb s\u00eb asociacionit p\u00ebr korrigjim sipas \u00a7\u00a7 623 ff. ZPO deri n\u00eb vendimin p\u00ebr nj\u00eb k\u00ebrkes\u00eb t\u00eb p\u00ebrkohshme p\u00ebr konstatim nga Institucioni i Kualifikuar sipas \u00a7 624 Paragrafi 2 ZPO.       <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Shpenzimet<br\/>Neni 16<br\/><\/strong>Shpenzimet p\u00ebr tarifat gjyq\u00ebsore, tarifat postare dhe shpenzimet e tjera, duke p\u00ebrfshir\u00eb tatimin mbi vler\u00ebn e shtuar, kompensohen ve\u00e7mas, p\u00ebrve\u00e7 n\u00ebse neni 23 p\u00ebrcakton ndryshe. Po ashtu, kompensohen ve\u00e7mas shpenzimet shtes\u00eb q\u00eb i shkaktohen nj\u00eb pale nga p\u00ebrfshirja e nj\u00eb avokati me t\u00eb drejt\u00eb bashk\u00ebvendimi sipas \u00a7 5 Paragrafi 1 EIRAG, por jo m\u00eb shum\u00eb se 25% e shum\u00ebs s\u00eb fitimeve, duke p\u00ebrfshir\u00eb norm\u00ebn uniforme; shpenzimet e udh\u00ebtimit, kompensimi p\u00ebr humbjen e koh\u00ebs dhe shpenzimet e tjera nuk llogariten n\u00eb shum\u00ebn e fitimeve.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Kryerja e disa pun\u00ebve gjat\u00eb nj\u00eb udh\u00ebtimi<br\/>Neni 17<\/strong><br\/>N\u00ebse kryhen disa pun\u00eb gjat\u00eb nj\u00eb udh\u00ebtimi, shpenzimet e udh\u00ebtimit duhet t\u00eb ndahen midis pun\u00ebve individuale n\u00eb raport me bazat e vler\u00ebsimit.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Regjistrat e kostove<br\/>Neni 18<\/strong><br\/>Avokati nuk ka t\u00eb drejt\u00eb t\u00eb marr\u00eb shp\u00ebrblim p\u00ebr hartimin e regjistrit t\u00eb kostove ose fatur\u00ebs s\u00eb honorarit p\u00ebr pal\u00ebn q\u00eb ai p\u00ebrfaq\u00ebson.<br\/><br\/><strong>Shp\u00ebrblimi n\u00eb rast t\u00eb veprimtaris\u00eb s\u00eb p\u00ebrbashk\u00ebt t\u00eb disa avokat\u00ebve<\/strong> <strong>Neni 19<\/strong> P\u00ebr sh\u00ebrbimet q\u00eb i jan\u00eb besuar disa avokat\u00ebve nga nj\u00eb pal\u00eb n\u00eb m\u00ebnyr\u00eb t\u00eb p\u00ebrbashk\u00ebt, \u00e7do avokat ka t\u00eb drejt\u00eb t\u00eb marr\u00eb kompensimin e plot\u00eb sipas tarif\u00ebs p\u00ebr sh\u00ebrbimet e tij ndaj pal\u00ebs q\u00eb ai p\u00ebrfaq\u00ebson.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Personi i autorizuar p\u00ebr sh\u00ebrbime<br\/>Neni 20<br\/><\/strong>Avokati, i cili \u00ebsht\u00eb caktuar si person i autorizuar p\u00ebr sh\u00ebrbime, ka vet\u00ebm t\u00eb drejt\u00eb t\u00eb marr\u00eb kompensim p\u00ebr shpenzimet p\u00ebr d\u00ebrgimin e dokumenteve dhe p\u00ebr shp\u00ebrblimin p\u00ebr hartimin dhe d\u00ebrgimin e letrave.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Verifikimi nga gjykata; shp\u00ebrblimi mbi mas\u00ebn e tarif\u00ebs<br\/>Neni 21<\/strong><br\/>(1) Kompetenca gjyq\u00ebsore p\u00ebr t\u00eb verifikuar nevoj\u00ebn dhe p\u00ebrshtatshm\u00ebrin\u00eb e sh\u00ebrbimeve individuale mbetet e paprekur. N\u00ebse n\u00eb raste individuale sh\u00ebrbimi i avokatit tejkalon ndjesh\u00ebm mesataren sipas shtrirjes ose llojit, shp\u00ebrblimi p\u00ebr k\u00ebt\u00eb duhet t\u00eb p\u00ebrcaktohet n\u00eb m\u00ebnyr\u00eb t\u00eb arsyeshme pavar\u00ebsisht nga tarifa, ve\u00e7an\u00ebrisht duke marr\u00eb parasysh koh\u00ebn dhe p\u00ebrpjekjen e shpenzuar. (2) N\u00ebn normat e tarif\u00ebs mund t\u00eb ulet vet\u00ebm n\u00ebse avokati nuk k\u00ebrkon nj\u00eb shp\u00ebrblim m\u00eb t\u00eb lart\u00eb, edhe n\u00eb rast t\u00eb p\u00ebrcaktimit gjyq\u00ebsor t\u00eb shp\u00ebrblimit p\u00ebr sh\u00ebrbime t\u00eb t\u00eb nj\u00ebjtit ose t\u00eb ngjash\u00ebm lloji, t\u00eb cilat nuk i n\u00ebnshtrohen tarif\u00ebs.<br\/>V\u00ebrejtje<br\/>Zbatohet vet\u00ebm n\u00ebse \u00e7\u00ebshtja \u00ebsht\u00eb paraqitur pas 31 dhjetorit 2004.<br\/>P\u00ebr t\u00eb gjitha procedurat e paraqitura m\u00eb par\u00eb,<br\/>k\u00ebto dispozita vazhdojn\u00eb t\u00eb zbatohen n\u00eb versionin e tyre t\u00eb m\u00ebparsh\u00ebm<br\/>(shih Art. 10 \u00a7 2, BGBl. I Nr. 113\/2003).   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Parashtresa t\u00eb ndara<br\/>Neni 22<\/strong><br\/>N\u00eb procedur\u00ebn civile dhe n\u00eb procedur\u00ebn e ekzekutimit (sigurimit), parashtresat kompensohen ve\u00e7mas vet\u00ebm n\u00ebse ato nuk mund t\u00eb lidhen me parashtresa t\u00eb tjera ose gjykata e njeh paraqitjen e tyre t\u00eb ndar\u00eb si t\u00eb nevojshme ose t\u00eb p\u00ebrshtatshme.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Norma uniforme p\u00ebr sh\u00ebrbime an\u00ebsore<br\/>Neni 23<\/strong><br\/>1) N\u00eb rast t\u00eb shp\u00ebrblimit t\u00eb sh\u00ebrbimeve q\u00eb hyjn\u00eb n\u00ebn postat tarifore 1, 2, 3, 4 ose 7, n\u00eb vend t\u00eb t\u00eb gjitha sh\u00ebrbimeve an\u00ebsore q\u00eb hyjn\u00eb n\u00ebn postat tarifore 5, 6 dhe 8 dhe n\u00eb vend t\u00eb kompensimit p\u00ebr tarifat postare brenda vendit, paguhet nj\u00eb norm\u00eb uniforme.<\/p>\n\n<p class=\"wp-block-paragraph\">(2) Megjithat\u00eb, avokati mund t\u00eb llogaris\u00eb sh\u00ebrbimet an\u00ebsore individuale t\u00eb specifikuara n\u00eb paragrafin 1 n\u00eb vend t\u00eb norm\u00ebs uniforme ndaj pal\u00ebs q\u00eb ai p\u00ebrfaq\u00ebson. Megjithat\u00eb, avokati mund t\u00eb llogaris\u00eb sh\u00ebrbimet an\u00ebsore individuale t\u00eb specifikuara n\u00eb paragrafin nj\u00eb n\u00eb vend t\u00eb norm\u00ebs uniforme ndaj pal\u00ebs q\u00eb ai p\u00ebrfaq\u00ebson. <\/p>\n\n<p class=\"wp-block-paragraph\">(3) Norma uniforme \u00ebsht\u00eb 60% e shum\u00ebs s\u00eb fitimeve deri n\u00eb dhe duke p\u00ebrfshir\u00eb 10.170 euro, dhe 50% e shum\u00ebs s\u00eb fitimeve mbi 10.170 euro, duke p\u00ebrjashtuar shpenzimet e udh\u00ebtimit, kompensimin p\u00ebr humbjen e koh\u00ebs dhe shpenzimet e tjera.<\/p>\n\n<p class=\"wp-block-paragraph\">(4) Norma uniforme nuk p\u00ebrfshin sh\u00ebrbime t\u00eb tilla an\u00ebsore n\u00eb negociatat gojore ose me shkrim jasht\u00eb gjyq\u00ebsore, t\u00eb cilat jan\u00eb kryer para ose gjat\u00eb nj\u00eb procedure gjyq\u00ebsore p\u00ebr t\u00eb shmangur nj\u00eb procedur\u00eb gjyq\u00ebsore ose p\u00ebr t\u00eb arritur nj\u00eb marr\u00ebveshje, n\u00ebse ato kan\u00eb shkaktuar nj\u00eb shpenzim t\u00eb konsideruesh\u00ebm t\u00eb koh\u00ebs dhe p\u00ebrpjekjes. Ato duhet t\u00eb kompensohen sipas post\u00ebs tarifore q\u00eb vlen p\u00ebr \u00e7do sh\u00ebrbim individual. E nj\u00ebjta gj\u00eb vlen p\u00ebr sh\u00ebrbimet an\u00ebsore, n\u00ebse \u00e7\u00ebshtja ligjore \u00ebsht\u00eb p\u00ebrfunduar para se t\u00eb kryhet sh\u00ebrbimi kryesor p\u00ebrkat\u00ebs i sh\u00ebrbimeve an\u00ebsore.  <\/p>\n\n<p class=\"wp-block-paragraph\">(5) P\u00ebr sh\u00ebrbimet q\u00eb hyjn\u00eb n\u00ebn post\u00ebn tarifore 3 A Seksioni II dhe III, post\u00ebn tarifore 3 B Seksioni II, post\u00ebn tarifore 3 C Seksioni II ose post\u00ebn tarifore 4 Seksioni I Z 5, 6, Seksioni II, pjesa e norm\u00ebs uniforme q\u00eb i atribuohet k\u00ebtij sh\u00ebrbimi duhet t\u00eb akordohet dyfish, n\u00ebse avokati e kryen sh\u00ebrbimin n\u00eb nj\u00eb vend jasht\u00eb selis\u00eb s\u00eb zyr\u00ebs s\u00eb tij ose ngarkon nj\u00eb avokat tjet\u00ebr me kryerjen e k\u00ebtij sh\u00ebrbimi dhe nuk pretendon t\u00eb drejt\u00ebn e kompensimit t\u00eb shpenzimeve t\u00eb udh\u00ebtimit dhe t\u00eb kompensimit p\u00ebr humbjen e koh\u00ebs ose gjykata nuk ia njeh nj\u00eb t\u00eb drejt\u00eb t\u00eb till\u00eb, sepse ai mund t\u00eb ishte p\u00ebrfaq\u00ebsuar nga nj\u00eb avokat i vendosur n\u00eb vendin e gjykat\u00ebs. P\u00ebr sh\u00ebrbimet q\u00eb hyjn\u00eb n\u00ebn post\u00ebn tarifore 3 A Seksioni romak II dhe romak III, post\u00ebn tarifore 3 B Seksioni romak II, post\u00ebn tarifore 3 C Seksioni romak II ose post\u00ebn tarifore 4 Seksioni romak nj\u00eb Numri 5,, 6, Seksioni romak II, pjesa e norm\u00ebs uniforme q\u00eb i atribuohet k\u00ebtij sh\u00ebrbimi duhet t\u00eb akordohet dyfish, n\u00ebse avokati e kryen sh\u00ebrbimin n\u00eb nj\u00eb vend jasht\u00eb selis\u00eb s\u00eb zyr\u00ebs s\u00eb tij ose ngarkon nj\u00eb avokat tjet\u00ebr me kryerjen e k\u00ebtij sh\u00ebrbimi dhe nuk pretendon t\u00eb drejt\u00ebn e kompensimit t\u00eb shpenzimeve t\u00eb udh\u00ebtimit dhe t\u00eb kompensimit p\u00ebr humbjen e koh\u00ebs ose gjykata nuk ia njeh nj\u00eb t\u00eb drejt\u00eb t\u00eb till\u00eb, sepse ai mund t\u00eb ishte p\u00ebrfaq\u00ebsuar nga nj\u00eb avokat i vendosur n\u00eb vendin e gjykat\u00ebs. <\/p>\n\n<p class=\"wp-block-paragraph\">(6) N\u00eb mosmarr\u00ebveshjet ligjore, n\u00eb t\u00eb cilat duhet t\u00eb l\u00ebshohet nj\u00eb urdh\u00ebr pagese i kusht\u00ebzuar ose n\u00eb t\u00eb cilat p\u00ebrgjigja ndaj padis\u00eb urdh\u00ebrohet sipas dispozitave t\u00eb Kodit t\u00eb Procedur\u00ebs Civile, pjesa e norm\u00ebs uniforme q\u00eb i atribuohet k\u00ebtij sh\u00ebrbimi duhet t\u00eb akordohet dyfish \u2013 me rezerva t\u00eb paragrafit 7 \u2013 edhe p\u00ebr padin\u00eb, p\u00ebrgjigjen ndaj padis\u00eb dhe kund\u00ebrshtimin ndaj urdhrit t\u00eb pages\u00ebs. N\u00eb mosmarr\u00ebveshjet ligjore, n\u00eb t\u00eb cilat duhet t\u00eb l\u00ebshohet nj\u00eb urdh\u00ebr pagese i kusht\u00ebzuar ose n\u00eb t\u00eb cilat p\u00ebrgjigja ndaj padis\u00eb urdh\u00ebrohet sipas dispozitave t\u00eb Kodit t\u00eb Procedur\u00ebs Civile, pjesa e norm\u00ebs uniforme q\u00eb i atribuohet k\u00ebtij sh\u00ebrbimi duhet t\u00eb akordohet dyfish \u2013 me rezerva t\u00eb paragrafit 7, \u2013 edhe p\u00ebr padin\u00eb, p\u00ebrgjigjen ndaj padis\u00eb dhe kund\u00ebrshtimin ndaj urdhrit t\u00eb pages\u00ebs. (7) N\u00eb mosmarr\u00ebveshjet ligjore, n\u00eb t\u00eb cilat k\u00ebrkohet pagesa e nj\u00eb shume parash q\u00eb nuk i kalon 360 euro dhe duhet t\u00eb l\u00ebshohet nj\u00eb urdh\u00ebr pagese i kusht\u00ebzuar, p\u00ebr padit\u00eb e p\u00ebrmendura n\u00eb post\u00ebn tarifore 2 paguhet norma uniforme sipas paragrafit 3. N\u00ebse ngrihet kund\u00ebrshtim ndaj urdhrit t\u00eb pages\u00ebs, at\u00ebher\u00eb n\u00eb vend t\u00eb k\u00ebsaj duhet t\u00eb akordohet norma e dyfisht\u00eb uniforme p\u00ebr padin\u00eb. N\u00eb mosmarr\u00ebveshjet ligjore, n\u00eb t\u00eb cilat k\u00ebrkohet pagesa e nj\u00eb shume parash q\u00eb nuk i kalon 360 euro dhe duhet t\u00eb l\u00ebshohet nj\u00eb urdh\u00ebr pagese i kusht\u00ebzuar, p\u00ebr padit\u00eb e p\u00ebrmendura n\u00eb post\u00ebn tarifore 2 paguhet norma uniforme sipas paragrafit 3, N\u00ebse ngrihet kund\u00ebrshtim ndaj urdhrit t\u00eb pages\u00ebs, at\u00ebher\u00eb n\u00eb vend t\u00eb k\u00ebsaj duhet t\u00eb akordohet norma e dyfisht\u00eb uniforme p\u00ebr padin\u00eb. (8) P\u00ebr k\u00ebrkesat p\u00ebr lejimin e ekzekutimit, si dhe p\u00ebr k\u00ebrkesat e kreditorit iniciues sipas post\u00ebs tarifore 3A Seksioni I Z 2, pjesa e norm\u00ebs uniforme q\u00eb i atribuohet k\u00ebtij sh\u00ebrbimi duhet t\u00eb akordohet dyfish. P\u00ebr k\u00ebrkesat p\u00ebr lejimin e ekzekutimit, si dhe p\u00ebr k\u00ebrkesat e kreditorit iniciues sipas post\u00ebs tarifore 3A Seksioni romak nj\u00eb Numri 2, pjesa e norm\u00ebs uniforme q\u00eb i atribuohet k\u00ebtij sh\u00ebrbimi duhet t\u00eb akordohet dyfish. (9) N\u00eb procedurat e apelit, n\u00eb t\u00eb cilat nuk merren prova ose nuk kryhen plot\u00ebsime t\u00eb tjera t\u00eb procedur\u00ebs, p\u00ebr apelin dhe p\u00ebrgjigjen ndaj apelit, pjesa e norm\u00ebs uniforme q\u00eb i atribuohet k\u00ebtyre sh\u00ebrbimeve duhet t\u00eb akordohet trefish \u2013 n\u00eb rast t\u00eb kryerjes s\u00eb nj\u00eb seance apelimi sipas paragrafit 5, kat\u00ebrfish; me k\u00ebt\u00eb jan\u00eb shlyer edhe t\u00eb gjitha sh\u00ebrbimet e lidhura me kryerjen e seanc\u00ebs s\u00eb apelimit. N\u00eb procedurat e apelit, n\u00eb t\u00eb cilat nuk merren prova ose nuk kryhen plot\u00ebsime t\u00eb tjera t\u00eb procedur\u00ebs, p\u00ebr apelin dhe p\u00ebrgjigjen ndaj apelit, pjesa e norm\u00ebs uniforme q\u00eb i atribuohet k\u00ebtyre sh\u00ebrbimeve duhet t\u00eb akordohet trefish \u2013 n\u00eb rast t\u00eb kryerjes s\u00eb nj\u00eb seance apelimi sipas paragrafit 5, kat\u00ebrfish; me k\u00ebt\u00eb jan\u00eb shlyer edhe t\u00eb gjitha sh\u00ebrbimet e lidhura me kryerjen e seanc\u00ebs s\u00eb apelimit.          (10) Paragrafi 9 nuk zbatohet p\u00ebr procedurat e apelit, n\u00eb t\u00eb cilat duhet t\u00eb zbatohet \u00a7 501 Paragrafi 1 ZPO.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Rritja e shp\u00ebrblimit n\u00eb komunikimin elektronik ligjor<br\/>Neni 23a<br\/><\/strong>N\u00ebse parashtresa q\u00eb inicion procedur\u00ebn paraqitet n\u00ebp\u00ebrmjet komunikimit elektronik ligjor, avokatit i takon p\u00ebr k\u00ebt\u00eb nj\u00eb rritje e shp\u00ebrblimit prej 5,00 euro. P\u00ebr parashtresa t\u00eb tjera t\u00eb paraqitura n\u00ebp\u00ebrmjet komunikimit elektronik ligjor, avokatit i takon p\u00ebrkat\u00ebsisht nj\u00eb rritje e shp\u00ebrblimit prej 2,60 euro. Shuma p\u00ebrkat\u00ebse e rritjes nuk duhet t\u00eb merret parasysh gjat\u00eb vler\u00ebsimit t\u00eb norm\u00ebs uniforme (\u00a7 23) dhe t\u00eb shtes\u00ebs p\u00ebr bashk\u00ebnd\u00ebrgjyq\u00ebsin\u00eb (\u00a7 15). N\u00ebse n\u00eb \u00e7\u00ebshtjet e regjistrit tok\u00ebsor dhe t\u00eb regjistrit t\u00eb kompanive t\u00eb gjitha dokumentet, t\u00eb cilat duhet t\u00eb p\u00ebrfshihen n\u00eb koleksionin e dokumenteve t\u00eb regjistrit tok\u00ebsor ose t\u00eb regjistrit t\u00eb kompanive n\u00eb baz\u00eb t\u00eb regjistrimit t\u00eb k\u00ebrkuar me paraqitjen, transmetohen n\u00eb komunikimin elektronik ligjor, avokatit i takon p\u00ebr k\u00ebt\u00eb nj\u00eb rritje tjet\u00ebr e shp\u00ebrblimit prej 9,50 euro   <sup> <\/sup><\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Regjistrimi i shkurtuar i kostove (tarifa normale e kostove)<br\/>Neni 24<\/strong><br\/>(1) Ministri Federal i Drejt\u00ebsis\u00eb autorizohet t\u00eb hartoj\u00eb me an\u00eb t\u00eb nj\u00eb rregulloreje nj\u00eb llogaritje t\u00eb shp\u00ebrblimit, q\u00eb i takon avokatit p\u00ebr sh\u00ebrbime q\u00eb ndodhin rregullisht n\u00eb raste t\u00eb thjeshta dhe q\u00eb p\u00ebrs\u00ebriten shpesh (tarifa normale e kostove). Kjo tarif\u00eb mund t\u00eb shtrihet vet\u00ebm<br\/>a) n\u00eb procesin civil p\u00ebr vendime t\u00eb munges\u00ebs,<br\/>b)  <em>shkronja b \u00ebsht\u00eb shfuqizuar nga Art. 13 Z 1,  <\/em><a href=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/I\/2021\/86\" target=\"_blank\" rel=\"noreferrer noopener\">BGBl. I Nr. 86\/2021 <\/a><br\/>c) n\u00eb procesin civil dhe n\u00eb procedur\u00ebn e ekzekutimit p\u00ebr k\u00ebrkesa, p\u00ebr t\u00eb cilat vendoset nga gjykata pa seanc\u00eb gojore, me p\u00ebrjashtim t\u00eb mjeteve ligjore.<br\/>(2) N\u00eb rastet e p\u00ebrmendura n\u00eb paragrafin 1, kostot mund t\u00eb regjistrohen n\u00eb at\u00eb m\u00ebnyr\u00eb q\u00eb t\u00eb k\u00ebrkohet kompensimi i kostove dhe tarifave sipas tarif\u00ebs normale t\u00eb kostove. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>P\u00ebrcaktimi i shtesave<br\/>Neni 25<br\/><\/strong>Ministri Federal i Drejt\u00ebsis\u00eb autorizohet, n\u00eb marr\u00ebveshje me komitetin kryesor t\u00eb K\u00ebshillit Komb\u00ebtar, t\u00eb p\u00ebrcaktoj\u00eb me an\u00eb t\u00eb nj\u00eb rregulloreje nj\u00eb shtes\u00eb p\u00ebr shumat fikse t\u00eb specifikuara n\u00eb tarif\u00eb si shp\u00ebrblim i avokatit dhe p\u00ebr shumat e specifikuara n\u00eb \u00a7 23a, n\u00ebse dhe p\u00ebr aq sa kjo \u00ebsht\u00eb e nevojshme p\u00ebr t&#8217;u siguruar avokat\u00ebve nj\u00eb shp\u00ebrblim t\u00eb p\u00ebrshtatsh\u00ebm q\u00eb korrespondon me kushtet e ndryshuara ekonomike.
