Vsak solastnik ima pravico storiti ta korak, tudi brez soglasja ostalih. Ker vsi solastniki nastopajo skupaj kot stranka, vpliva ravnanje posameznika na celoten postopek. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-ziel-der-teilungsklage\">Cilj delitvene to\u017ebe<\/h2>\n\n<p class=\"wp-block-paragraph\">Delitvena to\u017eba uresni\u010duje obligacijskopravno zahtevo za ukinitev solastni\u0161tva. Usmerjena je proti vsem solastnikom, ne glede na to, ali so vpisani v zemlji\u0161ko knjigo ali ne. <\/p>\n\n<p class=\"wp-block-paragraph\">Cilj: Nepremi\u010dnina se bodisi razdeli bodisi proda na dra\u017ebi.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-realteilung-vs-zivilteilung\">Stvarna delitev proti civilni delitvi<\/h2>\n\n<p class=\"wp-block-paragraph\">\u010ce ve\u010d oseb skupaj poseduje nepremi\u010dnino, vendar ne najdejo dogovora o njeni uporabi ali delitvi, lahko vsak solastnik zahteva ukinitev te skupnosti. Zakon predvideva dva na\u010dina: <strong>stvarno delitev<\/strong> in <strong>civilno delitev<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-realteilung\">Stvarna delitev<\/h3>\n\n<p class=\"wp-block-paragraph\">Pri <strong>stvarni delitvi<\/strong> se skupno lastni\u0161tvo dejansko razdeli. Vsak dobi svoj, jasno razmejen del nepremi\u010dnine. Ta re\u0161itev je \u0161e posebej smiselna, \u010de je nepremi\u010dnina dovolj velika ali \u010de jo je mogo\u010de lo\u010diti z ustanovitvijo eta\u017ene lastnine. Stvarna delitev je obi\u010dajno ekonomsko ugodnej\u0161a re\u0161itev, saj ni potreben prodajni postopek.   <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-voraussetzung-fur-eine-realteilung\">Pogoj za stvarno delitev<\/h3>\n\n<p class=\"wp-block-paragraph\">Da bi stvarna delitev sploh pri\u0161la v po\u0161tev, morajo biti izpolnjeni dolo\u010deni pravni in dejanski pogoji:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Gradbene in tehni\u010dne zna\u010dilnosti<\/strong> morajo omogo\u010dati jasno in trajno delitev nepremi\u010dnine. To se lahko zgodi z delitvijo zemlji\u0161\u010da ali z ustanovitvijo eta\u017ene lastnine. <\/li>\n\n\n\n<li><strong>Delitev mora biti ekonomsko smiselna<\/strong>. <\/li>\n\n\n\n<li>Ne sme obstajati <strong>nobena javnopravna ovira<\/strong>.<\/li>\n\n\n\n<li>Delitev ne sme <strong>nasprotovati zakonu ali dobrim obi\u010dajem<\/strong>.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-zivilteilung\">Civilna delitev<\/h3>\n\n<p class=\"wp-block-paragraph\">\u010ce pa tak\u0161na delitev <strong>ni mogo\u010da ali je nesprejemljiva<\/strong>, na primer ker je zemlji\u0161\u010de premajhno, ni mogo\u010de izvesti gradbene lo\u010ditve ali se udele\u017eenci ne morejo dogovoriti o delitvi, pride do <strong>civilne delitve<\/strong>. Pri tem se celotna nepremi\u010dnina <g id=\"gid_2\">proda na dra\u017ebi<\/g>, obi\u010dajno javno preko okrajnega sodi\u0161\u010da. Ta zabele\u017eba \u0161\u010diti pred ne\u017eelenimi razpolaganji tretjih oseb in zagotavlja kasnej\u0161o <g id=\"gid_1\">pravnomo\u010dnost delitvene sodbe<\/g>, tudi proti kasnej\u0161im kupcem. Kljub temu ostaja odtujitev solastni\u0161kih dele\u017eev \u0161e vedno mogo\u010da.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-wirkung-der-teilungsklage\">U\u010dinek delitvene to\u017ebe<\/h2>\n\n<p class=\"wp-block-paragraph\">Delitvena to\u017eba se obi\u010dajno uporablja po dedovanju, lo\u010ditvah ali pri sprtih solastnikih. Vsak udele\u017eenec jo lahko vlo\u017ei, pomembno je le: <strong>Vsi ostali solastniki morajo biti del postopka.<\/strong> <\/p>\n    <div class=\"mr-quote mrbg clearfix\">\n        <a class=\"mr-quote-person\" href=\"\/ueber-uns\/rechtsanwalt-sebastian-riedlmair\/\" title=\"Rechtsanwalt Sebastian Riedlmair\">\n            <img decoding=\"async\" class=\"mr-quote-person-img\" src=\"https:\/\/harlander-partner.eu\/wp-content\/themes\/harlander\/design\/sr100.webp\" width=\"100\"\n                 height=\"100\" loading=\"lazy\" alt=\"Rechtsanwalt Sebastian Riedlmair\">\n            <span class=\"mr-quote-person-text\">\n            Sebastian Riedlmair<br>\n            <span class=\"mr-quote-person-function\">Harlander &amp; Partner Rechtsanw\u00e4lte<\/span>\n        <\/span>\n        <\/a>\n        <span class=\"mr-quote-content\">\u201eViele Miteigent\u00fcmer z\u00f6gern zu lange, dabei kann man mit einer klaren Klagestrategie oft rasch eine L\u00f6sung erreichen\u201c<\/span>\n    <\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-teilungshindernis\">Ovira za delitev<\/h2>\n\n<p class=\"wp-block-paragraph\">Na\u010deloma lahko vsak solastnik zahteva ukinitev skupnosti, kar izhaja iz <strong><a href=\"https:\/\/ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10001622&amp;Artikel=&amp;Paragraf=830&amp;Anlage=&amp;Uebergangsrecht=\">\u00a7\u202f830 ABGB<\/a><\/strong>. V dolo\u010denih situacijah pa je ta pravica lahko <strong>za\u010dasno omejena<\/strong>: Takrat govorimo o tako imenovani <strong>oviri za delitev<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-unzeit\">Neprimeren \u010das<\/h3>\n\n<p class=\"wp-block-paragraph\">O neprimernem \u010dasu govorimo, ko zunanje okoli\u0161\u010dine delitve sicer ne prepre\u010dujejo trajno, bi pa bile v danem trenutku \u0161kodljive za vse udele\u017eence.<\/p>\n\n<p class=\"wp-block-paragraph\">Neprimeren \u010das ne pomeni, da zahtevek preneha, temve\u010d le, da ga <strong>v tem trenutku ni mogo\u010de uveljaviti<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-nachteil-fur-die-ubrigen\">Slabost za ostale<\/h3>\n\n<p class=\"wp-block-paragraph\">V dolo\u010denih primerih lahko takoj\u0161nja delitev za posamezne solastnike <strong>predstavlja nesprejemljivo stisko<\/strong>. Sodi\u0161\u010de nato preveri, ali uveljavljanje delitvenega zahtevka <g id=\"gid_1\">nasprotuje na\u010delu po\u0161tenja in vestnosti<\/g>. Le \u010de je uveljavljena \u0161koda <strong>za\u010dasne narave<\/strong> in bo v doglednem \u010dasu prenehala, se lahko postopek <strong>za\u010dasno odlo\u017ei<\/strong>.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-gerichtszustandigkeit\">Pristojnost sodi\u0161\u010da<\/h2>\n\n<p class=\"wp-block-paragraph\">Pristojno je <strong>sodi\u0161\u010de v kraju nepremi\u010dnine<\/strong>. Ali odlo\u010da okrajno ali de\u017eelno sodi\u0161\u010de, je odvisno od <g id=\"gid_1\">vrednosti spora<\/g>. Pri tem ni ve\u010d odlo\u010dilna enotna vrednost, temve\u010d tako imenovana <g id=\"gid_2\">vrednost zemlji\u0161\u010da<\/g>. Ta je tudi podlaga za <strong>sodne takse<\/strong>.   <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-risiken-und-kosten\">Tveganja in stro\u0161ki<\/h2>\n\n<p class=\"wp-block-paragraph\">V delitvenem postopku so vsi sporni partnerji na\u010deloma solidarno odgovorni za stro\u0161ke postopka. Tudi tisti, ki to\u017ebo takoj prizna, bo morda moral pod dolo\u010denimi pogoji prispevati k pla\u010dilu. Na\u0161a odvetni\u0161ka pisarna v tak\u0161nih primerih namensko skrbi za individualno var\u010devanje s stro\u0161ki in procesno ekonomi\u010dno strategijo.  <\/p>\n\n<h2 class=\"wp-block-heading\"
