Z njo lahko po sodni poti dose\u017eete takoj\u0161njo zaustavitev gradnje in ustavite nadaljnja gradbena dela. Zakon jo izrecno predvideva v <g id=\"gid_1\">\u00a7 340 ABGB<\/g>. Va\u0161a prednost: Sodi\u0161\u010de v pospe\u0161enem postopku hitro odlo\u010di o ukrepu za zaustavitev gradnje in lahko takoj ukrepa, \u010de je va\u0161a posest ogro\u017eena.   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10001622&amp;Artikel=&amp;Paragraf=340&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 340 ABGB<\/a><\/strong> zagotavlja le pravico do opustitve (nadaljnje) gradnje, ne pa tudi do vzpostavitve prej\u0161njega stanja.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-voraussetzungen-fur-die-bauverbotsklage\">Pogoji za to\u017ebo za prepoved gradnje<\/h2>\n\n<p class=\"wp-block-paragraph\">Sodno lahko zahtevate zaustavitev novogradnje, \u010de ta posega v va\u0161e zemlji\u0161\u010de. Pogoj je, da razpolagate z zadevnim zemlji\u0161\u010dem in da je ta posest akutno ogro\u017eena zaradi gradnje drugega. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-besitz-oder-dingliches-recht\">Posest ali stvarna pravica<\/h3>\n\n<p class=\"wp-block-paragraph\">To\u017eba na\u010deloma pripada tistemu, ki je posestnik nepremi\u010dnine ali imetnik stvarne pravice.<\/p>\n\n<p class=\"wp-block-paragraph\">Zakon \u0161\u010diti zlasti:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>posest na <strong>nepremi\u010dnini<\/strong><\/li>\n\n\n\n<li><strong>stvarne pravice<\/strong>, kot so slu\u017enosti<\/li>\n\n\n\n<li>in njihovo varstvo \u017ee <strong>ob zgolj ogro\u017eenosti<\/strong>, ne \u0161ele ob nastali motnji<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-blosse-gefahrdung\">Zgolj ogro\u017eanje <\/h3>\n\n<p class=\"wp-block-paragraph\">Nevarnost mora nastati zaradi <strong>\u017ee za\u010dete, ne le nameravane, gradnje<\/strong> in obstajati v morebitnem <strong>motenju posesti<\/strong>. Verjetno mora izhajati iz postavitve ali obstoja samega objekta, ne zgolj iz del, ki potekajo, ali iz njegove uporabe. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-keine-wirksame-behordliche-baugenehmigung\">Brez veljavnega uradnega gradbenega dovoljenja<\/h3>\n\n<p class=\"wp-block-paragraph\">\u010ce <strong>ni veljavnega uradnega gradbenega dovoljenja<\/strong> ali niste bili <strong>pravilno vabljeni<\/strong> v postopku, imate pravico vlo\u017eiti to\u017ebo za prepoved gradnje na sodi\u0161\u010du.<\/p>\n\n<p class=\"wp-block-paragraph\">\u010ce je bil gradbeni projekt uradno odobren in niste vlo\u017eili <strong>nobenih ugovorov<\/strong> v postopku izdaje dovoljenja, praviloma izgubite pravico do to\u017ebe za prepoved gradnje. <\/p>\n<a class=\"mr-cta-link mr-cta-button-cal\" href=\"#h2-booking\" title=\"Brezpla\u010den uvodni posvet\"><span class=\"mr-cta-link-normal\">Izberite \u017eeleni termin:<\/span><span class=\"mr-cta-link-bold\">Brezpla\u010den uvodni posvet<\/span><\/a>\n\n<h2 class=\"wp-block-heading\" id=\"h-ziel-und-wirkung-der-klage\">Cilj in u\u010dinek to\u017ebe<\/h2>\n\n<p class=\"wp-block-paragraph\">S to\u017ebo za prepoved gradnje na sodi\u0161\u010du zahtevate, da se gradnja <strong>ne nadaljuje ali sploh ne za\u010dne<\/strong>. Namen postopka je hitro razjasniti zadevo. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Zaustavitev gradnje je mogo\u010de dose\u010di \u017ee v nujnem postopku<\/strong>, torej pred dokon\u010dno odlo\u010ditvijo, z <strong>za\u010dasno prepovedjo gradnje<\/strong>. V praksi se to redno zgodi v kratkem \u010dasu. <\/p>\n\n<p class=\"wp-block-paragraph\">Vendar pa odstranitev \u017ee zgrajenih delov <strong>ni predmet te to\u017ebe<\/strong>; za to bi v primeru motenja pri\u0161la v po\u0161tev to\u017eba zaradi motenja posesti.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verhaltnis-zur-besitzstorungsklage\">Razmerje do to\u017ebe zaradi motenja posesti<\/h2>\n\n<p class=\"wp-block-paragraph\">\u010ce \u017ee pride do konkretnega motenja posesti (npr. dostop, po\u0161kodba, nesprejemljiva uporaba), lahko poleg ali namesto tega vlo\u017eite to\u017ebo zaradi motenja posesti. V mnogih primerih obstajata obe pravici vzporedno. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verfahrensablauf-der-bauverbotsklage\">Potek postopka to\u017ebe za prepoved gradnje<\/h2>\n\n<p class=\"wp-block-paragraph\">To\u017ebo za prepoved gradnje vlo\u017eite v pospe\u0161enem postopku neposredno pri pristojnem sodi\u0161\u010du.<\/p>\n\n<p class=\"wp-block-paragraph\">Vlo\u017eite to\u017ebo in utemeljite, zakaj je va\u0161a posest akutno ogro\u017eena. Ker gre za nujen primer, veljajo \u0161e posebej kratki roki.  <\/p>\n\n<p class=\"wp-block-paragraph\">Sodi\u0161\u010de pogosto sprejme odlo\u010ditev brez ustne obravnave in izda sklep. \u010ce je to\u017eba ugodena, sodi\u0161\u010de izda sklep o zaustavitvi gradnje. Ta zavezuje investitorja in ostane v veljavi, dokler ni o to\u017ebi dokon\u010dno odlo\u010deno.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Pomembno:<\/strong> Varstvo posesti lahko velja celo proti \u017ee odobrenim gradbenim ukrepom, \u010de obstaja nujna potreba po ukrepanju.
