Povolenie m\u00f4\u017ee by\u0165 z\u00edskan\u00e9 od pr\u00edslu\u0161n\u00e9ho vlastn\u00edka lesa (v pr\u00edpade lesn\u00fdch ciest od spr\u00e1vcu lesnej cesty). Ak vlastn\u00edk lesa udel\u00ed s\u00fahlas pre verejnos\u0165, je to rozpoznate\u013en\u00e9 prostredn\u00edctvom pr\u00edslu\u0161n\u00e9ho zna\u010denia.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-mountainbikefahren-unter-alkoholeinfluss\">Jazda na horskom bicykli pod vplyvom alkoholu<\/h3>\n\n<p class=\"wp-block-paragraph\">Jazda na horskom bicykli (rovnako ako v\u0161eobecn\u00e1 jazda na bicykli) podlieha z\u00e1konn\u00e9mu limitu alkoholu v krvi (promile) 0,8 promile. Hrozia pr\u00e1vne d\u00f4sledky, ak pri prekro\u010den\u00ed tejto hodnoty d\u00f4jde k nehode. Ak je hodnota promile nad 1,6 promile, osoba sa ozna\u010duje ako \u201enesp\u00f4sobil\u00e1 na jazdu\u201c.   <br\/>Ak d\u00f4jde k opakovan\u00fdm poru\u0161eniam alebo mimoriadne v\u00e1\u017enej nehode, m\u00f4\u017ee by\u0165 odobrat\u00fd aj vodi\u010dsk\u00fd preukaz (motorov\u00e9ho vozidla).<\/p>\n\n<p class=\"wp-block-paragraph\">Av\u0161ak aj pri pr\u00e1vne e\u0161te nerelevantn\u00fdch hodnot\u00e1ch promile m\u00f4\u017ee by\u0165 vplyv alkoholu relevantn\u00fd v ot\u00e1zkach zodpovednosti. Ak je vinn\u00edk nehody pod vplyvom alkoholu, tak to takmer v\u017edy znamen\u00e1 hrub\u00e9 zavinenie. Vinn\u00edk nehody potom zodpoved\u00e1 pri vecn\u00fdch \u0161kod\u00e1ch za nov\u00fa hodnotu po\u0161koden\u00fdch vec\u00ed a tie\u017e za u\u0161l\u00fd zisk obete nehody.   <br\/>Ak je obe\u0165 nehody pod vplyvom alkoholu, s\u00fad \u010dasto naopak ur\u010d\u00ed spoluvinu obete nehody. N\u00e1rok obete nehody na n\u00e1hradu \u0161kody sa potom percentu\u00e1lne zn\u00ed\u017ei. <\/p>\n\n<p class=\"wp-block-paragraph\">Alkoholiz\u00e1cia m\u00e1 teda priamy vplyv na rozsah a v\u00fd\u0161ku uplat\u0148ovan\u00fdch n\u00e1rokov.<\/p>\n\n<p class=\"wp-block-paragraph\">Kto je v d\u00f4sledku vplyvu alkoholu pri jazde na horskom bicykli obmedzen\u00fd, dop\u00fa\u0161\u0165a sa navy\u0161e <strong>trestn\u00e9ho \u010dinu<\/strong> <strong>ohrozenia telesnej bezpe\u010dnosti<\/strong> \u2013 aj vtedy, ak nikto nebol zranen\u00fd. Kto v d\u00f4sledku vplyvu alkoholu zran\u00ed in\u00fdch, dop\u00fa\u0161\u0165a sa <strong>nedbanliv\u00e9ho ubl\u00ed\u017eenia na zdrav\u00ed<\/strong>, ktor\u00e9 je v d\u00f4sledku hrubo nedbanliv\u00e9ho sp\u00f4sobenia trestan\u00e9 pr\u00edsnej\u0161ie. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-mountainbikefahren-unter-drogeneinfluss\">Jazda na horskom bicykli pod vplyvom drog<\/h3>\n\n<p class=\"wp-block-paragraph\">Pre jazdu na horskom bicykli pod vplyvom drog plat\u00ed to ist\u00e9 ako pre jazdu na horskom bicykli pod vplyvom alkoholu. Jazda na horskom bicykli pod vplyvom drog m\u00f4\u017ee prinies\u0165 mas\u00edvne nev\u00fdhody tak pre vinn\u00edka nehody, ako aj pre obe\u0165 nehody. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-fehlerhafte-mountainbikeausrustung\">Chybn\u00e1 v\u00fdbava horsk\u00e9ho bicykla<\/h3>\n\n<p class=\"wp-block-paragraph\">Chyba vo v\u00fdbave horsk\u00e9ho bicykla m\u00f4\u017ee vies\u0165 k nehod\u00e1m a zraneniam. Pritom je mo\u017en\u00e9 si predstavi\u0165 nieko\u013eko kon\u0161tel\u00e1ci\u00ed: <\/p>\n\n<ol class=\"wp-block-list\">\n<li>Vlastn\u00e9 chyby<\/li>\n\n\n\n<li>Chyba predajcu horsk\u00fdch bicyklov<\/li>\n\n\n\n<li>Chyba odbornej dielne<\/li>\n\n\n\n<li>Chyba po\u017ei\u010dovne horsk\u00fdch bicyklov<\/li>\n\n\n\n<li>Chyba v\u00fdrobcu horsk\u00fdch bicyklov<\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\"><strong>Vlastn\u00e9 chyby<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">Pre cyklistov na horsk\u00fdch bicykloch neexistuj\u00fa \u0161pecifick\u00e9 povinnosti spr\u00e1vania sa, ako sa maj\u00fa stara\u0165 o svoju vlastn\u00fa bezpe\u010dnos\u0165. Predov\u0161etk\u00fdm neexistuje povinnos\u0165 nosi\u0165 prilbu alebo \u0161peci\u00e1lnu ochrann\u00fa v\u00fdstroj pre dospel\u00fdch. Pre deti do dov\u0155\u0161enia 12. roku \u017eivota je v\u0161ak nosenie ochrannej prilby pri akomko\u013evek prevoze alebo vlastnej jazde na bicykli z\u00e1konom predp\u00edsan\u00e9. Pokuty v\u0161ak pri poru\u0161en\u00ed nie s\u00fa stanoven\u00e9.    <\/p>\n\n<p class=\"wp-block-paragraph\">Je v\u0161ak potrebn\u00e9 vzia\u0165 do \u00favahy, \u017ee pri nehode bez prilby alebo ochrannej v\u00fdstroje \u2013 bez oh\u013eadu na mieru zodpovednosti in\u00fdch z\u00fa\u010dastnen\u00fdch \u2013 existuje mo\u017enos\u0165 zapo\u010d\u00edtania vlastnej spoluviny. To m\u00f4\u017ee zn\u00ed\u017ei\u0165 n\u00e1roky na n\u00e1hradu \u0161kody. <\/p>\n\n<p class=\"wp-block-paragraph\">V z\u00e1sade sa rozli\u0161uje medzi <strong>\u0161portovo ambici\u00f3znymi cyklistami<\/strong> a be\u017en\u00fdmi cestn\u00fdmi cyklistami. Najvy\u0161\u0161\u00ed s\u00fad (OGH) vo svojej judikat\u00fare vych\u00e1dza z r\u00fdchlosti a s \u0148ou spojen\u00fdch riz\u00edk neh\u00f4d, \u010do zaklad\u00e1 \u201ev\u0161eobecn\u00e9 povedomie\u201c o d\u00f4le\u017eitosti nosenia prilby (OGH 2 Ob 8\/20w).  <br\/>V jednotliv\u00fdch pr\u00edpadoch sa posudzuje skuto\u010dn\u00e1 r\u00fdchlos\u0165 jazdy a mo\u017enos\u0165 predch\u00e1dzania vzniknut\u00fdm \u0161kod\u00e1m. Takto bola s\u00fadom u\u017e odmietnut\u00e1 spoluvina aj u pretek\u00e1rskych cyklistov s ni\u017e\u0161ou r\u00fdchlos\u0165ou (15-20 km\/h).  <\/p>\n\n<p class=\"wp-block-paragraph\">Aj pokia\u013e ide o nosenie ochrannej odevu, je potrebn\u00e9 vych\u00e1dza\u0165 zo v\u0161eobecn\u00e9ho povedomia (\u0161portov\u00e9ho) okruhu. Spoluvina je Najvy\u0161\u0161\u00edm s\u00fadom (OGH) predpokladan\u00e1 v pr\u00edpade motocyklov\u00e9ho oble\u010denia pri zodpovedaj\u00facom zv\u00fd\u0161enom vlastnom ohrozen\u00ed (2 Ob 119\/15m). <\/p>\n\n<p class=\"wp-block-paragraph\">Cyklisti musia okrem toho dodr\u017eiava\u0165 aj v\u0161eobecn\u00e9 pravidl\u00e1 cestnej prem\u00e1vky.<br\/>Pod\u013ea <strong>pravidla jazdy na doh\u013ead<\/strong> sa smie jazdi\u0165 len takou r\u00fdchlos\u0165ou, aby bolo mo\u017en\u00e9 v\u010das zastavi\u0165 pred prek\u00e1\u017ekou na preh\u013eadnej vozovke. Ak sa neo\u010dak\u00e1va mimoriadna alebo \u0165a\u017eko rozpoznate\u013en\u00e1 prek\u00e1\u017eka, pravidlo jazdy na doh\u013ead je obmedzen\u00e9 z\u00e1sadou d\u00f4very. <\/p>\n\n<p class=\"wp-block-paragraph\">Kto si s\u00e1m udr\u017eiava v\u00fdbavu horsk\u00e9ho bicykla, preber\u00e1 na seba ve\u013ek\u00e9 riziko. Ak boli napr\u00edklad brzdy alebo riadenie nastaven\u00e9 svojpomocne a po\u010das jazdy d\u00f4jde k poruche a p\u00e1du, potom sa za pr\u00ed\u010dinu p\u00e1du pova\u017euje vlastn\u00e9 chybn\u00e9 nastavenie, pokia\u013e sa spadnut\u00e9mu nepodar\u00ed preuk\u00e1za\u0165 in\u00fa pr\u00ed\u010dinu. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Cudzie chyby<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">Predajcovia horsk\u00fdch bicyklov, servisy horsk\u00fdch bicyklov, po\u017ei\u010dovne horsk\u00fdch bicyklov, dovozcovia a v\u00fdrobcovia horsk\u00fdch bicyklov zodpovedaj\u00fa ako odborn\u00e9 podniky za chybn\u00fa v\u00fdbavu alebo chybn\u00e9 nastavenia.<\/p>\n\n<p class=\"wp-block-paragraph\">D\u00f4kazn\u00e9 bremeno, \u017ee chybn\u00e1 v\u00fdbava horsk\u00e9ho bicykla sp\u00f4sobila nehodu, nesie \u017ealobca a teda spravidla obe\u0165 nehody. Pritom posta\u010duje takzvan\u00fd \u201ed\u00f4kaz prima facie\u201c. D\u00f4kaz prima facie umo\u017e\u0148uje na z\u00e1klade sk\u00fasenostn\u00fdch poznatkov vyvodzova\u0165 z\u00e1very z preuk\u00e1zan\u00fdch skuto\u010dnost\u00ed na skuto\u010dnosti, ktor\u00e9 sa maj\u00fa preuk\u00e1za\u0165.   <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-verschulden-bei-organisierten-mountainbikeveranstaltungen\">Zavinenie pri organizovan\u00fdch podujatiach na horsk\u00fdch bicykloch<\/h3>\n\n<p class=\"wp-block-paragraph\">Z\u00e1sadn\u00e1 zodpovednos\u0165 vlastn\u00edka lesa za \u0161peci\u00e1lne ozna\u010den\u00e9 a vyzna\u010den\u00e9 trate pre horsk\u00e9 bicykle sa nepredpoklad\u00e1, akon\u00e1hle sa tra\u0165 pou\u017e\u00edva pre <strong>organizovan\u00e9 preteky na horsk\u00fdch bicykloch<\/strong>. V takom pr\u00edpade musia organiz\u00e1tori zabezpe\u010di\u0165, aby bola tra\u0165 pre \u00fa\u010dastn\u00edkov bezpe\u010dn\u00e1 a zabezpe\u010den\u00e1. Opravy a z\u00e1brany s\u00fa \u010fal\u0161\u00edmi prevent\u00edvnymi opatreniami, ktor\u00e9 je potrebn\u00e9 prija\u0165.   <\/p>\n\n<p class=\"wp-block-paragraph\">Okrem toho nesie organiz\u00e1tor pretekov na horsk\u00fdch bicykloch zodpovednos\u0165 za to, aby sa vyhraden\u00e1 pretek\u00e1rska tra\u0165 nach\u00e1dzala v zabezpe\u010denom stave a aby bola zriaden\u00e1 riadna z\u00e1chrann\u00e1 slu\u017eba.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-sicherung-der-waldwege-bei-erlaubnis-zum-befahren\">Zabezpe\u010denie lesn\u00fdch ciest (pri povolen\u00ed vjazdu) <\/h3>\n\n<p class=\"wp-block-paragraph\">Cyklistom na horsk\u00fdch bicykloch m\u00f4\u017ee by\u0165 povolen\u00e9 jazdi\u0165 po turistick\u00fdch chodn\u00edkoch (\u201eshared trails\u201c). Pritom je potrebn\u00e9 dodr\u017eiava\u0165 z\u00e1sadu vz\u00e1jomnej oh\u013eaduplnosti vo\u010di v\u0161etk\u00fdm ostatn\u00fdm u\u017e\u00edvate\u013eom ciest (chodci, horolezci, be\u017ek\u00e1ri). Okrem toho m\u00f4\u017eu existova\u0165 \u0161peci\u00e1lne vyzna\u010den\u00e9 trate pre horsk\u00e9 bicykle (\u201eTrails\u201c).   <\/p>\n\n<p class=\"wp-block-paragraph\">Kto jazd\u00ed na bicykli alebo horskom bicykli mimo povolen\u00fdch lesn\u00fdch ciest alebo in\u00fdch lesn\u00fdch chodn\u00edkov, kon\u00e1 v z\u00e1sade na <strong>vlastn\u00e9 riziko<\/strong>, pokia\u013e ide o stav p\u00f4dy a porastu.<\/p>\n\n<p class=\"wp-block-paragraph\">Vlastn\u00edk lesa nem\u00e1 <strong>\u017eiadnu v\u0161eobecn\u00fa povinnos\u0165<\/strong> odvraca\u0165 typick\u00e9 (lesn\u00e9) nebezpe\u010denstv\u00e1 (ako padaj\u00face kon\u00e1re, nerovnosti ter\u00e9nu at\u010f.). To plat\u00ed aj pre pr\u00edrodn\u00e9 nebezpe\u010denstvo p\u00e1du, kol\u00edzie a lav\u00edn. Tu sa zodpoved\u00e1 len v r\u00e1mci princ\u00edpu ingerencie za vytvoren\u00e9 atypick\u00e9 nebezpe\u010denstv\u00e1. Spr\u00e1vca cesty v z\u00e1sade nezodpoved\u00e1, ak sa nehoda stane na ceste, ktor\u00e1 bola <strong>nepovolene<\/strong> pou\u017e\u00edvan\u00e1 a u\u017e\u00edvate\u013eovi to bolo zrejm\u00e9 (4 Ob 200\/12h).   <\/p>\n\n<p class=\"wp-block-paragraph\">Ak v\u0161ak ide o <strong>atypick\u00e9 nebezpe\u010denstv\u00e1<\/strong> (napr. ozna\u010denie napnut\u00fdch l\u00e1n po\u010das lesn\u00fdch pr\u00e1c alebo lovu), je povinn\u00fd toto nebezpe\u010denstvo zabezpe\u010di\u0165.<br\/>Ak vlastn\u00edk lesa povolil pou\u017e\u00edvanie lesn\u00fdch a po\u013en\u00fdch ciest, zodpoved\u00e1 pod\u013ea \u00a7 1319a ABGB, pri\u010dom zodpovednos\u0165 je obmedzen\u00e1 na \u00famysel a hrub\u00fa nedbanlivos\u0165.<\/p>\n\n<p class=\"wp-block-paragraph\">Vlastn\u00edk lesa m\u00e1 v\u0161ak vy\u0161\u0161iu povinnos\u0165 starostlivosti pri <strong>vyzna\u010den\u00fdch tratiach pre horsk\u00e9 bicykle<\/strong>. Ak je tra\u0165 \u0161peci\u00e1lne ozna\u010den\u00e1 pre cyklistov na horsk\u00fdch bicykloch, mus\u00ed by\u0165 v tomto rozsahu aj bezpe\u010dn\u00e1 a dobre vidite\u013ene vyzna\u010den\u00e1.<br\/>Zdroje nebezpe\u010denstva, ako s\u00fa obzvl\u00e1\u0161\u0165 nebezpe\u010dn\u00e9 miesta, je potrebn\u00e9 zabezpe\u010di\u0165 (napr. svahy, ve\u013ek\u00e9 vo\u013en\u00e9 kamene alebo prek\u00e1\u017eky) alebo uzavrie\u0165. Zodpovednos\u0165 vlastn\u00edka lesa zah\u0155\u0148a aj pravideln\u00fa \u00fadr\u017ebu, aby sa vyl\u00fa\u010dili pr\u00edpadn\u00e9 zdroje nebezpe\u010denstva.   <br\/>Pre cyklistov na horsk\u00fdch bicykloch plat\u00ed, \u017ee na v\u0161etk\u00fdch vyzna\u010den\u00fdch tratiach pre horsk\u00e9 bicykle plat\u00ed cestn\u00fd z\u00e1kon (StVO) (okrem tzv. funparkov).<\/p>\n\n<p class=\"wp-block-paragraph\">Konkr\u00e9tny rozsah povinnosti zabezpe\u010denia prev\u00e1dzky z\u00e1vis\u00ed v\u017edy od okolnost\u00ed jednotliv\u00e9ho pr\u00edpadu. Konkr\u00e9tne je potrebn\u00e9 vych\u00e1dza\u0165 z toho, ak\u00e9 opatrenia s\u00fa pre vlastn\u00edka lesa mo\u017en\u00e9 a primeran\u00e9 na zabr\u00e1nenie nebezpe\u010denstvu. <\/p>\n\n<p class=\"wp-block-paragraph\">Je v\u0161ak potrebn\u00e9 vzia\u0165 do \u00favahy aj to, \u017ee \u00fapln\u00e1 bezpe\u010dnos\u0165 prem\u00e1vky na lesn\u00fdch a po\u013en\u00fdch cest\u00e1ch nie je dosiahnute\u013en\u00e1. Na povinnosti vlastn\u00edka lesa preto nemo\u017eno kl\u00e1s\u0165 prehnan\u00e9 po\u017eiadavky. <\/p>\n\n<p class=\"wp-block-paragraph\">Ak <strong>turistick\u00e9 zdru\u017eenie<\/strong> spr\u00edstupn\u00ed cestu na v\u0161eobecn\u00e9 pou\u017e\u00edvanie, Najvy\u0161\u0161\u00ed s\u00fad (OGH) aktu\u00e1lne rozhodol, \u017ee turistick\u00e9 zdru\u017eenie preber\u00e1 vo\u010di opr\u00e1vnen\u00fdm cyklistom funkciu (spolu)dr\u017eite\u013ea pod\u013ea \u00a7 1319a ABGB. To znamen\u00e1, \u017ee pre neho existuje povinnos\u0165 \u00fadr\u017eby a dr\u017eby pre \u00fa\u010dely cyklistiky. Turistick\u00e9 zdru\u017eenie a vlastn\u00edk lesa\/po\u013enohospod\u00e1rskej p\u00f4dy preto zodpovedaj\u00fa spolo\u010dne.   <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-mangelhafte-sonderflachen\">Chybn\u00e9 \u0161peci\u00e1lne plochy <\/h3>\n\n<p class=\"wp-block-paragraph\">K \u0161peci\u00e1lnym ploch\u00e1m patria najm\u00e4 <strong>funparky\/bikeparky<\/strong>, ozna\u010den\u00e9 trate a podobn\u00e9 zariadenia, ako aj <strong>tr\u00e9ningov\u00e9 a pretek\u00e1rske trate<\/strong>. Ur\u010dit\u00fd \u00faspech vo v\u00fdu\u010dbe sa pritom spravidla nezaru\u010duje. <\/p>\n\n<p class=\"wp-block-paragraph\">Ako ved\u013eaj\u0161ia povinnos\u0165 zo zmluvn\u00e9ho vz\u0165ahu vypl\u00fdva povinnos\u0165 zabezpe\u010di\u0165 telesn\u00fa bezpe\u010dnos\u0165 hos\u0165a. \u0160pecifikom zmluvn\u00e9ho vz\u0165ahu je vz\u0165ah nadradenosti a podradenosti medzi in\u0161truktorom horskej cyklistiky a hos\u0165om. <\/p>\n\n<p class=\"wp-block-paragraph\">Prev\u00e1dzkovate\u013e \u0161koly horskej cyklistiky zodpoved\u00e1 hos\u0165ovi za \u0161kody z neh\u00f4d po\u010das kurzu pri vlastnom zavinen\u00ed alebo pri zavinen\u00ed jeho in\u0161truktorov horskej cyklistiky zo zmluvy. Samotn\u00fd in\u0161truktor horskej cyklistiky je pomocn\u00edkom prev\u00e1dzkovate\u013ea \u0161koly horskej cyklistiky a zodpoved\u00e1 hos\u0165ovi len deliktu\u00e1lne. <\/p>\n\n<p class=\"wp-block-paragraph\">Vyl\u00fa\u010denie zodpovednosti zo strany \u0161koly horskej cyklistiky za osobn\u00e9 \u0161kody, ako s\u00fa ubl\u00ed\u017eenia na zdrav\u00ed, nie je mo\u017en\u00e9. Smiem v lese jazdi\u0165 na horskom bicykli v\u0161ade?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Nie. V lese plat\u00ed vo\u013en\u00e9 pr\u00e1vo vstupu, ale z\u00e1sadn\u00fd z\u00e1kaz jazdy. Ak v\u0161ak vlastn\u00edk lesa udel\u00ed svoj s\u00fahlas (napr. prostredn\u00edctvom zna\u010diek alebo vyzna\u010denej trasy), je jazda na horskom bicykli povolen\u00e1.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>3. Smiem jazdi\u0165 na horskom bicykli po turistick\u00fdch chodn\u00edkoch?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">V z\u00e1sade nie. Ak je v\u0161ak cesta ur\u010den\u00e1 na spolo\u010dn\u00e9 vyu\u017e\u00edvanie (zna\u010denie) alebo ako \u201etrail\u201c (teda ako trasa pre horsk\u00e9 bicykle), je jazda na horskom bicykli povolen\u00e1. Pritom je potrebn\u00e9 zoh\u013eadni\u0165 z\u00e1sadu vz\u00e1jomnej oh\u013eaduplnosti. Zn\u00ed\u017ei\u0165 r\u00fdchlos\u0165, udr\u017eiava\u0165 dostato\u010dn\u00fd odstup (aj od okrajov) a bezpe\u010dne prech\u00e1dza\u0165.    <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>4. Naozaj zodpoved\u00e1m ako cyklista na horskom bicykli s\u00e1m, ak ignorujem tabu\u013eu \u201e\u010eal\u0161ia jazda na vlastn\u00e9 riziko\u201c?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Nie. Pravidl\u00e1 zodpovednosti s\u00fa stanoven\u00e9 z\u00e1konom. Ak z\u00e1kon stanovuje, \u017ee vlastn\u00edk lesa by mal v takom pr\u00edpade nies\u0165 zodpovednos\u0165, tabu\u013ea ni\u010d nemen\u00ed na tejto pr\u00e1vnej situ\u00e1cii. Vyl\u00fa\u010denie zodpovednosti prich\u00e1dza do \u00favahy len vtedy, ak ani z\u00e1konn\u00e9 predpisy tak\u00fato zodpovednos\u0165 nepredpokladaj\u00fa.<br\/>Ak ide najm\u00e4 o vyzna\u010den\u00fa trasu pre horsk\u00e9 bicykle, vlastn\u00edk lesa je zodpovedn\u00fd aj za jej zabezpe\u010denie a \u00fadr\u017ebu. Tabu\u013ea s opa\u010dn\u00fdm vyhl\u00e1sen\u00edm (\u201ePou\u017e\u00edvanie na vlastn\u00e9 riziko\u201c) na tom ni\u010d nemen\u00ed.    <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>5. Smiem by\u0165 ako cyklista na horskom bicykli zastaven\u00fd vlastn\u00edkom lesa alebo lesn\u00edkom?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">\u00c1no aj nie. Vlastn\u00edk lesa je v\u017edy aj vlastn\u00edkom pozemku pod\u013ea Ob\u010dianskeho z\u00e1konn\u00edka (ABGB). Ten mu do ur\u010ditej miery umo\u017e\u0148uje uplat\u0148ova\u0165 \u201epr\u00e1vo na svojpomoc\u201c na ochranu majetku. Toto pr\u00e1vo sa v\u0161ak smie vykon\u00e1va\u0165 len primerane. Fyzick\u00e9 n\u00e1silie je pr\u00edpustn\u00e9 len vo v\u00fdnimo\u010dn\u00fdch pr\u00edpadoch.<br\/>Lesn\u00edci (rovnako ako lesn\u00ed robotn\u00edci, in\u00ed turisti a pod.) v\u0161ak nemaj\u00fa \u017eiadne pr\u00e1va vo\u010di cyklistom. V\u00fdnimka plat\u00ed, ak ide o org\u00e1ny lesnej str\u00e1\u017ee. Tie sm\u00fa cyklistov na horsk\u00fdch bicykloch zastavi\u0165 a primeran\u00fdm sp\u00f4sobom zisti\u0165 toto\u017enos\u0165 a poda\u0165 ozn\u00e1menie.       <br\/>Vo v\u00fdnimo\u010dn\u00fdch pr\u00edpadoch s\u00fa dokonca opr\u00e1vnen\u00ed vyk\u00e1za\u0165 osoby z lesa. Ak sa osoba tvrdo\u0161ijne odmieta, pr\u00edslu\u0161n\u00edk lesnej str\u00e1\u017ee m\u00f4\u017ee dokonca vykona\u0165 zatknutie alebo zabavenie bicykla.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>6. Mus\u00edm ako vlastn\u00edk lesa dodr\u017eiava\u0165 \u0161pecifik\u00e1 StVO, ak existuj\u00fa trasy pre horsk\u00e9 bicykle?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Najprv je potrebn\u00e9 zd\u00f4razni\u0165, \u017ee StVO plat\u00ed v\u017edy u\u017e vtedy, ke\u010f existuje cesta. Aj ke\u010f sl\u00fa\u017ei len pre pe\u0161iu dopravu, je uzn\u00e1van\u00e1 ako verejn\u00e1 cesta s verejnou dopravou. StVO sa preto v plnom rozsahu uplat\u0148uje aj na lesn\u00e9 cesty. Ak vyzna\u010d\u00edte extra trasy pre horsk\u00e9 bicykle, zost\u00e1va v platnosti z\u00e1kladn\u00e1 platnos\u0165 StVO. \u017diadne dodato\u010dn\u00e9 predpisy neprib\u00fadaj\u00fa.     <br\/>\u010eal\u0161ie povinnosti \u00fadr\u017eby a zabezpe\u010denia s\u00fa v\u0161ak zalo\u017een\u00e9 na deliktu\u00e1lnej zodpovednosti.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>7. M\u00f4\u017eem ako vlastn\u00edk lesa vyl\u00fa\u010di\u0165 platnos\u0165 StVO?<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">V z\u00e1sade nie. Pou\u017eite\u013enos\u0165 StVO na lesn\u00e9 cesty zanik\u00e1 len vtedy, ak celkovo neprebieha \u017eiadna verejn\u00e1 doprava (v\u0161eobecn\u00e1 pe\u0161ia a automobilov\u00e1 doprava).
