Creditorul urm\u0103ritor solicit\u0103 executarea silit\u0103 pentru a-\u0219i ob\u021bine crean\u021ba b\u0103neasc\u0103 restant\u0103 din veniturile ob\u021binute din activele imobiliare. Debitorul este proprietarul propriet\u0103\u021bii imobiliare care este executat\u0103 silit.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verfahrensschritte\">Pa\u0219ii procedurii<\/h2>\n\n<p class=\"wp-block-paragraph\">Procedura de executare silit\u0103 urmeaz\u0103 o desf\u0103\u0219urare clar reglementat\u0103, care duce pas cu pas de la cerere p\u00e2n\u0103 la plata final\u0103 a veniturilor din executarea silit\u0103. Pa\u0219ii centrali ai procedurii sunt: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Depunerea unei cereri de executare silit\u0103<\/li>\n\n\n\n<li>Aprobarea cererii de executare silit\u0103 \u0219i notarea ini\u021bierii procedurii de executare silit\u0103 \u00een Cartea Funciar\u0103<\/li>\n\n\n\n<li>Desemnarea unui expert care \u00eentocme\u0219te un raport de evaluare \u0219i anun\u021b\u0103 valoarea estimat\u0103<\/li>\n\n\n\n<li>Stabilirea unei date pentru licita\u021bie<\/li>\n\n\n\n<li>Desf\u0103\u0219urarea licita\u021biei<\/li>\n\n\n\n<li>Stabilirea \u0219edin\u021bei pentru distribuirea sumei ob\u021binute<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-besonderheiten\">Particularit\u0103\u021bi<\/h2>\n\n<p class=\"wp-block-paragraph\">Partea care urm\u0103re\u0219te executarea silit\u0103 trebuie s\u0103 anexeze la cererea de executare silit\u0103 o copie a titlului executoriu, eventual cu confirmarea caracterului executoriu. Numai dac\u0103 exist\u0103 deja un drept de gaj asupra propriet\u0103\u021bii imobiliare, se poate renun\u021ba la aceast\u0103 anex\u0103. <\/p>\n\n<p class=\"wp-block-paragraph\">La cerere trebuie anexat\u0103 \u0219i o list\u0103 a p\u0103r\u021bilor interesate, care s\u0103 con\u021bin\u0103 toate persoanele care au drepturi reale sau drepturi de preemp\u021biune sau de r\u0103scump\u0103rare \u00eenregistrate asupra propriet\u0103\u021bii imobiliare. Competent este tribunalul districtual care gestioneaz\u0103 Cartea Funciar\u0103. <\/p>\n\n<p class=\"wp-block-paragraph\">Dac\u0103 cererea este aprobat\u0103, instan\u021ba dispune executarea silit\u0103 a propriet\u0103\u021bii imobiliare \u0219i noteaz\u0103 ini\u021bierea procedurii \u00een Cartea Funciar\u0103.<\/p>\n\n<p class=\"wp-block-paragraph\">Aceast\u0103 <strong>notare \u00een Cartea Funciar\u0103<\/strong> are ca efect faptul c\u0103 executarea silit\u0103 poate fi pus\u0103 \u00een aplicare \u0219i \u00eempotriva proprietarilor sau dob\u00e2nditorilor de drepturi ulteriori ai propriet\u0103\u021bii imobiliare. \u00cen acela\u0219i timp, creditorul este obligat s\u0103 pl\u0103teasc\u0103 \u00een avans, \u00eentr-un termen stabilit de instan\u021b\u0103, un avans de cheltuieli, care este de obicei utilizat pentru estimarea propriet\u0103\u021bii imobiliare. Dac\u0103 nu se efectueaz\u0103 nicio plat\u0103, procedura este oprit\u0103.   <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-schatzung\">Estimare<\/h2>\n\n<p class=\"wp-block-paragraph\">Dup\u0103 ce a fost pl\u0103tit avansul de cheltuieli, proprietatea imobiliar\u0103 este estimat\u0103 de un expert numit de instan\u021b\u0103. Estimarea se bazeaz\u0103 pe Legea privind evaluarea propriet\u0103\u021bilor imobiliare (LBG). Expertul trebuie s\u0103 aplice proceduri de evaluare recunoscute, care s\u0103 corespund\u0103 stadiului actual al \u0219tiin\u021bei. \u00cen practic\u0103, sunt utilizate \u00een principal urm\u0103toarele metode:   <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Procedura valorii comparative:<\/strong> Valoarea este determinat\u0103 pe baza unor propriet\u0103\u021bi imobiliare similare, v\u00e2ndute recent.<\/li>\n\n\n\n<li><strong>Procedura valorii de randament:<\/strong> Valoarea rezult\u0103 din veniturile din chirii care pot fi ob\u021binute \u00een mod durabil.<\/li>\n\n\n\n<li><strong>Procedura valorii materiale:<\/strong> Aici, substan\u021ba cl\u0103dirii este \u00een prim-plan. Cump\u0103r\u0103torul devine proprietar direct al propriet\u0103\u021bii imobiliare executate silit, inclusiv al accesoriilor, prin adjudecare.    <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-meistbotsverteilung\">Distribuirea sumei ob\u021binute<\/h2>\n\n<p class=\"wp-block-paragraph\">C\u00e2nd o proprietate imobiliar\u0103 sau un obiect este v\u00e2ndut \u00een cadrul unei execut\u0103ri silite, creditorul urm\u0103ritor este interesat \u00een primul r\u00e2nd s\u0103 i se pl\u0103teasc\u0103 crean\u021ba restant\u0103. Veniturile din v\u00e2nzare reprezint\u0103 a\u0219a-numita sum\u0103 ob\u021binut\u0103. C\u00e2nd cump\u0103r\u0103torul pl\u0103te\u0219te aceast\u0103 sum\u0103, instan\u021ba distribuie veniturile persoanelor \u00eendrept\u0103\u021bite.  <\/p>\n\n<p class=\"wp-block-paragraph\">De \u00eendat\u0103 ce cump\u0103r\u0103torul a achitat \u00eentregul pre\u021b de achizi\u021bie, instan\u021ba dispune din oficiu o negociere cu privire la distribuirea acestei sume ob\u021binute. Pentru ca supralicitarea s\u0103 fie valabil\u0103, pre\u021bul oferit trebuie s\u0103 fie <strong>cu cel pu\u021bin un sfert mai mare<\/strong> dec\u00e2t suma ob\u021binut\u0103 ini\u021bial. \u00cen plus, ofertantul trebuie s\u0103 depun\u0103 <strong>un sfert din pre\u021bul de achizi\u021bie oferit ca garan\u021bie<\/strong> la instan\u021b\u0103. Numai atunci supralicitarea devine efectiv\u0103.   <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-eingang-mehrere-uberbote\">Primirea mai multor supralicit\u0103ri<\/h3>\n\n<p class=\"wp-block-paragraph\">Dac\u0103 exist\u0103 mai multe supralicit\u0103ri, <strong>decide valoarea ofertei<\/strong>. Cine ofer\u0103 cel mai mare pre\u021b este admis. Dac\u0103 dou\u0103 persoane ofer\u0103 aceea\u0219i sum\u0103, conteaz\u0103 cine a depus supralicitarea mai \u00eent\u00e2i.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-wirkung-des-uberbots\">Efectul supralicit\u0103rii<\/h3>\n\n<p class=\"wp-block-paragraph\">Dac\u0103 supralicitarea este acceptat\u0103 de instan\u021b\u0103 \u0219i decizia devine definitiv\u0103, executarea silit\u0103 ini\u021bial\u0103 \u00ee\u0219i pierde valabilitatea. Instan\u021ba anuleaz\u0103 prima adjudecare \u0219i acord\u0103 adjudecarea noului ofertant. Aceast\u0103 decizie este comunicat\u0103 \u00een scris at\u00e2t p\u0103r\u021bilor implicate (ofertantului, fostului cump\u0103r\u0103tor, creditorului \u0219i debitorului), c\u00e2t \u0219i public \u00een fi\u0219ierul edictelor.  <\/p>\n\n<p class=\"wp-block-paragraph\">De \u00eendat\u0103 ce instan\u021ba acord\u0103 definitiv adjudecarea dup\u0103 acceptarea unei supralicit\u0103ri, nu mai este permis\u0103 nicio alt\u0103 supralicitare. Astfel, procedura se \u00eencheie definitiv, iar noul cump\u0103r\u0103tor devine proprietarul propriet\u0103\u021bii imobiliare. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-ihre-vorteile-mit-anwaltlicher-unterstutzung\">Avantajele dumneavoastr\u0103 cu asisten\u021b\u0103 juridic\u0103<\/h2>\n\n<p class=\"wp-block-paragraph\">Un avocat v\u0103 \u00eenso\u021be\u0219te pe parcursul \u00eentregii proceduri de executare silit\u0103 \u0219i se asigur\u0103 c\u0103 cererea dumneavoastr\u0103 este \u00eendeplinit\u0103 integral \u0219i \u00een siguran\u021b\u0103 din punct de vedere juridic.
