Mai degrab\u0103, clientul dumneavoastr\u0103 are dreptul la daune-interese.   <\/p>\n\n<p>Condi\u021biile legale pentru dreptul la daune-interese sunt:<\/p>\n\n<ul class=\"wp-block-list\"><li>Daune<\/li><\/ul>\n\n<ul class=\"wp-block-list\"><li>Ilegalitate<\/li><\/ul>\n\n<ul class=\"wp-block-list\"><li>Cauzalitate<\/li><\/ul>\n\n<ul class=\"wp-block-list\"><li>Vinov\u0103\u021bie.<\/li><\/ul>\n\n<p> Dac\u0103 lipse\u0219te doar una dintre aceste condi\u021bii, nu se acord\u0103 daune-interese. <\/p>\n\n<p><strong>Daune <\/strong><\/p>\n\n<p>Legea \u00een\u021belege prin daune un &#8222;dezavantaj care a fost cauzat cuiva la avere, la drepturile sale sau la persoana sa&#8221;. Acest concept de daune este larg \u0219i include, pe l\u00e2ng\u0103 daunele tangibile, materiale (&#8222;faian\u021b\u0103 distrus\u0103&#8221;) \u0219i daunele morale (&#8222;atingere adus\u0103 onoarei&#8221;), orice afectare a s\u0103n\u0103t\u0103\u021bii, at\u00e2t de natur\u0103 fizic\u0103, c\u00e2t \u0219i psihic\u0103.  <\/p>\n\n<p><strong>Ilegalitate<\/strong><\/p>\n\n<p>Dauna trebuie s\u0103 fie ilegal\u0103. Aceasta exist\u0103 atunci c\u00e2nd persoana care ac\u021bioneaz\u0103 folose\u0219te doar ap\u0103rarea necesar\u0103 pentru a respinge un atac ilegal actual sau iminent asupra vie\u021bii, s\u0103n\u0103t\u0103\u021bii, integrit\u0103\u021bii corporale, libert\u0103\u021bii sau propriet\u0103\u021bii sale sau a altei persoane.    <\/p>\n\n<p>Dac\u0103 aceste condi\u021bii sunt \u00eendeplinite, o cerere de daune-interese \u2013 indiferent de producerea unei daune \u2013 este exclus\u0103 din lips\u0103 de ilegalitate. <\/p>\n\n<p><strong>Cauzalitate<\/strong><\/p>\n\n<p>O daun\u0103 (ilegal\u0103) poate fi imputat\u0103 doar celui a c\u0103rui ac\u021biune a fost cauzal\u0103 pentru producerea daunei \u2013 cu alte cuvinte: cel care a cauzat producerea daunei. Este de \u00een\u021beles c\u0103 acum v\u0103 g\u00e2ndi\u021bi, ridic\u00e2nd din umeri: &#8222;Ace\u0219ti juri\u0219ti \u2013 este cu siguran\u021b\u0103 \u00eentotdeauna clar cine a cauzat dauna&#8230;&#8221;.  <\/p>\n\n<p>Practica arat\u0103 c\u0103 nu este cazul. Mai ales \u00een cazul proiectelor de construc\u021bii mai mari, se discut\u0103 adesea cu \u00eenver\u0219unare \u00een fa\u021ba instan\u021bei cine a cauzat presupusa daun\u0103.  <\/p>\n\n<p><strong>Vinov\u0103\u021bie<\/strong><\/p>\n\n<p>Cea mai important\u0103 condi\u021bie a unei cereri de daune-interese este vinov\u0103\u021bia.
