Tocmai de aceea, \u00a7 9 UWG interzice ca o alt\u0103 persoan\u0103 s\u0103 utilizeze \u00een activitatea comercial\u0103 un semn similar, dac\u0103 astfel <strong>pot ap\u0103rea confuzii<\/strong>. Decisiv\u0103 nu este simpla utilizare a unui semn, ci dac\u0103 acesta <strong>ac\u021bioneaz\u0103 pentru clien\u021bi ca un indiciu de provenien\u021b\u0103<\/strong> \u0219i \u00eei face s\u0103 cread\u0103 c\u0103 serviciile provin de la compania ini\u021bial\u0103 sau de la o entitate afiliat\u0103. Aici intervine \u00a7 9 UWG: <strong>protejeaz\u0103 \u00eentreprinderile \u00eempotriva utiliz\u0103rii semnelor lor distinctive de c\u0103tre alte \u00eentreprinderi \u00eentr-un mod care genereaz\u0103 confuzii.<\/strong>  <\/p>\n\n<p class=\"wp-block-paragraph\">\u00cen esen\u021b\u0103, este vorba despre <strong>corectitudine \u00een concuren\u021b\u0103<\/strong>. Cine \u00ee\u0219i construie\u0219te o reputa\u021bie bun\u0103 de-a lungul anilor nu ar trebui s\u0103 ri\u0219te ca un ter\u021b s\u0103 o exploateze. \u00cen acela\u0219i timp, legea protejeaz\u0103 \u0219i consumatorii, deoarece ace\u0219tia se pot baza pe <strong>provenien\u021ba serviciilor<\/strong>.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-wirtschaftliche-funktion\">Func\u021bia economic\u0103<\/h3>\n\n<p class=\"wp-block-paragraph\">Cea mai important\u0103 func\u021bie a unui semn distinctiv este <strong>func\u021bia de indicare a provenien\u021bei<\/strong>. Aceasta le permite clien\u021bilor s\u0103 atribuie bunuri, servicii \u0219i \u00eentreprinderi unui anumit furnizor. Semnele distinctive creeaz\u0103 recunoa\u0219tere \u0219i ajut\u0103 la diferen\u021bierea ofertelor diferitelor \u00eentreprinderi. Tocmai aceast\u0103 func\u021bie de atribuire constituie baza protec\u021biei semnelor distinctive \u00een temeiul \u00a7 9 UWG.   <\/p>\n\n<p class=\"wp-block-paragraph\">Mai ales \u00een cazul \u00eentreprinderilor consacrate apare un avantaj considerabil: <strong>semnul distinctiv func\u021bioneaz\u0103 ca o ancor\u0103 de \u00eencredere.<\/strong> Furnizorii noi trebuie s\u0103-\u0219i c\u00e2\u0219tige mai \u00eent\u00e2i aceast\u0103 \u00eencredere, \u00een timp ce numele cunoscute creeaz\u0103 imediat recunoa\u0219tere. <\/p>\n\n<p class=\"wp-block-paragraph\">Dac\u0103 lipse\u0219te aceast\u0103 func\u021bie de indicare a provenien\u021bei, nu exist\u0103 un semn distinctiv susceptibil de protec\u021bie. \u00cen acest caz, clien\u021bii nu recunosc din partea c\u0103rei \u00eentreprinderi provine o ofert\u0103. <\/p>\n\n<p class=\"wp-block-paragraph\">Cu c\u00e2t un semn distinctiv este mai cunoscut pe pia\u021b\u0103, cu at\u00e2t mai mare este nevoia sa de protec\u021bie. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-abgrenzung-zu-markenrecht-und-firmenrecht\">Delimitarea fa\u021b\u0103 de dreptul m\u0103rcilor \u0219i dreptul firmei<\/h2>\n\n<p class=\"wp-block-paragraph\"><strong>Protec\u021bia semnelor distinctive potrivit \u00a7<\/strong> <strong>9<\/strong> <strong>UWG nu este izolat\u0103, ci face parte dintr-un sistem mai amplu de drepturi de protec\u021bie.<\/strong> \u00cen practic\u0103, se suprapun \u00een special <strong>UWG, dreptul m\u0103rcilor \u0219i dreptul firmei<\/strong>, \u00eens\u0103 urm\u0103resc abord\u0103ri diferite. Cine nu cunoa\u0219te aceste diferen\u021be ia rapid decizii gre\u0219ite. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-verhaltnis-zum-markenrecht\">Rela\u021bia cu dreptul m\u0103rcilor<\/h3>\n\n<p class=\"wp-block-paragraph\"><strong>Dreptul m\u0103rcilor protejeaz\u0103 m\u0103rcile \u00eenregistrate ca drept de protec\u021bie formal.<\/strong> Protec\u021bia apare prin <strong>\u00eenregistrarea \u00een registrul m\u0103rcilor<\/strong> \u0219i se aplic\u0103 independent de existen\u021ba unor confuzii concrete \u00een concuren\u021b\u0103.<\/p>\n\n<p class=\"wp-block-paragraph\">\u00cen acest sens, dreptul m\u0103rcilor distinge mai multe categorii de cazuri:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Semne identice pentru bunuri sau servicii identice<\/strong><\/li>\n\n\n\n<li><strong>Semne similare \u00een cazul existen\u021bei unui risc de confuzie<\/strong><\/li>\n\n\n\n<li><strong>M\u0103rci notorii<\/strong>, care sunt protejate \u0219i \u00eempotriva simplei exploat\u0103ri a reputa\u021biei<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">\u00a7 9 UWG protejeaz\u0103, dimpotriv\u0103, \u0219i semnele distinctive care nu sunt \u00eenregistrate ca m\u0103rci. Esen\u021bial este ca semnul distinctiv s\u0103 fie utilizat \u00een rela\u021biile comerciale \u0219i s\u0103 fie apt s\u0103 diferen\u021bieze o \u00eentreprindere de altele. \u00cen centrul aten\u021biei se afl\u0103 \u00eentrebarea dac\u0103 prin utilizarea unui semn similar apare un risc de confuzie.  <\/p>\n\n<p class=\"wp-block-paragraph\">Pentru practic\u0103, aceasta \u00eenseamn\u0103 c\u0103 poate exista o protec\u021bie eficient\u0103 a semnelor distinctive chiar \u0219i f\u0103r\u0103 \u00eenregistrarea m\u0103rcii. Totu\u0219i, o marc\u0103 \u00eenregistrat\u0103 ofer\u0103 o protec\u021bie mai extins\u0103 \u0219i mai u\u0219or de aplicat. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-verhaltnis-zum-firmenrecht\">Rela\u021bia cu dreptul firmei<\/h3>\n\n<p class=\"wp-block-paragraph\"><strong>Dreptul firmei protejeaz\u0103 numele oficial al unei \u00eentreprinderi \u00een rela\u021biile comerciale.<\/strong>  Firma trebuie s\u0103 se deosebeasc\u0103 de firmele deja existente \u0219i nu trebuie s\u0103 con\u021bin\u0103 informa\u021bii \u00een\u0219el\u0103toare. Scopul este de a permite o identificare clar\u0103 a companiilor.<\/p>\n\n<p class=\"wp-block-paragraph\">\u00a7 9 UWG dep\u0103\u0219e\u0219te aceast\u0103 protec\u021bie. Dispozi\u021bia acoper\u0103 nu doar firmele \u00eenregistrate, ci \u0219i alte semne distinctive care servesc \u00een concuren\u021b\u0103 ca indiciu al unei anumite \u00eentreprinderi. Acestea includ, de exemplu, sloganuri ale firmei, denumiri speciale ale \u00eentreprinderii sau domenii cu func\u021bie de semn distinctiv.  <\/p>\n\n<p class=\"wp-block-paragraph\">Chiar dac\u0103 o firm\u0103 este <strong>admisibil\u0103 din punct de vedere al dreptului firmei<\/strong>, utilizarea sa poate <strong>\u00eenc\u0103lca \u00a7 9 UWG<\/strong>. Acest lucru se \u00eent\u00e2mpl\u0103 atunci c\u00e2nd \u00een <strong>rela\u021biile comerciale duce la confuzii<\/strong> cu un <strong>semn distinctiv deja existent<\/strong>. Prin urmare, decisiv nu este doar \u00eenregistrarea \u00een registrul firmelor, ci efectul real al semnului distinctiv asupra cercurilor de public vizate.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-geschutzte-kennzeichen-im-sinne-des-nbsp-9-nbsp-uwg\">Semne distinctive protejate \u00een sensul \u00a7 9 UWG<\/h2>\n\n<p class=\"wp-block-paragraph\">\u00a7 9 UWG nu protejeaz\u0103 doar nume sau logo-uri clasice, ci o multitudine de forme de semne distinctive. Sunt protejate nu doar denumirile clasice ale \u00eentreprinderilor sau firmele, ci \u0219i alte caracteristici pe care clien\u021bii le percep ca indiciu al provenien\u021bei comerciale. <\/p>\n\n<p class=\"wp-block-paragraph\">Nu forma exterioar\u0103 a semnului distinctiv este decisiv\u0103, ci func\u021bia sa ca <strong>element de recunoa\u0219tere \u0219i diferen\u021biere<\/strong>. Legea urm\u0103re\u0219te s\u0103 \u00eempiedice ca \u00eentreprinderile s\u0103 provoace confuzii prin utilizarea unor semne distinctive similare sau s\u0103 profite de reputa\u021bia altor participan\u021bi la pia\u021b\u0103.<\/p>\n\n<p class=\"wp-block-paragraph\">\u00cen acest sens, \u00a7 9 UWG distinge \u00eentre semnele distinctive care beneficiaz\u0103 deja de protec\u021bie datorit\u0103 utiliz\u0103rii lor \u00een activitatea comercial\u0103 \u0219i cele care presupun suplimentar dob\u00e2ndirea recunoa\u0219terii pe pia\u021b\u0103:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Semne distinctive protejate direct:<\/strong> Aici intr\u0103 \u00een special <strong>numele, firma \u0219i denumirea special\u0103 a \u00eentreprinderii<\/strong>. Acestea beneficiaz\u0103 de protec\u021bie de \u00eendat\u0103 ce sunt utilizate \u00een activitatea comercial\u0103 \u0219i \u00eendeplinesc o func\u021bie de diferen\u021biere. <\/li>\n\n\n\n<li><strong>Alte forme de semne distinctive:<\/strong> Aici intr\u0103 <strong>\u00eensemnele comerciale \u0219i configura\u021biile tipice<\/strong>, precum ambalaje, culori sau prezent\u0103ri. Acestea sunt \u00eens\u0103 protejate doar dac\u0103 au <strong>recunoa\u0219tere pe pia\u021b\u0103<\/strong>. Aceasta \u00eenseamn\u0103 c\u0103 s-au impus pe pia\u021b\u0103 astfel \u00eenc\u00e2t cercurile relevante le <strong>recunosc ca semn distinctiv al unei anumite \u00eentreprinderi<\/strong>.  <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-direkt-geschutzte-kennzeichen\">Semne distinctive protejate direct<\/h3>\n\n<p class=\"wp-block-paragraph\">Semnele distinctive protejate direct constituie baza central\u0103 a protec\u021biei semnelor distinctive \u00een temeiul \u00a7 9 UWG. Aici intr\u0103, \u00een special, <strong>numele, firma \u0219i denumirea special\u0103 a \u00eentreprinderii<\/strong>. Aceste semne distinctive trebuie s\u0103 fie apte s\u0103 <strong>indice o anumit\u0103 \u00eentreprindere<\/strong> \u0219i s\u0103 aib\u0103 o <strong>capacitate de diferen\u021biere<\/strong> suficient\u0103.  <\/p>\n\n<p class=\"wp-block-paragraph\">Protec\u021bia nu ia na\u0219tere abia prin \u00eenregistrare, ci deja prin <strong>utilizarea efectiv\u0103 \u00een activitatea comercial\u0103<\/strong>. Domeniul este ulterior <strong>v\u00e2ndut<\/strong> <strong>cu profit <\/strong>titularilor drepturilor. \u00cen plus, se \u00eencearc\u0103 astfel redirec\u021bionarea vizitatorilor c\u0103tre propriile oferte sau profitarea de notorietatea semnului distinctiv str\u0103in.  <\/p>\n\n<p class=\"wp-block-paragraph\">Totu\u0219i, nu orice \u00eenregistrare a unui domeniu asem\u0103n\u0103tor este automat ilegal\u0103. Pe l\u00e2ng\u0103 protec\u021bia semnelor distinctive conform \u00a7 9 UWG, pot fi luate \u00een considerare, \u00een special, <strong>dreptul la nume conform \u00a7<\/strong> <strong>43<\/strong> <strong>ABGB<\/strong>, precum \u0219i, \u00een cazul m\u0103rcilor \u00eenregistrate, <strong>Legea privind protec\u021bia m\u0103rcilor (MSchG)<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">Companiile afectate pot solicita, printre altele, \u00eencetarea utiliz\u0103rii, eliberarea sau transferul domeniului, precum \u0219i, dac\u0103 este cazul, desp\u0103gubiri.
