concuren\u021ba sau s\u0103 modifice substan\u021bial comportamentul economic al consumatorilor<\/strong>. Scopul normei este <strong>protejarea unei concuren\u021be loiale bazate pe performan\u021b\u0103<\/strong>. Companiile ar trebui s\u0103 se impun\u0103 pe pia\u021b\u0103 <strong>prin calitate, pre\u021b \u0219i performan\u021b\u0103<\/strong>, \u0219i nu prin metode str\u0103ine concuren\u021bei, cum ar fi \u00een\u0219el\u0103ciunea, presiunea sau exploatarea unor pozi\u021bii speciale pe pia\u021b\u0103. La evaluarea neloialit\u0103\u021bii se examineaz\u0103 <strong>dac\u0103 o ac\u021biune, prin caracterul s\u0103u general, este apt\u0103 s\u0103 denatureze concuren\u021ba<\/strong>. Dispozi\u021bia reglementeaz\u0103 condi\u021biile \u00een care practicile comerciale neloiale sau <strong>alte fapte neloiale<\/strong> sunt anticoncuren\u021biale. Sunt proteja\u021bi at\u00e2t concuren\u021bii, c\u00e2t \u0219i consumatorii.  <\/p>\n\n<p>Norma distinge \u00eentre dou\u0103 direc\u021bii de protec\u021bie. <strong>Art. 1 alin. 1 pct. 1 UWG <\/strong> protejeaz\u0103 concuren\u021ba loial\u0103 \u00eentre \u00eentreprinderi. Un comportament este anticoncuren\u021bial dac\u0103 este susceptibil s\u0103 influen\u021beze concuren\u021ba \u00een detrimentul altor \u00eentreprinderi nu doar \u00een mod nesemnificativ.  <strong>Art. 1 alin. 1 pct. 2 UWG <\/strong> serve\u0219te, \u00een schimb, protec\u021biei consumatorilor. Aici, accentul este pus pe influen\u021barea substan\u021bial\u0103 a comportamentului economic al consumatorului mediu. <\/p>\n\n<p>alin. 1 constituie, \u00een acela\u0219i timp, <strong>dispozi\u021bia de acoperire<\/strong> a UWG. Prin aceasta pot fi incluse \u0219i comportamente care nu sunt reglementate \u00een mod expres \u00een dispozi\u021bii speciale.  Clauza general\u0103 este \u00eens\u0103 completat\u0103 \u0219i concretizat\u0103 prin dispozi\u021bii speciale<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-abs-2-verbraucherleitbildung-und-besonders-schutzbedurftige-verbrauchergruppen\">alin. 2 \u2013 Orientarea consumatorilor \u0219i grupuri de consumatori cu nevoi speciale de protec\u021bie<\/h3>\n\n<p>alin. 2 reglementeaz\u0103 <strong>modelul consumatorului<\/strong> din UWG. La evaluarea unei practici comerciale, trebuie s\u0103 se ia \u00een considerare consumatorul mediu. Se \u00een\u021belege un <strong>consumator mediu informat, rezonabil \u0219i atent \u00een mod adecvat situa\u021biei<\/strong>.  <\/p>\n\n<p>Dac\u0103 o practic\u0103 comercial\u0103 se adreseaz\u0103 unui <strong>grup specific de consumatori<\/strong>, trebuie s\u0103 se ia \u00een considerare membrul mediu al acestui grup. Acest lucru se aplic\u0103, de exemplu, \u00een cazul publicit\u0103\u021bii c\u0103tre cercuri profesionale sau anumite grupe de v\u00e2rst\u0103. <\/p>\n\n<p>De o importan\u021b\u0103 deosebit\u0103 sunt, de asemenea, <strong>grupurile de consumatori vulnerabile<\/strong>. Dispozi\u021bia clarific\u0103 faptul c\u0103 <strong>practicile comerciale agresive \u0219i \u00een\u0219el\u0103toare<\/strong> sunt considerate neloiale \u00een orice caz. <\/p>\n\n<p>\u00cen acest sens, alin. 3 face trimitere la reglement\u0103rile speciale ale <a href=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P1a\/NOR40187729\" type=\"link\" id=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P1a\/NOR40187729\" target=\"_blank\" rel=\"noreferrer noopener\">art. 1a UWG<\/a> privind practicile comerciale agresive, precum \u0219i la <a href=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P2\/NOR40245448\" type=\"link\" id=\"https:\/\/www.ris.bka.gv.at\/eli\/bgbl\/1984\/448\/P2\/NOR40245448\" target=\"_blank\" rel=\"noreferrer noopener\">art. 2 UWG<\/a> privind practicile comerciale \u00een\u0219el\u0103toare. <strong>Practicile comerciale agresive<\/strong> exist\u0103 atunci c\u00e2nd consumatorii sunt afecta\u021bi \u00een libertatea lor de decizie prin presiune, h\u0103r\u021buire sau influen\u021b\u0103 nejustificat\u0103. <strong>Practicile comerciale \u00een\u0219el\u0103toare<\/strong> vizeaz\u0103 \u00een special informa\u021bii false sau \u00een\u0219el\u0103toare fa\u021b\u0103 de participan\u021bii pe pia\u021b\u0103. <\/p>\n\n<p>Enumerarea nu este \u00eens\u0103 exhaustiv\u0103. \u0218i alte practici comerciale pot fi neloiale conform art. 1 UWG, dac\u0103 \u00eencalc\u0103 cerin\u021bele unei concuren\u021be loiale. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-abs-4-begriffsdefinitionen\">alin. 4 \u2013 Defini\u021bii<\/h3>\n\n<p>alin. 4 con\u021bine defini\u021biile centrale ale termenilor din art. 1 UWG. Dispozi\u021bia serve\u0219te la asigurarea unei \u00een\u021belegeri unitare a termenilor esen\u021biali ai dreptului concuren\u021bei loiale. <\/p>\n\n<p>Sunt defini\u021bi urm\u0103torii termeni:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Produs<\/li>\n\n\n\n<li>Practic\u0103 comercial\u0103<\/li>\n\n\n\n<li>Influen\u021barea substan\u021bial\u0103 a comportamentului economic al consumatorului<\/li>\n\n\n\n<li>Cod de conduit\u0103<\/li>\n\n\n\n<li>Invita\u021bie la cump\u0103rare<\/li>\n\n\n\n<li>Influen\u021barea nejustificat\u0103 a unui consumator<\/li>\n\n\n\n<li>Decizia comercial\u0103 a unui consumator<\/li>\n\n\n\n<li>Diligen\u021ba profesional\u0103<\/li>\n\n\n\n<li>Clasament<\/li>\n\n\n\n<li>Pia\u021b\u0103 online<\/li>\n<\/ul>\n\n<p><strong>Produs<\/strong><br\/>Ca produs nu este considerat\u0103 doar o marf\u0103, ci practic tot ceea ce poate fi oferit sau v\u00e2ndut. Aceasta include \u0219i servicii, imobile, con\u021binut digital, drepturi sau obliga\u021bii. <\/p>\n\n<p><strong>Practic\u0103 comercial\u0103<\/strong><br\/>O practic\u0103 comercial\u0103 este orice comportament al unei \u00eentreprinderi legat de publicitate, v\u00e2nzare sau comercializarea unui produs. Aceasta include, de exemplu, anun\u021buri publicitare, promo\u021bii de v\u00e2nzare sau m\u0103suri de marketing. <\/p>\n\n<p><strong>Influen\u021barea substan\u021bial\u0103 a comportamentului economic al consumatorului<\/strong><br\/>Se \u00een\u021belege o influen\u021bare prin care consumatorii nu \u00ee\u0219i mai pot lua decizia liber \u0219i informat. Consumatorul ar trebui astfel s\u0103 fie determinat s\u0103 ia o decizie pe care altfel nu ar fi luat-o. <\/p>\n\n<p><strong>Cod de conduit\u0103<\/strong><br\/>Un cod de conduit\u0103 este un set voluntar de reguli pentru \u00eentreprinderi. Prin acesta, \u00eentreprinderile sau sectoare \u00eentregi se angajeaz\u0103 s\u0103 respecte anumite standarde de comportament. <\/p>\n\n<p><strong>Invita\u021bie la cump\u0103rare<\/strong><br\/>Prin aceasta se \u00een\u021belege publicitatea sau ofertele \u00een care un produs, \u00eempreun\u0103 cu pre\u021bul, este prezentat astfel \u00eenc\u00e2t consumatorii s\u0103 poat\u0103 cump\u0103ra direct.<\/p>\n\n<p><strong>Influen\u021barea nejustificat\u0103 a unui consumator<\/strong><br\/>Aceasta exist\u0103 atunci c\u00e2nd o \u00eentreprindere exercit\u0103 presiune asupra consumatorilor sau \u00ee\u0219i exploateaz\u0103 pozi\u021bia pentru a le restr\u00e2nge libertatea de decizie.<\/p>\n\n<p><strong>Decizia comercial\u0103 a unui consumator<\/strong><br\/>Aceasta include orice decizie a unui consumator \u00een leg\u0103tur\u0103 cu un produs. Relevant este dac\u0103 un comportament particip\u0103 la via\u021ba economic\u0103 \u00een exterior \u0219i are un referent obiectiv comercial. <\/p>\n\n<p>Nu este necesar\u0103 inten\u021bia de a ob\u021bine profit. Acest lucru este valabil \u00eens\u0103 doar \u00een domeniul <strong>administra\u021biei economiei private<\/strong>. Activit\u0103\u021bile \u00een cadrul administra\u021biei suverane nu intr\u0103 sub inciden\u021ba UWG.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-begriff-der-geschaftspraktik\">No\u021biunea de practic\u0103 comercial\u0103<\/h3>\n\n<p>O practic\u0103 comercial\u0103 exist\u0103 atunci c\u00e2nd o \u00eentreprindere <strong>ac\u021bioneaz\u0103 \u00een rela\u021biile comerciale<\/strong>, adic\u0103 ia m\u0103suri care au leg\u0103tur\u0103 cu <strong>publicitatea, marketingul, v\u00e2nzarea sau promovarea produselor sau serviciilor<\/strong>.<\/p>\n\n<p>Acestea nu includ doar reclamele clasice. Multe alte ac\u021biuni pot constitui o practic\u0103 comercial\u0103, printre altele <strong>m\u0103suri de marketing, strategii de v\u00e2nzare sau declara\u021bii publice despre produse<\/strong>. Esen\u021bial este doar ca comportamentul <strong>s\u0103 aib\u0103 o leg\u0103tur\u0103 cu concuren\u021ba pe pia\u021b\u0103<\/strong>.  <\/p>\n\n<p>Exemple tipice de practici comerciale sunt:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Publicitatea pentru produse sau servicii<\/strong>, de exemplu pe site-uri web, \u00een re\u021belele sociale sau \u00een mass-media tip\u0103rit\u0103<\/li>\n\n\n\n<li><strong>Ac\u021biuni de pre\u021b sau campanii de reduceri<\/strong> care urm\u0103resc s\u0103 determine clien\u021bii s\u0103 cumpere<\/li>\n\n\n\n<li><strong>Declara\u021bii despre produsele concuren\u021bei<\/strong> care fac ca propria ofert\u0103 s\u0103 par\u0103 mai atractiv\u0103<\/li>\n<\/ul>\n\n<p>Chiar \u0219i m\u0103suri aparent mici pot fi relevante din punct de vedere juridic. Deja un singur slogan publicitar, o indica\u021bie neclar\u0103 a pre\u021bului sau o descriere ambigu\u0103 a produsului poate fi considerat\u0103 o practic\u0103 comercial\u0103.  <\/p>\n\n<p>Pentru ca o practic\u0103 comercial\u0103 s\u0103 fie calificat\u0103 drept neloial\u0103, comportamentul unei \u00eentreprinderi \u00een concuren\u021b\u0103 trebuie <strong>s\u0103 \u00eencalce regulile unui comportament corect pe pia\u021b\u0103<\/strong> \u0219i astfel <strong>s\u0103 dezavantajeze concuren\u021bii sau consumatorii<\/strong>. Pentru a evalua acest lucru, legiuitorul a introdus standardul diligentei profesionale. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-begriff-der-unlauterkeit\">No\u021biunea de neloialitate<\/h3>\n\n<p>Ac\u021bioneaz\u0103 neloial cel care, \u00een concuren\u021b\u0103, adopt\u0103 comportamente care contravin principiilor unei concuren\u021be loiale bazate pe performan\u021b\u0103.<\/p>\n\n<p>Dreptul concuren\u021bei loiale porne\u0219te de la premisa c\u0103 \u00eentreprinderile ar trebui s\u0103 se impun\u0103 \u00een concuren\u021b\u0103 prin <strong>pre\u021b, calitate \u0219i performan\u021b\u0103<\/strong>. Relevant\u0103 nu este doar protec\u021bia concuren\u021bilor, ci \u0219i protec\u021bia consumatorilor, precum \u0219i func\u021bionalitatea concuren\u021bei \u00een ansamblu. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-massstab-der-beruflichen-sorgfalt\">Standardul diligentei profesionale<\/h4>\n\n<p>Dac\u0103 o practic\u0103 comercial\u0103 este neloial\u0103 \u0219i, prin urmare, inadmisibil\u0103, legea o evalueaz\u0103 pe baza <strong>diligentei profesionale<\/strong>. Aceasta include, \u00een special, ca informa\u021biile s\u0103 fie prezentate corect \u0219i ca clien\u021bii <strong>s\u0103 nu primeasc\u0103 impresii \u00een\u0219el\u0103toare sau manipulative<\/strong>.   <\/p>\n\n<p>Standardul diligen\u021bei profesionale cere:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>informa\u021bii clare \u0219i veridice despre produse sau servicii<\/strong><\/li>\n\n\n\n<li><strong>stabilirea transparent\u0103 a pre\u021burilor \u0219i oferte comprehensibile<\/strong><\/li>\n\n\n\n<li><strong>comunicare corect\u0103 fa\u021b\u0103 de consumatori \u0219i concuren\u021bi<\/strong><\/li>\n<\/ul>\n\n<p>Diligen\u021ba profesional\u0103 este, \u00een primul r\u00e2nd, elementul constitutiv central al art. 1 alin. 1 pct. 2 UWG, adic\u0103 \u00een cazul practicilor comerciale neloiale fa\u021b\u0103 de consumatori. Acolo, legea cere \u00een mod expres ca practica comercial\u0103 s\u0103 contravin\u0103 cerin\u021belor diligen\u021bei profesionale.  <\/p>\n\n<p>Instan\u021bele verific\u0103 \u00een <strong>fiecare caz \u00een parte<\/strong> dac\u0103 o \u00eentreprindere a respectat <strong>cerin\u021bele de diligen\u021b\u0103<\/strong> uzuale \u00een afaceri. Un comportament este <strong>anticoncuren\u021bial<\/strong> dac\u0103 este susceptibil s\u0103 <strong>influen\u021beze<\/strong> <strong>concuren\u021ba<\/strong> \u00een detrimentul altor \u00eentreprinderi <strong>nu doar \u00een mod nesemnificativ<\/strong>. Dreptul concuren\u021bei loiale nu intervine, prin urmare, la fiecare neregul\u0103 minor\u0103, ci doar la comportamente care pot avea efecte semnificative asupra condi\u021biilor de concuren\u021b\u0103.  <\/p>\n\n<p>Decisiv nu este dac\u0103 a avut loc deja un prejudiciu. Este suficient ca <strong>comportamentul s\u0103 fie obiectiv susceptibil<\/strong> s\u0103 influen\u021beze concuren\u021ba. Deja posibilitatea ca fluxurile de clien\u021bi s\u0103 fie deviate sau concuren\u021bii s\u0103 fie dezavantaja\u021bi economic poate fi suficient\u0103.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-z-2-beeinflussung-des-wirtschaftlichen-verhaltens-des-durchschnittsverbrauchers\">Pct. 2: Influen\u021barea comportamentului economic al consumatorului mediu<\/h3>\n\n<p>\u00cen <strong>\u00a7 1 UWG<\/strong>, <strong>protec\u021bia consumatorilor<\/strong> joac\u0103, de asemenea, un rol important. Legea pune \u00een principal \u00eentrebarea: <strong>Poate o practic\u0103 comercial\u0103 s\u0103 influen\u021beze \u00een mod semnificativ decizia unui consumator?<\/strong> Dac\u0103 o m\u0103sur\u0103 publicitar\u0103 sau o metod\u0103 de v\u00e2nzare determin\u0103 un client <strong>s\u0103 ia o decizie pe care nu ar fi luat-o f\u0103r\u0103 aceast\u0103 m\u0103sur\u0103<\/strong>, poate exista o practic\u0103 comercial\u0103 neloial\u0103. <\/p>\n\n<p>Nu conteaz\u0103 dac\u0103 <strong>sunt afectate foarte multe persoane<\/strong>. Se ia \u00een considerare un consumator mediu informat, atent \u0219i prudent \u00een mod rezonabil. O m\u0103sur\u0103 poate fi problematic\u0103 din punct de vedere juridic dac\u0103 este susceptibil\u0103 s\u0103 <strong>influen\u021beze semnificativ decizia consumatorilor individuali<\/strong>. Esen\u021bial este, prin urmare, dac\u0103 o \u00eentreprindere, prin comportamentul s\u0103u, <strong>denatureaz\u0103 decizia liber\u0103 a unui client<\/strong>.   <\/p>\n\n<p>Situa\u021bii tipice \u00een care comportamentul economic al consumatorilor poate fi influen\u021bat sunt, de exemplu:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>indica\u021bii incorecte sau neclare despre pre\u021bul sau calitatea unui produs<\/strong><\/li>\n\n\n\n<li><strong>presiune puternic\u0103 \u00een conversa\u021bia de v\u00e2nzare<\/strong><\/li>\n\n\n\n<li><strong>informa\u021bii importante nu sunt dezv\u0103luite \u00eenainte de cump\u0103rare<\/strong><\/li>\n<\/ul>\n\n<p>Dreptul concuren\u021bei dore\u0219te astfel s\u0103 asigure c\u0103 consumatorii <strong>\u00ee\u0219i pot lua deciziile \u00een mod liber \u0219i informat<\/strong>. \u00centreprinderile trebuie s\u0103 conving\u0103 clien\u021bii <strong>prin performan\u021b\u0103, calitate \u0219i informa\u021bii transparente<\/strong>, nu prin \u00een\u0219el\u0103ciune sau presiune inadecvat\u0103. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-fallgruppen-sonstiger-unlauteren-geschaftspraktiken\">Categorii de cazuri de alte practici comerciale neloiale<\/h2>\n\n<p>Pentru a face mai u\u0219or de \u00een\u021beles numeroasele decizii judec\u0103tore\u0219ti care intr\u0103 sub inciden\u021ba clauzei generale a art. 1 alin. 1 UWG, \u00een jurispruden\u021b\u0103 s-a dezvoltat o clasificare \u00een <strong>grupuri tipice de cazuri<\/strong>. Aceste grupuri de cazuri ajut\u0103 la identificarea \u0219i clasificarea \u00eenc\u0103lc\u0103rilor concuren\u021bei.  <\/p>\n\n<p>Se disting patru domenii centrale:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Atragerea clien\u021bilor<\/strong><\/li>\n\n\n\n<li><strong>Obstruc\u021bionarea concuren\u021bilor<\/strong><\/li>\n\n\n\n<li><strong>Exploatarea presta\u021biilor altuia<\/strong><\/li>\n\n\n\n<li><strong>\u00cenc\u0103lcarea legii \u00een concuren\u021b\u0103<\/strong><\/li>\n<\/ul>\n\n<p>\u00cen acest sens, art. 1 alin. 1 pct. 1 UWG vizeaz\u0103 \u00een special comportamentele care afecteaz\u0103 concuren\u021ba \u00eentre \u00eentreprinderi sau dezavantajeaz\u0103 concuren\u021bii. Acestea includ grupurile de cazuri de <strong>obstacolare, exploatarea serviciilor str\u0103ine, precum \u0219i \u00eenc\u0103lcarea legii<\/strong>.  <\/p>\n\n<p>Art. 1 alin. 1 pct. 2 UWG protejeaz\u0103, \u00een schimb, consumatorii de practicile comerciale neloiale. \u00cen centrul aten\u021biei se afl\u0103 practicile comerciale care sunt susceptibile s\u0103 influen\u021beze \u00een mod substan\u021bial comportamentul economic al consumatorilor. Aceasta include grupul de cazuri de <strong>atragere neloial\u0103 de clien\u021bi<\/strong>.   <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-kundenfang\">Atragerea clien\u021bilor<\/h3>\n\n<p>Prin <strong>atragere de clien\u021bi<\/strong> se \u00een\u021beleg practicile comerciale care vizeaz\u0103 <strong>determinarea consumatorilor<\/strong>, \u00eentr-un mod nesubstan\u021bial sau inadecvat, <strong>s\u0103 \u00eencheie un contract<\/strong>. Publicitatea \u0219i abordarea \u021bintit\u0103 a clien\u021bilor sunt, \u00een principiu, permise \u0219i o component\u0103 esen\u021bial\u0103 a concuren\u021bei. <strong>Anticoncuren\u021bial\u0103<\/strong> devine atragerea de clien\u021bi, \u00eens\u0103, atunci c\u00e2nd libertatea de decizie a consumatorilor este afectat\u0103 sau se exercit\u0103 presiune nesubstan\u021bial\u0103. <\/p>\n\n<p><strong>Cazuri tipice<\/strong> sunt m\u0103surile publicitare \u00een\u0219el\u0103toare, constr\u00e2ngerea psihic\u0103 la cump\u0103rare, metodele agresive de v\u00e2nzare sau publicitatea intruziv\u0103. De asemenea, invita\u021biile la evenimente de v\u00e2nzare concepute \u00een mod \u00een\u0219el\u0103tor sau publicitatea ascuns\u0103 pot intra sub inciden\u021ba acestui grup de cazuri. <\/p>\n\n<p>Concuren\u021ba ar trebui s\u0103 fie decis\u0103 prin <strong>pre\u021b, calitate \u0219i performan\u021b\u0103<\/strong>. Dac\u0103 <strong>consumatorul nu \u00ee\u0219i mai poate lua decizia liber \u0219i obiectiv<\/strong>, ci este ghidat de presiune, \u00een\u0219el\u0103ciune sau alte influen\u021be nesubstan\u021biale, exist\u0103 o <strong>atragere neloial\u0103 de clien\u021bi<\/strong>.  <\/p>\n\n<p>Grupul de cazuri protejeaz\u0103, prin urmare, at\u00e2t <strong>libertatea de decizie<\/strong> a consumatorilor, c\u00e2t \u0219i <strong>concuren\u021ba loial\u0103 bazat\u0103 pe performan\u021b\u0103<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-behinderung-von-mitbewerbern\">Obstruc\u021bionarea concuren\u021bilor<\/h3>\n\n<p><strong>Categoria de cazuri a obstruc\u021bion\u0103rii<\/strong> cuprinde comportamente prin care concuren\u021bii sunt afecta\u021bi \u00een mod deliberat \u00een dezvoltarea lor economic\u0103. Comportamentul este inadmisibil atunci c\u00e2nd nu mai este vorba de propria performan\u021b\u0103, ci de prejudicierea sau eliminarea inten\u021bionat\u0103 a unui concurent. <\/p>\n\n<p><strong>Cazurile tipice<\/strong> de obstruc\u021bionare sunt m\u0103surile de boicot, denigrarea nejustificat\u0103 a concuren\u021bilor, reducerile agresive de pre\u021buri sau a\u0219a-numitul \u201edomain-grabbing\u201d. De asemenea, interceptarea inten\u021bionat\u0103 a clien\u021bilor imediat \u00eenainte de magazinul unui concurent poate fi contrar\u0103 concuren\u021bei. <\/p>\n\n<p><strong>Obstruc\u021bionarea este contrar\u0103 concuren\u021bei<\/strong>, deoarece concuren\u021ba nu mai este condus\u0103 prin propria performan\u021b\u0103, ci prin afectarea inten\u021bionat\u0103 a unui concurent. Concuren\u021ba bazat\u0103 pe performan\u021b\u0103 ar trebui s\u0103 decid\u0103 ce companie se impune pe pia\u021b\u0103.
