C\u00e9lja lehet a hozz\u00e1tartoz\u00f3k vagy m\u00e1s szem\u00e9lyek p\u00e9nz\u00fcgyi t\u00e1mogat\u00e1sa az \u00f6r\u00f6kl\u00e9s el\u0151tt, ad\u00f3kedvezm\u00e9nyek kihaszn\u00e1l\u00e1sa, vagy a csal\u00e1di vagyon c\u00e9lzott meg\u0151rz\u00e9se. Ez a vagyon\u00e1truh\u00e1z\u00e1si forma nemcsak jogilag, hanem gyakran \u00e9rzelmileg is jelent\u0151s, mivel befoly\u00e1solja az aj\u00e1nd\u00e9koz\u00f3 mozg\u00e1ster\u00e9t \u00e9s a megaj\u00e1nd\u00e9kozott biztons\u00e1g\u00e1t.  <\/p>\n\n<div class=\"wp-block-uagb-container uagb-block-3019fe8e alignfull uagb-is-root-container\">\n<div class=\"wp-block-uagb-container uagb-block-32585033\">\n<p class=\"wp-block-paragraph\">Az \u00e9letk\u00f6zbeni aj\u00e1nd\u00e9koz\u00e1s vagyon vagy jogok ingyenes \u00e1truh\u00e1z\u00e1sa \u00e9l\u0151 szem\u00e9lyek k\u00f6z\u00f6tt, gyakran korai t\u00e1mogat\u00e1s vagy biztos\u00edt\u00e1s c\u00e9lj\u00e1b\u00f3l.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-container uagb-block-45819ab6\"><picture>\n\t\t<source srcset=\"https:\/\/harlander-partner.eu\/wp-content\/uploads\/Schenkung-zu-Lebzeiten-352x198.webp\" >\n\t\t<img decoding=\"async\" class=\"mr-picture-small\" src=\"https:\/\/harlander-partner.eu\/wp-content\/uploads\/Schenkung-zu-Lebzeiten.webp\" alt=\"\u00c9letk\u00f6zbeni aj\u00e1nd\u00e9koz\u00e1s magyar\u00e1zata: jogi alapok, tipikus kock\u00e1zatok \u00e9s az el\u0151rehozott \u00f6r\u00f6kl\u00e9s el\u0151nyei Ausztri\u00e1ban.\" >\n\t<\/picture>\n<\/div>\n<\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-wesentliche-rechtliche-grundlagen\">L\u00e9nyeges jogi alapok<\/h2>\n\n<p class=\"wp-block-paragraph\">Ausztri\u00e1ban m\u00e1r nem kell aj\u00e1nd\u00e9koz\u00e1si ad\u00f3t fizetni. Ennek ellen\u00e9re bejelent\u00e9st kell tenni az ad\u00f3hivatalnak, ha bizonyos \u00e9rt\u00e9khat\u00e1rokat t\u00fall\u00e9pnek. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Kiv\u00e9telek<\/strong>: Bizonyos alkalmi aj\u00e1nd\u00e9kok (pl. sz\u00fclet\u00e9snapi vagy \u00e9retts\u00e9gi aj\u00e1nd\u00e9kok \u00e9vi 1.000 eur\u00f3ig), valamint a lak\u00e1sszerz\u00e9sre ir\u00e1nyul\u00f3 aj\u00e1nd\u00e9koz\u00e1sok egy\u00e9rtelm\u0171 felt\u00e9telek mellett bejelent\u00e9smentesek. Az ingatlanok nem tartoznak a bejelent\u00e9si k\u00f6telezetts\u00e9g al\u00e1, mivel az ad\u00f3hivatal azokat az ingatlan\u00e1truh\u00e1z\u00e1si ad\u00f3n kereszt\u00fcl tartja nyilv\u00e1n. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>\u00c1ltal\u00e1nos bejelent\u00e9si k\u00f6telezetts\u00e9g<\/strong>: Ing\u00f3 vagyont\u00e1rgyakat, mint k\u00e9szp\u00e9nz, \u00e9kszer, takar\u00e9kbet\u00e9tk\u00f6nyv, t\u00e1rsas\u00e1gi r\u00e9szesed\u00e9s vagy jogok, be kell jelenteni az ad\u00f3hivatalnak, ha \u00e9rt\u00e9k\u00fck \u00f6t \u00e9ven bel\u00fcl el\u00e9ri a 15.000 eur\u00f3t.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Emelt \u00e9rt\u00e9khat\u00e1r hozz\u00e1tartoz\u00f3k eset\u00e9n<\/strong>: K\u00f6zeli hozz\u00e1tartoz\u00f3knak t\u00f6rt\u00e9n\u0151 aj\u00e1nd\u00e9koz\u00e1s eset\u00e9n \u00e9vi <strong>50.000 eur\u00f3t\u00f3l<\/strong> \u00e9rv\u00e9nyes a bejelent\u00e9si k\u00f6telezetts\u00e9g.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-pflichtteil-und-schenkungspflichtteil\">K\u00f6telesr\u00e9sz \u00e9s aj\u00e1nd\u00e9koz\u00e1si k\u00f6telesr\u00e9sz<\/h2>\n\n<p class=\"wp-block-paragraph\">Az aj\u00e1nd\u00e9koz\u00e1sok befoly\u00e1solhatj\u00e1k az \u00f6r\u00f6k\u00f6s\u00f6k <strong><a href=\"https:\/\/harlander-partner.eu\/hu\/oroklesi-jog-vagyonrendezes\/kotelesresz-joga\/\">k\u00f6telesr\u00e9sz-ig\u00e9ny\u00e9t<\/a><\/strong>. H\u00e1zast\u00e1rsak, bejegyzett \u00e9lett\u00e1rsak \u00e9s gyermekek k\u00f6vetelhetik, hogy bizonyos aj\u00e1nd\u00e9koz\u00e1sokat vegyenek figyelembe a k\u00f6telesr\u00e9sz sz\u00e1m\u00edt\u00e1s\u00e1n\u00e1l. <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Nem <strong><a href=\"https:\/\/harlander-partner.eu\/hu\/oroklesi-jog-vagyonrendezes\/kotelesresz-joga\/\" target=\"_blank\" rel=\"noreferrer noopener\">k\u00f6telesr\u00e9szre jogosult szem\u00e9lyeknek<\/a><\/strong> t\u00f6rt\u00e9n\u0151 aj\u00e1nd\u00e9koz\u00e1s eset\u00e9n \u00e9rv\u00e9nyes: Ha az aj\u00e1nd\u00e9koz\u00e1s az aj\u00e1nd\u00e9koz\u00f3 hal\u00e1la el\u0151tt t\u00f6bb mint k\u00e9t \u00e9vvel t\u00f6rt\u00e9nt, az a k\u00f6telesr\u00e9sz szempontj\u00e1b\u00f3l figyelmen k\u00edv\u00fcl marad.<\/li>\n\n\n\n<li><strong><a href=\"https:\/\/harlander-partner.eu\/hu\/oroklesi-jog-vagyonrendezes\/kotelesresz-joga\/\">K\u00f6telesr\u00e9szre jogosult szem\u00e9lyeknek<\/a><\/strong> t\u00f6rt\u00e9n\u0151 aj\u00e1nd\u00e9koz\u00e1s eset\u00e9n nincs id\u0151beli korl\u00e1toz\u00e1s. Ez\u00e1ltal megn\u0151 az alap, amelyb\u0151l a k\u00f6telesr\u00e9szeket sz\u00e1m\u00edtj\u00e1k. Az aj\u00e1nd\u00e9k \u00e9rt\u00e9k\u00e9t az elhunyt hal\u00e1l\u00e1nak id\u0151pontj\u00e1hoz igaz\u00edtj\u00e1k.  <br\/><\/p>\n\n<p class=\"wp-block-paragraph\">Ha egy <a href=\"https:\/\/harlander-partner.eu\/hu\/oroklesi-jog-vagyonrendezes\/kotelesresz-joga\/\">k\u00f6telesr\u00e9szre jogosult<\/a> maga is kapott aj\u00e1nd\u00e9kot, azt \u2013 amennyiben el\u0151\u00edrt \u2013 besz\u00e1m\u00edtj\u00e1k a k\u00f6telesr\u00e9sz\u00e9be. Fontos, hogy ez csak a k\u00f6telesr\u00e9sznek arra a kieg\u00e9sz\u00edt\u0151 r\u00e9sz\u00e9re vonatkozik, amely az aj\u00e1nd\u00e9koz\u00e1sok figyelembev\u00e9tel\u00e9vel keletkezik (\u00fan. aj\u00e1nd\u00e9koz\u00e1si k\u00f6telesr\u00e9sz), nem pedig a teljes k\u00f6telesr\u00e9szre. <\/p>\n\n<p class=\"wp-block-paragraph\">K\u00fcl\u00f6nbs\u00e9get tesz\u00fcnk a tiszta hagyat\u00e9kb\u00f3l sz\u00e1rmaz\u00f3 k\u00f6telesr\u00e9sz \u00e9s az aj\u00e1nd\u00e9koz\u00e1sok hozz\u00e1ad\u00e1s\u00e1b\u00f3l ered\u0151 aj\u00e1nd\u00e9koz\u00e1si k\u00f6telesr\u00e9sz k\u00f6z\u00f6tt. Az aj\u00e1nd\u00e9koz\u00e1sok figyelembev\u00e9tele a k\u00f6telesr\u00e9sz t\u00f6bblet\u00f6sszeg\u00e9t eredm\u00e9nyezi, amelyet aj\u00e1nd\u00e9koz\u00e1si k\u00f6telesr\u00e9sznek nevez\u00fcnk. <\/p>\n\n<p class=\"wp-block-paragraph\">M\u00e1s <a href=\"https:\/\/harlander-partner.eu\/hu\/oroklesi-jog-vagyonrendezes\/kotelesresz-joga\/\">k\u00f6telesr\u00e9szre jogosultak<\/a> vagy <a href=\"https:\/\/harlander-partner.eu\/hu\/oroklesi-jog-vagyonrendezes\/torvenyes-orokles\/\">\u00f6r\u00f6k\u00f6s\u00f6k<\/a> k\u00edv\u00e1ns\u00e1gra k\u00f6vetelhetik, hogy a <a href=\"https:\/\/harlander-partner.eu\/hu\/oroklesi-jog-vagyonrendezes\/kotelesresz-joga\/\">k\u00f6telesr\u00e9szre jogosultaknak<\/a> t\u00f6rt\u00e9nt aj\u00e1nd\u00e9koz\u00e1sokat vegy\u00e9k figyelembe \u00e9s sz\u00e1m\u00edts\u00e1k be. A hagyom\u00e1nyosok is k\u00e9rhetik a besz\u00e1m\u00edt\u00e1st, ha hozz\u00e1 kell j\u00e1rulniuk a k\u00f6telesr\u00e9szek teljes\u00edt\u00e9s\u00e9hez. <\/p>\n\n<p class=\"wp-block-paragraph\">Nem minden aj\u00e1nd\u00e9koz\u00e1s ker\u00fcl besz\u00e1m\u00edt\u00e1sra. Kiv\u00e9telek akkor \u00e1llnak fenn, ha az elhunyt kifejezetten el\u0151\u00edrta vagy \u00edr\u00e1sban meg\u00e1llapodott arr\u00f3l, hogy egy aj\u00e1nd\u00e9kot nem kell besz\u00e1m\u00edtani. <\/p>\n\n<p class=\"wp-block-paragraph\">Ha a hagyat\u00e9k nem elegend\u0151 az \u00f6sszes k\u00f6telesr\u00e9sz kifizet\u00e9s\u00e9re, a megaj\u00e1nd\u00e9kozottnak ar\u00e1nyosan kell fedeznie a hi\u00e1nyz\u00f3 \u00f6sszeget, azaz a kapott aj\u00e1nd\u00e9k \u00e9rt\u00e9k\u00e9vel ar\u00e1nyosan.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-formen-der-schenkung-zu-lebzeiten\">Az \u00e9letk\u00f6zbeni aj\u00e1nd\u00e9koz\u00e1s form\u00e1i<\/h2>\n\n<h3 class=\"wp-block-heading\">1. \u00c9l\u0151k k\u00f6z\u00f6tti aj\u00e1nd\u00e9koz\u00e1s<\/h3>\n\n<p class=\"wp-block-paragraph\">A vagyon\u00e1truh\u00e1z\u00e1s azonnal megt\u00f6rt\u00e9nik. Ez k\u00fcl\u00f6n\u00f6sen akkor c\u00e9lszer\u0171, ha a megaj\u00e1nd\u00e9kozottnak s\u00fcrg\u0151sen sz\u00fcks\u00e9ge van az eszk\u00f6z\u00f6kre egy adott id\u0151pontban, p\u00e9ld\u00e1ul h\u00e1z\u00e9p\u00edt\u00e9shez vagy p\u00e1lyakezd\u00e9shez. <\/p>\n\n<h3 class=\"wp-block-heading\">2. Hal\u00e1l eset\u00e9re sz\u00f3l\u00f3 aj\u00e1nd\u00e9koz\u00e1s<\/h3>\n\n<p class=\"wp-block-paragraph\">Ebben az esetben az aj\u00e1nd\u00e9koz\u00f3 m\u00e1r \u00e9let\u00e9ben szerz\u0151d\u00e9sben k\u00f6telezi mag\u00e1t, hogy egy bizonyos dolgot csak hal\u00e1la ut\u00e1n ruh\u00e1z \u00e1t.<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Alaki k\u00f6vetelm\u00e9ny<\/strong>: K\u00f6zjegyz\u0151i okirat<\/li>\n\n\n\n<li><strong>Visszavon\u00e1s<\/strong>: Csak szerz\u0151d\u00e9sben r\u00f6gz\u00edtett visszavon\u00e1si jog eset\u00e9n, k\u00f6z\u00f6s megegyez\u00e9ssel vagy a megaj\u00e1nd\u00e9kozott s\u00falyos h\u00e1l\u00e1tlans\u00e1ga eset\u00e9n lehets\u00e9ges.<\/li>\n\n\n\n<li><strong>Kock\u00e1zat<\/strong>: A hagyat\u00e9k mag\u00e1ban foglalja a dolgot, \u00e9s azt ad\u00f3ss\u00e1grendez\u00e9sre vagy a k\u00f6telesr\u00e9szre jogosultak kifizet\u00e9s\u00e9re haszn\u00e1lja fel.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">T\u00f6bbet olvashat a hal\u00e1l eset\u00e9re sz\u00f3l\u00f3 aj\u00e1nd\u00e9koz\u00e1sr\u00f3l itt:<a href=\"https:\/\/harlander-partner.eu\/hu\/oroklesi-jog-vagyonrendezes\/halaleseti-ajandekozas\/\" target=\"_blank\" rel=\"noreferrer noopener\"> Hal\u00e1l eset\u00e9re sz\u00f3l\u00f3 aj\u00e1nd\u00e9koz\u00e1s<\/a><\/p>\n\n<h2 class=\"wp-block-heading\">K\u00fcl\u00f6nleges szempontok ingatlanok eset\u00e9n<\/h2>\n\n<p class=\"wp-block-paragraph\">Az <strong>ingatlan aj\u00e1nd\u00e9koz\u00e1sa<\/strong> \u00edr\u00e1sbeli aj\u00e1nd\u00e9koz\u00e1si szerz\u0151d\u00e9st ig\u00e9nyel, amelyet mindk\u00e9t f\u00e9l al\u00e1\u00edr. Az aj\u00e1nd\u00e9koz\u00f3 sz\u00e1m\u00e1ra fontos biztos\u00edt\u00e9ki jogokat felt\u00e9tlen\u00fcl fel kell t\u00fcntetni a szerz\u0151d\u00e9sben \u00e9s az ingatlan-nyilv\u00e1ntart\u00e1sban: <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Lakhat\u00e1si jog<\/strong>: Az aj\u00e1nd\u00e9koz\u00f3 \u00e9lete v\u00e9g\u00e9ig lakhat az ingatlanban.<\/li>\n\n\n\n<li><strong>Haszon\u00e9lvezeti jog<\/strong>: Az aj\u00e1nd\u00e9koz\u00f3 tov\u00e1bbra is r\u00e9szes\u00fclhet az ingatlanb\u00f3l sz\u00e1rmaz\u00f3 bev\u00e9telekb\u0151l (pl. b\u00e9rleti d\u00edj).<\/li>\n\n\n\n<li><strong>Terhel\u00e9si \u00e9s elidegen\u00edt\u00e9si tilalom<\/strong>: Az ingatlan csak az aj\u00e1nd\u00e9koz\u00f3 hozz\u00e1j\u00e1rul\u00e1s\u00e1val adhat\u00f3 el vagy terhelhet\u0151 meg.<\/li>\n<\/ul>\n<a class=\"mr-cta-link mr-cta-button-cal\" href=\"#h2-booking\" title=\"Ingyenes els\u0151 konzult\u00e1ci\u00f3\"><span class=\"mr-cta-link-normal\">V\u00e1lassza ki az id\u0151pontot most:<\/span><span class=\"mr-cta-link-bold\">Ingyenes els\u0151 konzult\u00e1ci\u00f3<\/span><\/a>\n\n<h2 class=\"wp-block-heading\" id=\"h-ihre-vorteile-mit-anwaltlicher-unterstutzung\">Az \u00d6n el\u0151nyei \u00fcgyv\u00e9di seg\u00edts\u00e9ggel<\/h2>\n\n<p class=\"wp-block-paragraph\">Az \u00e9letk\u00f6zbeni aj\u00e1nd\u00e9koz\u00e1sok sz\u00e1mos jogi \u00e9s gazdas\u00e1gi kih\u00edv\u00e1st rejtenek magukban.
