To je oblik ovrhe na potra\u017eivanjima. Pritom se dio primanja osobe ovr\u0161uje radi podmirenja otvorenih dugova. Poslodavac ovr\u0161enika u ovom postupku postaje tre\u0107a osoba o dugu i upla\u0107uje ovr\u0161ivi dio pla\u0107e izravno ovrhovoditelju. Ovr\u0161eniku ostaje minimalni iznos, takozvani egzistencijalni minimum prema <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10001700&amp;Artikel=&amp;Paragraf=291a&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 291a EO<\/a>, kako bi mogao osigurati svoju egzistenciju.    <\/p>\n\n<div class=\"wp-block-uagb-container uagb-block-3019fe8e alignfull uagb-is-root-container\">\n<div class=\"wp-block-uagb-container uagb-block-32585033\">\n<p class=\"wp-block-paragraph\">Ovraha na pla\u0107u omogu\u0107uje naplatu otvorenih potra\u017eivanja izravno putem primanja ovr\u0161enika. Kod ovrhe nad pla\u0107om, <strong>ovrhovoditelj<\/strong> je vjerovnik koji \u017eeli naplatiti otvoreno potra\u017eivanje. <strong>Ovr\u0161enik<\/strong> je du\u017enik \u010diji se dohodak ovr\u0161uje. Osim toga, va\u017enu ulogu igra <strong>tre\u0107i du\u017enik<\/strong>. Za to koristi ogledni obrazac koji dostavlja i sudu i ovrhovoditelju. U ovoj izjavi poslodavac daje informacije o radnom odnosu du\u017enika. Izme\u0111u ostalog, navodi kolika je mjese\u010dna neto zarada, postoje li obveze uzdr\u017eavanja i postoje li ve\u0107 druge ovrhe. Ovi podaci omogu\u0107uju ispravan izra\u010dun ovr\u0161ivog iznosa.    <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-rangverhaltnis\">Redoslijed prvenstva<\/h3>\n\n<p class=\"wp-block-paragraph\">Ako vi\u0161e vjerovnika podnese zahtjev za ovrhu nad pla\u0107om, u osnovi vrijedi: tko prvi, njegovo. To zna\u010di da poslodavac prvo mora namiriti one vjerovnike \u010dija su potra\u017eivanja vremenski ranije zatra\u017eena i odobrena. <\/p>\n\n<p class=\"wp-block-paragraph\">Tek kada se ti prvenstveni vjerovnici u potpunosti namire, poslodavac smije proslijediti ovr\u0161ni iznos podre\u0111enim vjerovnicima. Tako nastaje jasan redoslijed kojim se potra\u017eivanja obra\u0111uju. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-drittschuldnerklage\">Tu\u017eba protiv tre\u0107e osobe o dugu<\/h3>\n\n<p class=\"wp-block-paragraph\">Tu\u017eba protiv tre\u0107e osobe o dugu pravno je sredstvo ovrhovoditelja protiv poslodavca ovr\u0161enika. Koristi se kada poslodavac kr\u0161i svoje obveze iz ovrhe na pla\u0107u, primjerice ne da izjavu tre\u0107e osobe o dugu ili ne upla\u0107uje uredno ovr\u0161eni iznos. U takvom slu\u010daju vjerovnik mo\u017ee tu\u017eiti poslodavca na isplatu. Time se osigurava da se ovrha provede ispravno i da se ostvari potra\u017eivanje vjerovnika.   <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-verstandigung-vom-bezugsende\">Obavijest o prestanku primanja<\/h3>\n\n<p class=\"wp-block-paragraph\">Ako se radni odnos prekine, poslodavac o tome mora obavijestiti ovrhovoditelja. Za to koristi sudski ogledni obrazac. Ako se takve posebne isplate pojave, ovrhovoditelj u tom razdoblju prima ve\u0107u isplatu, jer se uz teku\u0107u pla\u0107u ovr\u0161uje i dio posebne isplate. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-unbekannter-arbeitgeber\">Nepoznat poslodavac<\/h2>\n\n<p class=\"wp-block-paragraph\">Ovrhovoditelj mo\u017ee podnijeti prijedlog za ovrhu na pla\u0107u i ako poslodavac ovr\u0161enika nije poznat. Za to je u prijedlogu za ovrhu potrebno navesti samo datum ro\u0111enja ovr\u0161enika. Sud se s ovom informacijom obra\u0107a krovnoj udruzi nositelja socijalnog osiguranja i tra\u017ei informaciju kod kojeg je poslodavca ovr\u0161enik zaposlen. Ako se utvrdi poslodavac, provodi se ovrha na pla\u0107u.   <\/p>\n\n<p class=\"wp-block-paragraph\">Ako potraga za poslodavcem ostane bezuspje\u0161na, prijedlog zasad nema uspjeha. Me\u0111utim, ovrhovoditelj mo\u017ee ponovno podnijeti prijedlog u kasnijem trenutku.  Novim zahtjevom za ovrhu nad pla\u0107om mo\u017ee se utvrditi je li du\u017enik kasnije zaposlen kod novog poslodavca.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-vorrang-der-gehaltsexekution-vor-der-fahrnisexekution\">Prioritet ovrhe na pla\u0107u u odnosu na ovrhu na pokretninama<\/h2>\n\n<p class=\"wp-block-paragraph\">Ako je mogu\u0107a ovrha na pla\u0107u, ovrha na pokretninama se u po\u010detku ne provodi. Ovrhovoditelj mo\u017ee istovremeno zatra\u017eiti obje vrste ovrhe i sud ih odobrava zajedno. U praksi se prvo poku\u0161ava naplatiti potra\u017eivanje putem primanja du\u017enika.
