Ve\u0107 prihva\u0107anje ponude za kupnju od strane prodavatelja i njezino potpisivanje od strane zainteresiranog kupca dovode do <g id=\"gid_4\">pravno obvezuju\u0107eg ugovora<\/g>. Stoga bi ponuda za kupnju trebala sadr\u017eavati sve bitne sastojke ugovora, kao \u0161to su jamstvo, odgovornosti, osloba\u0111anje od tereta i datum prijenosa, kako bi se izbjegli kasniji sporovi.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-abwicklung-des-liegenschaftskaufs-mittels-treuhandschaft\">Realizacija kupnje nekretnine putem escrow usluga<\/h2>\n\n<p class=\"wp-block-paragraph\">Zbog temeljnog <strong>na\u010dela istodobnog ispunjenja obveza<\/strong> u gra\u0111anskom pravu, istovremena predaja predmeta kupnje i kupoprodajne cijene nije mogu\u0107a, jer vlasni\u0161tvo nad nekretninom prelazi tek upisom u zemlji\u0161ne knjige. To zna\u010di da se moraju izbrisati zalo\u017ena prava, slu\u017enosti ili druga optere\u0107enja u zemlji\u0161nim knjigama. Brisanje se vr\u0161i putem javnobilje\u017eni\u010dki ovjerenih izjava ovla\u0161tenika, koje prikuplja povjerenik po nalogu.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-grundbucheintragung-und-eigentumsubergang\">Upis u zemlji\u0161ne knjige i prijenos vlasni\u0161tva<\/h2>\n\n<p class=\"wp-block-paragraph\">Nakon ispunjenja svih preduvjeta i pla\u0107anja kupoprodajne cijene, povjerenik podnosi <strong>zahtjev za upis vlasni\u0161tva<\/strong> u zemlji\u0161ne knjige.
