Svaki suvlasnik ima pravo poduzeti ovaj korak, \u010dak i bez suglasnosti ostalih. Tu\u017eba je usmjerena protiv svih ostalih suvlasnika, bez obzira jesu li upisani u zemlji\u0161ne knjige ili samo izvanknji\u017eno dr\u017ee udjele.  <\/p>\n\n<div class=\"wp-block-uagb-container uagb-block-3019fe8e alignfull uagb-is-root-container\">\n<div class=\"wp-block-uagb-container uagb-block-32585033\">\n<p class=\"wp-block-paragraph\">Zajedni\u010dko vlasni\u0161tvo nad nekretninom mo\u017ee postati teret, primjerice nakon razvoda ili nasljedstva. Budu\u0107i da svi suvlasnici zajedno nastupaju kao stranka, pona\u0161anje pojedinca utje\u010de na cijeli postupak. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-ziel-der-teilungsklage\">Cilj tu\u017ebe za razvrgnu\u0107e<\/h2>\n\n<p class=\"wp-block-paragraph\">Tu\u017eba za razvrgnu\u0107e provodi obveznopravni zahtjev za ukidanje zajednice vlasni\u0161tva. Usmjerena je protiv svih suvlasnika, bez obzira jesu li upisani u zemlji\u0161ne knjige ili ne. <\/p>\n\n<p class=\"wp-block-paragraph\">Cilj: Ili \u0107e se nekretnina podijeliti ili prodati na dra\u017ebi.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-realteilung-vs-zivilteilung\">Realna dioba vs. civilna dioba<\/h2>\n\n<p class=\"wp-block-paragraph\">Ako vi\u0161e osoba zajedni\u010dki posjeduje nekretninu, ali se ne mogu dogovoriti o njezinu kori\u0161tenju ili podjeli, svaki suvlasnik mo\u017ee zahtijevati ukidanje te zajednice. Zakon predvi\u0111a dva na\u010dina za to: <strong>realnu diobu<\/strong> i <strong>civilnu diobu<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-realteilung\">Realna podjela<\/h3>\n\n<p class=\"wp-block-paragraph\">Kod <strong>realne diobe<\/strong> zajedni\u010dko vlasni\u0161tvo se stvarno dijeli. Svatko dobiva vlastiti, jasno razgrani\u010deni dio nekretnine. Ovo rje\u0161enje je posebno korisno ako je nekretnina dovoljno velika ili se mo\u017ee odvojiti osnivanjem eta\u017enog vlasni\u0161tva. Realna dioba je obi\u010dno ekonomski povoljnije rje\u0161enje jer nije potreban postupak prodaje.   <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-voraussetzung-fur-eine-realteilung\">Pretpostavka za realnu diobu<\/h3>\n\n<p class=\"wp-block-paragraph\">Da bi realna dioba uop\u0107e do\u0161la u obzir, moraju biti ispunjene odre\u0111ene pravne i \u010dinjeni\u010dne pretpostavke:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Gra\u0111evinske i tehni\u010dke okolnosti<\/strong> moraju omogu\u0107iti jasno i trajno odvajanje nekretnine. To se mo\u017ee posti\u0107i parcelacijom ili osnivanjem eta\u017enog vlasni\u0161tva. <\/li>\n\n\n\n<li><strong>Podjela mora biti ekonomski smislena<\/strong>. <\/li>\n\n\n\n<li>Ne smije postojati <strong>javnopravna prepreka<\/strong>.<\/li>\n\n\n\n<li>Podjela ne smije biti <strong>protivna zakonu ili dobrim obi\u010dajima<\/strong>.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-zivilteilung\">Civilna dioba<\/h3>\n\n<p class=\"wp-block-paragraph\">Ako takva podjela <strong>nije mogu\u0107a ili je nerazumna<\/strong>, primjerice zato \u0161to je zemlji\u0161te premalo, nije mogu\u0107a gra\u0111evinska podjela ili se sudionici ne mogu dogovoriti o podjeli, dolazi do <strong>civilne diobe<\/strong>. Pritom se cijela nekretnina <strong>prodaje na dra\u017ebi<\/strong>, obi\u010dno javno preko op\u0107inskog suda. Ova zabilje\u017eba \u0161titi od ne\u017eeljenih raspolaganja tre\u0107ih osoba i osigurava kasniju <strong>pravomo\u0107nost presude o diobi<\/strong>, \u010dak i prema kasnijim kupcima. Unato\u010d tome, otu\u0111enje suvlasni\u010dkih udjela i dalje je mogu\u0107e.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-wirkung-der-teilungsklage\">U\u010dinak tu\u017ebe za razvrgnu\u0107e<\/h2>\n\n<p class=\"wp-block-paragraph\">Tu\u017eba za razvrgnu\u0107e tipi\u010dno se koristi nakon nasljedstava, razvoda ili kod posva\u0111anih suvlasnika. Me\u0111utim, u odre\u0111enim situacijama to pravo mo\u017ee biti <strong>privremeno ograni\u010deno<\/strong>: Tada govorimo o takozvanoj <strong>prepreci diobi<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-unzeit\">Nevrijeme<\/h3>\n\n<p class=\"wp-block-paragraph\">O nevremenu govorimo kada vanjske okolnosti ne sprje\u010davaju trajno diobu, ali bi u ovom trenutku bile \u0161tetne za sve sudionike.<\/p>\n\n<p class=\"wp-block-paragraph\">Nevrijeme ne zna\u010di da zahtjev otpada, ve\u0107 samo da se <strong>u ovom trenutku ne mo\u017ee provesti<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-nachteil-fur-die-ubrigen\">\u0160teta za ostale<\/h3>\n\n<p class=\"wp-block-paragraph\">U odre\u0111enim slu\u010dajevima, trenutna dioba mo\u017ee predstavljati <strong>neprihvatljivu te\u0161ko\u0107u<\/strong> za pojedine suvlasnike. Sud tada ispituje je li provedba zahtjeva za diobu <g id=\"gid_1\">protivna na\u010delu savjesnosti i po\u0161tenja<\/g>. Samo ako je navedena \u0161teta <strong>privremene prirode<\/strong> i nestane u dogledno vrijeme, postupak se mo\u017ee <strong>privremeno odgoditi<\/strong>.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-gerichtszustandigkeit\">Nadle\u017enost suda<\/h2>\n\n<p class=\"wp-block-paragraph\">Nadle\u017ean je <strong>sud u mjestu gdje se nalazi nekretnina<\/strong>. O tome ho\u0107e li odlu\u010divati op\u0107inski ili \u017eupanijski sud ovisi o <g id=\"gid_1\">vrijednosti spora<\/g>. Mjerodavna vi\u0161e nije jedinstvena vrijednost, ve\u0107 takozvana <strong>vrijednost zemlji\u0161ta<\/strong>. Ona tako\u0111er \u010dini osnovu za <strong>sudske pristojbe<\/strong>.   <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-risiken-und-kosten\">Rizici i tro\u0161kovi<\/h2>\n\n<p class=\"wp-block-paragraph\">U postupku diobe svi suparni\u010dari u na\u010delu solidarno odgovaraju za tro\u0161kove postupka. \u010cak i onaj tko odmah prizna tu\u017ebu, pod odre\u0111enim okolnostima mo\u017ee morati platiti. Na\u0161 ured u takvim slu\u010dajevima ciljano pazi na individualnu u\u0161tedu tro\u0161kova i procesno-ekonomsku strategiju.  <\/p>\n\n<h2 class=\"wp-block-heading\"
