Time mo\u017eete sudskim putem ishoditi trenuta\u010dni prekid gradnje i zaustaviti daljnje gra\u0111evinske radove. Zakon to izri\u010dito predvi\u0111a u <a href=\"https:\/\/ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10001622&amp;Artikel=&amp;Paragraf=340&amp;Anlage=&amp;Uebergangsrecht=\">\u00a7 340 ABGB<\/a>. Va\u0161a prednost: Sud u ubrzanom postupku brzo odlu\u010duje o mjeri prekida gradnje i mo\u017ee odmah intervenirati ako je Va\u0161 posjed ugro\u017een.   <\/p>\n\n<p><strong><a href=\"https:\/\/ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10001622&amp;Artikel=&amp;Paragraf=340&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 340 ABGB<\/a><\/strong> daje samo pravo na propu\u0161tanje (daljnje) gradnje, ali ne i na uspostavu prija\u0161njeg stanja.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-voraussetzungen-fur-die-bauverbotsklage\">Pretpostavke za tu\u017ebu za zabranu gra\u0111enja<\/h2>\n\n<p>Sudskim putem mo\u017eete zahtijevati zaustavljanje nove gradnje ako ona utje\u010de na Va\u0161u parcelu. Pretpostavka je da raspola\u017eete doti\u010dnom parcelom i da je taj posjed akutno ugro\u017een gradnjom drugoga. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-besitz-oder-dingliches-recht\">Posjed ili stvarna prava<\/h3>\n\n<p>Tu\u017ebu u na\u010delu ima onaj tko je posjednik nekretnine ili nositelj stvarnog prava.<\/p>\n\n<p>Zakon \u0161titi osobito:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>posjed <strong>nekretnine<\/strong><\/li>\n\n\n\n<li><strong>stvarna prava<\/strong> kao \u0161to su slu\u017enosti<\/li>\n\n\n\n<li>i njihovu za\u0161titu ve\u0107 <strong>u slu\u010daju puke ugro\u017eenosti<\/strong>, a ne tek u slu\u010daju nastalog smetanja<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-blosse-gefahrdung\">Puka ugro\u017eenost <\/h3>\n\n<p>Opasnost mora nastati <strong>ve\u0107 zapo\u010detom, a ne tek namjeravanom, gradnjom<\/strong> i postojati u mogu\u0107em <strong>smetanju posjeda<\/strong>. Ona mora potjecati od same izgradnje ili postojanja gra\u0111evine, a ne samo od pripadaju\u0107ih radova ili se strahovati od njezina kori\u0161tenja. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-keine-wirksame-behordliche-baugenehmigung\">Nema va\u017ee\u0107e upravne dozvole za gradnju<\/h3>\n\n<p>Ako <strong>ne postoji va\u017ee\u0107a upravna dozvola za gradnju<\/strong> ili Vi u postupku <strong>niste uredno pozvani<\/strong>, imate pravo podnijeti tu\u017ebu za zabranu gra\u0111enja sudu.<\/p>\n\n<p>Ako je gra\u0111evinski projekt slu\u017ebeno odobren i Vi <strong>niste ulo\u017eili prigovore<\/strong> u postupku odobravanja, u pravilu gubite pravo na tu\u017ebu za zabranu gra\u0111enja. <\/p>\n<a class=\"mr-cta-link mr-cta-button-cal\" href=\"#h2-booking\" title=\"Besplatne prve konzultacije\"><span class=\"mr-cta-link-normal\">Sada odaberite \u017eeljeni termin:<\/span><span class=\"mr-cta-link-bold\">Besplatne prve konzultacije<\/span><\/a>\n\n<h2 class=\"wp-block-heading\" id=\"h-ziel-und-wirkung-der-klage\">Cilj i u\u010dinak tu\u017ebe<\/h2>\n\n<p>Tu\u017ebom za zabranu gra\u0111enja zahtijevate pred sudom da se gradnja <strong>ne nastavi ili da se uop\u0107e ne zapo\u010dne<\/strong>. Postupak je osmi\u0161ljen kako bi se brzo razjasnila situacija. <\/p>\n\n<p><strong>Prekid gradnje mo\u017ee se posti\u0107i ve\u0107 u hitnom postupku<\/strong>, dakle prije kona\u010dne odluke, putem <strong>privremene zabrane gra\u0111enja<\/strong>. U praksi se to redovito doga\u0111a u kratkom vremenu. <\/p>\n\n<p>Povratak u prija\u0161nje stanje ve\u0107 izgra\u0111enih dijelova, me\u0111utim, <strong>nije predmet ove tu\u017ebe<\/strong>, za to bi, u slu\u010daju nastalog smetanja, do\u0161la u obzir tu\u017eba zbog smetanja posjeda.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verhaltnis-zur-besitzstorungsklage\">Odnos prema tu\u017ebi zbog smetanja posjeda<\/h2>\n\n<p>Ako ve\u0107 do\u0111e do konkretnog smetanja posjeda (npr. ulazak, o\u0161te\u0107enje, neprihvatljivo kori\u0161tenje), mo\u017eete dodatno ili umjesto toga podnijeti tu\u017ebu zbog smetanja posjeda. U mnogim slu\u010dajevima oba zahtjeva postoje usporedno. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verfahrensablauf-der-bauverbotsklage\">Tijek postupka tu\u017ebe za zabranu gra\u0111enja<\/h2>\n\n<p>Tu\u017ebu za zabranu gra\u0111enja vodite u ubrzanom postupku izravno pred nadle\u017enim sudom.<\/p>\n\n<p>Podnosite tu\u017ebeni zahtjev i obrazla\u017eete za\u0161to je Va\u0161 posjed akutno ugro\u017een. Budu\u0107i da se radi o hitnom slu\u010daju, vrijede posebno kratki rokovi.  <\/p>\n\n<p>\u010cesto sud donosi svoju odluku bez usmene rasprave i donosi rje\u0161enje. Ako se tu\u017eba usvoji, sud donosi rje\u0161enje o prekidu gradnje. Ovo obvezuje investitora i ostaje na snazi dok se o tu\u017ebi kona\u010dno ne odlu\u010di.  <\/p>\n\n<p><strong>Va\u017eno:<\/strong> Za\u0161tita posjeda mo\u017ee se primijeniti \u010dak i protiv ve\u0107 odobrenih gra\u0111evinskih mjera, ako postoji akutna potreba za djelovanjem.
