Contrairement \u00e0 l&rsquo;administration forc\u00e9e, qui saisit les revenus courants d&rsquo;un bien immobilier, et \u00e0 la vente aux ench\u00e8res forc\u00e9e, qui vise \u00e0 vendre l&rsquo;objet, la constitution forc\u00e9e d&rsquo;hypoth\u00e8que conf\u00e8re au cr\u00e9ancier <strong>un droit de gage ex\u00e9cutoire<\/strong>, mais <strong>pas de satisfaction mon\u00e9taire imm\u00e9diate<\/strong>. <\/p>\n\n<div class=\"wp-block-uagb-container uagb-block-3019fe8e alignfull uagb-is-root-container\">\n<div class=\"wp-block-uagb-container uagb-block-32585033\">\n<p class=\"wp-block-paragraph\">Le moyen d&rsquo;ex\u00e9cution est r\u00e9gi par l&rsquo;<strong><a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10001700&amp;Artikel=&amp;Paragraf=88&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">article 88 EO<\/a><\/strong>. Conform\u00e9ment \u00e0 cette disposition, la constitution forc\u00e9e d&rsquo;un privil\u00e8ge sur un bien immobilier, une part de bien immobilier, une construction sur sol d&rsquo;autrui ou un droit de superficie du d\u00e9biteur peut \u00eatre effectu\u00e9e. <\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-container uagb-block-45819ab6\"><picture>\r\n\t\t<source srcset=\"https:\/\/harlander-partner.eu\/wp-content\/uploads\/Zwangsweise-Pfandrechtsbegruendung-352x198.webp\" >\r\n\t\t<img decoding=\"async\" class=\"mr-picture-small\" src=\"https:\/\/harlander-partner.eu\/wp-content\/uploads\/Zwangsweise-Pfandrechtsbegruendung.webp\" alt=\"La constitution forc\u00e9e d'hypoth\u00e8que selon l'article 88 EO explique\u00a0: conditions, d\u00e9roulement, effets et droits du cr\u00e9ancier et du d\u00e9biteur.\" >\r\n\t<\/picture>\n<\/div>\n<\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-parteien-der-zwangsweisen-pfandrechtsbegrundung\">Parties \u00e0 la constitution forc\u00e9e d&rsquo;hypoth\u00e8que<\/h2>\n\n<p class=\"wp-block-paragraph\">Lors de la constitution forc\u00e9e d&rsquo;hypoth\u00e8que, deux parties s&rsquo;opposent. <strong>Le cr\u00e9ancier poursuivant<\/strong> est la personne qui poss\u00e8de une cr\u00e9ance p\u00e9cuniaire ex\u00e9cutoire et qui demande l&rsquo;inscription de l&rsquo;hypoth\u00e8que. <strong>Le d\u00e9biteur<\/strong> est le propri\u00e9taire du bien immobilier ou du droit concern\u00e9. L&rsquo;hypoth\u00e8que est inscrite sur son bien et garantit la cr\u00e9ance du cr\u00e9ancier poursuivant. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-exekutionsantrag\">Demande d&rsquo;ex\u00e9cution<\/h2>\n\n<p class=\"wp-block-paragraph\">La constitution forc\u00e9e d&rsquo;un privil\u00e8ge est introduite par une <strong>demande d&rsquo;ex\u00e9cution<\/strong>. L&rsquo;ex\u00e9cution a lieu par l&rsquo;inscription au livre foncier du privil\u00e8ge sur le bien immobilier du d\u00e9biteur \u00e0 indiquer.  <\/p>\n\n<p class=\"wp-block-paragraph\">Le tribunal de district qui g\u00e8re le livre foncier du bien immobilier concern\u00e9 est comp\u00e9tent pour l&rsquo;autorisation et l&rsquo;ex\u00e9cution. La d\u00e9cision relative \u00e0 la constitution forc\u00e9e du privil\u00e8ge est prise par le greffier. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-vollzug\">Ex\u00e9cution<\/h2>\n\n<p class=\"wp-block-paragraph\">L&rsquo;ex\u00e9cution a lieu par l&rsquo;incorporation de l&rsquo;hypoth\u00e8que au livre foncier. Ce faisant, la cr\u00e9ance pour laquelle l&rsquo;hypoth\u00e8que est inscrite est express\u00e9ment d\u00e9sign\u00e9e comme ex\u00e9cutoire. <\/p>\n\n<p class=\"wp-block-paragraph\">L&rsquo;incorporation de l&rsquo;hypoth\u00e8que a pour cons\u00e9quence que le cr\u00e9ancier peut faire valoir sa cr\u00e9ance par ex\u00e9cution, m\u00eame \u00e0 l&rsquo;encontre de propri\u00e9taires ult\u00e9rieurs du bien immobilier. Ainsi, l&rsquo;hypoth\u00e8que est maintenue lors du changement de propri\u00e9taire. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-aufhebung-oder-einschrankung\">Annulation ou restriction <\/h3>\n\n<p class=\"wp-block-paragraph\">Le d\u00e9biteur peut demander la suppression ou la limitation du privil\u00e8ge constitu\u00e9 de force si le cr\u00e9ancier obtient ainsi une s\u00e9curit\u00e9 plus importante que celle pr\u00e9vue par la loi.<\/p>\n\n<p class=\"wp-block-paragraph\">Une limitation peut notamment signifier que le privil\u00e8ge est limit\u00e9 \u00e0 certains biens immobiliers ou constructions sur sol d&rsquo;autrui.
