Palga arestimise korral on <strong>n\u00f5uet sisse n\u00f5udev pool<\/strong> v\u00f5lausaldaja, kes soovib esitada avatud n\u00f5uet. <strong>Kohustatud pool<\/strong> on v\u00f5lgnik, kelle sissetulek arestitakse. Lisaks m\u00e4ngib olulist rolli <strong>kolmas v\u00f5lgnik<\/strong>. Selleks kasutab ta n\u00e4idisvormit, mille ta edastab nii kohtule kui ka hagi esitavale poolele. Selles avalduses annab t\u00f6\u00f6andja teavet v\u00f5lgniku t\u00f6\u00f6suhte kohta. Ta teatab muu hulgas, kui k\u00f5rge on igakuine netosissetulek, kas eksisteerivad \u00fclalpidamiskohustused ja kas juba eksisteerivad muud arestimised. Need andmed v\u00f5imaldavad arestimisele kuuluvat summat \u00f5igesti arvutada.    <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-rangverhaltnis\">J\u00e4rjestus<\/h3>\n\n<p>Kui mitu v\u00f5lausaldajat taotlevad palga arestimist, kehtib p\u00f5him\u00f5te: kes esimesena esitab, see saab esimesena tasutud. See t\u00e4hendab, et t\u00f6\u00f6andja peab esmalt rahuldama nende v\u00f5lausaldajate n\u00f5uded, kelle n\u00f5uded esitati ja rahuldati ajaliselt varem. <\/p>\n\n<p>Alles siis, kui need eelisj\u00e4rjekorras olevad v\u00f5lausaldajad on t\u00e4ielikult rahuldatud, tohib t\u00f6\u00f6andja arestimisele kuuluva summa edastada j\u00e4rgnevatele v\u00f5lausaldajatele. Nii tekib selge j\u00e4rjestus, milles n\u00f5uded rahuldatakse. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-drittschuldnerklage\">Kolmanda v\u00f5lgniku hagi<\/h3>\n\n<p>Kolmanda v\u00f5lgniku hagi on hagi esitaja \u00f5iguslik vahend kohustatud isiku t\u00f6\u00f6andja vastu. Seda kasutatakse siis, kui t\u00f6\u00f6andja rikub oma kohustusi palgaarestimisest, n\u00e4iteks ei esita kolmanda v\u00f5lgniku avaldust v\u00f5i ei kanna arestitud summat korrektselt \u00fcle. Sellisel juhul v\u00f5ib v\u00f5lausaldaja t\u00f6\u00f6andjat maksmisele kaevata. Sellega tagatakse, et arestimine viiakse korrektselt ellu ja v\u00f5lausaldaja n\u00f5ue j\u00f5ustatakse.   <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-verstandigung-vom-bezugsende\">Teavitamine t\u00f6\u00f6suhte l\u00f5ppemisest<\/h3>\n\n<p>Kui teenistussuhe l\u00f5petatakse, peab t\u00f6\u00f6andja sellest hagi esitavat poolt teavitama. Selleks kasutab ta kohtu n\u00e4idisvormit. Kui sellised erimaksed tekivad, saab hagi esitaja sel ajal k\u00f5rgema makse, sest lisaks jooksvale palgale arestimakse ka osa erimaksest. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-unbekannter-arbeitgeber\">Tundmatu t\u00f6\u00f6andja<\/h2>\n\n<p>Hagi esitaja v\u00f5ib palgaarestimise avalduse esitada ka siis, kui kohustatud isiku t\u00f6\u00f6andja ei ole teada. Selleks tuleb t\u00e4iteavalduses m\u00e4rkida ainult kohustatud poole s\u00fcnnikuup\u00e4ev. Kohus p\u00f6\u00f6rdub selle teabega sotsiaalkaitse kandjate katusorganisatsiooni poole ja palub teavet selle kohta, millise t\u00f6\u00f6andja juures kohustatud isik t\u00f6\u00f6tab. Kui t\u00f6\u00f6andja tuvastatakse, viiakse palgaarestimine l\u00e4bi.   <\/p>\n\n<p>Kui t\u00f6\u00f6andja otsingud j\u00e4\u00e4vad edututeks, ei ole avaldus esialgu edukas. Hagi esitav pool v\u00f5ib aga hiljem uuesti avalduse esitada.  Uue palga arestimise avaldusega saab v\u00e4lja selgitada, kas v\u00f5lgnik on hilisemal ajal uue t\u00f6\u00f6andja juures t\u00f6\u00f6l.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-vorrang-der-gehaltsexekution-vor-der-fahrnisexekution\">Palgaarestimise eelis vallasvarade arestimise ees<\/h2>\n\n<p>Kui palgaarestimine on v\u00f5imalik, ei viida vallasvarade arestimist esialgu l\u00e4bi. Hagi esitav pool v\u00f5ib m\u00f5lemaid t\u00e4iteliike samaaegselt taotleda ja kohus rahuldab need ka \u00fchiselt. Praktikas p\u00fc\u00fctakse k\u00f5igepealt n\u00f5uet v\u00f5lgniku sissetuleku kaudu sisse n\u00f5uda. Ainult siis, kui palgaarestimine j\u00e4\u00e4b edututuks, viiakse seej\u00e4rel l\u00e4bi vallasvarade arestimine.   <\/p>\n\n<p>Vallasvara arestimise korral arestitakse v\u00f5lgniku vallasvara, n\u00e4iteks m\u00f6\u00f6bel, elektriseadmed v\u00f5i muud v\u00e4\u00e4rtesemed, ja vajadusel m\u00fc\u00fcakse oksjonil, et avamata n\u00f5uded tasuda.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-ihre-vorteile-mit-anwaltlicher-unterstutzung\">Teie eelised advokaadi abiga<\/h2>\n\n<p>Palgaarestimise l\u00e4biviimine on sageli seotud \u00f5iguslike ebakindlustega.
