See on era\u00f5iguslik leping, mida saab s\u00f5lmida kas <strong>enne<\/strong> v\u00f5i <strong>p\u00e4rast p\u00e4randvara \u00fcleandmist<\/strong>. <\/p>\n\n<p>Kui see s\u00f5lmitakse enne p\u00e4randvara \u00fcleandmist, puudutab see \u00f5iguslikult p\u00e4rijate ootust p\u00e4randvara esemetele ja j\u00f5ustub alles p\u00e4randvara \u00fcleandmise j\u00f5ustumisega. S\u00f5lmimine v\u00f5ib toimuda t\u00e4iesti kohtuv\u00e4liselt v\u00f5i protokollitakse kohtuvoliniku juures. <\/p>\n\n<p><strong>M\u00e4rkus:<\/strong> Kui p\u00e4randvara jagamise kokkulepe s\u00f5lmitakse enne p\u00e4randvara \u00fcleandmist, peab p\u00e4rija olema p\u00e4rimismenetluses juba esitanud <strong>p\u00e4randi vastuv\u00f5tmise avalduse<\/strong>. P\u00e4randvara jagamise hagiga saab iga kaasp\u00e4rija sundida \u00fchisuse l\u00f5petamist. Seej\u00e4rel j\u00e4rgneb professionaalne hindamine, eriti kinnisvara, ettev\u00f5tte osade v\u00f5i v\u00e4\u00e4rtuslike kollektsioonide puhul. See hindamine on otsustav \u00f5iglase jagamise v\u00f5imaldamiseks.<br\/>Sellele tuginedes peavad p\u00e4rijad l\u00e4bir\u00e4\u00e4kimisi \u00fcksikute varade jaotamise \u00fcle. Kui saavutatakse kokkulepe, fikseeritakse tulemus p\u00e4randvara jagamise kokkuleppes, mida seej\u00e4rel rakendatakse, n\u00e4iteks kinnistusraamatusse kandmise v\u00f5i tasaarvestussummade v\u00e4ljamaksmise kaudu.   <\/p>\n\n<h2 class=\"wp-block-heading\">Vormin\u00f5uded ja maksustamisega seotud kaalutlused<\/h2>\n\n<p>Eriti kinnisvara v\u00f5i osa\u00fchingu osade puhul tuleb j\u00e4rgida erilisi vormin\u00f5udeid. Kinnistud n\u00f5uavad tavaliselt notariaalakti v\u00f5i kinnitatud allkirju. <\/p>\n\n<p>Ka maksustamise seisukohast v\u00f5ib lepingu s\u00f5lmimise aeg olla otsustav: Maksuvaba p\u00e4randvara jagamiseks <a href=\"https:\/\/harlander-partner.eu\/et\/parimisoigus-ettevaatusabinoud\/kinnisvara-omandamise-maks-parimisoiguses\/\">kinnisvaramaksu<\/a> osas tuleb kokkulepe allkirjastada enne <a href=\"https:\/\/harlander-partner.eu\/et\/parimisoigus-ettevaatusabinoud\/paranduse-uleandmine\/\">p\u00e4randvara \u00fcleandmist<\/a>. Vastasel juhul v\u00f5ivad tekkida nii <a href=\"https:\/\/harlander-partner.eu\/et\/parimisoigus-ettevaatusabinoud\/kinnisvara-omandamise-maks-parimisoiguses\/\">kinnisvaramaks<\/a> kui ka kinnisvara tulumaks. <\/p>\n\n<h2 class=\"wp-block-heading\">Rohkem v\u00f5imalusi alates 2017<\/h2>\n\n<p>Alates 2017. aasta seadusemuudatusest saab <a href=\"https:\/\/harlander-partner.eu\/et\/parimisoigus-ettevaatusabinoud\/kohtukomissar\/\"><strong>kohtuvoliniku<\/strong><\/a> juures s\u00f5lmida mitte ainult p\u00e4randvara jagamise kokkuleppeid.
