Iga\u00fcks saab oma selgelt piiritletud osa kinnisasjast. See lahendus on eriti m\u00f5istlik siis, kui kinnistu on piisavalt suur v\u00f5i seda saab eraldada korteromandi asutamise teel. Reaaljagamine on tavaliselt majanduslikult s\u00e4\u00e4stvam lahendus, sest m\u00fc\u00fcgiprotsess ei ole vajalik.   <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-voraussetzung-fur-eine-realteilung\">Reaaljagamise eeldus<\/h3>\n\n<p class=\"wp-block-paragraph\">Et reaaljagamine \u00fcldse k\u00f5ne alla tuleks, peavad olema t\u00e4idetud teatud \u00f5iguslikud ja tegelikud eeldused:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Ehituslikud ja tehnilised tingimused<\/strong> peavad v\u00f5imaldama kinnistu selget ja p\u00fcsivat eraldamist. See v\u00f5ib toimuda krundijaotuse v\u00f5i korteromandi asutamise kaudu. <\/li>\n\n\n\n<li><strong>Jagamine peab olema majanduslikult m\u00f5istlik<\/strong>. <\/li>\n\n\n\n<li>Ei tohi olla <strong>avalik-\u00f5iguslikku takistust<\/strong>.<\/li>\n\n\n\n<li>Jagamine ei tohi <strong>rikkuda seadust v\u00f5i head kommet<\/strong>.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-zivilteilung\">Tsiviiljagamine<\/h3>\n\n<p class=\"wp-block-paragraph\">Kui selline jagamine aga <strong>ei ole v\u00f5imalik v\u00f5i on lubamatu<\/strong>, n\u00e4iteks kuna krunt on liiga v\u00e4ike, ehituslik eraldamine ei ole teostatav v\u00f5i osalejad ei suuda jagamises kokku leppida, toimub <strong>tsiviiljagamine<\/strong>. Sel juhul <strong>m\u00fc\u00fcakse<\/strong> kogu kinnistu oksjonil, tavaliselt avalikult maakohtu kaudu. Teatud olukordades v\u00f5ib see \u00f5igus olla aga <strong>ajutiselt piiratud<\/strong>: siis r\u00e4\u00e4gitakse nn <strong>jagamistakistusest<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-unzeit\">Ebasobiv aeg<\/h3>\n\n<p class=\"wp-block-paragraph\">Ebasobivast ajast r\u00e4\u00e4gitakse siis, kui v\u00e4lised asjaolud ei takista jagamist p\u00fcsivalt, kuid praegu oleks see k\u00f5igi osaliste jaoks kahjulik.<\/p>\n\n<p class=\"wp-block-paragraph\">Ebasobiv aeg ei t\u00e4henda, et n\u00f5ue kaob, vaid ainult seda, et seda <strong>ei saa praegusel hetkel l\u00e4bi suruda<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-nachteil-fur-die-ubrigen\">Kahju teistele<\/h3>\n\n<p class=\"wp-block-paragraph\">Teatud juhtudel v\u00f5ib kohene jagamine \u00fcksikutele kaasomanikele <strong>kujutada lubamatu karmust<\/strong>.
