Seda kohaldatakse, kui p\u00e4randatakse p\u00f5llu- v\u00f5i metsamajanduslik ettev\u00f5te ja t\u00e4idetud on teatud tingimused. Asjakohased eeskirjad ei ole \u00fcleriigiliselt \u00fchtlustatud, vaid sisalduvad kolmes erinevas liidumaa seaduses:  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Talupidamise p\u00e4rimisseadus (AnerbenG)<\/strong> \u2013 kehtib k\u00f5igis liidumaades, v\u00e4lja arvatud K\u00e4rnten ja Tirooli.<\/li>\n\n\n\n<li><strong>K\u00e4rnteni p\u00e4randtalude seadus (KrntErbHG)<\/strong> \u2013 K\u00e4rntenis asuvatele taludele.<\/li>\n\n\n\n<li><strong>Tirooli talude seadus (TirHG)<\/strong> \u2013 nn \u201esuletud taludele&#8221; Tiroolis.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-definition-des-erbhofes\">P\u00e4randtalu m\u00e4\u00e4ratlus<\/h2>\n\n<p>Talu kuulub talupidamise p\u00e4rimis\u00f5iguse alla ainult siis, kui see kvalifitseerub nn <strong>p\u00e4randtaluna<\/strong>. Selleks peavad olema t\u00e4idetud j\u00e4rgmised kriteeriumid: <\/p>\n\n<ul class=\"wp-block-list icon\">\n<li><strong>P\u00f5llu- ja metsamajanduslik ettev\u00f5te<\/strong> koos lisavarustuse ja <strong>talukohaga<\/strong> (mitte ainult metsandus).<\/li>\n\n\n\n<li>Objektiivselt sobiv \u00fclal pidama v\u00e4hemalt kahte, maksimaalselt 40 inimest (m\u00e4\u00e4rav on keskmine tulu koos riiklike ja EL-i toetustega).<\/li>\n\n\n\n<li>Omandi\u00f5igus: f\u00fc\u00fcsiliste isikute ainuomand v\u00f5i abikaasade, registreeritud partnerite, vanema ja lapse v\u00f5i \u00f5dede-vendade kaasomand.<\/li>\n<\/ul>\n    <div class=\"mr-quote mrbg clearfix\">\n        <a class=\"mr-quote-person\" href=\"\/ueber-uns\/rechtsanwalt-sebastian-riedlmair\/\" title=\"Rechtsanwalt Sebastian Riedlmair\">\n            <img decoding=\"async\" class=\"mr-quote-person-img\" src=\"https:\/\/harlander-partner.eu\/wp-content\/themes\/harlander\/design\/sr100.webp\" width=\"100\"\n                 height=\"100\" loading=\"lazy\" alt=\"Rechtsanwalt Sebastian Riedlmair\">\n            <span class=\"mr-quote-person-text\">\n            Sebastian Riedlmair<br>\n            <span class=\"mr-quote-person-function\">Harlander &amp; Partner Rechtsanw\u00e4lte<\/span>\n        <\/span>\n        <\/a>\n        <span class=\"mr-quote-content\">\u201eH\u00f6fe au\u00dferhalb dieser Definition unterliegen nicht dem Anerbenrecht. Die Eintragung eines geschlossenen Hofes in Tirol ist im Grundbuch ersichtlich. \u00c4nderungen der Eigentumsverh\u00e4ltnisse sind nur mit Zustimmung der Grundverkehrsbeh\u00f6rde zul\u00e4ssig.\u201c<\/span>\n    <\/div>\n<a class=\"mr-cta-link mr-cta-button-cal\" href=\"#h2-booking\" title=\"Tasuta esmane konsultatsioon\"><span class=\"mr-cta-link-normal\">Valige sobiv aeg kohe:<\/span><span class=\"mr-cta-link-bold\">Tasuta esmane konsultatsioon<\/span><\/a>\n\n<h2 class=\"wp-block-heading\" id=\"h-wer-wird-anerbe\">Kes saab p\u00e4rijaks?<\/h2>\n\n<p>Talupidamise p\u00e4rimis\u00f5igus lubab ainult <strong>\u00fcht p\u00e4rijat<\/strong>. Teda v\u00f5ib m\u00e4\u00e4rata erinevatel viisidel: <\/p>\n\n<ol class=\"wp-block-list\">\n<li><strong>Viimse tahte avaldusega<\/strong>,<\/li>\n\n\n\n<li><strong>Kaasp\u00e4rijate vastastikusel kokkuleppel<\/strong>,<\/li>\n\n\n\n<li><strong>Seaduse alusel<\/strong>, kui muud m\u00e4\u00e4ramist ei ole tehtud.<\/li>\n<\/ol>\n\n<p>Mitme potentsiaalse p\u00e4rija puhul m\u00e4\u00e4rab seadus kindlaks <strong>j\u00e4rjestuse<\/strong>: talus \u00fcles kasvanud j\u00e4reltulijad on eelistatud abikaasale, viimane omakorda teistele sugulastele. P\u00f5llumajandusliku haridusega j\u00e4reltulijatel on eelis\u00f5igus. V\u00f5rdse positsiooni korral otsustab sugulussuhte l\u00e4hedus v\u00f5i kohalik tava.  <\/p>\n\n<p>P\u00e4rija ei pea p\u00e4randit vastu v\u00f5tma. Der Anerbe haftet mit dem \u00dcbernahmspreis gegen\u00fcber der Verlassenschaft wie ein K\u00e4ufer. Minderj\u00e4hrige Nachkommen haben unter Umst\u00e4nden zus\u00e4tzliche Versorgungsanspr\u00fcche.\u201c<\/span>\n    <\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-anspruche-des-uberlebenden-ehegatten-oder-partners\">\u00dcleelanud abikaasa v\u00f5i partneri n\u00f5uded<\/h2>\n\n<p>Kui \u00fcleelanud abikaasa v\u00f5i partner <strong>ei ole p\u00e4rija<\/strong>, siis on tal \u00f5igus <strong>seaduslikule \u00fclalpidamisele<\/strong>. Kui \u00fcleelanud abikaasa v\u00f5i partner majandab talu p\u00e4rija eest (n\u00e4iteks oma lapse eest), v\u00f5ib talle lisaks anda <strong>kasutusvalduse \u00f5iguse<\/strong> \u2013 maksimaalselt kuni p\u00e4rija 24. eluaastani. <\/p>\n<a class=\"mr-cta-link mr-cta-button-cal\" href=\"#h2-booking\" title=\"Tasuta esmane konsultatsioon\"><span class=\"mr-cta-link-normal\">Valige sobiv aeg kohe:<\/span><span class=\"mr-cta-link-bold\">Tasuta esmane konsultatsioon<\/span><\/a>\n\n<h2 class=\"wp-block-heading\" id=\"h-nachtragserbteilung-bei-weiterverkauf\">T\u00e4iendav p\u00e4randijagamine edasim\u00fc\u00fcgi korral<\/h2>\n\n<p>Kui p\u00e4rija m\u00fc\u00fcb talu v\u00f5i selle osad k\u00fcmne aasta jooksul, tuleb v\u00f5imalik <strong>lisatulu<\/strong> p\u00e4randvarale tagastada. Eesm\u00e4rk on v\u00e4ltida spekulatsiooni eelistatud talu \u00fclev\u00f5tmisega. P\u00e4rija ei pea lisatulu tagastama, kui ta reinvesteerib tulu v\u00f5i kui tema abikaasa v\u00f5i registreeritud partner v\u00f5tab talu \u00fcle.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-bauerlicher-ubergabsvertrag-vs-anerbenrecht\">Talupidamise \u00fcleandmisleping vs talupidamise p\u00e4rimis\u00f5igus<\/h2>\n\n<p>Paljud ettev\u00f5tted antakse \u00fcle juba omanike eluajal, sageli talupidamise \u00fcleandmislepingu vormis. See on omalaadne leping. V\u00e4\u00e4rtuse hindamisel kasutatakse siiski sageli <strong>analoogselt talupidamise p\u00e4rimis\u00f5igust<\/strong>, n\u00e4iteks \u00fclev\u00f5tmishinna arvutamisel. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-ihre-vorteile-mit-anwaltlicher-unterstutzung\">Teie eelised advokaadi abiga<\/h2>\n\n<p>P\u00e4rimisjuhtum talupidamise p\u00e4rimis\u00f5iguse kohaldamisel toob kaasa erilisi v\u00e4ljakutseid. \u00d5iguslikud ja majanduslikud n\u00f5uded on k\u00f5rged.
