The asset is <strong>already lawfully in their possession<\/strong>, for example, because it was handed over or entrusted for care. The punishable act is <strong>not the taking<\/strong>, but <strong>the breach of trust<\/strong>, because the asset is used <strong>contrary to the agreed purpose<\/strong> for their own assets or those of a third party. It is about <strong>what actually happened to the asset<\/strong>, not what the perpetrator thought or intended. What is decisive is that <strong>an asset was entrusted<\/strong> and this asset is <strong>used or retained in breach of duty<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">It is essential that the asset is <strong>already lawfully under the perpetrator&#8217;s control<\/strong>. The entitled party has <strong>knowingly left<\/strong> the asset to the perpetrator, for example, for safekeeping, administration, or use for a specific purpose. The objective element is fulfilled if the perpetrator <strong>uses this asset contrary to the agreed or expected purpose<\/strong> for themselves or for a third party and thereby <strong>visibly withdraws it from the foreign assets<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=133&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 133 StGB<\/a> thus protects <strong>foreign assets from the abuse of trust<\/strong>. The decisive factor is the <strong>actual handling of the entrusted asset<\/strong>, which shows that the trust of the entitled party has been violated. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-qualifizierende-umstande\">Qualifying circumstances<\/h3>\n\n<p class=\"wp-block-paragraph\">Qualified embezzlement exists if <strong>the value of the embezzled asset exceeds certain value limits<\/strong>. If the value of the asset exceeds <strong>5,000 euros<\/strong>, the penalty is significantly increased. If the value is <strong>more than 300,000 euros<\/strong>, there is a particularly serious form of embezzlement, which is punishable by a long prison sentence.  <\/p>\n\n<p class=\"wp-block-paragraph\">The value qualification is based exclusively on <strong>the objective financial loss<\/strong>. The decisive factor is the objective value of the asset at the time of appropriation, not a later proceeds or an individual benefit of the perpetrator. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-prufungsschritte\">Steps of legal assessment<\/h3>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatsubjekt\">Perpetrator:<\/h4>\n\n<p class=\"wp-block-paragraph\">The subject of the offense can be <strong>any person who is criminally responsible<\/strong>, to whom an asset has been <strong>entrusted<\/strong> and who <strong>appropriates this asset in breach of duty<\/strong>. Personal characteristics of the perpetrator are generally irrelevant for the offense. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatobjekt\">Object of the Offense:<\/h4>\n\n<p class=\"wp-block-paragraph\">The object of the offense is <strong>any entrusted asset with asset value<\/strong>. This includes physical objects, amounts of money, and other economically valuable assets. The decisive factor is that the asset was not left to the perpetrator for free disposal, but only for a specific purpose.  <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tathandlung\">Act:<\/h4>\n\n<p class=\"wp-block-paragraph\">The act consists of the <strong>appropriation of the entrusted asset<\/strong>. This exists if the perpetrator <strong>treats the asset as their own entitled party<\/strong>, for example, through consumption, transfer, sale, or other final withdrawal from the assets of the entitled party. A formal transfer of ownership is not required.  <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-taterfolg\">Result of the Offense:<\/h4>\n\n<p class=\"wp-block-paragraph\">The result of the offense is that <strong>the asset is withdrawn from the assets of the entitled party<\/strong> and economically assigned to the perpetrator or a third party. The final misappropriation is sufficient, even if the asset is not used further later. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-kausalitat\">Causality:<\/h4>\n\n<p class=\"wp-block-paragraph\">The financial disadvantage must be <strong>attributable to the perpetrator&#8217;s act of appropriation<\/strong>. The decisive factor is the <strong>abuse of an existing relationship of trust<\/strong>, not the way in which the perpetrator came into possession of the asset. The focus is on the <strong>misappropriation of an entrusted asset<\/strong> and the resulting externally recognizable change in the asset allocation.  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>\u00a7 127 StGB \u2013 Theft:<\/strong> In the case of theft, the <strong>removal of a foreign movable object<\/strong> is in the foreground. At the beginning, the perpetrator has <strong>no lawful power of disposal<\/strong>, but deprives the entitled party of the actual control over the object. In the case of embezzlement, this removal is missing, as the asset has already been voluntarily left to the perpetrator. The distinction is therefore based on whether the perpetrator first takes possession of the asset or whether they abuse an asset that has already been entrusted.   <\/li>\n\n\n\n<li><strong>\u00a7 146 StGB \u2013 Fraud:<\/strong> Fraud requires a <strong>deception<\/strong>, through which the deceived person themselves makes a disposition of assets. In the case of embezzlement, on the other hand, the damage to assets occurs <strong>without deception<\/strong>, solely through the use of an entrusted asset in breach of duty. The decisive factor is that the trust already exists and is not first created by deception.  <\/li>\n\n\n\n<li><strong>\u00a7 153 StGB \u2013 Breach of trust:<\/strong> Breach of trust concerns cases in which someone <strong>abuses their legal authority<\/strong> to dispose of foreign assets or to obligate another. In the case of embezzlement, on the other hand, it concerns <strong>specifically entrusted assets<\/strong>, not a comprehensive asset management. The distinction is made according to whether the perpetrator violates a general asset responsibility or uses a single entrusted asset for a purpose other than that intended.  <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-konkurrenzen\">Concurrences:<\/h3>\n\n<h4 class=\"wp-block-heading\" id=\"h-echte-konkurrenz\">Genuine concurrence:<\/h4>\n\n<p class=\"wp-block-paragraph\">Genuine concurrence exists if <strong>further independent offenses are added to the embezzlement<\/strong>, such as fraud, forgery of documents, or breach of trust against various asset holders. <strong>The injustice of the embezzlement remains independent<\/strong>, because in addition to the breach of trust, <strong>further legal interests are violated<\/strong>. The offenses then stand <strong>side by side<\/strong>. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-unechte-konkurrenz\">Spurious Concurrence:<\/h4>\n\n<p class=\"wp-block-paragraph\">A non-genuine concurrence comes into consideration if <strong>another offense already completely covers the entire injustice of the embezzlement<\/strong>. This is particularly relevant if <strong>a more specific asset offense completely includes the breach of trust<\/strong>. In these cases, <strong>the embezzlement recedes<\/strong>, because no additional core of injustice remains.  <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatmehrheit\">Plurality of acts:<\/h4>\n\n<p class=\"wp-block-paragraph\">Plurality of acts exists if <strong>several acts of embezzlement are committed independently<\/strong>, for example, in the case of <strong>appropriations separated in time<\/strong> or in the case of <strong>different entrusted assets<\/strong>. <strong>Each appropriation in breach of duty constitutes a separate act<\/strong>, provided that there is no close connection.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-fortgesetzte-handlung\">Continued action:<\/h4>\n\n<p class=\"wp-block-paragraph\">A continued action can be assumed if <strong>several appropriations are closely related in time<\/strong> and <strong>are supported by a uniform intention to commit the act<\/strong>, for example, in the case of repeated access to entrusted assets within the framework of the same plan. <strong>The act ends<\/strong> as soon as no further appropriations take place or <strong>the perpetrator abandons their intention<\/strong>.<\/p>\n    <div class=\"mr-quote mrbg clearfix\">\n        <a class=\"mr-quote-person\" href=\"\/en\/about-us\/sebastian-riedlmair\/\" title=\"Attorney Sebastian Riedlmair\">\n            <img decoding=\"async\" class=\"mr-quote-person-img\" src=\"https:\/\/harlander-partner.eu\/wp-content\/themes\/harlander\/design\/sr100.webp\" width=\"100\"\n                 height=\"100\" loading=\"lazy\" alt=\"Attorney Sebastian Riedlmair\">\n            <span class=\"mr-quote-person-text\">\n            Sebastian Riedlmair<br>\n            <span class=\"mr-quote-person-function\">Harlander &amp; Partner Attorneys<\/span>\n        <\/span>\n        <\/a>\n        <span class=\"mr-quote-content\">\u201eThe criminal classification does not depend on the label of the legal relationship, but on whether a specific entrusted asset was withdrawn from the foreign assets for a purpose other than that intended.\u201c<\/span>\n    <\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-beweislast-amp-beweiswurdigung\">Burden of proof and evaluation of evidence<\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-staatsanwaltschaft\">Public prosecutor&#8217;s office:<\/h3>\n\n<p class=\"wp-block-paragraph\">The public prosecutor&#8217;s office must prove that <strong>embezzlement exists<\/strong>, i.e. that <strong>an asset was entrusted<\/strong> and <strong>was appropriated in breach of duty<\/strong>. What is decisive is not a removal, but that the asset <strong>was already lawfully with the accused<\/strong> and <strong>was used contrary to the agreed purpose<\/strong>. In addition, for higher amounts, the <strong>value of the asset<\/strong> must be determined, as the penalty depends on this.  <\/p>\n\n<p class=\"wp-block-paragraph\">It must be proven, in particular, that<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>an entrusted asset was present<\/strong>, for example, through handover, safekeeping, or administration<\/li>\n\n\n\n<li><strong>the accused had actual power of disposal<\/strong> over this asset<\/li>\n\n\n\n<li><strong>the asset was used for a purpose other than that intended for themselves or a third party<\/strong><\/li>\n\n\n\n<li><strong>this resulted in a shift in assets to the outside world<\/strong><\/li>\n\n\n\n<li><strong>no consent or authorization<\/strong> existed for this use<\/li>\n\n\n\n<li><strong>the value of the asset<\/strong> exceeds the relevant value limits, if relevant<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Contracts, invoices, accounting documents, account statements, witness statements, e-mails, or other documents from which trust, earmarking, and use result serve as <strong>evidence<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-gericht\">Court:<\/h3>\n\n<p class=\"wp-block-paragraph\">The court assesses all evidence <strong>in the overall context<\/strong> and examines whether it is shown according to objective standards that <strong>an entrusted asset was appropriated in breach of duty<\/strong>. The focus is on the question of whether the behavior of the accused <strong>visibly represents a breach of trust<\/strong> and has led to an <strong>unlawful shift in assets<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">In doing so, the court particularly considers:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Type of trust<\/strong> and the agreed earmarking<\/li>\n\n\n\n<li><strong>Powers of disposal<\/strong> of the accused<\/li>\n\n\n\n<li><strong>Concrete use or transfer<\/strong> of the asset<\/li>\n\n\n\n<li><strong>Time and course<\/strong> of the appropriation<\/li>\n\n\n\n<li><strong>Documents or witness statements<\/strong> that prove misappropriation<\/li>\n\n\n\n<li><strong>Evidence of the value of the asset<\/strong>, if relevant<\/li>\n\n\n\n<li>whether a reasonable average person would assume <strong>handling in breach of duty<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">To be distinguished are mere <strong>administrative errors, misunderstandings, late returns, or civil law disputes<\/strong>, in which there is no breach of trust relevant under criminal law.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-beschuldigte-person\">Accused person:<\/h3>\n\n<p class=\"wp-block-paragraph\">The accused person bears <strong>no burden of proof<\/strong>. What is decisive is not what the money was spent on, but that the trust placed in them was broken.     <\/li>\n\n\n\n<li><strong>Misappropriation of an entrusted object:<\/strong><br\/>An employee receives a high-quality work device from their employer for official use. Without consent, they pass the device on to a third party, who keeps it permanently. The object was <strong>knowingly entrusted<\/strong> to the employee and not left for free disposal. By passing it on, the object is <strong>withdrawn from the access of the entitled party<\/strong> and appropriated to a third party. The objective element of embezzlement is fulfilled because the asset was used in breach of duty and the asset allocation was changed. The value of the device can be decisive for the amount of the penalty.     <\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">These examples show that embezzlement according to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=133&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 133 StGB<\/a> exists if <strong>entrusted assets are used or passed on contrary to their intended purpose<\/strong>. The decisive factor is the <strong>externally recognizable breach of trust<\/strong>, not the duration of use or a later intention to return. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-subjektiver-tatbestand\">subjective elements of the offence<\/h2>\n\n<p class=\"wp-block-paragraph\">The subjective element of embezzlement under <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=133&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 133 StGB<\/a> requires <strong>intent and intent to enrich oneself<\/strong>. The perpetrator must know that an asset has been <strong>entrusted<\/strong> to them and that this asset <strong>does not belong to them<\/strong>, but that they only hold it for a specific purpose or in the interest of another. They must recognize that they <strong>are not free to dispose of it<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">The intent must relate to the fact that the perpetrator <strong>uses the entrusted asset in breach of duty for themselves or for a third party<\/strong> and thus <strong>consciously changes the asset allocation<\/strong>. It is sufficient if the perpetrator seriously considers it possible and willingly accepts that they are adding the foreign asset to their own assets or those of a third party through their behavior. A special intention is not required, <strong>conditional intent is sufficient<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">In addition, <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=133&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 133 StGB<\/a> requires an <strong>intent to enrich oneself<\/strong>. The perpetrator must at least willingly accept to <strong>obtain an unlawful financial advantage<\/strong> for themselves or a third party, for example, by retaining, using, passing on, or exploiting the entrusted asset. The decisive factor is that the perpetrator knows or accepts that this advantage <strong>is not legally entitled to them<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">In the case of the <strong>value-qualified forms<\/strong> of embezzlement, the intent must also extend to the <strong>value of the asset<\/strong>. The perpetrator must at least expect and accept that the value exceeds the relevant limit of 5,000 euros or, if applicable, 300,000 euros. It is sufficient if they seriously consider the higher value possible. On the other hand, anyone who seriously assumes that the asset is significantly below the value limit does not subjectively realize the qualified form.   <\/p>\n\n<p class=\"wp-block-paragraph\">There is no subjective element if the perpetrator <strong>in good faith assumes<\/strong> to be entitled to use the asset, if they assume an <strong>effective consent<\/strong> of the entitled party, or if they seriously believe to use the asset within the framework of the agreed purpose. Anyone who engages in conduct that <strong>recognizably interferes with the rights of others<\/strong> cannot claim that they did not recognize the illegality. Everyone is obliged to inform themselves about the <strong>legal limits<\/strong> of their actions. Mere ignorance or a reckless error does not absolve one of responsibility.   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Principle of culpability:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Only those who act <strong>culpably<\/strong> are punishable. Intentional offenses require that the perpetrator recognizes the essential events and at least <strong>accepts them as a possibility<\/strong>. If this intent is lacking, for example, because the perpetrator mistakenly assumes that their behavior is permitted or is <strong>voluntarily supported<\/strong>, at most negligence exists. This is not sufficient for intentional offenses.   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Incapacity to be held accountable:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">No guilt is attributed to someone who, at the time of the offense, was unable to recognize the injustice of their actions or to act in accordance with this insight due to a <strong>severe mental disorder<\/strong>, a <strong>pathological mental impairment<\/strong>, or a <strong>significant inability to control their actions<\/strong>. In case of corresponding doubts, a <strong>psychiatric assessment<\/strong> will be obtained. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/exculpatory-necessity\/\">Excusable state of necessity<\/a>:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">An excusable state of necessity may exist if the perpetrator acts in an <strong>extreme situation of duress<\/strong> in order to avert an <strong>acute danger<\/strong> to their own life or the lives of others. The behavior remains unlawful but can have a <strong>mitigating<\/strong> or excusing effect if there was no other way out. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/erroneous-assumption-of-justifying-circumstances\/\">Putative self-defense<\/a>:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Anyone who mistakenly believes that they are entitled to an act of defense acts without intent if the error was <strong>serious and comprehensible<\/strong>. Such an error can <strong>reduce or exclude guilt<\/strong>. However, if a breach of duty of care remains, a negligent or mitigating assessment comes into consideration, but not a justification.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-strafaufhebung-amp-diversion\">Extinction of punishment and diversion<\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-diversion\">Diversion:<\/h3>\n\n<p class=\"wp-block-paragraph\">A diversion is generally <strong>not excluded<\/strong> in the case of <strong>embezzlement under <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=133&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 133 of the Criminal Code<\/a><\/strong>, but is considered <strong>with restraint<\/strong>. The offense requires a <strong>deliberate breach of trust<\/strong>, as an entrusted asset is misappropriated in breach of duty. This is regularly associated with an increased injustice, which only allows a diversionary settlement to a limited extent.  <\/p>\n\n<p class=\"wp-block-paragraph\">In cases in which <strong>the value of the embezzled property is low<\/strong>, the perpetrator <strong>is a first-time offender<\/strong>, <strong>acts with insight<\/strong>, and the <strong>damage caused is quickly and fully compensated<\/strong>, a diversion can nevertheless be considered. As the amount of damage increases, especially when the statutory value limits are exceeded, and in the case of a targeted or prolonged approach, the probability of a diversionary settlement decreases significantly. <\/p>\n\n<p class=\"wp-block-paragraph\">Diversion may be considered if<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>the overall guilt is minor<\/strong>,<\/li>\n\n\n\n<li><strong>the financial damage is manageable<\/strong>,<\/li>\n\n\n\n<li><strong>no special position of trust has been seriously abused<\/strong>,<\/li>\n\n\n\n<li><strong>no serious consequential effects have occurred<\/strong>,<\/li>\n\n\n\n<li><strong>there is no systematic or repeated behavior<\/strong>,<\/li>\n\n\n\n<li><strong>the facts are clear and simple<\/strong>,<\/li>\n\n\n\n<li><strong>the perpetrator is insightful, cooperative, and willing to compromise<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">If a diversion is considered, the court may order <strong>monetary payments<\/strong>, <strong>community service<\/strong>, <strong>supervision orders<\/strong>, or a <strong>victim-offender mediation<\/strong>. A diversion <strong>does not lead to a conviction or a criminal record<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-ausschluss-der-diversion\">Exclusion of Diversion:<\/h3>\n\n<p class=\"wp-block-paragraph\">Diversion is excluded if<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>significant financial damage has occurred<\/strong>,<\/li>\n\n\n\n<li><strong>the statutory value limits have been significantly exceeded<\/strong>,<\/li>\n\n\n\n<li><strong>a particularly pronounced position of trust has been abused<\/strong>,<\/li>\n\n\n\n<li><strong>the act was committed deliberately or over a longer period of time<\/strong>,<\/li>\n\n\n\n<li><strong>several independent acts of embezzlement exist<\/strong>,<\/li>\n\n\n\n<li><strong>there is repeated or systematic behavior<\/strong>,<\/li>\n\n\n\n<li><strong>special aggravating circumstances are added<\/strong>,<\/li>\n\n\n\n<li><strong>the overall behavior constitutes a serious violation of the property interests of others<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Only in the case of <strong>clearly minor guilt<\/strong>, <strong>rapid compensation for damages<\/strong> and <strong>clear insight<\/strong> can it be examined in individual cases whether an exceptional diversionary procedure is permissible. In practice, diversion in the case of <strong><a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=133&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 133 of the Criminal Code<\/a> is possible<\/strong>, but <strong>strictly limited<\/strong> and strongly dependent on the specific circumstances of the individual case. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-strafzumessung-amp-folgen\">Sentencing and consequences<\/h2>\n\n<p class=\"wp-block-paragraph\">The court assesses the penalty according to the <strong>extent of the financial intervention<\/strong>, the <strong>nature, duration and intensity of the breach of duty<\/strong>, and the <strong>extent to which the abuse of the entrusted property<\/strong> has impaired the economic position of the entitled party. It exists if an entrusted asset is intentionally misappropriated in order to unlawfully enrich oneself or a third party. The statutory penalty is <strong>imprisonment for up to six months or a fine of up to 360 daily rates<\/strong>.   <\/p>\n\n<p class=\"wp-block-paragraph\">If the <strong>value of the embezzled property exceeds \u20ac5,000<\/strong>, the value qualification of \u00a7 133 para. 2 first case of the Criminal Code applies. In these cases, the penalty is increased to <strong>imprisonment for up to three years<\/strong>. Only the objective value of the entrusted property at the time of the offense is decisive.   <\/p>\n\n<p class=\"wp-block-paragraph\">If the <strong>value of the embezzled property exceeds \u20ac300,000<\/strong>, this constitutes a particularly serious form of embezzlement pursuant to \u00a7 133 para. 2 second case of the Criminal Code. The law provides for a significantly increased penalty of <strong>one to ten years&#8217; imprisonment<\/strong> for this. A fine is no longer provided for in this constellation.   <\/p>\n\n<p class=\"wp-block-paragraph\">The penalty is based exclusively on the <strong>value of the entrusted and misappropriated property<\/strong>. Further modalities of the execution of the offense do not constitute independent qualifications, but can be taken into account in the context of sentencing. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-geldstrafe-tagessatzsystem\">Monetary Penalty \u2013 Day-fine System<\/h2>\n\n<p class=\"wp-block-paragraph\">Austrian criminal law calculates monetary penalties according to the <strong>day-fine system<\/strong>. The <strong>number of day-fines<\/strong> depends on the <strong>guilt<\/strong>, the <strong>amount per day<\/strong> depends on the <strong>financial capacity<\/strong>. In this way, the penalty is adapted to the personal circumstances and yet remains noticeable.  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Range:<\/strong> up to <strong>720 daily rates<\/strong> \u2013 at least <strong>\u20ac4<\/strong>, maximum <strong>\u20ac5,000<\/strong> per day.<\/li>\n\n\n\n<li><strong>Practical formula:<\/strong> Approximately <strong>6 months imprisonment corresponds to around 360 day-fines<\/strong>. This conversion serves only as <strong>orientation<\/strong> and is <strong>not a rigid scheme<\/strong>. <\/li>\n\n\n\n<li><strong>In case of non-payment:<\/strong> The court can impose a <strong>substitute custodial sentence<\/strong>. As a rule, the following applies: <strong>1 day of substitute custodial sentence corresponds to 2 day-fines<\/strong>. <\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\" id=\"h-hinweis\">Note:<\/h4>\n\n<p class=\"wp-block-paragraph\">In the case of <strong>Embezzlement under \u00a7 133 para. 1 of the Criminal Code <\/strong> , a fine is expressly provided for and is common in practice, especially in the case of minor guilt, first-time offenders or full compensation for damages.<\/p>\n\n<p class=\"wp-block-paragraph\">In the case of <strong>qualified embezzlement under \u00a7 133 para. 2 of the Criminal Code <\/strong> , on the other hand, the fine recedes significantly into the background. With increasing damage and especially when the value limit of <strong>\u20ac300,000<\/strong> is exceeded, only a <strong>prison sentence<\/strong> is regularly considered. A fine is no longer provided for by law or is factually excluded in these cases.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-freiheitsstrafe-amp-teil-bedingte-nachsicht\">Imprisonment and (partially) suspended sentence<\/h2>\n\n<p class=\"wp-block-paragraph\">\u00a7 37 of the Criminal Code: If the statutory penalty is <strong>up to five years&#8217; imprisonment<\/strong>, the court may <strong>impose a fine instead of a short prison sentence of no more than one year<\/strong>. This possibility therefore exists <strong>also in the case of embezzlement under <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=133&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 133 of the Criminal Code<\/a><\/strong>, especially in the basic form with low guilt and limited financial damage. <\/p>\n\n<p class=\"wp-block-paragraph\">In the case of <strong>high value qualifications with a statutory minimum prison sentence<\/strong>, an application is excluded.<\/p>\n\n<p class=\"wp-block-paragraph\">\u00a7 43 of the Criminal Code: A prison sentence can <strong>be conditionally suspended<\/strong> if it <strong>does not exceed two years<\/strong> and the perpetrator has <strong>a positive social prognosis<\/strong>. This possibility exists <strong>also in the case of embezzlement<\/strong>.
