The perpetrator takes away a movable object belonging to another person by breaking foreign custody and establishing new custody, acting intentionally and with the aim of unlawfully enriching himself or a third party. The increased injustice results either from the revenue generation aimed at repetition or from the organized form of commission within a connection of several persons established for a longer period of time. <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> increases the penalty because these methods of commission show an increased level of planning and criminal energy.  <\/p>\n\n<div class=\"wp-block-uagb-container uagb-block-f014c6a5 alignfull uagb-is-root-container\">\n<div class=\"wp-block-uagb-container uagb-block-60e61cc5\">\n<p class=\"wp-block-paragraph\">A theft according to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> exists if a movable object belonging to another person is intentionally taken away and the perpetrator either acts commercially or commits the theft as a member of a criminal association.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-container uagb-block-613eb3e6\"><picture>\n\t\t<source srcset=\"https:\/\/harlander-partner.eu\/wp-content\/uploads\/\u00a7130-Gewerbsmaessiger-Diebstahl-und-Diebstahl-im-Rahmen-einer-kriminellen-Vereinigung-352x198.webp\" >\n\t\t<img decoding=\"async\" class=\"mr-picture-small\" src=\"https:\/\/harlander-partner.eu\/wp-content\/uploads\/\u00a7130-Gewerbsmaessiger-Diebstahl-und-Diebstahl-im-Rahmen-einer-kriminellen-Vereinigung.webp\" alt=\"Commercial theft and theft in criminal association. Therefore, the <strong>removal of a movable object belonging to another person<\/strong> is required. Removal means that the perpetrator <strong>removes the actual control of the entitled party<\/strong> and establishes <strong>new custody<\/strong> himself or through a third party.  <\/p>\n\n<p class=\"wp-block-paragraph\">In addition, the offense requires a <strong>special form of commission<\/strong>. Objectively relevant is, in particular, that the theft is committed <strong>within the framework of a criminal association<\/strong>. This exists if the perpetrator acts <strong>as a member of a group established for a longer period of time<\/strong>, which is oriented towards the <strong>repeated commission of criminal acts<\/strong>, and <strong>cooperates with another member<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">Also in the case of <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a>, the <strong>short-term acquisition of actual control over the object<\/strong> is sufficient if the entitled party thereby loses control over the object. <strong>Permanent possession is not required<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">Insofar as <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> also mentions the <strong>commercial commission<\/strong>, it should be pointed out that this is an <strong>internal intention of the perpetrator<\/strong>. This belongs to the <strong>subjective element of the offense<\/strong> and is explained separately there. <\/p>\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> is based on the <strong>basic element of theft<\/strong> and <strong>increases the penalty<\/strong> because of the particular danger of <strong>organized or systematic commission of the offense<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-qualifizierende-umstande\">Qualifying circumstances<\/h3>\n\n<p class=\"wp-block-paragraph\">A theft according to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> exists objectively if the removal is carried out <strong>as a member of a criminal<\/strong> <strong>association with the participation of another member<\/strong>. Required is a <strong>connection of several persons established for a longer period of time<\/strong>, which is directed towards the <strong>repeated commission of criminal acts<\/strong> and within whose organizational framework the perpetrator acts. <\/p>\n\n<p class=\"wp-block-paragraph\">In addition, <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> also mentions the <strong>commercial commission<\/strong> as a qualification. However, it should be noted that the commercial nature is <strong>not an objectively ascertainable circumstance of the execution of the act<\/strong>, but is based on the <strong>internal objective of the perpetrator<\/strong> to obtain a continuous source of income through repeated thefts. It therefore represents a <strong>subjective element of the offense<\/strong> and is explained in more detail in the section on the subjective element of the offense.  <\/p>\n\n<p class=\"wp-block-paragraph\">The <strong>specific type of removal<\/strong> depends on the respective basic offense or the further qualified form of theft on which <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> is based. <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> does <strong>not refer to specific types of execution<\/strong> such as burglary or carrying weapons, but to the <strong>organizational or repetitive context of the act<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-prufungsschritte\">Steps of legal assessment<\/h3>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatsubjekt\">Perpetrator:<\/h4>\n\n<p class=\"wp-block-paragraph\">The perpetrator can be <strong>any person responsible under criminal law<\/strong>. When committing the offense within the framework of a criminal association, the perpetrator must be a <strong>member of this association<\/strong> and act <strong>with the participation of another member<\/strong>. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatobjekt\">Object of the Offense:<\/h4>\n\n<p class=\"wp-block-paragraph\">The object of the offense is <strong>any movable physical object belonging to another person with asset value<\/strong>. An object is foreign if it <strong>does not belong exclusively to the perpetrator<\/strong>. Movable is any object that <strong>can actually be taken away<\/strong>.  <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tathandlung\">Act: <\/h4>\n\n<p class=\"wp-block-paragraph\">The act consists of the <strong>removal of the object without or against the will of the entitled party<\/strong>. The qualification results from the <strong>commission as a member of a criminal association<\/strong>, not from the type of removal. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-taterfolg\">Result of the Offense:<\/h4>\n\n<p class=\"wp-block-paragraph\">The success of the act lies in the fact that the entitled party <strong>loses actual control over the object<\/strong> and the perpetrator <strong>acquires new custody<\/strong>. Even a <strong>short-term taking<\/strong> is sufficient. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-kausalitat\">Causality:<\/h4>\n\n<p class=\"wp-block-paragraph\">The loss of control must be <strong>attributable to the perpetrator&#8217;s act of removal<\/strong>. Without this action, the success <strong>would not have occurred<\/strong>. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-objektive-zurechnung\">Objective Attribution: <\/h4>\n\n<p class=\"wp-block-paragraph\">The success is objectively attributable if exactly the <strong>risk is realized<\/strong> that <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> wants to prevent, namely the <strong>unauthorized removal of foreign objects within the framework of organized and repetitive theft structures<\/strong>.<\/p>\n    <div class=\"mr-quote mrbg clearfix\">\n        <a class=\"mr-quote-person\" href=\"\/en\/about-us\/sebastian-riedlmair\/\" title=\"Attorney Sebastian Riedlmair\">\n            <img decoding=\"async\" class=\"mr-quote-person-img\" src=\"https:\/\/harlander-partner.eu\/wp-content\/themes\/harlander\/design\/sr100.webp\" width=\"100\"\n                 height=\"100\" loading=\"lazy\" alt=\"Attorney Sebastian Riedlmair\">\n            <span class=\"mr-quote-person-text\">\n            Sebastian Riedlmair<br>\n            <span class=\"mr-quote-person-function\">Harlander &amp; Partner Attorneys<\/span>\n        <\/span>\n        <\/a>\n        <span class=\"mr-quote-content\">\u201eA joint theft is not sufficient for \u00a7 130 StGB. Here, too, a movable object belonging to another person is intentionally taken away, so that the entitled party loses actual control and the perpetrator establishes new custody. However, the increased injustice does <strong>not result from the type of removal<\/strong>, but from the <strong>organizational context or the repetitive commission of the act<\/strong>.  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>\u00a7 142 StGB \u2013 Robbery:<\/strong> Robbery differs from theft according to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> in that <strong>violence against a person or dangerous threat<\/strong> is used to enable or maintain the removal. While a removal also exists in the case of <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a>, the attack in the case of robbery is directed <strong>directly against the person<\/strong>. If violence is used or threatened, there is no longer theft, but robbery with a significantly higher penalty.  <\/li>\n\n\n\n<li><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/unauthorized-medical-treatment-2\/\" title=\"Property damage\">\u00a7 125 StGB<\/a> \u2013 Damage to property:<\/strong> Damage to property covers the <strong>intentional impairment of a foreign object<\/strong>, which worsens its condition or usability. The entitled party does not lose the object in the process, it remains in his possession. In the case of theft according to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a>, on the other hand, the <strong>removal of the object itself<\/strong> is in the foreground. If damage and removal are combined, for example if an object is damaged and then stolen, <strong>damage to property and theft exist side by side<\/strong>, as different legal interests are violated.   <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\" id=\"h-konkurrenzen\">Concurrences:<\/h3>\n\n<h4 class=\"wp-block-heading\" id=\"h-echte-konkurrenz\">Genuine Concurrence: <\/h4>\n\n<p class=\"wp-block-paragraph\">Genuine concurrence exists if, in addition to the <strong>theft according to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a><\/strong>, further <strong>independent offenses<\/strong> are added, such as <strong>damage to property, trespassing or dangerous threat<\/strong>. The theft retains its <strong>independent content of injustice<\/strong> and is not displaced. If <strong>several legal interests are violated<\/strong>, the offenses stand <strong>side by side<\/strong>.  <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-unechte-konkurrenz\">Spurious Concurrence:<\/h4>\n\n<p class=\"wp-block-paragraph\">A displacement due to <strong>specialty<\/strong> comes into consideration if another element of the offense already includes the <strong>entire content of injustice<\/strong> of the theft. This is particularly the case with <strong>further qualified forms of theft<\/strong>, if additional aggravating circumstances such as burglary or particularly serious methods of commission are added. In such cases, the <strong>simpler qualification is withdrawn<\/strong>.  <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatmehrheit\">Multiple Offenses: <\/h4>\n\n<p class=\"wp-block-paragraph\">Multiple offenses exist if <strong>several thefts<\/strong> are committed independently, for example in the case of <strong>removals separated in time<\/strong> or in the case of <strong>different objects of the offense<\/strong>. <strong>Each removal forms its own act<\/strong>, provided that <strong>no natural unit of action<\/strong> exists.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-fortgesetzte-handlung\">Continued Action: <\/h4>\n\n<p class=\"wp-block-paragraph\">A <strong>unitary act<\/strong> can be assumed if <strong>several removals<\/strong> are in <strong>close temporal and factual connection<\/strong> and are supported by a <strong>unitary plan of action<\/strong>, for example in the case of <strong>commercial action<\/strong> or within the framework of a <strong>joint concept of action within a criminal association<\/strong>. Decisive is the proof that the entitled party has lost actual control over the object and that the accused himself or through a third party has established new custody. In addition, it must be determined that the theft was committed <strong>either within the framework of a criminal association<\/strong> or <strong>commercially<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">It must be proven, in particular, that<\/p>\n\n<ul class=\"wp-block-list\">\n<li>an act of taking away was actually carried out,<\/li>\n\n\n\n<li>the object belonged to someone else, i.e., was not exclusively owned by the accused,<\/li>\n\n\n\n<li>the entitled party has lost actual control over the object,<\/li>\n\n\n\n<li>the accused has established new custody, even if this was only short-term,<\/li>\n\n\n\n<li>the removal is causally related to the behavior of the accused,<\/li>\n\n\n\n<li>a qualifying circumstance of <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> exists, i.e. either the commission of the act as a member of a criminal association or a commercial objective<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">In the case of the <strong>criminal association<\/strong>, it must be proven that the accused acted as a member of a connection of several persons established for a longer period of time and committed the act with the participation of another member.<br\/>In the case of <strong>commerciality<\/strong>, it must be shown that the perpetrator acted with the intention of obtaining a continuous source of income through repeated thefts.<\/p>\n\n<p class=\"wp-block-paragraph\">The public prosecutor&#8217;s office must also present whether the alleged removal and the qualifying circumstance are objectively ascertainable, for example through witness statements, video recordings, communication data, organizational processes, earlier similar acts or other comprehensible circumstances.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-gericht\">Court: <\/h3>\n\n<p class=\"wp-block-paragraph\">The court examines <strong>all evidence in the overall context<\/strong> and assesses whether, according to <strong>objective standards<\/strong>, a removal exists and the requirements of <strong><a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> are met<\/strong>. The focus is on the question of whether the entitled party has <strong>actually lost<\/strong> the object, whether this loss is <strong>attributable<\/strong> to the accused and whether the <strong>qualifying connection<\/strong> of the act is proven. <\/p>\n\n<p class=\"wp-block-paragraph\">In doing so, the court particularly considers:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>the <strong>custody relationships<\/strong> before and after the incident,<\/li>\n\n\n\n<li><strong>type and course<\/strong> of the alleged removal,<\/li>\n\n\n\n<li><strong>time and duration<\/strong> of the loss of control,<\/li>\n\n\n\n<li><strong>witness statements<\/strong> on the course of the act and the participation of the accused,<\/li>\n\n\n\n<li><strong>objective evidence<\/strong> such as video recordings or communication data,<\/li>\n\n\n\n<li>circumstances that suggest an <strong>organized commission of the act<\/strong> or a <strong>repetitive approach<\/strong>,<\/li>\n\n\n\n<li>whether a <strong>reasonable average person<\/strong> would assume that the object was removed from the entitled party and that the act falls within the <strong>qualified framework<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The court clearly distinguishes between <strong>mere misunderstandings<\/strong>, <strong>oversights<\/strong>, <strong>temporary transfers of possession<\/strong>, or <strong>situations without a real loss of control<\/strong>, which do not constitute a removal that fulfills the elements of the offense.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-beschuldigte-person\">Accused Person: <\/h3>\n\n<p class=\"wp-block-paragraph\">The accused person bears <strong>no burden of proof<\/strong>. Decisive is not the individual value of the goods, but that the perpetrator aims from the beginning to obtain a continuous source of income through repeated thefts. The removal therefore fulfills a theft according to \u00a7 127 StGB, which is to be assessed as a qualified theft according to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> due to the commercial objective.    <\/li>\n\n\n\n<li><strong>Theft within the framework of a criminal association:<\/strong> Several persons permanently join together to steal bicycles from residential complexes in a division of labor. One participant scouts out suitable objects, another takes over the removal, a third organizes the removal. In a concrete act, the perpetrator steals a locked bicycle from the inner courtyard of an apartment building and hands it over directly to another member of the group. The owner loses actual control over the object, while new custody is established within the group. Since the act is committed as a member of an association established for a longer period of time and with the participation of another member, there is a qualified theft according to <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a>.    <\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">These examples show that <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> does not refer to special types of execution of the removal, but to the <strong>revenue generation aimed at repetition<\/strong> or to the <strong>organized commission within a group<\/strong>. Decisive remains the loss of actual control over the object, not the duration of the removal or the later use. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-subjektiver-tatbestand\">subjective elements of the offence<\/h2>\n\n<p class=\"wp-block-paragraph\">The subjective element of theft under <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> requires <strong>intent<\/strong>. The perpetrator must know that they are <strong>taking away someone else&#8217;s movable property<\/strong> by depriving the entitled party of actual control and establishing new possession themselves. They must recognize that the item <strong>does not belong to them<\/strong> and that the removal occurs <strong>without the consent of the entitled party<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">The perpetrator must therefore understand that their behavior, in its entirety, constitutes a <strong>targeted removal of someone else&#8217;s property<\/strong> and is typically suitable to exclude the entitled party from using and disposing of the item. For intent, it is sufficient that the perpetrator <strong>seriously considers the removal possible and accepts it<\/strong>. Intentional purpose is not required; <strong>conditional intent is sufficient<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">In addition, the intent must also extend to the <strong>qualifying characteristic of <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a><\/strong>. If the perpetrator acts <strong>as a member of a criminal organization<\/strong>, they must at least tacitly accept <strong>acting within this organized structure<\/strong> and <strong>with the participation of another member<\/strong>. In the case of <strong>commercial commission<\/strong>, it is necessary that the perpetrator acts with the <strong>intention<\/strong> of obtaining a <strong>continuous source of income through repeated thefts<\/strong>. This objective represents a <strong>subjective element of the offense<\/strong>.   <\/p>\n\n<p class=\"wp-block-paragraph\">Furthermore, theft also requires an <strong>intent to enrich oneself<\/strong>. The perpetrator must at least tacitly accept obtaining an <strong>unlawful financial advantage<\/strong> for themselves or a third party, for example, by keeping, using, passing on, or selling the item. This inner objective is typical for property offenses and must also be present in qualified theft.  <\/p>\n\n<p class=\"wp-block-paragraph\">There is no subjective element if the perpetrator <strong>sincerely believes<\/strong> to be entitled to the removal, if they assume <strong>consent from the entitled party<\/strong>, or if they assume they have a claim to the item. Anyone who engages in conduct that <strong>recognizably interferes with the rights of others<\/strong> cannot claim that they did not recognize the illegality. Everyone is obliged to inform themselves about the <strong>legal limits<\/strong> of their actions. Mere ignorance or a reckless error does not absolve one of responsibility.   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Principle of culpability:<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">Only those who act <strong>culpably<\/strong> are punishable. Intentional offenses require that the perpetrator recognizes the essential events and at least <strong>accepts them as a possibility<\/strong>. If this intent is lacking, for example, because the perpetrator mistakenly assumes that their behavior is permitted or is <strong>voluntarily supported<\/strong>, at most negligence exists. This is not sufficient for intentional offenses.   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Incapacity to be held accountable:<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">No guilt is attributed to someone who, at the time of the offense, was unable to recognize the injustice of their actions or to act in accordance with this insight due to a <strong>severe mental disorder<\/strong>, a <strong>pathological mental impairment<\/strong>, or a <strong>significant inability to control their actions<\/strong>. In case of corresponding doubts, a <strong>psychiatric assessment<\/strong> will be obtained. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/exculpatory-necessity\/\">Excusable state of necessity<\/a>:<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">An excusable state of necessity may exist if the perpetrator acts in an <strong>extreme situation of duress<\/strong> in order to avert an <strong>acute danger<\/strong> to their own life or the lives of others. The behavior remains unlawful but can have a <strong>mitigating<\/strong> or excusing effect if there was no other way out. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/erroneous-assumption-of-justifying-circumstances\/\">Putative self-defense<\/a>:<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">Anyone who mistakenly believes that they are entitled to an act of defense acts without intent if the error was <strong>serious and comprehensible<\/strong>. Such an error can <strong>reduce or exclude guilt<\/strong>. However, if a breach of duty of care remains, a negligent or mitigating assessment comes into consideration, but not a justification.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-strafaufhebung-amp-diversion\">Extinction of punishment and diversion<\/h2>\n\n<h3 class=\"wp-block-heading\" id=\"h-diversion\">Diversion:<\/h3>\n\n<p class=\"wp-block-paragraph\">A diversion in the case of theft under <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> is <strong>not fundamentally excluded<\/strong>, but is <strong>only considered to a very limited extent<\/strong>. The offense concerns a <strong>qualified theft<\/strong>, in which either a <strong>commercial commission<\/strong> or <strong>action within the framework of a criminal organization<\/strong> exists. This regularly involves an <strong>increased injustice<\/strong>, which only allows a diversionary settlement in exceptional cases.  <\/p>\n\n<p class=\"wp-block-paragraph\">In cases in which the requirements of <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=130&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 130 StGB<\/a> are <strong>only marginally fulfilled<\/strong>, the perpetrator acts <strong>immediately with insight<\/strong>, and the consequences of the crime can be <strong>quickly and completely compensated<\/strong>, a diversion can still be considered. With increasing <strong>planning<\/strong>, <strong>intention to repeat<\/strong>, or <strong>organized commission of the offense<\/strong>, the probability of a diversionary settlement decreases significantly. <\/p>\n\n<p class=\"wp-block-paragraph\">Diversion may be considered if<\/p>\n\n<ul class=\"wp-block-list\">\n<li>the <strong>overall guilt is minor<\/strong>,<\/li>\n\n\n\n<li>the <strong>commercial orientation is only weakly pronounced<\/strong>, or the participation in an association appears only subordinate,<\/li>\n\n\n\n<li><strong>no serious consequential effects<\/strong> have occurred,<\/li>\n\n\n\n<li><strong>no pronounced planned or repeated behavior<\/strong> can be determined,<\/li>\n\n\n\n<li>the facts are <strong>clear and manageable<\/strong>,<\/li>\n\n\n\n<li>and the perpetrator is <strong>insightful, cooperative, and willing to make amends<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">If a diversion comes into consideration, the court can order <strong>monetary payments<\/strong>, <strong>community service<\/strong>, <strong>supervision instructions<\/strong> or a <strong>victim-offender mediation<\/strong>. A diversion leads to <strong>no conviction<\/strong> and <strong>no criminal record entry<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-ausschluss-der-diversion\">Exclusion of Diversion:<\/h3>\n\n<p class=\"wp-block-paragraph\">Diversion is excluded if<\/p>\n\n<ul class=\"wp-block-list\">\n<li>the offense was committed <strong>commercially in the narrower sense<\/strong>,<\/li>\n\n\n\n<li>the theft took place <strong>within the framework of a consolidated criminal organization<\/strong>,<\/li>\n\n\n\n<li>there is a <strong>planned or repetitive approach<\/strong>,<\/li>\n\n\n\n<li><strong>several independent acts of theft<\/strong> were committed,<\/li>\n\n\n\n<li>a <strong>significant financial loss<\/strong> has occurred,<\/li>\n\n\n\n<li>special <strong>aggravating circumstances<\/strong> are added,<\/li>\n\n\n\n<li>or the overall behavior constitutes a <strong>serious violation of another person&#8217;s property rights<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Only in the case of <strong>clearly the slightest guilt<\/strong> and <strong>immediate insight<\/strong> can it be exceptionally examined whether a diversionary approach is permissible. The value of the item is not decisive, but rather the revenue generation aimed at repetition or the organized commission of the offense.  <\/p>\n\n<p class=\"wp-block-paragraph\">If, in this manner of commission, there is also a <strong>serious theft<\/strong> or a <strong>theft by burglary or with weapons in the basic form<\/strong>, the penalty is increased to <strong>imprisonment from six months to five years<\/strong>. Several increases in injustice come together here. <\/p>\n\n<p class=\"wp-block-paragraph\">Finally, if there is a <strong>particularly serious theft<\/strong>, such as a burglary into a dwelling or a particularly dangerous execution of the offense, in this qualified manner of commission, the law provides for a <strong>imprisonment of one to ten years<\/strong>. An application is only considered if the offense is <strong>at the lower end of the qualification<\/strong>, there is no pronounced planning, and the damage was minor or completely compensated. In cases with a <strong>statutory minimum imprisonment<\/strong>, an application is excluded.  <\/p>\n\n<p class=\"wp-block-paragraph\">\u00a7 43 StGB: A prison sentence can be <strong>conditionally suspended<\/strong> if it <strong>does not exceed two years<\/strong> and the perpetrator has a <strong>positive social prognosis<\/strong>. It is realistic above all if the damage has been fully compensated, the perpetrator is insightful, and the offense remains in the <strong>lower range of the penalty range<\/strong>.   <\/p>\n\n<p class=\"wp-block-paragraph\">\u00a7 43a StGB: The <strong>partially conditional suspension<\/strong> allows a combination of unconditional and conditionally suspended parts of the sentence and is possible for sentences <strong>over six months and up to two years<\/strong>. A <strong>District Court is out of the question due to a lack of sufficient subject-matter jurisdiction<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">If forms of theft are covered in which the <strong>penalty range increases to six months to five years imprisonment<\/strong>, the <strong>Regional Court is also responsible<\/strong>. Since this offense also concerns the <strong>unauthorized removal of someone else&#8217;s movable property<\/strong>, the claims relate in particular to the <strong>value of the item<\/strong>, <strong>replacement costs<\/strong>, <strong>loss of use<\/strong>, <strong>lost use advantage<\/strong>, as well as other <strong>property law damages<\/strong> caused by the removal. <\/p>\n\n<p class=\"wp-block-paragraph\">Depending on the case, <strong>consequential damages<\/strong> can also be claimed, for example if the item was required for <strong>professional or business purposes<\/strong> and the removal has led to <strong>significant economic disadvantages<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">The <strong>private party connection<\/strong> suspends the statute of limitations for all claims asserted as long as the criminal proceedings are pending.
