The offense is particularly complex because it often takes place in secluded structures, is organized across borders and those affected usually have significant dependencies and fears. The focus is on <strong>procuring, recruiting, transporting, accommodating or receiving<\/strong> a person with the aim of exploiting them. This refers to situations in life in which a person&#8217;s economic, professional or sexual self-determination is no longer really given because they are effectively under the control of another. The standard protects personal freedom, sexual integrity and economic self-determination.   <\/p>\n\n<p class=\"wp-block-paragraph\">Any situation in which a person is brought into or finds themselves in an exploitative situation through <strong>recruitment<\/strong>, <strong>mediation<\/strong>, <strong>transportation<\/strong>, <strong>accommodation<\/strong> or <strong>reception<\/strong> is an element of the offense. The decisive factor is the <strong>objectively perceptible relationship of dependence or control<\/strong>, which is based on sustained exploitation, exertion of pressure or economic or sexual power of disposal. The inner motivation of the perpetrator is irrelevant for the objective element of the offense. Only the <strong>external circumstances<\/strong> and the <strong>actually existing state of dependence, unfreedom and exploitation<\/strong> are decisive.   <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-prufungsschritte\">Steps of legal assessment<\/h3>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatsubjekt\">Perpetrator:<\/h4>\n\n<p class=\"wp-block-paragraph\">The perpetrator can be <strong>any person<\/strong> who, through their behavior, contributes to another person being brought into or kept in an <strong>exploitative situation<\/strong>. <strong>No special characteristics<\/strong> or roles are required. Even people who only <strong>organize, mediate, transport or work \u201cin the background\u201d<\/strong> can be considered as perpetrators or participants if their contribution actually enables or facilitates the exploitation.  <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatobjekt\">Object of the Offense:<\/h4>\n\n<p class=\"wp-block-paragraph\">The object of the offense is <strong>every human being<\/strong> who gets into a situation in which their <strong>labor, sexuality, physical integrity or economic freedom<\/strong> is abused.<\/p>\n\n<p class=\"wp-block-paragraph\">For adults, exploitation must have been made possible by <strong>unfair or abusive means<\/strong>, such as violence, threats, deception or the exploitation of dependencies.<br\/>In the case of minors, it is sufficient to <strong>influence the person<\/strong> because they are particularly vulnerable.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tathandlung\">Act: <\/h4>\n\n<p class=\"wp-block-paragraph\">An extortionate kidnapping exists if a person is taken <strong>against or without their will<\/strong> to a The objective element of the offense is any behavior by which a person is <strong>brought into, mediated to, transported to, received, accommodated or passed on to others<\/strong> in such a situation.<\/p>\n\n<p class=\"wp-block-paragraph\">Typical actions include:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Recruiting<\/strong> a person for work, services or \u201copportunities\u201d that actually amount to exploitation.<\/li>\n\n\n\n<li><strong>Receiving or accommodating<\/strong> if this prepares or secures the exploitation.<\/li>\n\n\n\n<li><strong>Transporting<\/strong> people to places where they are exploited.<\/li>\n\n\n\n<li><strong>Passing on or \u201chanding over\u201d<\/strong> to third parties who carry out the actual exploitation.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The decisive factor is that the action visibly leads to a person <strong>coming under control<\/strong> and being used for external purposes.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-unlautere-mittel\">Unfair Means:<\/h4>\n\n<p class=\"wp-block-paragraph\">In the case of adult victims, the objective element of the offense includes in particular <strong>unfair or abusive methods<\/strong>, such as<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Violence or threats<\/strong>,<\/li>\n\n\n\n<li><strong>Deception about essential circumstances<\/strong>,<\/li>\n\n\n\n<li><strong>Exploitation of an emergency, dependence or position of authority<\/strong>,<\/li>\n\n\n\n<li><strong>Intimidation<\/strong> or<\/li>\n\n\n\n<li>the <strong>\u201cselling\u201d or \u201cpassing on\u201d<\/strong> of a person in exchange for advantages.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">A <strong>clear power imbalance<\/strong> is always externally recognizable, in which the person concerned effectively no longer has equivalent decision-making or withdrawal options.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-ausbeutungslage-und-taterfolg\">Exploitation Situation and Success of the Act: <\/h4>\n\n<p class=\"wp-block-paragraph\">The objective success of the act exists if the person concerned is in a situation in which they are<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>sexually exploited<\/strong>,<\/li>\n\n\n\n<li><strong>abused through their labor<\/strong>,<\/li>\n\n\n\n<li><strong>used for begging<\/strong>,<\/li>\n\n\n\n<li><strong>forced to commit criminal acts<\/strong> or<\/li>\n\n\n\n<li>can be used or is already being used for <strong>organ removal<\/strong>.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">It is sufficient that the external circumstances <strong>enable a real use for these purposes<\/strong> or are already realizing it. A merely short-term, easily resolvable dependency is not sufficient. A <strong>stable, burdensome external control<\/strong> is required, which significantly restricts real freedom of choice.  <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-kausalitat\">Causality:<\/h4>\n\n<p class=\"wp-block-paragraph\">Causal is any action without which the <strong>exploitation situation<\/strong> would not have existed in this form. This also includes preparatory or organizational steps. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-objektive-zurechnung\">Objective Attribution: <\/h4>\n\n<p class=\"wp-block-paragraph\">The success is objectively attributable if the behavior creates or reinforces a <strong>typical risk situation for exploitation<\/strong>. Normal, socially customary dependencies (such as a normal employment relationship with fair conditions) are not covered by this. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-qualifizierende-umstande\">Qualifying Circumstances<\/h2>\n\n<p class=\"wp-block-paragraph\">Slavery does not distinguish between classic qualifications. The injustice lies in the <strong>exploitation of a particular vulnerability<\/strong> or in the <strong>establishment of a relationship of dependence<\/strong> that enables continued exploitation. It proves that the person concerned <strong>without effective consent<\/strong>, through <strong>violence<\/strong>, <strong>dangerous threats<\/strong>, <strong>deception<\/strong>, <strong>exploitation of an emergency<\/strong>, <strong>intimidation<\/strong> or through another suitable means came into a situation in which they were <strong>externally controlled<\/strong> and <strong>exploitable<\/strong>. It must also be proven that the perpetrator side exercised an <strong>actual influence or access<\/strong> to the victim&#8217;s labor, sexuality, freedom of movement or other living conditions, which actually enabled the exploitative use.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-gericht\">Court: <\/h3>\n\n<p class=\"wp-block-paragraph\">The court examines and assesses all evidence in the overall context. It does not use any unsuitable or illegally obtained evidence. The decisive factor is whether the victim was actually brought into a <strong>lasting dependency and exploitation situation<\/strong> and whether the objective actions were suitable to establish or maintain this form of <strong>externally determined control<\/strong>. The court determines whether an <strong>exploitation mechanism<\/strong> existed that supports the offense and significantly undermines the protected personal or economic freedom of the victim.  <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-beschuldigte-person\">Accused Person: <\/h3>\n\n<p class=\"wp-block-paragraph\">The accused person has <strong>no burden of proof<\/strong>. However, they can raise doubts about the alleged dependency, the alleged involuntariness, the use of unfair means or the actual act of exploitation. There, they are brought into an <strong>exploitative situation<\/strong>, for example through complete dependence, surveillance, withdrawal of identity documents, artificially created debts or social isolation. The deception is sufficient if it serves to create a situation in which the victim effectively <strong>no longer has any decision-making or withdrawal options<\/strong>.<br\/>The decisive factor is the <strong>continued use of the person for exploitative purposes<\/strong>, not whether the victim resisted at the beginning.   <\/li>\n\n\n\n<li><strong>Exploitation of defenselessness:<\/strong> A minor, mentally impaired or incapacitated person is taken by a person of trust into an environment in which they are <strong>controlled, exploited or forced to perform labor, begging or sexual services<\/strong>. The decisive factor is the <strong>targeted and sustainable influence<\/strong> on the living conditions of the victim, regardless of whether a kidnapping, deception or other transfer action has taken place beforehand. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-subjektiver-tatbestand\">subjective elements of the offence<\/h2>\n\n<p class=\"wp-block-paragraph\">The perpetrator acts intentionally. He knows or at least accepts that he is <strong>bringing a person into or keeping them in an exploitative situation<\/strong>, and that the person concerned is <strong>under his actual control or under the control of a third party<\/strong>. He recognizes that the victim thereby largely loses his economic, sexual or personal freedom and enters into a relationship of dependence that enables use for exploitative purposes.  <\/p>\n\n<p class=\"wp-block-paragraph\">The intention to bring about a <strong>permanent situation of exploitation<\/strong> is essential. The perpetrator wants to ensure that the victim can no longer freely dispose of their labor, their movements, or their social and economic decisions, and they seriously accept the associated <strong>third-party use<\/strong>. Whether the victim is actually fully exploited later on is irrelevant for criminal liability, as long as the intent is directed towards <strong>establishing or maintaining an exploitative situation<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">There is no intent if the perpetrator believes that the victim <strong>freely, informedly, and earnestly<\/strong> consents to the specific living, working, or residence situation, or if they mistakenly assume that <strong>no exploitative or abusive position<\/strong> arises. Anyone who assumes that the person concerned is independently shaping their living conditions and is only seeking temporary support does not fulfill the subjective element of the offense. <\/p>\n\n<p class=\"wp-block-paragraph\">It is crucial that the perpetrator <strong>consciously creates or exploits<\/strong> the victim&#8217;s situation in order to establish <strong>de facto control<\/strong> that goes far beyond mere dependencies or organizational support. Mere ignorance or a reckless error does not absolve one of responsibility.   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Principle of culpability:<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">Only those who act <strong>culpably<\/strong> are punishable. Intentional offenses require that the perpetrator recognizes the essential events and at least <strong>accepts them as a possibility<\/strong>. If this intent is lacking, for example, because the perpetrator mistakenly assumes that their behavior is permitted or is <strong>voluntarily supported<\/strong>, at most negligence exists. This is not sufficient for intentional offenses.   <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Incapacity to be held accountable:<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">No guilt is attributed to someone who, at the time of the offense, was unable to recognize the injustice of their actions or to act in accordance with this insight due to a <strong>severe mental disorder<\/strong>, a <strong>pathological mental impairment<\/strong>, or a <strong>significant inability to control their actions<\/strong>. In case of corresponding doubts, a <strong>psychiatric assessment<\/strong> will be obtained. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/exculpatory-necessity\/\">Excusable state of necessity<\/a>:<\/strong> <\/p>\n\n<p class=\"wp-block-paragraph\">An excusable state of necessity may exist if the perpetrator acts in an <strong>extreme situation of duress<\/strong> in order to avert an <strong>acute danger<\/strong> to their own life or the lives of others. For longer sentences, a <strong>partially conditional suspension<\/strong> may be considered. In addition, the court may order instructions, such as therapy, compensation for damages, or supervision requirements.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-strafrahmen\">Penalty Range<\/h2>\n\n<p class=\"wp-block-paragraph\">In the case of human trafficking, the penalty range in the basic case is <strong>between six months and five years imprisonment<\/strong>. It is possible for penalties between <strong>more than six months and up to two years<\/strong>. Since the basic offense of human trafficking can allow penalties in this area, an application <strong>is quite possible in individual cases<\/strong>, especially in the case of shorter or less intensely pronounced exploitation. However, if a qualified case according to para. 4 or para. 5 exists, the individual judge is excluded.   <\/p>\n\n<p class=\"wp-block-paragraph\">A jury court is not provided for.
