The <strong>legal situation<\/strong> is <strong>too different<\/strong> even with elementary legal norms such as the Civil Code and the Code of Civil Procedure. <\/p>\n\n<p class=\"wp-block-paragraph\">Based on our dual admission, we can say from experience: &#8220;<strong>Almost everything is different in Austria.<\/strong>&#8220;<\/p>\n\n<h3 class=\"wp-block-heading\">Consensual Lawyer<\/h3>\n\n<p class=\"wp-block-paragraph\">German lawyers who become active in Austria due to the freedom to provide services and the lack of a language barrier incur a <strong>high liability risk<\/strong>. A mere <strong>consensual lawyer<\/strong> in the form of an Austrian lawyer does little to change this. <\/p>\n\n<h3 class=\"wp-block-heading\">Hearing representation<\/h3>\n\n<p class=\"wp-block-paragraph\">For the same reason, we advise against German lawyers drafting lawsuits or pleadings and then sending an Austrian <strong>hearing representative<\/strong> to the hearing.<\/p>\n\n<h3 class=\"wp-block-heading\">Corresponding lawyer<\/h3>\n\n<p class=\"wp-block-paragraph\">Ideally, however, a directly mandated <strong>corresponding lawyer<\/strong> should be involved.<\/p>\n\n<p class=\"wp-block-paragraph\">It is recommended that our lawyers receive a <strong>direct mandate<\/strong> with the task of processing the entire file and conducting the <strong>correspondence<\/strong> with the clients <strong>via their in-house lawyers or company lawyers<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">In this way, foreign clients have their usual <strong>law firm as a proven contact partner<\/strong>.
