These are awarded in different amounts in the various court districts.<\/p>\n\n<p class=\"wp-block-paragraph\">For example, the Regional Court of Salzburg would likely award compensation for pain and suffering of approximately EUR 5,520.00 for an injury involving 3 days of severe pain, 8 days of moderate pain, and 21 days of mild pain.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-sachschaden\">Property damage<\/h3>\n\n<p class=\"wp-block-paragraph\">The <strong>property damage<\/strong> includes the costs for the <strong>replacement or repair<\/strong> of <strong>items<\/strong> that were <strong>destroyed or damaged<\/strong> by the ski accident. Property damage, such as ski equipment damaged by the ski accident, must also be compensated.<\/p>\n\n<p class=\"wp-block-paragraph\">The purpose of the claim for damages is to provide the injured party with compensation for the loss suffered. If already used items, e.g. old ski equipment, are damaged, the &#8220;new for old&#8221; problem arises. If, due to a ski accident, a recovery by helicopter was necessary, then the injured party can also demand these costs from the person who caused the accident.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>ATTENTION:<\/strong> If the rescue costs were reimbursed by an insurance company, the related claims against the person causing the damage are transferred to the insurance company.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-heilungskosten\">Medical costs<\/h3>\n\n<p class=\"wp-block-paragraph\">The <strong>medical costs<\/strong> include the costs for <strong>treatments, medications, medical aids<\/strong> and <strong>travel to treatments<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>ATTENTION:<\/strong> If the services were provided by the social insurance provider, the related claims against the person causing the damage are transferred to the social insurance provider.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-frustrierte-aufwendungen\">Frustrated expenses<\/h3>\n\n<p class=\"wp-block-paragraph\"><strong>Frustrated expenses<\/strong> are all expenses that were not caused by the ski accident itself, but have become useless due to the ski accident. The accident victim is entitled to compensation for frustrated expenses.<\/p>\n\n<p class=\"wp-block-paragraph\">The claim for reimbursement of frustrated expenses includes, among other things, the costs of the no longer needed <strong>hotel room<\/strong>, <strong>travel expenses for a holiday that can no longer be consumed<\/strong> and <strong>cancellation costs<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">If you have canceled your vacation in the ski area  due to an accident, you may also be entitled to compensation for this.<\/p>\n<a class=\"mr-cta-link mr-cta-button-cal\" href=\"#h2-booking\" title=\"Free initial consultation\"><span class=\"mr-cta-link-normal\">Select your preferred appointment now:<\/span><span class=\"mr-cta-link-bold\">Free initial consultation<\/span><\/a>\n\n<h3 class=\"wp-block-heading\" id=\"h-verdienstentgang\">Loss of earnings<\/h3>\n\n<p class=\"wp-block-paragraph\">The <strong>loss of earnings<\/strong> includes all damages to the accident victim due to a <strong>reduction<\/strong> or <strong>loss<\/strong> of <strong>earning capacity<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">If the accident victim suffers a loss of earnings due to the ski accident, the person causing the accident must compensate for the loss of earnings.<\/p>\n\n<p class=\"wp-block-paragraph\">The <strong>loss of earnings<\/strong> must be compensated by the person causing the accident <strong>even in case of slight negligence<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-entgangener-gewinn\">Lost Profit<\/h3>\n\n<p class=\"wp-block-paragraph\"><strong>Loss of profit<\/strong> always occurs when the injured party loses a <strong>future opportunity<\/strong> that was already largely certain to happen.<\/p>\n\n<p class=\"wp-block-paragraph\">The non-receipt of an already imminent, but not yet fixed, professional promotion represents a loss of profit if the accident victim is no longer able to perform the higher-paid job due to permanent damage.<\/p>\n\n<p class=\"wp-block-paragraph\">The <strong>loss of profit<\/strong> must be compensated by the accident perpetrator <strong>in case of gross negligence<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-pauschale-unkosten\">Lump Sum Expenses<\/h3>\n\n<p class=\"wp-block-paragraph\">The <strong>lump-sum expenses<\/strong> serve to <strong>compensate for all other expenses<\/strong> incurred by the injured party as a result of the skiing accident. This includes, in particular, one&#8217;s own time spent dealing with the consequences.
