The compulsory portion is not cancelled, but merely <strong>fulfilled later<\/strong>, either in one lump sum or in installments. However, the law provides for a waiting period: The entitled party can only assert his monetary claim <g id=\"gid_1\">one year after the death<\/g>. This period is intended to give the heir time to settle the estate and create liquidity.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Important:<\/strong> The claim exists from the moment of death. Also, <strong>default interest accrues from this point in time<\/strong>. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-letztwillige-stundung\">Post-mortem Deferral<\/h2>\n\n<p class=\"wp-block-paragraph\">The testator can stipulate in his will that the compulsory portion is <strong>not paid immediately<\/strong>, but only <strong>after up to five years<\/strong>. <strong>Installment payments<\/strong> may also be ordered by will. <\/p>\n\n<ul class=\"wp-block-list\">\n<li>A <strong>justification is not required by law.<\/strong><\/li>\n\n\n\n<li>The entitled parties can only demand the compulsory portion after the specified period has expired.<\/li>\n\n\n\n<li>In the case of a deferred <strong>testamentary disposition covering the compulsory portion<\/strong>, its fulfillment can also be postponed.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>Objection in case of unfair hardship:<\/strong><br\/>Entitled parties can raise objections in court if the deferral places an <strong>unreasonable<\/strong> burden on them, for example if they need the compulsory portion for their own livelihood.<\/p>\n\n<p class=\"wp-block-paragraph\">In this case, the court may:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Revoke<\/strong> or <strong>adjust<\/strong> the deferral arrangement<\/li>\n\n\n\n<li>Determine a <strong>different interest rate<\/strong><\/li>\n\n\n\n<li><strong>Extend<\/strong> the deferral for up to ten years<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-gerichtliche-stundung\">Judicial Deferral<\/h2>\n\n<p class=\"wp-block-paragraph\">If the testator has not ordered a post-mortem deferral, the heir can apply to the court for a <strong>judicial deferral<\/strong>. The prerequisite is that the immediate payment of the compulsory portion would <strong>affect him unfairly hard<\/strong>. <\/p>\n\n<p class=\"wp-block-paragraph\">Typical examples:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The estate contains an apartment that the heir <strong>urgently needs to live in himself<\/strong><\/li>\n\n\n\n<li>The heir would have to sell a company that secures his economic existence<\/li>\n\n\n\n<li>The continued existence of a business would be jeopardized (e.g. by forced sale of business assets)<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">In such cases, the court may:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Defer<\/strong> the payment completely or partially<\/li>\n\n\n\n<li>Order an <strong>installment payment<\/strong><\/li>\n\n\n\n<li><strong>Limit<\/strong> the deferral to a maximum of five years <\/li>\n\n\n\n<li>Extend it to <strong>a total of ten years<\/strong> in exceptional cases <\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Even in the case of judicial deferral, <strong>interest starts to accrue from the date of death<\/strong> of the testator. The decision is made in <strong>contentious civil proceedings<\/strong>. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-anpassung-oder-aufhebung\">Adjustment or Cancellation  <\/h2>\n\n<p class=\"wp-block-paragraph\">If the economic circumstances change significantly, for example due to the sale of the deferred asset or due to changed income circumstances, the court can <strong>adjust or cancel<\/strong> the deferral arrangement.<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The application can be made by the heir or by the entitled party.<\/li>\n\n\n\n<li>The prerequisite is a <strong>serious change in circumstances.<\/strong><\/li>\n\n\n\n<li>The court also decides in contentious proceedings.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">In addition, there is a legally standardized <strong>duty to inform<\/strong>: Compulsory portion debtors and creditors must inform each other about relevant changes. In the event of a breach of duty, <strong>claims for damages are conceivable.<\/strong> <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-sicherstellung-des-pflichtteils\">Securing the Compulsory Portion<\/h2>\n\n<p class=\"wp-block-paragraph\">In the event of a deferral, entitled parties can apply for their claim to be <strong>judicially secured<\/strong>, for example by mortgage, guarantee or other security.
