The forced share is a monetary claim against the heirs and not a claim to specific assets. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-voraussetzungen-fur-eine-wirksame-enterbung\">Requirements for Effective Disinheritance<\/h2>\n\n<p class=\"wp-block-paragraph\">Disinheritance is only valid if:<\/p>\n\n<ol class=\"wp-block-list\">\n<li>a formally valid testamentary disposition (will or inheritance contract) exists,<\/li>\n\n\n\n<li>a legally recognized ground for disinheritance is present, and<\/li>\n\n\n\n<li>this ground was <strong>causal<\/strong> for the disinheritance.<\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\">Even if the law does not strictly require stating the reason, a clear justification is recommended. Wer wirksam enterben will, muss sauber arbeiten.\u201c<\/span>\n    <\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-gesetzliche-enterbungsgrunde\">Statutory Grounds for Disinheritance<\/h2>\n\n<p class=\"wp-block-paragraph\">The law lists the grounds for disinheritance <strong>exhaustively<\/strong>. These include: <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Serious offenses against the testator<\/strong> (e.g., bodily harm, fraud (only intentional offenses with a penalty exceeding one year))<\/li>\n\n\n\n<li><strong>Similar offenses against close relatives<\/strong> (e.g., spouse, children, life partner)<\/li>\n\n\n\n<li><strong>Frustration or manipulation of the last will<\/strong><\/li>\n\n\n\n<li><strong>Reprehensible infliction of severe emotional distress<\/strong><\/li>\n\n\n\n<li><strong>Gross neglect of family law obligations<\/strong><\/li>\n\n\n\n<li><strong>Conviction to life imprisonment or a 20-year prison sentence<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">A mere family conflict or cessation of contact is not sufficient. The law requires particularly serious conduct. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-enterbung-aus-guter-absicht\">Disinheritance for Good Cause<\/h2>\n\n<p class=\"wp-block-paragraph\">The forced share can also be withdrawn if the testator fears that a spendthrift lifestyle of the forced heir would harm their descendants. In this case, the forced share must be passed directly to their children. This tacit disinheritance is only valid if a statutory ground for disinheritance actually exists. If this is missing, the omission is considered a &#8220;reduction to the forced share&#8221;.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-irrtumliche-ubergehung\">Erroneous Omission<\/h2>\n\n<p class=\"wp-block-paragraph\">If the testator was unaware of the existence of a child entitled to a forced share, a legal presumption applies: they intended to grant this child at least the minimum share. If this child was the only one, statutory succession applies in case of doubt. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-beweislast-und-kausalitat\">Burden of Proof and Causality<\/h2>\n\n<p class=\"wp-block-paragraph\">The burden of proof for the ground of disinheritance lies with the forced share debtor, usually the heir. The law presumes that a proven ground was also causal for the disinheritance. This presumption applies to both express and tacit disinheritance.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-folgen-einer-wirksamen-enterbung\">Consequences of Effective Disinheritance<\/h2>\n\n<ul class=\"wp-block-list\">\n<li>The claim to the forced share is entirely or partially forfeited.<\/li>\n\n\n\n<li>The disinherited person nevertheless remains capable of inheriting if they were named as an heir in the will.<\/li>\n\n\n\n<li>Descendants of the disinherited person retain their claim to the forced share, unless they are also disinherited.<\/li>\n\n\n\n<li>A claim for <strong>necessary maintenance<\/strong> against the estate remains.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-widerruf-und-verzeihung\">Revocation and Forgiveness<\/h2>\n\n<p class=\"wp-block-paragraph\">The testator can revoke the disinheritance by:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>express revocation<\/strong> (formally valid disposition),<\/li>\n\n\n\n<li><strong>tacit revocation<\/strong> (e.g., subsequent gift to the disinherited person), or<\/li>\n\n\n\n<li><strong>forgiveness<\/strong>, if a new disposition is no longer possible (e.g., due to lack of testamentary capacity).
