This claim must be secured by a <g id=\"gid_1\">lien on a property<\/g>. This means that the property in question serves as security for the outstanding payment.  <\/p>\n\n<p class=\"wp-block-paragraph\">Even if the existence of the claim and the lien are registered in the land register for mortgages, the creditor must <strong>prove that the debt is actually due<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-forderung-ist-durch-eine-hypothek-im-grundbuch-gesichert\">Claim is Secured by a Mortgage in the Land Register<\/h3>\n\n<p class=\"wp-block-paragraph\">In addition, the <strong>lien must be registered in the land register<\/strong>. Only then can the creditor bring a mortgage action and, if successful, achieve a <g id=\"gid_1\">forced sale of the property<\/g>. An important point is that the <strong>claim can be clearly proven<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">The mortgage action is <strong>not necessarily directed against the original debtor<\/strong>, but against the current owner of the property, even if they did not cause the debt. Therefore, it is often crucial to <strong>have the action noted in the land register<\/strong> in order to secure the rights of the creditor even against subsequent owners. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-der-schuldner-ist-mit-der-zahlung-in-verzug\">The Debtor is in Default of Payment<\/h3>\n\n<p class=\"wp-block-paragraph\">The <strong>maturity of the claim<\/strong> and the <strong>default in payment<\/strong> are essential, because the court can only allow the <strong>forced sale of the property<\/strong> if the debtor has <strong>not met<\/strong> their contractual obligations <strong>in time<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\">No action without default: As long as no due date has occurred, the creditor may not enforce their lien.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-ablauf-einer-hypothekarklage\">Procedure of a Mortgage Action<\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Examination of the claim and the mortgage<\/strong><\/li>\n\n\n\n<li><strong>Determine the owner<\/strong>: Is the debtor also the owner?<\/li>\n\n\n\n<li><strong>Filing the action<\/strong><\/li>\n\n\n\n<li><strong>Apply for a note in the land register<\/strong>: This ensures that the title remains effective even if the owner changes<\/li>\n\n\n\n<li><strong>Await judgment<\/strong><\/li>\n\n\n\n<li><strong>Lien enforcement<\/strong><\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-ziel-der-klage\">Objective of the Action<\/h2>\n\n<p class=\"wp-block-paragraph\">The mortgage action does <strong>not<\/strong> aim to achieve the payment of the claim itself, but the <strong>judicial recognition of the lien<\/strong>.
