If there are indications, a <strong>forensic psychiatric report<\/strong> must be obtained. <\/li>\n\n\n\n<li><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/exculpatory-necessity\/\">Excusable Necessity<\/a>:<\/strong> Applies in cases of <strong>unreasonableness of lawful conduct<\/strong> in an <strong>extreme predicament<\/strong> \u2013 for example, if providing assistance or rescue would seriously endanger one&#8217;s own life.<\/li>\n\n\n\n<li><strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/erroneous-assumption-of-justifying-circumstances\/\">Putative self-defense<\/a>:<\/strong> An error regarding the existence of a justification <strong>excludes intent<\/strong>, but not <strong>negligence<\/strong>, provided the breach of duty of care remains.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-strafaufhebung-amp-diversion\">Extinction of punishment and diversion<\/h2>\n\n<p class=\"wp-block-paragraph\">A <strong><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/withdrawal-from-attempt\/\">withdrawal from attempt<\/a><\/strong> plays no role in negligent offenses, as there is no intent and thus no attempt. <br\/>However, a <strong>criminal proceeding can end without conviction<\/strong> if <strong>diversion<\/strong> is applied.<\/p>\n\n<p class=\"wp-block-paragraph\">Diversion is <strong>generally possible in cases of negligent homicide<\/strong>, provided the culpability is <strong>not severe<\/strong> and the accused <strong>takes responsibility<\/strong>. Particularly crucial is <strong>demonstrable reparation<\/strong>, for example through compensation, apology, or support for the bereaved. <\/p>\n\n<p class=\"wp-block-paragraph\">If there is a gross breach of duty or a serious disregard for safety regulations, diversion is excluded. In all other cases, it can help to resolve the conflict out of court and mitigate the criminal consequences. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-strafzumessung-amp-folgen\">Sentencing and consequences<\/h2>\n\n<p class=\"wp-block-paragraph\">The severity of the penalty depends on the <strong>culpability<\/strong> and the <strong>impact of the act<\/strong>. The court considers how <strong>serious the breach of duty<\/strong> was, <strong>how foreseeable and avoidable<\/strong> the death was, and whether the act was <strong>momentarily careless<\/strong> or an expression of <strong>persistent negligence<\/strong>. <strong>Personal circumstances<\/strong> are also examined, such as previous convictions, life situation, willingness to confess, or efforts towards <strong>reparation<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Aggravating circumstances<\/strong> include, in particular, multiple or particularly gross breaches of duty, disregard for clear safety rules, influence of alcohol or drugs, and indifference to recognizable dangers.<br\/><strong>Mitigating circumstances<\/strong> include blamelessness, a sincere confession, active compensation for damages, co-responsibility of the victim, or an exceptional psychological stress situation. A <strong>long duration of the criminal proceedings<\/strong> can also have a mitigating effect on the sentence. <\/p>\n\n<p class=\"wp-block-paragraph\">Austrian criminal law uses the <strong>daily rate system<\/strong> for fines: The number of daily rates depends on the severity of the culpability, and the individual daily rate depends on the income situation. This is intended to make the penalty <strong>equally noticeable for all affected parties<\/strong>. If the fine is not paid, it can be converted into a <strong>substitute custodial sentence<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">A <strong>custodial sentence<\/strong> can be <strong>conditionally suspended<\/strong> in whole or in part if the sentence does not exceed two years and there is a <strong>positive social prognosis<\/strong>. In this case, the convicted person remains at liberty but must prove themselves during a <strong>probationary period of one to three years<\/strong>. If all conditions are met, the sentence is considered definitively suspended.  <\/p>\n\n<p class=\"wp-block-paragraph\">Courts can also issue <strong>directives<\/strong> \u2013 for example, regarding <strong>compensation for damages<\/strong>, <strong>therapy<\/strong>, <strong>driving fitness assessment<\/strong>, or <strong>contact restrictions<\/strong> \u2013 and order <strong>probation assistance<\/strong>. In particularly serious cases, <strong>grossly negligent homicide under Section 81 StGB<\/strong> may also be considered, which carries a significantly higher penalty. The range of penalties for <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=80&amp;Anlage=&amp;Uebergangsrecht=\">Section 80 StGB<\/a> thus remains in the lower range of homicide offenses and reflects the lesser degree of culpability.  <\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-freiheitsstrafe-amp-teil-bedingte-nachsicht\">Imprisonment and (partially) suspended sentence<\/h2>\n\n<p class=\"wp-block-paragraph\">Section 37 StGB: If the <strong>statutory penalty provides for imprisonment of up to five year<\/strong>s, the court should impose a<strong> fine <\/strong><strong>instead of a short prison sentence of no more than one year.<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Section 43 StGB: A <strong>suspended prison sentence<\/strong> may be imposed if the sentence <strong>does not exceed two years <\/strong>and the convicted person is deemed to have a <strong>favourable social prognosis<\/strong>.
