It is responsible for appeals and complaints against decisions of the Vienna Regional Courts, as well as for the technical and organizational supervision of the subordinate courts. In addition, it plays a central role in the Austrian judiciary and, together with the Supreme Court, the General Prosecutor’s Office, the Vienna Public Prosecutor’s Office and the Regional Court for Civil Matters, is housed in the Palace of Justice.

The Higher Regional Court of Vienna is the second-instance court level for Vienna and is located in the Palace of Justice on Schmerlingplatz.

<picture>

</picture>

General Information about the Higher Regional Court of Vienna

The district of the Higher Regional Court of Vienna comprises the federal states of Vienna, Lower Austria and Burgenland. In these three federal states, the court decides on appeals against judgments and decisions of the regional courts. With this regional jurisdiction, the Higher Regional Court of Vienna covers an area in which more than one third of the Austrian population lives.

The court works exclusively in senates, i.e. panels of several professional judges. There are no single-judge decisions. This collective form of decision-making ensures that judgments are based on joint consultation and do not depend on a single opinion.

            Peter Harlander

Tasks and Significance

The main task of the Higher Regional Court of Vienna is to rule on decisions of the regional courts as a court of appeal. It ensures the uniformity and reliability of the case law by reviewing and, if necessary, correcting judgments and decisions.

In addition, it performs special tasks of national importance:

It acts as a cartel court for the whole of Austria.

It decides on appeals against decisions of the Patent Office.

It examines complaints in criminal enforcement matters, for example in questions of detention on remand or the execution of measures.

In addition to its case law, the Higher Regional Court of Vienna bears responsibility in judicial administration. The President of the Higher Regional Court of Vienna heads the administration of all courts in the district. This includes the selection and training of junior judges, the organization of further training courses and the supervision of services. In this function, she is directly subordinate to the Federal Minister of Justice.

Structure and Senates

The Higher Regional Court of Vienna is divided into several senates. Each senate is responsible for specific legal matters.

Civil Senates

The civil senates deal with appeals and recurses in civil proceedings. These include contractual disputes, claims for damages, family and inheritance law, corporate and company law, and land registry matters.

Criminal Senates

The criminal senates decide on appeals and complaints in criminal matters. They examine both judgments and procedural decisions of the criminal regional courts. This also includes complaints about detention on remand or other coercive measures.

Cartel Senate

The Higher Regional Court of Vienna acts as the cartel court for the whole of Austria. It decides in the first instance on restrictions of competition, merger controls and abuse proceedings.

Specialized Legal Matters

In addition, there are senates responsible for special matters such as intellectual property law (patents, trademarks, designs) or issues of criminal enforcement.

The distribution of business determines annually which senate deals with which matters. It is published in the office building and creates transparency. At the same time, it ensures that there is no arbitrary allocation of proceedings.

Legal Remedies before the Higher Regional Court of Vienna

Appeal

The appeal is the central legal remedy against judgments of the regional courts. In civil matters, the Higher Regional Court of Vienna examines whether there are procedural errors or errors of law. In criminal matters, it reviews both the sentence and the legal assessment of the facts.

Appeal

The recourse is directed against decisions of the regional courts. Typical examples are decisions in execution or insolvency proceedings, but also interim decisions in the process. Of particular practical importance is the recourse in execution and insolvency proceedings, where high assets are often involved.

Complaints in Criminal Matters

In criminal proceedings, complaints can be lodged against certain decisions, for example in cases of detention on remand, house searches or decisions in the execution of measures. The Higher Regional Court of Vienna ensures that the rights of those affected are protected.

Revision to the Supreme Court

In certain cases, a revision to the Supreme Court is possible against decisions of the Higher Regional Court of Vienna. However, this is only permissible if a significant legal issue is involved or if the law expressly provides for it. In many cases, the Higher Regional Court of Vienna is therefore the last instance.

As a revision is only permissible in the case of significant legal issues or exceptional cases provided for by law, the proceedings for many clients already end with the decision of the Higher Regional Court of Vienna. Careful representation in the second instance is therefore of decisive importance

Significance for Citizens and Businesses

The Higher Regional Court of Vienna has a special significance for different groups:

For citizens, it is the instance that ensures that judgments and decisions of the regional courts do not remain arbitrary or incorrect.

For companies, the Higher Regional Court of Vienna is of central relevance, especially in competition and patent matters. Especially in cartel law, in merger controls or in trademark disputes, it decides on proceedings with considerable economic implications.

It thus fulfils a dual function: it is a corrective in individual cases and at the same time a guarantor for the uniform application of the law in the Austrian legal system.

Information on the Location and Accessibility of the Higher Regional Court of Vienna

The Higher Regional Court of Vienna is located in the traditional Palace of Justice at Schmerlingplatz 11, 1010 Vienna. It was built in the 19th century and today serves several important institutions: In addition to the Higher Regional Court, the Supreme Court, the General Prosecutor’s Office, the Vienna Public Prosecutor’s Office and the Vienna Regional Court for Civil Matters are also located here.

Appeal hearings and complaint proceedings in civil and criminal matters take place regularly at the Higher Regional Court of Vienna. For many clients, this is the decisive instance, as numerous proceedings end with the judgment of the Higher Regional Court of Vienna.

For visitors, there is a security check at the entrance, similar to airports. Sufficient time should therefore be planned for entry.

It is accessible both by public transport and by car, although arrival by public transport is advisable due to the limited parking facilities.

There is also a publicly accessible Justizcafé. in the Palace of Justice.

Your Advantages with our Support

Legal remedies before the Higher Regional Court of Vienna are demanding.
