Para 1a extends this regulation to so-called substitute values, i.e., assets that have replaced the original object, such as proceeds from a sale.<br\/>According to para 2, the court must examine whether the confiscation is proportionate. The court will not order confiscation if it is disproportionate to the significance of the act or the personal culpability.  <\/p>\n\n<p class=\"wp-block-paragraph\">Systematically, confiscation in the StGB precedes <strong>forfeiture<\/strong> and <strong>seizure<\/strong>. It thus forms the first part of criminal asset recovery. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-voraussetzungen\">Requirements<\/h2>\n\n<p class=\"wp-block-paragraph\">Confiscation may only be ordered if the following conditions are met:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Intentional Act:<\/strong> Negligent conduct is not sufficient.<\/li>\n\n\n\n<li><strong>Connection to the Act:<\/strong> The object was used for the commission of the act, intended for it, or produced by the act.<\/li>\n\n\n\n<li><strong>Ownership by the Perpetrator:<\/strong> Only objects owned by the perpetrator at the time of the decision are subject to confiscation.<\/li>\n\n\n\n<li><strong>Proportionality:<\/strong> The measure must not be excessive and must be proportionate to the act.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">If one of these criteria is missing, confiscation is inadmissible.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-verhaltnismassigkeit\">Proportionality<\/h2>\n\n<p class=\"wp-block-paragraph\">Confiscation must be refrained from if it is grossly disproportionate to the severity of the act or the culpability of the perpetrator.<br\/>Courts must therefore always examine whether the intervention is justified or whether it would constitute undue hardship.<br\/>In the case of minor offenses or high material value, the measure may be waived.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-abgrenzung-zu-verfall-und-einziehung\">Distinction from Forfeiture and Seizure<\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Forfeiture:<\/strong> concerns assets derived from a criminal offense.<\/li>\n\n\n\n<li><strong>Confiscation:<\/strong> is directed against the object itself \u2013 instruments or products of a crime.<\/li>\n\n\n\n<li><strong>Seizure:<\/strong> concerns objects whose possession or use is prohibited independently of a specific act (e.g., prohibited weapons or narcotics).<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Thus, confiscation is primarily a security measure, not a punishment or profit skimming.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-folgen-in-der-praxis\">Practical Implications<\/h2>\n\n<p class=\"wp-block-paragraph\">Confiscation permanently deprives the perpetrator of assets.
