It specifies the constitutional principle of guilt and forms the bridge between the abstract penalty range of an offense and the specific penalty in individual cases.<br\/>The standard obliges the court to <strong>weigh aggravating and mitigating circumstances against each other<\/strong>, to take into account the personality of the offender and the consequences of the punishment for his life, and to ensure that the punishment is neither excessively harsh nor trivializing.<br\/>Thus, the punishment becomes a <strong>fair balance between the injustice of the act, the guilt of the perpetrator and social responsibility<\/strong>. <\/p>\n\n<div class=\"wp-block-uagb-container uagb-block-3019fe8e alignfull uagb-is-root-container\">\n<div class=\"wp-block-uagb-container uagb-block-32585033\">\n<p class=\"wp-block-paragraph\">Sentencing is the part of the judgment in which the court determines the amount and type of punishment. The court must impose the penalty that corresponds to the injustice of the act and the personal responsibility.<br\/>It takes into account the severity of the damage, the extent of the breach of duty, the preparation and planning of the act, and the manner in which it was carried out. The more deliberate and reckless the act, the more severe the punishment.  <\/p>\n\n<p class=\"wp-block-paragraph\">Austrian criminal law rejects rigid sentencing schemes. Each sentence must be individually assessed and justified. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-abwagung-von-erschwerungs-und-milderungsgrunden\">Balancing Aggravating and Mitigating Circumstances<\/h2>\n\n<p class=\"wp-block-paragraph\">Aggravating and mitigating circumstances are central elements of sentencing. They must <strong>not<\/strong> be used twice if they are already inherent in the offense. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Aggravating circumstances<\/strong> include:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Multiple commission of the act or repetition,<\/li>\n\n\n\n<li>particular recklessness or brutality,<\/li>\n\n\n\n<li>systematic preparation,<\/li>\n\n\n\n<li>self-serving motives,<\/li>\n\n\n\n<li>indifference to legally protected values.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>Mitigating circumstances<\/strong> include:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Confession or admission of guilt,<\/li>\n\n\n\n<li>lengthy proceedings,<\/li>\n\n\n\n<li>previous integrity,<\/li>\n\n\n\n<li>compensation for damages, remorse or cooperation in the investigation,<\/li>\n\n\n\n<li>acting in a particular personal emergency.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">The weighting of these factors is a <strong>discretionary decision of the court<\/strong>, but must always be justified in a comprehensible manner.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-bedeutung-der-personlichkeit-und-der-sozialen-folgen\">Significance of Personality and Social Consequences<\/h2>\n\n<p class=\"wp-block-paragraph\">The court is also obliged to take into account the <strong>effects of the punishment<\/strong> on the future life of the perpetrator.<br\/>The decisive factor is whether and how the punishment enables social reintegration.<br\/>The aim is not retribution, but a punishment that guides the perpetrator to uphold the law without permanently displacing him from society.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-strenge-der-strafe\">Severity of the Punishment<\/h2>\n\n<p class=\"wp-block-paragraph\">Paragraph 3 of \u00a7 32 StGB names objective criteria for the severity of the punishment. The court takes the repeated commission of the act into account as an aggravating factor and imposes a severe prison sentence, as persistent delinquency shows an increased risk. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Example 2 \u2013 Confession and reparation:<\/strong><br\/>A perpetrator fully compensates for the damage caused and makes a credible confession. The court sees this as a significant mitigating factor and significantly reduces the prison sentence. <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Example 3 \u2013 Serious violent crime:<\/strong><br\/>In the case of a sexual offense against minors, a long prison sentence is imposed in order to reflect the high injustice of the act and the massive social disruption.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Example 4 \u2013 Excessive length of proceedings:<\/strong><br\/>Proceedings drag on for many years without the accused being responsible for this.
