Therefore, not only the completed offense but also the serious commencement of its realization is punishable. <strong>Not punishable<\/strong> are mere <strong>preparatory acts<\/strong> as long as there is no direct commencement. <strong>Absolutely impossible<\/strong> attempts are not punishable. <\/p>\n\n<div class=\"wp-block-uagb-container uagb-block-3019fe8e alignfull uagb-is-root-container\">\n<div class=\"wp-block-uagb-container uagb-block-32585033\">\n<p class=\"wp-block-paragraph\">Attempt means: to commence the act with intent, but not complete it. The commencement of the act is reached as soon as the perpetrator carries out their decision through an <strong>act immediately preceding the execution<\/strong>. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-voraussetzungen-des-strafbaren-versuches\">Requirements for a Criminally Liable Attempt<\/h2>\n\n<p class=\"wp-block-paragraph\">For an attempt to be criminally liable, four conditions must be met:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Intent<\/strong>: The perpetrator has the firm will to realize the offense.<\/li>\n\n\n\n<li><strong>Non-completion<\/strong>: At least one objective element is still missing, such as the occurrence of the outcome.<\/li>\n\n\n\n<li><strong>Direct Commencement<\/strong>: The act is in direct proximity to the realization of the offense.<\/li>\n\n\n\n<li><strong>Aptitude<\/strong>: The perpetrator, the object of the offense, and the act are fundamentally suitable for carrying out the offense.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-abgrenzung-vorbereitung-vs-versuch-unmittelbares-ansetzen\">Distinction: Preparation vs. Attempt (Direct Commencement)<\/h2>\n\n<p class=\"wp-block-paragraph\"><strong>Preparation<\/strong> refers to the <strong>preliminary stage<\/strong> of an offense: planning, reconnaissance, procuring tools, driving to the crime scene. This is <strong>generally not punishable<\/strong>. <br\/><strong>Direct Commencement<\/strong> begins where the act <strong>directly transitions into the statutory offense<\/strong> and is intended to lead to completion <strong>without significant intermediate steps<\/strong>.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Practical Guidance:<\/strong><\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Still Preparation<\/strong>: Purchasing a crowbar, observing the branch, approaching the location, putting on gloves.<\/li>\n\n\n\n<li><strong>Already an Attempt<\/strong>: Commencing at the object \u2013 e.g., <strong>prying open<\/strong> the window with the crowbar, <strong>pointing the pistol at the victim and pulling the trigger<\/strong>, <strong>administering the drug to the victim<\/strong>.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-arten-des-versuches\">Types of Attempt<\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Uncompleted Attempt<\/strong>: The perpetrator has not yet done everything and intends to continue acting (e.g., entry into the premises fails at the first door).<\/li>\n\n\n\n<li><strong>Completed Attempt<\/strong>: The perpetrator believes to have done everything necessary; the outcome only accidentally fails to occur (e.g., a shot fired with intent to kill, but the victim survives).<\/li>\n\n\n\n<li><strong>Impossible Attempt<\/strong>: The act cannot succeed for factual reasons (see below regarding absolute impossibility).<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-rucktritt-vom-versuch\">Withdrawal from Attempt<\/h2>\n\n<p class=\"wp-block-paragraph\">A perpetrator can, under certain circumstances, avoid criminal liability if they desist from further execution of the offense or actively prevent the already occurred outcome. This is referred to as withdrawal from attempt. Whether a withdrawal is possible and which conditions apply depends on the type of attempt.  <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-absolute-untauglichkeit-15-abs-3-stgb\">Absolute Impossibility (\u00a7 15 Para 3 StGB)<\/h2>\n\n<p class=\"wp-block-paragraph\"><strong>Absolutely impossible attempt<\/strong> is <strong>not punishable<\/strong>.
