This question becomes particularly relevant when the heirs&#8217; assets are commingled with the estate. In this process, a portion of the estate is separated from the heirs&#8217; assets and placed under judicial control. These include: <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Creditors of the deceased<\/strong><\/li>\n\n\n\n<li><strong>Estate creditors<\/strong>, e.g., for funeral expenses or care of the deceased<\/li>\n\n\n\n<li><strong>Legatees<\/strong><\/li>\n\n\n\n<li><strong><a href=\"https:\/\/harlander-partner.eu\/en\/inheritance-law-estate-planning\/forced-heirship-law\/\">Beneficiaries of a compulsory share<\/a><\/strong><\/li>\n\n\n\n<li><strong>Maintenance claimants<\/strong><\/li>\n\n\n\n<li><strong>Surviving spouses or registered partners<\/strong>, insofar as they assert a preferential legacy<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Each of these creditors can individually file an application for segregation. <strong>Heirs<\/strong> themselves may only utilize segregation if they are also creditors of the estate. This option is not available to <strong>heirs&#8217; creditors<\/strong>.<\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-absicherbare-forderungen\">Securable Claims<\/h2>\n\n<p class=\"wp-block-paragraph\">Segregation serves exclusively to secure <strong>obligatory claims<\/strong>, not real rights. Non-monetary claims, such as an obligatory claim for restitution, can also be covered. It is important that the applicant credibly demonstrates a concrete interest in security.  <\/p>\n\n<h2 class=\"wp-block-heading\">Prerequisites for Judicial Segregation<\/h2>\n\n<p class=\"wp-block-paragraph\">The court approves segregation only under the following conditions:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The application must be filed <strong>before the legal finality of the decree of inheritance<\/strong>.<\/li>\n\n\n\n<li>The applicant must <strong>attest to<\/strong> (not prove) their <strong>creditor status and the endangerment<\/strong> of their claim.<\/li>\n\n\n\n<li>For beneficiaries of a compulsory share, proof of belonging to the group of beneficiaries of a compulsory share is sufficient.<\/li>\n\n\n\n<li>There must be an <strong>objective risk<\/strong>, for example, due to the heir&#8217;s free disposal of the estate assets.<\/li>\n<\/ul>\n\n<blockquote class=\"wp-block-quote\">\n<p class=\"wp-block-paragraph\"><strong>Note:<\/strong> Under current legal provisions, a merely subjective concern is no longer sufficient. There must be an objectively comprehensible risk factor. <\/p>\n<\/blockquote>\n\n<p class=\"wp-block-paragraph\">The heir can avert segregation <strong>by providing security<\/strong>. This security may also be provided from the estate&#8217;s assets. <\/p>\n\n<h2 class=\"wp-block-heading\" id=\"h-wirkung-der-verlassenschaftsabsonderung\">Effect of the Segregation of the Estate<\/h2>\n\n<p class=\"wp-block-paragraph\">After approval, the segregated assets form a <strong>judicially managed special fund<\/strong>, separate from the rest of the estate and the heirs&#8217; assets. Practical security is achieved through: <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Locking or sealing<\/strong><\/li>\n\n\n\n<li>Appointment of a <strong>segregation curator<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">Since January 1, 2017, <strong>only the relevant portion of the assets<\/strong> is segregated, no longer the entire estate. In practice, this raises issues, for example, with indivisible assets such as real estate or artworks. <\/p>\n\n<p class=\"wp-block-paragraph\">Creditors with a successful application for segregation have priority over the segregated assets. The heir is liable to them only with the segregated portion.
