Entscheidend ist der zielgerichtete Ortswechsel in eine vom T\u00e4ter beherrschte Lage.\u201c<\/span>\n    <\/div>\n\n<h2 class=\"wp-block-heading\" id=\"h-objektiver-tatbestand\">objective elements of the offence<\/h2>\n\n<p>The offense defined in <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=100&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 100 StGB<\/a> protects persons who, due to <strong>mental illness or defenselessness<\/strong>, cannot defend their freedom of movement or sexual self-determination.<\/p>\n\n<p>An <strong>abduction<\/strong> occurs when someone <strong>removes<\/strong> such a person from their previous place of residence and thereby <strong>removes them from their protective environment<\/strong>. Even a slight change of location is sufficient if the victim is thereby <strong>no longer able to freely decide<\/strong> where they stay. Violence is not required; deception, psychological pressure, or exploiting trust are also sufficient. The decisive factor is that the transfer occurs <strong>against or without the free will<\/strong>.   <\/p>\n\n<p>Especially with mentally ill or defenseless people, the ability to resist is often lacking. The wrongdoing lies in <strong>exploiting this defenselessness<\/strong>. <\/p>\n\n<h3 class=\"wp-block-heading\" id=\"h-prufungsschritte\">Steps of legal assessment<\/h3>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatsubjekt\">Perpetrator:<\/h4>\n\n<p>Any person who determines or influences the whereabouts of another.<\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tatobjekt\">Object of the Act<strong>:<\/strong> <\/h4>\n\n<p>The object of the offense is a <strong>mentally ill or defenseless person<\/strong>, regardless of age, gender, or social status.<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Mentally ill<\/strong> is anyone who, due to a pathological mental disorder such as psychosis, dementia, or severe intellectual disability, does not understand what is happening or cannot grasp the meaning of the events. The decisive factor is that the person <strong>is unable<\/strong> to recognize the implications of being moved or of potential exploitation. <\/li>\n\n\n\n<li><strong>Defenseless<\/strong> is anyone who, due to physical or mental impairment, unconsciousness, intoxication, age, or illness, <strong>cannot offer resistance or seek help<\/strong>. Even a temporary disturbance of consciousness can be sufficient. <\/li>\n<\/ul>\n\n<p>The state of defenselessness must exist <strong>at the time of the abduction<\/strong>. If it is only brought about by the perpetrator during the act, for example through violence, medication, or alcohol, an <strong>accomplished offense<\/strong> is nevertheless present if a change of location follows. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-tathandlung\">Act: <\/h4>\n\n<p>An abduction occurs when the victim is taken to another location <strong>against or without their will<\/strong>. Typical actions include: <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Removing<\/strong> from the familiar environment (home, nursing home, hospital).<\/li>\n\n\n\n<li><strong>Transporting<\/strong> to a place where the victim can be more easily controlled or abused (e.g., secluded apartment, vehicle, hotel room).<\/li>\n\n\n\n<li><strong>Deception or manipulation<\/strong>, for example, by feigning false intentions (&#8220;I&#8217;m just taking you home&#8221;) or by exploiting a dependency or an authority relationship.<\/li>\n<\/ul>\n\n<p>No abduction occurs if the victim accompanies voluntarily and <strong>is capable of judgment<\/strong>. However, apparent consent is <strong>ineffective<\/strong> if it is based on deception, error, or lack of discernment. <\/p>\n\n<p>The act must lead to an <strong>actual change of location<\/strong>. Mere detention or imprisonment at the same location does not fall under <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=100&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 100 StGB<\/a>, but under <strong>\u00a7 99 StGB (Deprivation of Liberty)<\/strong>. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-taterfolg\">Result of the Act: <\/h4>\n\n<p>The perpetrator&#8217;s conduct must be the cause of the restriction of liberty. Whoever creates or maintains the situation bears responsibility. Anyone who supports the act of another can also be jointly responsible.  <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-kausalitat\">Causality:<\/h4>\n\n<p>The perpetrator&#8217;s action is <strong>causal<\/strong> if, without it, the victim would not have fallen into the defenseless situation. Causal is any action that brings about or maintains the result, i.e., the <strong>deprivation of liberty<\/strong>. <\/p>\n\n<h4 class=\"wp-block-heading\" id=\"h-objektive-zurechnung\">Objective Attribution: <\/h4>\n\n<p>The outcome is <strong>objectively attributable<\/strong> to the perpetrator if they <strong>knowingly create or allow a situation to persist<\/strong> in which the victim can no longer free themselves. A lawful deprivation of liberty only exists if it is based on a <strong>legal basis<\/strong> (e.g., police detention or court order). While \u00a7 99 StGB already covers <strong>detention at the same location<\/strong>, <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=100&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 100 StGB<\/a> requires a <strong>change of location<\/strong>. A particularly vulnerable group of persons is protected, whose condition the perpetrator deliberately exploits to remove them from their previous environment and bring them into their sphere of influence.  <\/p>\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/deprivation-of-liberty\/\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>\u00a7 99 StGB \u2013 Deprivation of Liberty:<\/strong> <\/a>Covers the <strong>imprisonment or detention<\/strong> of a person against or without their will, without requiring a change of location. Even a short-term restriction of freedom of movement is sufficient. However, if the victim is removed or transported to another location, it regularly constitutes an abduction under <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=100&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 100 StGB<\/a>.  <\/li>\n\n\n\n<li><strong>\u00a7 101 StGB \u2013 Abduction of a Minor<\/strong>: Concerns the <strong>removal or transportation of a child under 14 years of age<\/strong> against or without the will of the legal guardians, in order to <strong>remove them from their influence or detain them in another place<\/strong>. This protects <strong>parental custody rights and the personal care relationship<\/strong>, not just physical liberty. <\/li>\n\n\n\n<li><strong>\u00a7 102 StGB \u2013 Hostage-taking:<\/strong> Occurs when a person is <strong>detained or abducted<\/strong> to coerce a third person or authority into a certain action. The deprivation of liberty here is a means of <strong>extortion or coercion<\/strong> and is subsumed by the more serious offense. <\/li>\n\n\n\n<li><strong>\u00a7 105 StGB \u2013 Coercion:<\/strong> Covers the <strong>compelling of specific behavior<\/strong> through violence or threat. A deprivation of liberty can coincide with coercion if the detention is <strong>not merely a means of pressure<\/strong>, but <strong>an independent impairment of liberty<\/strong>. <\/li>\n\n\n\n<li><strong>\u00a7 107 StGB \u2013 Dangerous Threat:<\/strong> Punishes the <strong>instilling of fear<\/strong> through the threat of significant harm. A threat only becomes a deprivation of liberty if it is so <strong>concrete and compelling<\/strong> that the victim <strong>objectively has no possibility of leaving<\/strong>. <\/li>\n\n\n\n<li><strong>\u00a7<a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/bodily-harm\/\">\u00a7 83<\/a> to <a href=\"https:\/\/harlander-partner.eu\/en\/criminal-law\/intentional-grievous-bodily-harm\/\">87 StGB<\/a> \u2013 Offenses against Physical Integrity:<\/strong> Protect physical integrity. Die Freiheitsentziehung erfasst das Festhalten am selben Ort.\u201c<\/span>\n    <\/div>\n\n<h3 class=\"wp-block-heading\" id=\"h-konkurrenzen\">Concurrences:<\/h3>\n\n<ul class=\"wp-block-list\">\n<li><strong>Genuine Concurrence:<\/strong> If a person is simultaneously abducted, threatened, and abused, the perpetrator commits several independent criminal offenses. These are punished separately because several legal interests such as <strong>liberty<\/strong>, <strong>physical integrity<\/strong>, and <strong>security<\/strong> are affected. <\/li>\n\n\n\n<li><strong>Apparent Concurrence:<\/strong> Occurs when the deprivation of liberty is part of a more serious crime, such as the abduction of a minor or hostage-taking. In this case, <a href=\"https:\/\/www.ris.bka.gv.at\/NormDokument.wxe?Abfrage=Bundesnormen&amp;Gesetzesnummer=10002296&amp;Artikel=&amp;Paragraf=100&amp;Anlage=&amp;Uebergangsrecht=\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a7 100 StGB<\/a> is subsumed by the more serious offense. <\/li>\n\n\n\n<li><strong>Plurality of Offenses:<\/strong> If more than one person is abducted or the same act is committed in multiple instances, the actions are judged separately. Each abduction constitutes an <strong>independent offense<\/strong>. <\/li>\n\n\n\n<li><strong>Continuing Offense:<\/strong> If the same person is detained and moved against their will over a longer period or in different locations, the entire sequence is considered a <strong>single offense<\/strong>, as long as there is a <strong>continuing intent<\/strong>. A change of location or type of restriction does not alter this. <\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\" id=\"h-beweislast-amp-beweiswurdigung\">Burden of proof and evaluation of evidence<\/h2>\n\n<ul class=\"wp-block-list\">\n<li><strong>Public Prosecutor&#8217;s Office:<\/strong> bears the <strong>burden of proof<\/strong> for the <strong>existence of an abduction<\/strong>, the <strong>duration and intensity of the deprivation of liberty<\/strong>, and for a <strong>possible connection between the act and the resulting consequence<\/strong>. It must prove that the affected person was <strong>against their will<\/strong> <strong>removed or detained<\/strong> from their previous environment and thereby became <strong>defenseless within the perpetrator&#8217;s sphere of influence<\/strong>. <\/li>\n\n\n\n<li><strong>Court:<\/strong> examines and <strong>evaluates all evidence in its overall context<\/strong>. Inappropriate or <strong>illegally obtained evidence<\/strong> may not be used. The decisive factor is whether the victim was <strong>objectively prevented from free movement<\/strong> and placed in a situation where they <strong>could not free themselves<\/strong>.  <\/li>\n\n\n\n<li><strong>Accused Person:<\/strong> has <strong>no burden of proof<\/strong>, but may point out <strong>doubts regarding defenselessness, criminal intent, or the actual change of location<\/strong>. Likewise, they can point to <strong>gaps in evidence, contradictory statements, or unclear expert opinions<\/strong>. <\/li>\n<\/ul>\n\n<p><strong>Typical Evidence:<\/strong> medical <strong>findings on injuries or states of consciousness<\/strong>, <strong>witness statements<\/strong> on the course of the removal, <strong>video or surveillance material<\/strong>, <strong>digital location data<\/strong> (e.g., GPS, mobile phone, or smart home protocols) as well as <strong>traces on vehicles, doors, or clothing<\/strong>.
